<!--EZCODE BOLD START--><strong>Pedophile's sentence too harsh, judge rules</strong><!--EZCODE BOLD END--><br><br>Last Updated Wed, 31 May 2006 11:22:28 EDT<br>CBC News<br><br>A Quebec judge on Tuesday reduced the sentence of a Montreal man who raped his infant daughter, saying the original ruling was too harsh.<br><br>The 32 year old was found guilty in March 2005 of sexual assault and using his daughter to possess, produce and distribute child pornography. The assaults started when his daughter was 24 months old and lasted for two years.<br><br>The man was originally sentenced to 15 years in prison.<br><br>But in its 2-1 decision earlier this week, the Quebec Court of Appeal ruled the assaults were not among the worst sexual assaults committed and the man shouldn't have received the maximum sentence.<br><br>The court reduced his sentence to nine years in prison.<br><br>"There was no violence <!--EZCODE BOLD START--><strong>[?]</strong><!--EZCODE BOLD END-->, such as gagging, threatening or hitting the child," wrote Judge Lise Cote.<br><br>Cote cited the father of four's young age and lack of criminal record — other than the sexual assault of another child when he was 17 — in the ruling.<br><br>The prosecution's case was based on roughly 5,000 pictures and 5,000 videos found on the man's computer, some featuring very young children.<br><br><!--EZCODE LINK START--><a href="http://www.cbc.ca/story/canada/national/2006/05/31/pedophile-reduce.html">www.cbc.ca</a><!--EZCODE LINK END--> <p></p><i></i>

This has been happenning since I can remember. <br><br>About 25 years ago I recall my own Mother being appalled to read that a proven child rapist had, on the same day, in the same court house complex received a lighter sentence than a young man who'd deliberately damaged a tree with his pocket knife. <br><br>And the list goes on. <p></p><i></i>

I agree with all these comments. first, it is something of a miracle if any child rapist gets in to court. second miracle if the police or prosecuting authority hasn't trashed the evidence. third miracle if the rapist and his buddies haven't got big gun psychiatrists/lawyers on the payroll to besmirch victim and any decent player in the farce,(social worker, prosecution expert etc) and get him off. fourth miracle if the court finds him guilty and gives anything more than 3 years.<br><br>save the trees, f*** the kids<br><br>Child pornography is big business. <br><br>God help little children. <p></p><i></i>

judges from their position and from practicing anything to do with law for life. This sort of sentencing should require they themselves to do prison time. I know on average in the US that sex offedners get a slap on the wrist but this sinks to a new low. <p></p><i></i>

I wonder, if the death penalty is being considered, why not consider less morally questionable, yet equally radical solutions? For example, couldn't repeat child rapists be tattooed in an obvious place such as the forehead, making them instantly recognizable? It sounds crazy, but, less crazy than letting them out to victimize helpless children... <p></p><i></i>

why shouldn't the punishment fit the crime?<br><br>do we let somebody who knifed a victim, keep their weapon and take it with them to jail? do we let somebody who shot a victim, keep their weapon and take it with them to jail?<br><br>i say society should remove his weapons: both hands, and his penis.<br><br>then there'd be no need for the rest of everybody to sacrifice of themselves to lock him up and feed him and keep him warm and healthy. let him walk the streets with what these judges would probably call "alterations". <br><br>then tattoo the judge's forehead with "i don't believe child-rape is a violent crime"<br><br>goddamn it, i'll be post-feminist in the post-patriarchy. <p></p><i></i>

anger control

though my head is full of details about ra offenders who deserve any punishment that can be devised and more, and my anger is great, and at times overwhelming, legal mutilation and the death penalty are out. too easy for the justice system to make a mistake, especially as the organised gangs use the strategy of blaming and framing.<br><br> Is there room for the extreme anger which the great majority feel at these crimes to be recognised, when under such provocation victims or their carers settle what the justice system so often fails to settle?<br><br>and can we please have appropriate police response to complaints? <p></p><i></i>

(anger management is the new term..).<br><br>I was just thinking about it, today, when i read a letter by Ken Wilber, regarding a sex offender, who operated in Israel (a new age Rabbi, and his dear friend). the guy messed up the lives of several ladies and then when they complained he escaped to the USA, to Wilbur's institute. There, he wrote an apologetic letter to his community here, and said that he was "sick" and is now seeking treatment. Wilber wrote in his blog that the institute is forming a "steering committee" to oversee his treatment etc., so that is doesn't turn into a joke, BUT that the guy should be allowed to write, cause his writing is not connected etc..then, as a Buddhist he reminded all about compassion etc. I was very ambivalent. On one hand, I now realize that revenge is not the answer, but then again people charming their way out by "new age" talk, ONLY when it comes to sex offenses...i thought this was annoying too.<br>--<br>In Israel, sentences of pedophiles are ridiculously low, and MOSTLY in incest for some reason. (as is the case in question here). I think incest is worse than other cases, cause it destroys the basic ability to trust, but the judges do not.<br> <p></p><i></i>
