<br>There is a tendency in the United States to treat the past like a design detail to be adjusted when it suits current requirements. But one cannot erase facts. As documented below, starting in the mid-1980s former US Attorney General Ramsey Clark was politically allied with the Baltic Nazi war criminals who entered the US under the Nazi-friendly immigration policies of the late 1940s. <br><br>If this were Clark's only blemish - and it is not - it would be sufficient to rule out any association with the defense of Slobodan Milosevic at The Hague. <br><br>What is being debated in Mr. Milosevic's trial is the history of the Yugoslav wars of the 1990s. Who is guilty? Who smells of Fascism?<br><br>Because of this, and because Mr. Milosevic is perceived as a key leader of the Serbs, the public face of his defense reflects on the Serbian people as a whole. The Serbs fought Fascism during World War II and again during the 1990s, both times paying dearly. He has helped redefine this concept to include taking up the cause of people once considered enemies of the Left: violent antisemites of various varieties. <br><br>In this article, we examine the specific case of former Nazi concentration camp boss Karl Linnas. We will show that in 1986 Ramsey Clark chose to make a cause celebre of Linnas, taking his case to the supreme court. When he lost and Linnas was deported to the Soviet Union, Clark flew to his deathbed in Leningrad. Four years later, Clark used the Linnas case to make a public appeal for "reconciliation" with Nazi war criminals. In making this appeal, Clark outdid perhaps even Reagan administration official Pat Buchanan who was also a big defender of Baltic Nazis. <br><br>Clark joined Pat Buchanan and Baltic-American groups in trying to abolish the Office of Special Investigations, or O.S.I. This was the US agency which deported Nazi to their home countries in Eastern Europe, especially the Baltic states. These Nazis had gotten into the US by lying on their immigration papers. The O.S.I. was created for the express purpose of finding such falsifications and deporting the Nazis, thus reversing the previous US policy of giving them safe haven. [1]<br><br>What especially infuriated the ultra-right winger Pat Buchanan, and the ultra-right wing Baltic-American groups, was that the O.S.I. cooperated with authorities in the Soviet Union who were trying to bring these Nazis to justice. <br><br>Matters came to a head when the O.S.I. tried to deport Karl Linnas, wanted by the Soviets for mass murder in Estonia during World War II. <br><br>Ramsey Clark argued against the O.S.I. because, he claimed, hunting Nazi war criminals was *wrong on principle*: <br><br>"'I oppose the idea of regenerating hatreds and pursuits 40 years after the fact,' Clark said." [2]<br><br>"Regenerating hatreds"? Is that what a progressive lawyer calls it when racist murderers are brought to justice? The O.S.I. took the opposite position:<br><br>'''The passage of time does not mitigate what they have done, and it doesn't excuse it,' said Neal M. Sher, 39, the director of Office of Special Investigations. ''We're dealing with people who would do it all over again.''' [2]<br><br>In 1991, even as Clark was in the process of setting up the supposedly Leftist International Action Center (IAC) he gave an interview to the NY Times in which he again called for "reconciliation" with aging Nazis. As late as 2002 Clark defended another Nazi being deported for having lied on his immigration papers about his past.<br><br>The full text follows. <br><br>-- Jared Israel and Nico Varkevisser <br><br>========================================================<br><br>Ramsey Clark defines his "calling" by his practice <br><br>========================================================<br><br>We of course agree that every person accused of a crime has the right to legal counsel. However, it does not follow that every lawyer is obliged to accept every case. This is especially true of 'political' lawyers. Indeed, if one is a political lawyer, and if one publicly declares that representing the vulnerable is one's calling, then the cases which one chooses define one's political intent. <br><br>In his self-descriptions, Ramsey Clark tries to obscure this point. Explaining why he has represented certain "bad people," Clark says: <br><br>"Are they human beings? Do they need help? Is that your calling? You can't do it all, but you do what you can." [3]<br><br>This is very dramatic-sounding, but in asking, "Are they human beings," Clark begs the question: how does he choose *which* human beings to help? There are thousands of defendants worldwide who could use the assistance of a world famous attorney. How does Clark pick the people for whom he will "do what he can"? <br><br>It is precisely because, as Clark says, "you can't do it all," that a political attorney defines "his calling" by deciding whom he will represent. <br><br>Clark has mixed some cases which, in our view, have real merit (such as the Nicaraguan government's case against the US in the 1980s) with a snake pit of violent antisemites. By doing so, Clark has communicated his world outlook: that these antisemites are part of the oppressed. <br><br>* 1984 *<br><br>Clark champions the mass murderer, Karl Linnas, a World War II death camp boss who emigrated from Estonia to escape Soviet justice. Clark's arguments inside and outside of court parallel those of the pro-Nazi Right. Clark emotionally attacks the legitimacy of the O.S.I., the Justice Department group trying to deport Nazis to the Soviet Union to face charges of mass murder; <br><br>* 1989 * <br><br>Clark defends Mahmoud El-Abed Ahmad against extradition to Israel, where he is wanted for allegedly murdering passengers in a bus; <br><br>* 1989 * <br><br>Clark defends Lyndon LaRouche, the ultra Right wing, anti-Semitic cult leader; <br><br>* 1990s *<br><br>Clark defends Sheikh Rahman, head of Gama'a al-Islamyya. These are the terrorists who sliced noses and ears off some of the 58 foreign tourists and four Egyptian workers whom they slaughtered at Luxor in Egypt in 1997. They fought the Soviets in Afghanistan. They fought the Serbs in Bosnia. Both times, they were under covert US direction; [4]<br><br>* 1980s-1990s *<br><br>Clark defends the PLO against the lawsuit by the family of Leon Klinghoffer, the wheelchair-bound, disabled American Jew whom PLO terrorists murdered and then tossed, wheelchair and all, into the sea. <br><br>* 2002 *<br><br>Clark represents Jack Riemer, former Nazi SS guard, accused of playing "a supporting role" during "the liquidation of the Warsaw and Czestochowa ghettoes" in World War II Poland. [5] <br><br>========================================================<br><br>The road not taken...<br><br>========================================================<br><br>How different Clark's public persona would be if, like Leftist attorneys of times past, he had concentrated his efforts on championing the poor, or workers injured because of unsafe conditions on the job, or Mexican immigrant farm workers, or big city workers fired for organizing on the job, or tenants mistreated by landlords, or Black victims of racism, or elderly victims of the Managed Care medical system. <br><br>Instead of encouraging people to view Nazi concentration camp personnel and the religious gurus of Islamist terrorist groups as the oppressed, he would have engendered concern and respect for the genuine heroes of our social system - working people. Remember them? And in favor of social change. Do you remember social change? At one time the Left talked about social change. <br><br>However, it is not just Clark's choice of cases which communicates a message. Time and again, Clark has made public pronouncements which were unnecessary from the standpoint of legally defending his chosen monsters, statements which parroted the views of said monsters and of their fascist supporters as well. Let us consider one example: Clark's championing of Karl Linnas in the 1980s and Clark's use of the Linnas case in an attempt to discredit the O.S.I. <br><br>========================================================<br><br>Linnas vs. the O.S.I. - A landmark case, a political battlefield<br><br>========================================================<br><br>The Karl Linnas case was important because Linnas was one of the first Nazis whom the Office of Special Investigations, O.S.I., attempted to deport. And he was the first who was wanted for war crimes in the Soviet Union.<br><br>Created by Congress in 1979 despite powerful resistance, the O.S.I. had a most important mission: to deport *thousands* of Nazi war criminals who had been welcomed into the US after World War II: <br><br>[Excerpt from Newsday starts here] <br><br>These war criminals were beneficiaries of the Displaced Persons Act, a 1948 law that virtually excluded Jews and gave preference to their wartime oppressors, especially those from Lithuania, Latvia, Estonia and Ukraine, sites of some of the most notorious Nazi atrocities. Death-camp guards and collaborators from these areas were welcome - invited, even - to become new Americans as long as they denied being old Nazis. So they did. <br><br>Many ended up living in well-established Baltic and Ukrainian communities in and around Chicago and Cleveland. Others settled right here in the New York metropolitan area. Those who lied about their Nazi pasts have, since 1979, been subject to denaturalization and deportation proceedings initiated by the Office of Special Investigations, a branch of the Justice Department created specifically to prosecute Nazis and their collaborators for immigration fraud. [6] <br><br>[Excerpt from Newsday ends here] <br><br>The O.S.I. pulled no punches in discussing the U.S. policy it was created to reverse. Here is Neal M. Sher, then the director of O.S.I., interviewed by the New York Times in 1987: <br><br>'"I think the number of Nazi criminals who came here after the war is at least 10,000. I would assume they are all still here except for those who have died and those who have been deported. The United States was a haven for Nazi war criminals.'" [7] <br><br>These words, honest and blunt, are to us especially surprising to read because we know something about the role which World War II Nazi émigrés played in creating the US Central Intelligence Agency. And yet here was a US agency actually saying these Nazi émigrés should be deported! [8]<br><br>Moreover, the O.S.I. did something previously taboo: it cooperated with Soviet authorities to hunt down Nazi murderers. This was fiercely attacked by a coalition of forces which not surprisingly included pro-Nazi East European émigré groups and Pat Buchanan, a high official in the Reagan administration. As we shall see, Ramsey Clark also attacked the O.S.I. <br><br>The Linnas deportation case became a battleground. It lasted for years, with some "13 or 14 appeals". [7]<br><br>It was a continual focus of attacks from Buchanan and the Baltic-American Right. It was in this context that Clark chose to represent Linnas, convicted of mass murder in the Soviet Union, in his Supreme Court appeal against deportation. <br><br>[The excerpt from Newsday starts here] <br><br>...after a denaturalization proceeding was brought against him in 1979, Linnas was supported by some of O.S.I.'s most vociferous critics. Heading the list was Pat Buchanan who, while serving in the Reagan Administration, repeatedly urged then-Attorney General Ed Meese to quash the O.S.I. action against Linnas. <br><br>That denaturalization order was granted in 1981 and upheld by the U.S. Second Circuit Court of Appeals in 1986.... <br><br>After finding that Linnas was chief guard at the Tartu concentration camp, a job in which he committed numerous acts of murder, the appeals court showed unmistakable contempt for Linnas' request that he not be deported back to the USSR for the sake of decency and compassion. <br><br>"Noble words such as 'decency' and 'compassion' ring hollow," wrote the judge, "when spoken by a man who ordered the extermination of innocent men, women and children kneeling at the edge of a mass grave. Karl Linnas' appeal to humanity, a humanity which he has grossly, callously and monstrously offended, truly offends this court's sense of decency." [6] <br><br>[The excerpt from Newsday ends here] <br><br>Buchanan and the East European émigré groups went all out in the Linnas case: <br><br>"In a syndicated column published this past February, Buchanan called the O.S.I. the 'dim-witted instrument' of the Soviet K.G.B. and stated that 'in its zealotry to punish naturalized Americans who collaborated in the Holocaust, forty years ago,' the office 'is relying upon 'evidence' produced by the secret police of a neo-Stalinist state.'" [9]<br><br>But the O.S.I. refused to back down on the use of Soviet evidence. Here is Eli Rosenbaum, then on leave from the O.S.I., commenting on the Soviet track record regarding Nazi war criminals:<br><br>"'Not once in 40 years has anyone proved a case of Soviet forgery or perjury by a Soviet-supplied witness,' says former OSI Prosecutor Eli Rosenbaum...'" [1<!--EZCODE EMOTICON START 0] --><img src=http://www.ezboard.com/images/emoticons/alien.gif ALT="0]"><!--EZCODE EMOTICON END--> <br><br>And here is then-director of the O.S.I., Neil Sher:<br><br>"OSI Director Neil M. Sher has said that in West German war crimes trials, 'not once to my knowledge' has a court 'found that the Soviets supplied forged documents or suborned perjury.'" [11] <br><br>U.S. Atty. Rudolph W. Giuliani, who helped prosecute Linnas, said the Soviet evidence was air tight. Giuliani, whom *nobody* would suggest was pro-Soviet, was interviewed by the LA Times after Linnas died in a Soviet hospital following his deportation: <br><br>"In New York, U.S. Atty. Rudolph W. Giuliani, who argued twice before the federal appeals court in Manhattan to have Linnas deported, had no comment on his death. But he said the record against Linnas contained 'proof to a certainty that he was a mass murderer and a butcher.'" [12]<br><br>Ramsey Clark did *not* agree about Soviet evidence. Clark's court arguments eerily echoed Pat Buchanan's claims that Soviet evidence was intrinsically unreliable: [12]<br><br>[Excerpt from LA Times starts here] <br><br>In his appeal on behalf of Mr. Linnas, Ramsey Clark, who was Attorney General of the United States from 1967 to 1969, stressed the Government's collaboration with the Soviet Union in the case and reliance on evidence obtained through Soviet authorities. <br><br>''It is unthinkable that a United States court would allow deportation to be used to send a man to his decreed death in a foreign country without due process,'' Mr. Clark said in his brief. <br><br>[Excerpt from LA Times ends here] <br><br>Note the use of the phrases, "without due process" and "decreed death," mimicking the words of Pat Buchanan. One could defend Clark's statement, quoted above, on the grounds that this was a legal brief and therefore what Clark wrote did not necessarily reflect his true feelings. We would challenge that. By using this language, Clark was lending his credibility and his media presence to the campaign by Buchanan and the ultra-right Baltic groups to discredit the O.S.I. as the "'dim-witted instrument' of the Soviet K.G.B." Clark is a political lawyer; the Linnas affair was a highly visible political case; and he was using the Supreme Court appeal, which nobody expected him to win, as a bully pulpit to express views strikingly like those of Pat Buchanan. <br><br>Clark spoke to the New York Times, again sounding much like Buchanan: <br><br>'''I find it remarkable that the Department of Justice, which is part of an Administration that consistently criticizes Soviet justice, would accept evidence that it's unable to independently examine in a real sense,' said Mr. Clark." [2]<br><br>And Clark continued to speak out publicly, opposing the O.S.I. long after the Supreme Court refused to hear his appeal, indeed, several years after Linnas died. <br><br>Since both Pat Buchanan and Ramsey Clark argued *in favor* of abolishing the O.S.I., it is informative to compare what they said. As we shall see, Buchanan attacked the O.S.I. straightforwardly and politically, with no tricky sub-text. Clark usually made sneak attacks, relying on emotional manipulation. <br><br>First, Buchanan:<br><br>"In 1982, appearing on the Washington television talk show After Hours, Buchanan called for the O.S.I.'s abolition and asked what the purpose was of 'going after people who are about 70 years old now' and whose crimes were committed 'thirty-five, forty-five years ago.' [9]<br><br>Now here's Clark. <br><br>========================================================<br><br>Ramsey calls for "reconciliation"<br><br>========================================================<br><br>On June 14th, 1991, the New York Times published a sympathetic article about Clark called, "The Long and Lonely Journey of Ramsey Clark". In it, they quoted him as follows concerning the O.S.I.'s campaign against Nazi illegal immigrants:<br><br>"'There comes a time after the most horrible acts when the possibility of reconciliation outweighs any possible need for retribution or to maintain the integrity of the law,' he said. 'If you take a man who's senile, who's on his deathbed, and you can hear the rattle, and you have to rush to strangle him before he dies, then there's no hope for reconciliation.'" [13]<br><br>Let us note, for the record, that in 1987, as the "senile" Mr. Linnas was taken to the airport for deportation, this Nazi managed to shout quite coherently: [14]<br><br>[Associated Press quote starts here] <br><br>Linnas accused the United States of murder as he was put aboard the Czechoslovak Airlines flight at John F. Kennedy International Airport. <br><br>"What they are doing right now is murder and kidnapping," the retired surveyor shouted as he was led into a police office at the New York airport. <br><br>[Associated Press quote ends here] <br><br>Note that in contrast to Mr. Buchanan, who at least has the virtue of being straightforward, Mr. Clark never speaks to the point but relies on emotional manipulation. He calls for an end to retribution against Nazi war criminals in the interest of some "possibility of reconciliation." But what does he mean? With whom are we to reconcile? Or are we to encourage reconciliation between some groups? What groups? Does he mean that the survivors of Nazi butchery should be reconciled with Nazi butchers? Let bygones be bygones? Forgive and forget?<br><br>Apparently that is exactly what Ramsey Clark means. In plain English, he is an apologist for Nazi war criminals. Frankly Clark's attempt to seduce us by appealing to our sense of compassion makes him all the worse.<br><br>Former Attorney General Clark goes so far as to proclaim that the need for reconciliation "outweighs any possible need...to maintain the integrity of the law"! <br><br>For whom should we override the "integrity of the law"? For the Nazi butchers. But why should we override the law even though, by Clark's own admission, these people have committed "the most horrible acts"? Because they have been punished? But they have *not* been punished. Because they are truly sorry? But Clark does not claim they are sorry. Then why? Because, Clark explains, they have...grown old. <br><br>They have grown old. <br><br>Our government welcomed these monsters during the 1940s and 1950s. They were allowed to escape justice in the U.S., to live, to prosper, and so now they have grown old and we should let them live in peace. After all, monsters are human too; they have needs; and so, as Mr. Clark says, "you do what you can."<br><br>People claim that Clark was a progressive U.S. Attorney General and that he became more progressive after leaving office. It is noteworthy that while Clark, the false progressive, did everything he could to protect Karl Linnas, the true Nazi butcher, it was Reagan's Attorney General, Ed Meese, the notorious Ed Meese of Iran-Contra fame, who deported Karl Linnas to the Soviet Union. <br><br>We do not raise this point because of what it says about Attorney General Ed Meese, who was under great pressure to deport Linnas. Rather, we raise this point because of what it says about Attorney General Ramsey Clark.<br><br>And remember, Clark gave this interview, calling for reconciliation with Nazi war criminals, in June of 1991. At that time he was already in the process of forming the International Action Center.<br><br>========================================================<br><br>A touching farewell<br><br>========================================================<br><br>After Karl Linnas was deported to the Soviet Union, he got sick. The Soviets gave him the best medical treatment available because, of course, the last thing they wanted was for him to die in a Leningrad hospital. Nevertheless he died in a Leningrad hospital. <br><br>The last two visitors whom Linnas saw before he died were his daughter and Ramsey Clark; the two of them flew to the monster's bedside. Clark's presence served the political purpose of calling attention to Linnas' death, thereby lending seeming credence to Clark's argument that the O.S.I. was heartlessly persecuting poor, old, decrepit mass murderers.<br><br>Just before he died, we are told, Karl Linnas gave his daughter and Ramsey Clark the thumbs-up sign. Which means: keep up the good work. <br> Jared Israel's site was the first place I learned (4 years ago) that the events in Yugoslavia were, shall we say, 'different' from what had been presented by the MSM. What I also learned there was that, like everyone else, Jared has a handy way of leaving out certain inconvenient items which might challenge his personal interpretation. The one thing Ramsey Clark's clients have in common is that they have all been patsys of the US alphabet agencies. I happen to agree that everyone is entitled to a defense and who knows better where the bodies are buried than someone who has been there? If the O.S.I. had been serious, they should have exposed not only the rank and file nazis but also the scientists, doctors, operation paperclip™ and the entire political apparatus that made it possible. There have been some 300 trial days. More than 200 witnesses have testified. The trial transcript is near 33,000 pages.<br><br> The Prosecution has failed to present significant or compelling evidence of any criminal act or intention of President Milosevic. In the absence of incriminating evidence, the Prosecution apparently hoped to create a record so massive that it would be years, if the effort was ever made, before scholars could examine and analyze the evidence to determine whether it supported a conviction.<br><br> Meanwhile the spectacle of this huge onslaught by an enormous prosecution support team with vast resources pitted against a single man, defending himself, cut off from all effective assistance, his supporters under attack everywhere and his health slipping away from the constant strain, portrays the essence of unfairness, of persecution.<br><br> In contrast, the Prosecution of the "first trial in history for crimes against the peace of the world" at Nuremberg began November 20, 1945 against 19 accused and ended just over three months later on March 4, 1946 after four nations presented evidence. In his opening, Chief Prosecutor Robert H. Jackson observed<br><br>There is a dramatic disparity between the circumstances of the accusers and the accused that might discredit our work if we should falter, in even minor matters, in being fair and temperate. ... We must never forget that the record on which we judge these defendants is the record on which history will judge us tomorrow. To pass these defendants a poisoned chalice is to put it to our lips as well.<br><br> The Prosecution began its investigation of President Milosevic under Richard Goldstone of South Africa in October 1994. When he left office in December 1996 he had found no evidence to support an indictment. His successor, Louise Arbour of Canada, continued the investigation without formal action until late May 1999 when President Milosevic was first indicted for acts allegedly committed earlier in 1999. <br><br> The indictment came during the heavy U.S./NATO bombing of all Serbia including Kosovo, a war of aggression. It had killed civilians throughout Serbia and destroyed property costing billions of dollars to replace. It had destroyed President Milosevic's home in Belgrade in an assassination attempt on April 22, 1999. The Chinese Embassy in Belgrade had been bombed on May 7, 1999. Depleted uranium, cluster bombs and super bombs had targeted civilians and civilian facilities. Hundreds of civilian facilities were destroyed and civilians killed from Nova Sad to Nis to Pristina.<br><br> The initial indictment made no allegations of any crimes in Croatia, or Bosnia. It dealt exclusively with alleged acts by Serb forces in Kosovo in 1999. All of Serbia, including Kosovo, remained under heavy U.S./NATO bombardment at the time of the indictment. There were no U.S., or NATO forces, or ICTY investigators in Kosovo. Investigation was impossible. The indictment was purely a political act to demonize President Milosevic and Serbia and justify U.S. and NATO bombing of Serbia which was itself criminal and in violation of the U.N. and NATO Charters.<br><br> As U.S. Ambassador to the U.N., Madeleine Albright led the U.S. effort to cause the Security Council to create the ICTY. Later she wrote in her memoir that while she was U.S. Secretary of State she had sought removal of President Milosevic from office for years:<br><br> "With colleagues Joschka Fischer and others, I urged Serb opposition leaders to build a real political organization and focus on pushing Milosevic out... In public remarks I said repeatedly that the United States wanted Milosevic 'out of power, out of Serbia, and in the custody of the war crimes tribunal.'" <br><br> President Milosevic was indicted and is on trial because he intended and acted to protect and preserve Yugoslavia, a federation that was essential to peace in the Balkans. Powerful foreign interests, supporting nationalist and ethnic groups and business interests within the several republics of Yugoslavia, were, for their various reasons, determined to dismember Yugoslavia. Foremost among these was the United States. Germany played a major role. Later NATO lent its name to the effort in violation of its own Charter. The violence that followed was foreseeable and tragic.<br><br> Throughout there was no more conciliatory leader than President Milosevic who avoided all out war as Slovenia, Croatia, Bosnia and Macedonia seceded from the Federal Republic. For his later defense of Yugoslavia, reduced to Serbia and Montenegro, he will be remembered primarily for his compromises at Dayton, Ohio and, later, to end the brutal U.S. bombing of Serbia from March to June 1999. His conduct intended peace and the survival of a core federation of southern Slavs which in a better day might seed a broader federation of Balkan states which is essential to peace, political independence and economic viability in the region. The U.S. and others intended otherwise.<br><br> The consequences have been disastrous for each of the former states of the federal republic. Today there is economic intervention and stagnation, political unrest, public dissatisfaction and growing threats of violence in former Yugoslavia. The U.S. is courting Croatia for membership in NATO as the base for European forces to control the region and maintain its division. Croatia has sent a small military unit to assist NATO in Afghanistan and is being pressured to send troops to Iraq, thereby continuing its confrontations with Muslim peoples in Croatian and Bosnia. U.S. Secretary of Defense Rumsfeld, met with the nationalist leadership of Croatia, including the President and Prime Minister, on February 8, 2004. He proclaimed "I look forward to the day when Croatia becomes a part" of NATO.<br><br> The former President of Yugoslavia is on trial for defending Yugoslavia in a court the Security Council had no power to create. In contrast, the President of the United States, who has openly and notoriously committed war of aggression, "the supreme international crime", against a defenseless Iraq killing tens of thousands of people, spreading violence there and elsewhere, faces no charges. President Bush continues to threaten unilateral wars of aggression and presses for U.S. development of a new generation of nuclear weapons, tactical nuclear bombs, after invading Iraq on the fabricated claim it was a threat to the U.S. and possessed weapons of mass destruction. This can happen only because power, not principle, still prevails.<br><br> The United Nations cannot hope to end the scourge of war until it finds the will to outface power and stands united for the principles of peace. What better evidence is needed of U.S. intention to stand above the law and rule by force than the extensive U.S. efforts to destroy the International Criminal Court and coerce bilateral treaties in which nations agree not to surrender U.S. citizens to the ICC. Compound this obstruction of justice with the June 30, 2002 statement of the U.S. Permanent Representative to the U.N., Ambassador John Negroponte, demanding immunity for the U.S. from foreign prosecution, to which the Security Council submitted. Negroponte threatened that the U.S. would veto a pending Security Council resolution to renew the U.N. peacekeeping mission in Bosnia-Herzegovina, unless the Security Council provided immunity, that is impunity, for personnel contributed to Security Council authorized peace keeping missions. The purpose was to place U.S. personnel and U.S. surrogates above the law while U.S. enemies are victims of discriminatory prosecution in illegal courts. <br><br> The ICTY and other ad hoc criminal tribunals crated by the Security Council are illegal because the Charter of the United Nations does not empower the Security Council to create any criminal court. The language of the Charter is clear. Had such power been placed in the Charter in 1945 there would be no U.N. None of the five powers made permanent members of the Security Council in the Charter would have agreed to submit to a U.N. criminal report. <br><br> The ICC was created by treaty, recognizing the U.N. had no power without amendment of its Charter to create such a court. Creation of the ICC should preclude creation of any additional criminal tribunals and calls for the abolition of those that exist. They were created to serve geo political ambitions of the U.S. The issue is of the highest importance. It determines whether the Security Council itself is above the Charter and the rule of law.<br><br> The ad hoc criminal tribunals are inherently discriminatory, evading the principles of equality in the administration of justice. The discrimination is intended to destroy enemies. The International Criminal Tribunal of Rwanda has not indicted a single Tutsi after nine years, though Faustin Twagirimungu, the first Prime Minister under the Tutsi RPF government in 1994 and 1995, testified before it that he believed more Hutu's than Tutsi's were killed in Rwanda in the tragic violence of 1994. Hundreds of thousands of Hutu's were slaughtered later in Zaire, now the Democratic Republic of Congo, and remain endangered today. The ICTR is an instrumentality for U.S. support of Tutsi control in Uganda, Rwanda, Burundi, and for a time and perhaps again, the Democratic Republic of Congo.<br><br> ICTY prosecutions are overwhelmingly against Serbs and only Serb leaders have been indicted by it, including not only President Milosevic and Serb leadership, but Serb leaders in Srpska, the segregated Serb part of Bosnia.<br><br> As the prosecution of the former President of Yugoslavia draws to a close his health is seriously impaired and has become life threatening. Hearings were cancelled last week because he was too ill to participate, but the Tribunal added onerous hours of hearings for the two final weeks of the prosecution case. Only yesterday the Tribunal was forced to reduce the hearings to half days because of a medical report on President Milosevic prepared by court appointed doctors. President Milosevic has been kept in total isolation for months during the period he headed the socialist party's ticket in parliamentary elections and when his party joined the coalition which elected the new speaker of the Parliament last week. Earlier this week the Tribunal extended his isolation for another month because of political events in Serbia.<br><br> President Milosevic, imprisoned, his health dangerously impaired, defending himself alone in the courtroom, has been given less than three months to prepare his defense to more than two years of evidence before the defense presentation is scheduled to begin in May. These most recent actions of the Tribunal are representative of the gross consistent unfairness of the proceedings during the years of President Milosevic imprisonment and the prosecution case against him.<br><br> To properly prepare the defense, it will be necessary to secure and review tens of thousands of documents, find and interview hundreds of potential witnesses and organize the evidence into a coherent and effective presentation. <br><br> The United Nations must take the following acts in the interest of simple justice, to right former wrongs, to assess the legality and fairness of a court it created and to maintain credibility in the eyes of the Peoples of the United Nations:<br><br> <br><br>1. Declare a moratorium on all proceedings in all U.N. ad hoc criminal tribunals for a period of at least six months and for such additional periods as may prove necessary for the United Nations to:<br><br> <br><br> A. Create a Commission of international public law scholars and historians to examine the precedents, the drafting, language and intention of the Charter of the United Nations to determine whether the Charter empowers the Security Council to create any criminal tribunal and, if so, the basis, authority and scope of such power, or refer the issue to the International Court of Justice for decision.<br><br> <br><br> B. Create a commission of international criminal law scholars to review the trial proceedings in the case against President Milosevic to determine whether legal errors, violations of due process of law, or unfairness in the conduct of the trial compel dismissal of the proceedings, and whether the evidence presented by the prosecution against former President Milosevic to is sufficient under international law, before any defense is presented, to support and justify continuation of the trial.<br><br> <br><br> C. Provide former President Milosevic with funds to retain advisory counsel, investigators, researchers, document examiners and other experts sufficient to effectively respond to the evidence presented against him and assure the time required to complete the task before any further trial proceedings resume, such efforts being essential even if the court is abolished, or the prosecution has been dismissed in order to help establish historic fact for future peace.<br><br> <br><br> D. We think to a) discredit Milosevic by associating him in the public mind with *their own* support for *real* war criminals, for anti-Semitism and for terrorism and b) to draw Milosevic's sympathizers into their orbit, in which anti-Semitic Muslim terrorists are touted as leading the fight against Empire. <br><br>Milosevic is *hugely* popular in the Slavic world, where of course anti-Semitism has roots, so this attempt is no small matter.<br><br>Recently we have seen greatly increased efforts by forces tied to Clark and also Verges to assume control of the Milosevic support work.<br><br>Milosevic fiercely opposes anti-Semitism, as he opposes all racism. Genoud took the drink into his hands. He was 81. <br><br>An urbane man with an air of influence and respectability, Genoud was no ordinary Swiss pensioner. <br><br>He was an unrepentant Nazi who devoted his life to aiding Adolf Hitler's surviving henchman and those he saw as Hitler's natural anti-Jewish successors: Arab terrorists. <br><br>He was a financier of fascism, and a manager of the hidden Swiss treasure of third Reich. <br><br>A shadowy figure in six decades of international intrigue, he masterminded an airplane hijacking, underwrote attacks on Israel and paid for the defense of Adolf Eichmann, Klaus Barbie and 'Carlos the Jackal.' An anti Jewish propagandist, he made a fortune publishing Nazi tracts. <br><br>In the end he slipped away just as a 50-year old scandal was breaking that might have implicated him in one history's great cover-ups: The Swiss collaboration with Nazi Germany in hiding gold looted from Holocaust victims and subjugated governments. <br><br>Genoud's suicide came just four weeks after Jewish leaders and Swiss banking officials announced an unprecedented agreement setting up a commission to examine secret bank and government files, searching for funds deposited in Switzerland by Holocaust victims. Chaired by former Federal Reserve Chairman Paul Volker, the panel is working separately from a Swiss government probe into Nazi plunder in Switzerland. <br><br>In the United States, Sen. D' Amato, the Senate banking Committee chairman, is investigating Swiss wartime holdings and campaigning for release of billions of dollars in Holocaust victims' funds from Swiss banks. President Clinton has pledged "full moral and political support," for the investigations. And Holocaust survivors and families of victims have filed class action lawsuits in federal court in New York against a group of Swiss banks, trying to recover assets taken from Jews during the War. <br><br>Responding to a question during the Inquirer's investigation of Genoud, D'Amato last month called on the Swiss government to fully investigate and disclose Genoud's role in the Swiss handling of the Nazi gold. <br><br>"The accusations made against Mr. Genoud seem to be reprehensible," said D'Amato. "We would hope that the Swiss would be forthcoming with information on his activities before, during and after the war." <br><br>Did Genoud take his own life to avoid the coming scrutiny? <br><br>Daniel Lack, a Geneva attorney and legal adviser to the World Jewish Congress, said, "It stands to reason he [Genoud] must be implicated in the illegal transfer of Nazi assets to Switzerland and concealing it. I dare say that the man realized this. All these inquirers into the opening of the records of Nazi assets in Swiss banks may have compromised him in more ways than one. It's not improbable, his connections being what they were and his sympathies being what they were." <br><br>In October the world Jewish Congress released a once-secret U.S. Army document from 1945 found in the National Archives. It told of Allied Soldiers finding bags of gold fillings from human teeth hidden by the Nazis in Germany at the end of the war. The document reported the bags were among stacks of gold bars, gold coins, silver, Passover candlesticks, paintings and other assets looted by the Nazis and hidden in a salt mine in Merkers, in western Germany. <br><br>The document was a stark reminder, WJB president Edgar Bronfman said, the looted Nazi gold sought by investigators was not just gold bullion taken from the treasuries of Europe, but items seized from human beings. According to testimony at the Nuremberg War Crimes Tribunal in 1945-46, the Nazis extracted gold from the teeth of people they executed in death camps and melted it down to sell for the war effort. Captured SS records on microfilm at the National Archives show that Oswald Pohl, head of the SS Economic and Administrative Main Office, had distributed a chart that said: "Efficient utilization of the prisoner's body at the end of nine months increases this profit by the return of dental gold. It is possible at times to obtain additional revenue from the utilization of bones and ashes." <br><br>As a teenager in the fall of 1932, Francois Genoud briefly met the man who was to shape the rest of his life. In a hotel in Bad Godesberg, near Bonn, the young Genoud encountered Adolf Hitler. He told Hitler of his great interest in National Socialism, and Hitler shook his hand. Genoud's parents--his father was a wealthy wallpaper manufacturer--had sent him from Lausanne to study in Germany at 16 to learn discipline. He found Hitler's writings "very relevant," he said years later. Sixty years after that single meeting, Genoud told a London newspaper, "My views have not changed since I was a young man. Hitler was a great leader, and if he had won the War the world would be a better place today." <br><br>In 1934, back in Switzerland, the 19 year old Genoud joined the pro-Nazi National Front, and two years later he began to forge the other political links that would prove so valuable. He traveled to Palestine. There he met the grand mufti of Jerusalem, the pro-Nazi religious and political leader of Palestinian Muslims, Amin el-Husseini, who was to spend most of World War II in Germany, and who, according to British author Gitta Sereny, "would consider [Genoud] a confidant until his death in 1974." <br><br>Genoud traveled to Berlin frequently during the war "to see his friend the grand mufti," and visited him afterward many times in Beirut, according to Le Monde correspondent Jean-Claude Buhrer. The grand mufti "entrusted Genoud with the management of his enormous financial affairs," according to Sereny. Working for both Swiss and German intelligence agencies, Genoud traveled extensively in the Middle East. <br><br>In Lausanne in 1940, along with a Lebanese national, he set up the Oasis nightclub to serve as a covert operation for the Abwehr, the German counterintelligence service. In 1941, Abwehr agent Paul Dickopf sent Genoud into Germany, Czechoslovakia, Hungary and Belgium. Genoud befriended several top Nazis, including SS Gen. Karl Wolff, who had been Heinrich Himmler's personal adjutant and who by 1943 would be "supreme SS and police leader" in Italy. <br><br>"It was a tit for tat between me and my Abwehr contact [Dickopf]," Genoud reminisced shortly before his death. "I was dealing in all kinds of things including currency, diamonds and gold, and Dickopf liked dealing, too. So I pushed things his way, and he pushed things my way . . . . It was all very satisfactory; everybody was happy. We were all friends." Dickopf, meanwhile, went underground in the fall of 1942 with Genoud's help, emerging in Switzerland. Ironically, from 1968 to 1972, Dickopf was president of Interpol, the widely respected international police agency. At the end of the war, Genoud represented the Swiss Red Cross in Brussels, according to Buhrer. <br><br>Genoud, according to documents from Nazi-hunter Serge Klarsfeld of Paris, soon used his banking contacts to set in motion networks that later became known as ODESSA, which functioned principally for the transfer of millions of marks from Germany into Swiss banks and the evacuation of key Nazi leaders into Morocco, Spain and Latin America. <br><br>"The money," wrote Toronto author Erna Paris in a book about Klaus Barbie, "most of which was stolen from European Jews, was deposited in numbered bank accounts through a clandestine club of former SS officers called Die Spinne (The Spider), the successor to the ODESSA organization." <br><br>Meanwhile, Genoud acquired from the families of Hitler, Bormann and Goebells all posthumous rights to the writings of the three men-- agreements that made him a fortune when he published the volumes. (Sereny said the sheer force of Genoud's personality enabled him to obtain those rights: "To the surprise of many people," she wrote in the London Observer a month before his death, "he invariably comes across as a sympathetic and honest man.") <br><br>It was at the Nuremberg trials in 1946 that Genoud befriended Maj. Gen. Herman Bernhard Ramcke and obtained Bormann's account of Hitler's conversations from Ramcke's subordinate, former SS Capt. Hans Reichenberg. In the preface to the Bormann document, Hitler's Table talk, Genoud wrote that Hitler wanted the people of the Third World to carry on the work of the Thousand Year Reich. <br><br>A December 1952 State Department telegram from Bonn leaves no doubt about Genoud's circle of friends. The formerly classified document, obtained by The Inquirer under the Freedom of Information Act, names "Swiss citizen Francois Genoud" as the "middleman" in a meeting in Cologne in which former paratrooper Ramcke and Gen. Heinz Guderian told a French government adviser and a Swiss colonel of their opposition to the European Defense Community, a Cold War alliance in Western Europe. Ramcke and Guderian were well-known to Western officials. <br><br>Ramcke had been charged by the Greece with murder and pillage as the leader of the German troops who captured Crete in 1941; he also was charged by France with murder and wanton destruction of property as commander of the Second Parachute Division at Brest in July and August 1994. And Guderian had been chief of staff for the high command of the German army. <br><br>By 1955, Genoud had used his wartime contacts to become an adviser, researcher and banker to the cause of Arab nationalism. Along with Reichenberg in Tangiers and Cairo, Genoud set up AraboAfrika, an import-export company that served as a cover for the dissemination of anti-Jewish and anti-Israeli propaganda and the delivery of weapons to the Algerian National Liberation Front (FLN). Genoud made investments for Hjalmar Schacht, the former Nazi Reichsminister of Finance, president of the Reichsbank and a key postwar intermediary between Germans and Arabs. Numerous former Third Reich officials gained refuge in the Arab world, including Eichmann's deputy, Alois Brunner, who for years was protected by Hafez el-Assad in Damascus. <br><br>The U.S. Central Intelligence Agency, seeking to offset Soviet influence in the Middle East, helped bankroll the activities of Brunner and other former Nazis working in Egypt after the war, according to documentation by American journalist Christopher Simpson. <br><br>Also, in November 1956, William J. Porter of the U.S. Embassy in Rabat notified the State Department that "Mr. Francois Genoud, a Swiss national residing at Frankfurt/Main, Germany, and purporting to represent the Hjalmar Schacht interests, called at the Embassy this week to discuss . . . massive investments" in Morocco. <br><br>"The crux of the proposition made to the Moroccan Government by Mr. Genoud and his associates," says the once-classified document obtained by the Inquirer under the Freedom of Information Act, "involves the sale by the United States--through a long-term, low-interest loan--of 55 million dollars' worth of agricultural surpluses to the Schacht group, which would dispose of them in Western Europe and utilize the counterpart for investment in Morocco in the form of equipment and technicians." Genoud said the Moroccans were keenly interested in securing Schacht's collaboration, according to the document, "partly because of the esteem in which he is held in the Arab world generally, but also because the Moroccans tend 'to admire the philosophies for which he stands.'" Porter reported that the embassy did not encourage Genoud, and did not think the Schacht plan would benefit the United States. <br><br>More is to be learned about Genoud's contacts with the Americans. The State Department has yet to declassify 16 documents relating to Genoud; 29 other documents relating to his application for a visa or permit to enter the U.S. remain classified. <br><br>The Lufthansa Boeing 747 bound for Frankfurt was ready for takeoff in Bombay when the control tower received a bizarre message: "Call us the Victorious Jihad. If you call us Lufthansa, we won't answer you." It was the evening of Feb. 21, 1972, and Palestinian hijackers had taken the plane hostage. Among the 188 passengers was Joseph Kennedy, 19-year-old son of assassinated Sen. Robert F. Kennedy. <br><br>The next day, a letter from Cologne demanded $5 million for the "Organization for the Victims of the Zionist Occupation." In perfect English, the letter gave Lufthansa explicit instructions: A man carrying a suitcase with the money should wear a black jacket and gray pants, disembark at the Beirut airport holding Newsweek magazine in his left hand and the suitcase in his right hand, and go to the parking lot. With the key sent in the envelope from Cologne, he was to open an old Volkswagen parked under a sycamore tree and read the instructions on the rear seat. <br><br>The jet flew to Yemen, where the crew and passengers were freed, including the young Kennedy. And $5 million in used bills went to the Popular Front for the Liberation of Palestine, which has committed numerous international terrorist attacks since. <br><br>The operation was orchestrated by the Palestinian terrorist Wadi Haddad with the assistance of Francois Genoud, who drove overnight to Cologne with his wife carrying the letter with the ransom demand. After sending the letter to Lufthansa and to news agencies, Genoud and Elisabeth took off for vacation in the Belgian Ardennes. "The amount of money demanded of Lufthansa was very high," Genoud told French journalist Pierre Pean, revealing his role in the hijacking in a biography published this year in Paris. "Too low a number would have made us lose credibility. Too high a number might have made the operation fall through, especially considering how quickly the money had to be collected." <br><br>Probably the leading Genoud-watcher in the last three decades has been Le Monde's Buhrer, who lives in Lausanne. He believes Genoud told Pean about his role in the Lufthansa hijacking because a 20-year statute of limitations gave him immunity from prosecution. But in February, the Swiss attorney general summoned Genoud to Bern to explain his role in the hijacking and his revelation in Pean's book that he had been in contact with terrorist Carlos the Jackal since the early 1970s. "I think he killed himself partly because he saw he could have difficulties with Swiss justice for the first time in his life," says Buhrer. <br><br>As the hijacking dramatically demonstrated, Genoud's postwar intrigues increasingly were on behalf of anti-Israel forces in the Arab world. <br><br>Before the end of the 1950s, Genoud had set up Swiss bank accounts on behalf of the North African liberation armies of Morocco, Tunisia and Algeria. In 1958, in partnership with a Syrian--and with Hjalmar Schacht as an adviser--Genoud set up the Arab Commercial Bank in Geneva, to manage the war chest for the Algerian separatists. Schacht was quoted as saying National Socialism would conquer the world without having to wage another war. When Algerian independence was proclaimed in 1962, Genoud became director of the Arab Peoples' Bank in Algiers. He brought his highly placed friend Schacht with him. But two years later, Genoud was arrested in Algeria and charged with violating exchange control regulations in the transfer of $15 million of FLN money to a Swiss bank. The intercession of Egyptian President Gamal Abdel Nasser got Genoud out of Algeria without a trial, and he never went back. After a 15 year battle in Swiss courts, the money was returned to Algeria. <br><br>Beginning in the 1960s, Genoud helped finance numerous Arab terrorist causes, selling weapons and paying legal fees. In November 1969, he sat alongside the radical lawyer Jacques Verges as an adviser at the trial in Switzerland of three terrorists from the Popular Front for the Liberation of Palestine (PFLP) who had blown up an El Al plane in Zurich that February. Genoud's Arab Commerical Bank paid for the defense. <br><br>Two decades later, Genoud would team up with Verges again, this time as financier for the left-wing lawyer's defense of Barbie, the Gestapo chief known as the "Butcher of Lyon." In June 1987, Genoud ignored a summons to appear as a witness in the Lyon court trying Barbie for crimes against humanity. Barbie killed 4,000 non-Jewish French citizens and deported 7,000 Jews to death camps. He was convicted in 1987 and died in prison. <br><br>Genoud meanwhile, set up a fund to help Nazis in prison. "He even had baskets of chocolate sent in to people in jail," says American journalist Kevin Coogan, who met Genoud in 1986. <br><br>The French press increasingly was reporting links between Islamic fundamentalist groups and classic, far-right European anti-Jewish organizations. In August 1987, the International Herald Tribune reported from Paris that "Francois Genoud, pro-Nazi Swiss banker living in Lausanne, . . . who has been named several times in the French press as the trustee of the 'Nazi war chest,'" had been a contact of Wahid Gordji, an official in the Iranian embassy in Paris, who was implicated by a French court in bombing attacks that killed 13 persons in Paris in 1986. Those attacks allegedly were carried out by a pro-Iranian Islamic fundamentalist terrorist network. Gordji also had paid for the publication of a mail order catalog advertising neo-Nazi books, the newspaper reported. <br><br>In 1982, Genoud acknowledged to a Lausanne newspaper that he had writer David Irving, who has no formal academic training in history, but claimed that there were no gas chambers, the Hitler knew nothing about death camps, and that fewer than one million Jews died in the war. He once claimed that Anne Frank's diary was a fake. "David Irving was asked about Genoud," says Gerry Gable, editor of Searchlight, an international anti-fascist magazine based in London. "And Irving said, 'Oh, I've known Genoud for many years, we're very good friends. Ah, there's an interesting man--a banker for the movement.'" Irving and Genoud later had falling out, over translation rights to the Goebbels diaries. But Genoud's propaganda campaign survived him, and his pro-Nazi successors have gone high-tech, making Holocaust-denial and neo-Nazi literature widely available on the Internet. <br><br>"He was not a person who was hung up on whether one was left-wing or right-wing, just anyone who was against Israel," says American journalist Martin Lee, who accompanied Coogan in the 1986 interview of Genoud and vividly recalls the meeting in Lausanne. <br><br>"The guy was a fanatic," says Lee. "From the first moment that he appeared and extended his hand for a handshake, he reeked of fanaticism. He came forward and clicked his heels in a sort of a Nazi heel-clicking mode, extended his hand and announced very proudly, 'I am Francois Genoud.'" <br><br>Genoud had agreed to meet with Lee and Coogan on the condition that they neither tape him nor quote him in an article. The well-dressed Genoud drove Lee and Coogan to the Beau Rivage, a luxury hotel in Lausanne overlooking Lake Geneva, where they sat down for a drink and conversation. "Clearly Genoud commanded the respect of the people in the hotel," says Lee. "He snapped his fingers, and people came running. Clearly he was perceived by others as a man of influence." Genoud refused to discuss his work, but spoke excitedly for 90 minutes about his politics. <br><br>"Literally, his eyes moistened when he spoke of how great Hitler was . . . . Genoud insisted that Hitler was not an invader of Czechoslovakia, that he was welcomed in, cheered en masse. He was practically crying when he said that." <br><br>Lee maintains that Genoud "is a much more significant figure in the postwar neo-Nazi scene than Barbie. Genoud is more the behind-the-scenes wire-puller. He was not someone who lined people up and shot them to death, but he had dealings with those who did. Genoud was a living embodiment of the continued political maneuvering and influence by Third Reich activists and hard-core Nazis after World War II--activities that had measurable influence in world affairs, as evidenced by Arab terrorism and other political violence." <br><br>In their article, which appeared in the May 1987 issue of Mother Jones magazine, Lee and Coognar refrained from quoting Genoud directly. Still, it was the only examination of Genoud by an American publication during his lifetime. "If a Swiss banking investigation doesn't turn up an involvement on the part of Genoud, I would suspect that it is not a full-fledged, serious investigation," says Lee. "A no-holds-barred probe has to turn up Genoud." <br><br>As far back as 1963, a German language newspaper in Basel reported that "a Swiss citizen who lives in Lausanne" was managing the remnants of the Nazi treasury, most of which had been stolen from European Jews. Twenty-four years later, during the Barbie trial in June 1987, Guy Bermann, a lawyer representing civil plaintiffs, summarized methods used by the Germans to accumulate wartime treasure--such as extracting gold fillings of death camp victims--and identified Genoud as the postwar manager of that fortune. <br><br>In 1992 the Observer called Genoud "one of the world's leading Nazis," noting: "Security services claim he transferred the defeated Nazis' gold into Swiss bank accounts." <br><br>The first English language portrait of Genoud appeared in 1985 in Unhealed Wounds: France and the Klaus Barbie Affair, by Erna Paris, who drew upon the work of Buhrer. <br><br>"It's impossible to say whether he committed suicide because there was going to be an investigation," says Paris. "But I think the timing suggests that given his age and physical decline, and given his daughter's comment, he might have decided this might be a propitious moment for departing." <br><br>Gitta Sereny, who knew Genoud for 25 years and called him "the most mysterious man in Europe," believes his deteriorating health led him to commit suicide. "He was really not at all well," she says. "He certainly was not going to last very long, and it really was as simple as that. He did not choose to be ill for a long time. It's a human thing, it's nothing political." <br><br>But Genoud--who narrowly escaped injury in October 1993 when a bomb exploded in front of the door to his home--was aware that circles of inquiry were closing in on him. In addition to the banking probes, a Lausanne judge was reviewing a Swiss television documentary about him co-produced by the International League Against Racism and Anti-Semitism, for possible violation of a new Swiss law on racial incitement. <br><br>"I don't absolutely believe that there was a planned attempt for a 'Final Solution,'" Genoud said the Pean book. "In my opinion, this is completely false. They [the Jews] were mobilized to work, but they were not systematically exterminated." Under the new law, the Swiss Federation of Jewish Communities retained a Lausanne lawyer to sue Genoud for that statement and others. On May 28, the Lawyer began legal action, seeking a search warrant of Genoud's residence. <br><br>The warrant was not be carried out. Two days later, the Swiss boy who had shaken Hitler's hand--exited the same way as his beloved Fuehrer--on his own terms, never having strayed from the cause. As the text from the Philadelphia Inquirer below suggests, Jacques Verges is, like Ramsey Clark, linked to the most extreme Islamic Fundamentalist groups and to neo-Nazism - the very things opposed by Milosevic and the Serbian people. Their involvement reinforces the already negative media image of Slobodan Milosevic by associating him with their own identification with Nazism and terrorism and b) draws Milosevic sympathizers into their orbit, in which Muslim terrorists are touted as leading the fight against Empire. An anti Jewish propagandist, he made a fortune publishing Nazi tracts. <br><br>...<br><br>In 1934, back in Switzerland, the 19 year old Genoud joined the pro-Nazi National Front, and two years later he began to forge the other political links that would prove so valuable. He traveled to Palestine. There he met the grand mufti of Jerusalem, the pro-Nazi religious and political leader of Palestinian Muslims, Amin el-Husseini, who was to spend most of World War II in Germany, and who, according to British author Gitta Sereny, "would consider [Genoud] a confidant until his death in 1974." <br><br>Genoud traveled to Berlin frequently during the war "to see his friend the grand mufti," and visited him afterward many times in Beirut, according to Le Monde correspondent Jean-Claude Buhrer. The grand mufti "entrusted Genoud with the management of his enormous financial affairs," according to Sereny. Working for both Swiss and German intelligence agencies, Genoud traveled extensively in the Middle East. <br><br>...<br><br>"Beginning in the 1960s, Genoud helped finance numerous Arab terrorist causes, selling weapons and paying legal fees. In November 1969, he sat alongside the radical lawyer Jacques Verges as an adviser at the trial in Switzerland of three terrorists from the Popular Front for the Liberation of Palestine (PFLP) who had blown up an El Al plane in Zurich that February. Genoud's Arab Commerical Bank paid for the defense. <br><br>"Two decades later, Genoud would team up with Verges again, this time as financier for the left-wing lawyer's defense of Barbie, the Gestapo chief known as the 'Butcher of Lyon.' In June 1987, Genoud ignored a summons to appear as a witness in the Lyon court trying Barbie for crimes against humanity. Barbie killed 4,000 non-Jewish French citizens and deported 7,000 Jews to death camps. He was convicted in 1987 and died in prison. <br><br>"Genoud meanwhile, set up a fund to help Nazis in prison. 'He even had baskets of chocolate sent in to people in jail,' says American journalist Kevin Coogan, who met Genoud in 1986. (This is the first of a three-part series on Mr. Clark.)<br><br>***<br><br>Exhibit A<br><br>Transcript of the exchange between International Action Center (IAC) founder Ramsey Clark and Tammy Lydel, president of the National Press Club in Washington D.C. <br><br>This exchange was broadcast live across the United States on C-SPAN television, May 12, 2003. Why have you represented the war criminals like Milosevic? <br><br>Ramsey Clark: Why would I? <br><br>Tammy Lydel: m-hmmm. <br><br>Ramsey Clark: Well the real reason is I'm a lawyer - and therefore never far from sin, as Kafka observed. I would take any capital case in the world because I have always opposed the death penalty passionately and always will, and - um - if you listed all the people that have been demonized that I've - um - represented - um - you'd have a hard time thinking of any others. One thing I do is - if - if no one represents someone I would insist on their being represented that's how I got into Sheik Abdel Rahman's case. He had no lawyer. I couldn't stand the idea that a - um Islamic scholar with a Ph.D. from Al-Azhar University in Cairo, who spoke no English, had no legal background, would go to trial without a lawyer... <br><br>Ramsey Clark: But - um - it's a form of guilt by association to, to ask the question, "Why would you represent such a bad person?" Are they human beings? Do they need help? Is that your calling? You can't do it all, but you do what you can. <br><br>[Excerpt from transcript of Lydel-Clark exchange ends here] <br><br>Regarding the claim that Ramsey Clark is Slobodan Milosevic's lawyer, we present Exhibit B. <br><br>==============<br>Exhibit B<br>==============<br><br>On November 20, 2001 United Nations Foundation Website reprints news report that Slobodan Milosevic rejected Ramsey Clark as attorney and legal advisor [2] <br><br>[Report that Milosevic rejected Clark as either his lawyer or advisor starts here] <br><br>Former Yugoslav President Slobodan Milosevic has rebuffed an International Criminal Tribunal for the Former Yugoslavia effort to assign him two attorneys who he can meet with confidentially as manipulation by the system, defense attorney Dragoslav Ognjanovic of Belgrade said yesterday. Milosevic has previously refused to appoint a defense team because he does not recognize the tribunal's authority. <br><br>"Milosevic 's stand is that this is a new manipulation by the court," Ognjanovic said. "The court has never asked Milosevic if he wants these two people to be appointed as his advisers." <br><br>... <br><br>The tribunal named former U.S. Attorney General Ramsey Clark and British lawyer John Livingston as the advisers, but Ognjanovic says the ICTY move restricts the number of other people who would be able to hold meetings with Milosevic without being monitored. (Reuters/ABCNews.com, Nov. 19).<br><br>[Report that Milosevic rejected Clark as either his lawyer or advisor ends here] <br><br>**** <br><br>On Monday, 12 May 2003, Mr. Ramsey Clark appeared at a luncheon of the National Press Club in Washington, D.C. At that luncheon, National Press Club president Tammy Lydel asked Ramsey Clark why he represented war criminals like Slobodan Milosevic. His answer was televised on the C-Span cable network and viewed in the US nationwide, perhaps by hundreds of thousands or even millions of people. <br><br>Many of us who have worked to refute the lies about Yugoslavia have restrained ourselves regarding Ramsey Clark's behavior. But this latest episode, in which Mr. Clark lied and attacked Slobodan Milosevic and, by extension, the Serbian people, cries out for public comment. <br><br>What is remarkable about the exchange between Ms. Lydel and Ramsey Clark? <br><br>The first notable thing is that, of all the questions Ms. Lydel could have asked Ramsey Clark, she led off by asking why he represented Yugoslav President Milosevic. Why would she make that her main question? Indeed, why would she ask that question at all, now? Clark hasn't publicly done a thing about the Milosevic case since he visited Mr. Milosevic in August of 2001 - 21 months ago! If Lydel wanted to attack Clark, as Clark suggested in their exchange, why didn't she start by asking him about supporting Saddam Hussein or the Islamist terrorists? Why did she ask why he is representing Milosevic? <br><br>The second question is, why did Mr. Clark answer with a lie? <br><br>Lydel said: <br><br>"Salon Magazine called you 'the war criminal's best friend.' Why have you represented the war criminals like Milosevic?" <br><br>And Clark answered: <br><br>"Well the real reason is I'm a lawyer -..." <br><br>But Clark's explanation, that he is representing Milosevic *because Clark is a lawyer,* is a lie. Because *Ramsey Clark is not representing Slobodan Milosevic*! (See Exhibit B) <br><br>*Why* did Ramsey Clark lie? Why didn't he just say, "I am not representing Slobodan Milosevic"? <br><br>And why, once he chose to pretend he was Milosevic's lawyer, didn't he do what lawyers do - which is to defend their client in public? <br><br>Why didn't he refute the false accusation that Yugoslav President Slobodan Milosevic is a war criminal? <br><br>Why didn't he say, "Has Milosevic been convicted before a legitimate court? Are you the judge and jury? Why don't you try reading the Hague Tribunal transcripts and you will see that Milosevic has exposed all their charges as lies, has proven that the Tribunal's sponsors - the U.S., Germany, France, England, Saudi Arabia and NATO - supported terrorism against Yugoslavia? It is precisely because President Milosevic so thoroughly exposed their lies about him - and the Serbian people - that all the big TV networks have stopped broadcasting the Hague proceedings!" [3] <br><br>Why didn't Clark say that Milosevic stood up to the KLA terrorists who attacked Serbia with NATO support? Why, having falsely posed as Milosevic's lawyer, did he accept without comment Lydel's characterization of Milosevic as a war criminal? Why did he say that even war criminals are human and that he, Ramsey Clark, is a lawyer and "you can't do it all, but you do what you can"?<br><br>If a doctor is asked why he would give you medical care even though you are a thief, and he replies that even a thief should be given medical care and he, the doctor, is a caring person, *he is agreeing that you are a thief.* <br><br>In the Untied States, when lawyers are asked by reporters if their client is guilty, they always say he is innocent. <br><br>If a lawyer fails to insist on his client's innocence, everyone knows that not only is the client guilty, but he or she is so guilty that not even their own lawyer has the nerve to deny it! <br><br>So by first affirming the lie that he represents Milosevic and then accepting the lie that Milosevic is a war criminal, Clark was strengthening the *false* impression among the public that Milosevic is a monster. A viewer would think, "Even his own attorney admits he is a 'bad person' and a war criminal. I mean, like Clark said, everyone deserves a lawyer, but I am sure glad I don't have to represent him!" <br><br>Moreover, Clark didn't just go along with Lydel's charge that Milosevic is a war criminal. He built on it. <br><br>He said, "One thing I do is - if - if no one represents someone I would insist on their being represented... " <br><br>That implies that Milosevic was desperate for a lawyer. But in fact:<br><br>a) Clark of course knows that Milosevic has *refused to hire any attorney to represent him before the Hague Tribunal* because he does not recognize it as a legitimate court and <br><br>b) Half the lawyers in the world would give their right arm for a chance to represent Milosevic and <br><br>c) As proven in Exhibit B, Milosevic made a specific point of publicly rejecting the appointment by The Hague Tribunal of Ramsey Clark as his attorney or, even, his legal advisor. <br><br>========================================================<br><br>Never too many lies...<br><br>========================================================<br><br>Having told so many lies, Clark went further. He placed Milosevic in the same class as Sheik Abdel Rahman, the blind Islamic fundamentalist convicted for trying to blow up the World Trade Center. (And what a grotesque comparison. Milosevic led the Yugoslav resistance to the Kosovo Liberation Army, linked to Al Qaeda, which terrorized Yugoslav loyalists - whether of Serb, Roma, or Albanian ethnicity - in Kosovo.) And to top it off, Clark accused Tammy Lydel of smearing him - Clark! - through guilt by association, because she had asked about his "representing" Milosevic. <br><br>========================================================<br><br>Tribunal gives Clark the red carpet while persecuting Attorney Steijnen, who *actually* represents Milosevic in the Dutch and European courts <br><br>========================================================<br><br>Exhibit C<br><br>Hague Tribunal spokesperson Jim Landale reports that in July 2001 the Tribunal gave Ramsey Clark special access to Milosevic, hoping Clark would convince the Yugoslav President to drop his strategy of speaking for himself in court, which was proving to be a disaster for the Tribunal. [4]<br><br>[Excerpt from AP dispatch begins here]<br><br>Associated Press Worldstream July 31, 2001; Tuesday Headline: Former U.S. attorney general visits Milosevic in U.N. detention unit, plans further consultations Dateline: The Hague, Netherlands <br><br>Ramsey Clark, a noted human rights activist and former U.S. attorney general, visited former Yugoslav president Slobodan Milosevic Tuesday at the U.N. war crimes detention unit, and was granted confidentiality normally accorded to legal counsel, officials said. <br><br>''We hope that the legal advise will result in him (Milosevic) formally giving power of attorney to someone,'' tribunal spokesman Jim Landale said. Clark also was at the seaside prison on Monday and planned to go again on Wednesday. <br><br>Previous visits by other lawyers and even by his wife, who saw him for three days earlier this month, had been monitored. <br><br>But judges of the U.N. tribunal for the former Yugoslavia granted Clark confidentiality privileges, even though he has not been appointed Milosevic 's lawyer. <br><br>''An exception was made. He is entitled to consult with lawyers and it was felt that that could take place in a private environment,'' Landale said. ''It is a temporary arrangement.'' <br><br>Milosevic appeared before the court alone at his initial appearance a month ago. He refused to recognize its jurisdiction, to appoint an attorney or to plead guilty or innocent. The court entered a [not-]guilty plea on his behalf.<br><br>[Excerpt from AP dispatch ends here]<br><br>So, in July 2001 the Tribunal made a special exception for Ramsey Clark, affording him rights denied even to Milosevic's wife. (Exhibit C) <br><br>Then in November 2001, the Tribunal appointed Clark as Milosevic's lawyer - despite Milosevic's opposition, thus forcing Mr. Milosevic to publicly reject this appointment. (Exhibit B) <br><br>And now, in May 2003, Clark pretends that he is representing Milosevic and smears him before a nationwide US Television audience. <br><br>By way of contrast, Nico Steijnen who has *actually* been appointed by Milosevic to represent him before the Dutch and European Courts, has been banned by the Tribunal from meeting with Milosevic, a violation of international humanitarian law. Also, the Tribunal has brought charges against Steijnen before the Dutch Bar, trying to get him disbarred. <br><br>A real lawyer for Milosevic is banned and threatened with disbarment. The fake lawyer goes on public TV, pretending to represent Milosevic and smearing him. <br><br>We know that Ramsey Clark does not represent Slobodan Milosevic. But clearly he has a professional interest in this case.<br><br>So who is his client? Could it be The Hague Tribunal? In an effort to silence President Milosevic, Richard May, who runs the proceedings, frequently shut off his microphone. <br><br>So by representing himself, Milosevic was in one fell swoop refuting the lies that have been pumped out for a decade about the Serbian people, and utterly contradicting the fictional Milosevic created by the media. Moreover, he was a beacon to people in Yugoslavia, suffering under a pro-NATO government installed in the October 2000 coup, which was financed and controlled by the US, Germany and Norway. Clark has never publicly disavowed this outrageous act. Thanks for posting the story on Genoud, proldic. I'm ashamed to say, I didn't know about his post-war association with Schacht, nor of his friendship with Jacques Vergès. It's enough to make my head spin. This is one of the most important stories out there, I think, for those who want to understand the contemporary world.<br><br>I found this quote by Hjalmar Schacht extremely chilling:<br><!--EZCODE QUOTE START--><blockquote><strong><em>Quote:</em></strong><hr>National Socialism will conquer the world, without having to wage another war.<hr></blockquote><!--EZCODE QUOTE END--><br>How likely is it Ayman al-Zawahiri knew Genoud? It wouldn't surprise me the least if Genoud was a co-conspirator in the Bojinka plot, which several years later would become 9/11.<br><br>I'll just theorize freely here. Was this post-war Nazi-Islamist underworld, or whatever it has morphed into, the real force behind 9/11? Aided by well-placed moles or collaborators or sympathizers in the US govt? It's a stretch, but then again, how big of a stretch is it? They've been in this game for decades. They are likely to have friends in high places. In the world of finance. In military organizations. In secret societies. In the Muslim Brotherhood and among the Gulf Arab elite. <br><br>Didn't I recently read about Pentagon IG Joseph Schmitz that he had redesigned the eagle in the IG seal, because the old had looked too "chicken-like"? And that the same Schmitz is a member of the Sovereign Military Order of Malta, like so many of the old-boys CIA types? And that his father was a virulent anti-semitist who was found to be too extreme by the John Birch Society (he wrote the foreword to the JBC classic "None Dare Call It Conspiracy").<br><br>And do I even have to mention Project Paperclip?<br><br>And where do Ramsey Clark and ANSWER fit in?<br><br>The "Underground Reich", if it exists, is of course likely to have an incredibly nefarious agenda, which perhaps we are ignoring, because we're chasing the distractions we are meant to chase. "National Socialism will conquer the world"...<br><br>Still speculating freely: suppose the above theory is correct. Suppose the "Underground Reich" has infiltrated the US govt and has its moles in high places. Remember Cheney, at the <!--EZCODE ITALIC START--><em>Holocaust memorial</em><!--EZCODE ITALIC END-->? His attire? The qutb is a spiritual being, or function, which can reside in a human being or several human beings or a moment. I am gonna stick with the basics on this .. the euro/american royalty and their many cabals are still behind the schemes..Muslims or Arabs or Jews are easy targets in this age of rabid rightie rascism...<br>It appears to me that the rulers have decided to press for a global catosrophe whether its nukes,chemicals.,disease natural disasters. I said RELIABLE source. Al Martin doesn't fit that bill, in my opinion. I say that as someone who was reading his website years ago, before it become a pay site. <br><br>This is the sort of data that generally requires more than one anecdotal source as corroboration in order to be considered reliable anyway, even if the person saying it isn't a genial con man like Al Martin. <br><br>Sometimes I wonder what this board would look like if there was a consensus to practice more diligence, instead of repeating every wild rumor in the world, including ones that have long since been convincingly discredited.<br><br>The real suspicious phenomenon isn't what the rumors say, but the existence of the rumors themselves, along with the people who delight in originating them, secure in the knowledge that that there's a sucker born every minute, willing to swallow them uncritically and repeat them.
