Judith Miller to talk to Fitz today

Postby marykmusic » Fri Sep 30, 2005 5:30 pm

Here's what the article on Truthout.org says, in part:
Quote:
Fitzgerald has the authority to extend the grand jury investigating possible leaks for another 18 months, and he could ask the judge to hold Miller in jail for six more months, lawyers familiar with the case said.

So this raises some more questions. It seems to be the general opinion that Fitzgerald's time is almost up, but doesn't this say differently?

Is Scooter Libby turning?

Read the whole article: Judith Miller Agrees to Testify --MaryK

Re: Fitz is planning on extending the grand jury

Postby seemslikeadream » Fri Sep 30, 2005 7:45 pm

Arianna says that Fitz is planning on extending the grand jury
"Was Miller’s sudden eagerness to find a get-out-of-jail excuse prompted by Fitzgerald’s planning to ask for an extension of the grand jury?"

www.commondreams.org/views05/0930-24.htm

Miller Walks: The Plot Thickens
by Arianna Huffington

It’s time for Judy Miller and Arthur Sulzberger to change their talking points.

The claim that Miller “has finally received a direct and uncoerced waiver” is laughable… and, indeed, has already been laughed at by 1) my increasingly frustrated sources within the Times 2) a chorus of voices in the blogosphere (see here, here, and here) and 3) (and much more significantly) Joseph Tate, Scooter Libby’s lawyer, who told the Washington Post yesterday that he informed Miller’s attorney, Floyd Abrams, a year ago that Libby’s waiver “was voluntary and that Miller was free to testify”.

So it defies credulity for Miller, Sulzberger, and Bill Keller to keep insisting that Libby’s earlier waiver was coerced when Libby says that it wasn’t. I don’t have much good to say about the vice president’s chief of staff, but I don’t doubt that he knows the difference between being coerced and acting on his own free will. How deep is the Times’ contempt for its readers that they really think they’ll buy the “Oh, Judy finally has the right waiver” line?

The truth of the matter is there is no way that the New York Times editorial claiming “it should be clear…that Ms. Miller is not going to change her mind” can be squared with Ms. Miller changing her mind. And there is no way to accept at face value Miller’s grandstanding about “fighting for the cause of the free flow of information.” Who is she still trying to convince? Herself?

After she answers Patrick Fitzgerald’s questions today, Judy Miller needs to start answering some of the obvious questions raised by her head-scratching stance:

What made her refuse Libby’s waiver when it was first offered but accept it now? (Especially since Judge Hogan had told Miller that “she was mistaken in her belief that she was defending a free press, stressing that the government source she ‘alleges she is protecting’ had already released her from her promise of confidentiality.”)

Was Miller’s sudden eagerness to find a get-out-of-jail excuse prompted by Fitzgerald’s planning to ask for an extension of the grand jury?

Or was it prompted by Fitzgerald’s gearing up to charge her with criminal contempt?

If all it took for Miller to feel properly released was a phone call, why did she wait 85 days to make it?

And so we don’t forget what this story is really about, and given that the aluminum tubes crap that Miller put on the front page of the New York Times was being heavily promoted by Cheney, how much of that bogus information came to Miller via Libby?

And here are a few questions for the Times:

Had a Plame/Wilson story been assigned to Miller or not?

What, if anything, did she say about the story to anyone at the paper at the time… and what did they say back?

Why did the Times hold back the story about Miller’s release and let multiple other news sources scoop them? Were they trying to miss the evening news cycle and avoid the overnight thrashing their spin has rightly received?

So, as the image of Judy as a principled, conscience-driven defender of the First Amendment gives way to the image of Judy wearing her "new" waiver as a fig leaf allowing her to get out and sing, the big question remains: What is she hiding?

Lewis “Scooter” Libby, to Miller on September 15, expressed surprise that her lawyers had asked him to "repeat for you the waiver of confidentiality that I specifically gave to your counsel over a year ago." Surprisingly, he stated that he expected her testimony to help him.

This “Dear Judy” letter repeatedly expressed his admiration for her and cited everything she was losing in jail, from missing out on covering new biological threats to enjoying the aspens turning out West. He noted that the aspens "turn in clusters, because their roots connect them."

But maybe the personal tone is not so surprising. The letter suggests that the two, who saw eye to eye on Iraqi weapons of mass destruction, which never materialized, are either very close—or Libby was just pretending, to make her go easy on him if she did testify.

The text of the entire letter, which was mailed to Miller's attorney, Robert Bennett, has not been printed in the Times or elsewhere.

It begins with “Dear Judy, Your reporting, and you are missed. Like many Americans, I admire your principled stand. But, like many friends and readers, I would welcome you back among the rest of us, doing what you do best—reporting.”

Then, several paragraphs expressed his surprise that she has not acted on his voluntary offer of a year earlier to waive his rights to confidentiality, since it “served my best interests…this is the rare case where this ‘source’ will be better off if you testified.” He dubbed this the “Miller corollary.”

He closed the letter on this personal note (although he wasn’t quite right on when autumn begins): “You went into jail in the summer. It is fall now. You will have stories to cover—Iraqi elections and suicide bombers, biological threats and the Iranian nuclear program. Out West, where you vacation, the aspens will already be turning. They turn in clusters, because their roots connect them. Come back to work—-and life. Until then, you will remain in my thoughts and prayers.”

“With admiration, Scooter Libby.”

It is fall now."
Fall now means Stand Down. It's okay to walk out of jail now. No one will silence you for what you know.

"You will have stories to cover--Iraqi elections and suicide bombers, biological threats and the Iranian nuclear program."

You won't be killed, you'll be going back to work (for us).

"Out West, where you vacation, the aspens will already be turning."

Already be turning means one of two things: The Espionage investigators have turned one of Cheney's gang and he's already singing - probably Franklin who just pled guilty - OR Fitzgeralds already been turned. The investigation has been fixed.

Which can be discerned by finding the meaning of Out West.

"They turn in clusters, because their roots connect them."

Fitzgerald is going to get the goods on all of them because all the investigations, AIPAC, Fitzgerald, are connected OR not just Fitzgeralds investigation, but ALL the investigations have been taken care of. They have avoided disaster.

"Come back to work---and life. Until then, you will remain in my thoughts and prayers."

Says it all one more time to be perfectly clear. You can go back to work now. We won't have to kill you for what you know. It's safe. Either the investigators have broken the case and it's a moot point, or the investigations have been fixed and it's still a moot point.

The final key, the one I can't figure out, is the one that would tell us which way it is going down:

Out West, where you vacation
