CARTER<br>THE PRESS DEMOCRAT<br><br>Two Sonoma County sheriff's deputies traveled to Colorado this week to extradite John Mark Karr, but returned empty-handed, sources in both states confirmed Friday.<br>Sheriff Bill Cogbill would not discuss the details of the trip or why deputies left Boulder without bringing back the high-profile defendant on a local warrant for failing to appear at a 2001 hearing on charges of possessing child pornography .<br>But he alluded to larger issues in the case that could affect Sonoma County's five-count misdemeanor prosecution of the former Petaluma substitute teacher who famously confessed, apparently falsely, to the 1996 JonBenet Ramsey slaying .<br>"The dynamics evolve day to day," Cogbill said, adding to the mystery surrounding an already bizarre case. "There are huge dynamics going on that could change the whole course of this." He said he would be able to talk more freely early next week.<br>"There is a whole other dimension to this that I'll probably be able to talk about later, but not today," he said.<br>Cogbill said it is still the intention of local authorities to return Karr, 41, to Sonoma County to face charges.<br>"That could change," he added.<br>Boulder County Sheriff Joe Pelle confirmed that Sonoma County deputies arrived Thursday to transport Karr, but that Karr remained in custody Friday at Boulder County Jail.<br>Neither of the two deputies would discuss the trip, which was described by other sources as a quick turnaround after a flight to Colorado.<br>Colorado prosecutors and court administrators said nothing had changed with Karr's status and that no legal motions had been filed to delay his extradition.<br>After his arrest in Thailand last month, Karr admitted involvement in the killing a decade ago of the 6-year-old beauty queen at the Ramsey family's Boulder home. Karr was deported from Bangkok and then charged with murder upon his return. B ut Karr's DNA failed to match evidence found at the scene and the Boulder County case against him dissolved.<br>Sonoma County authorities then asserted their jurisdiction over Karr for the pending 2001 case and a Boulder judge ordered Karr retrieved by Sept 13. Conviction on the misdemeanor charges, involving computer images of children in sexual situations, could result in jail time and force Karr to register as a sex offender for the rest of his life.<br>Karr's 2001 arrest on the child porn charges grew out of an investigation into the unsolved murder of 12-year-old Georgia Moses. Karr was audiotaped by a sheriff's informant at that time discussing a "psychic connection" he had to Ramsey and Petaluma murder victim Polly Klaas.<br>One of Karr's attorneys, Gayle Gutekunst of San Francisco, said Friday she hadn't been advised of any problems with the extradition to Santa Rosa. She said extradition could be delayed if Karr had now decided to fight the process.<br>Another possibility for the delay may be that another jurisdiction - possibly the federal government - is interested in Karr in connection with other crimes, Sonoma County Public Defender John Abrahams said.<br>A 3-year-old federal sex-tourism law makes it illegal for Americans to travel to a foreign country to have sex with children. Each count can mean up to 30 years in federal prison.<br>Karr, who has talked and written about his sexual fascination with young girls, was working in Thailand as a teacher of young girls at the time of his arrest.<br>FBI spokesman LaRae Quy in San Francisco said Friday the agency has no interest in Karr.<br>Meanwhile, responses from Cogbill, the Sonoma County sheriff, raised as many questions as they answered.<br>"I'll know more Monday or Tuesday about how everything could play out in this, and it could be completely different than what I think could play out today," he said. I know, I know, it's a tabloid, but I am highly interested in the drawings of Burke, as a child's drawings can tell us alot about what goes on in their household. Can someone please try and post this? TIA! <p></p><i></i>

They want someone else, anyone else, to find the body.<br> John Ramsey didn't want anyone else finding the body. there were some loose ends that he needed to "tie up".<br> He HAD to say that he removed the tape from his daughter's mouth. No one else saw the tape on her mouth. Fleet White was right behind him and he didn't see it. The autopsy mentions no residue on her face indicating the presence of tape. I don't believe her mouth was taped when he found her. I think the killer tried to apply it to her skin, it wouldn't stick, and left it somewhere near the body. Fibers matching Patsy's clothing were found attached to the tape. No fiber evidence has been mentioned as being located around the mouth area of the body. Dried emisis was noted in the area that tape would have touched. Karr has no history of drug abuse, crime or violence. He is an animal rescuer and has a keen sense of humor. Though highly intelligent, Karr can be argumentative and temperamental and cannot keep a job. <br><br>Behavioral scientists tell us that psychopaths and pedophiles do not wait until age 37 to manifest their demons; instead they begin setting fires, torturing animals, peeping into windows, molesting children and exhibiting violent propensities early on. Karr has never exhibited any of these traits. <br><br>The murder of JonBenet Ramsey at Christmastime 1996 mesmerized Karr and, while living in Hamilton, Alabama, he began obsessively compiling information for a book about her which his father, Wex Karr, had suggested he write. <br><br>In July 2000, Karr sold his meager possessions, loaded his wife and three sons into their beat-up van and set out for California where, in the spring of 2001, Karr met Wendy Hutchens, longtime friend of Richard Allen Davis, the infamous murderer of 12-year-old Polly Klaas. Karr wanted to interview Davis to gain insight into the psyche of a child murderer. Hutchens gave Karr an entree to Davis and he interviewed him in prison. <br><br>At some point early on in their relationship, Hutchens apparently became persuaded of Karr's involvement in the Ramsey case, contacted law enforcement officials and began taping her conversations with him. (Although a purported 10 hours of recordings were made, we have to wonder why less than 1 percent of the tapes have been aired.) At the beginning of one of the tapes we have heard, Hutchens asks Karr to profile JonBenet's killer: How did he kill her? What was going through his mind? (In one of Karr's instant messages to University of Colorado communications professor Michael Tracey, he explains how Hutchens persisted in her requests to entrap him into playing the role of JonBenet's killer.) <br><br>Karr relented and Hutchens eventually turned the tapes over to those she had contacted at the FBI and Sonoma County Sheriff's Department, laying claim to the $100,000 reward being offered by the Ramsey camp. <br><br>If the tapes incriminated Karr in JonBenet's murder, why did Hutchens fail to collect a dime? If the tapes did not implicate Karr in the crime, they certainly could not have formed the basis for the issuance of a valid search warrant. <br><br><!--EZCODE BOLD START--><strong>Nevertheless, Sonoma proceeded to raid Karr's home in April 2001, seize his computer and charge him with possession of five photos depicting "child pornography" despite the fact they had been deleted and buried in the unallocated space on the computer, thus rendering the photos inaccessible to Karr. It took a highly trained computer expert using sophisticated software techniques to recover the photos before Sonoma could view them.</strong><!--EZCODE BOLD END--> <br><br>Can we not presume that Sonoma has determined the name(s) and age(s) of the depicted "child" or "children" during the five years since Karr's arrest? If not, Karr's acquittal under the California statute in question is a certainty. <!--EZCODE BOLD START--><strong>Moreover, why has Sonoma refused to release the police report, warrant affidavit, etc., to the public as required under California law?</strong><!--EZCODE BOLD END--> <br><br><!--EZCODE BOLD START--><strong>Karr remained in jail for six months under a $100,000 bond - unprecedented in the history of the American criminal justice system.</strong><!--EZCODE BOLD END--> Violent felons are routinely released on much lower bonds every day in America. The purpose of a bond is not to keep the defendant in jail while awaiting trial, but rather to ensure his presence at trial. Given the lack of any criminal record, Karr should have been released on his own recognizance. We can only try to imagine the hostile treatment he received while incarcerated; it is little wonder he ran as soon as he was released. <br><br>Meanwhile, Sonoma says it gave the Hutchens tapes to Boulder in 2001, but Mary Lacy proclaimed to the world on Aug. 29, 2006, that she had never heard of Karr or the Hutchens tapes until August 2006. It strains credulity to believe that Sonoma and the FBI procured tapes that ostensibly deal with one of the most famous unsolved murder cases in American history, but simply failed to notify Boulder. Either Sonoma or Boulder is lying and fully engaged in a giant cover-up of their incompetence. <br><br>John Karr's life has been destroyed. He can never work again. He will probably never be allowed to see his children again. Karr has been turned into a modern-day Elephant Man to be stared at, cursed, physically attacked, and vilified for the rest of his life. <br><br>Gary Harris has practiced law in Georgia for 39 years and lives with his wife in the northeast Georgia mountains. On the day prosecutors offered John Mark Karr a plea bargain, Sonoma County sheriff's officials Tuesday acknowledged they lost a computer containing images used to charge Karr with possessing child pornography.<br>A sheriff's spokesman said the computer - one of at least two seized from Karr's Petaluma residence in April 2001 - may have been missing since early 2002.<br>Karr gained national notoriety last month when he admitted, apparently falsely, on television in Bangkok, Thailand, that he had been present at the 1996 slaying of 6-year-old beauty pageant contestant JonBenet Ramsey in Boulder, Colo.<br>"It appears that in the move from the old office to the new building, it was either lost or accidentally purged. But, no, we have not been able to locate it," Sheriff's Lt. Dave Edmonds said Tuesday.<br>Printed copies of five images, which purportedly show children in sexual situations and a detailed report of the hard drive contents were retained, Edmonds said.<br>"The loss of the original media is a mistake. It was an error, definitely," he said. "It is unfortunate, but we don't think that significantly changes the provability of the case."<br>Assistant District Attorney Larry Scoufos said the loss of the original source of the evidence will not critically damage the case.<br>"We think we will still get in the evidence that we need," he said. "We feel we have sufficient evidence to still link the images to Mr. Karr."<br>Karr's attorneys, who learned of the missing evidence from a reporter, were shocked at the revelation. They said they are exploring the ramifications of the problem and are considering what steps to take before hearings scheduled for next week.<br>"I wonder if that was the impetus of the offer today," said Rob Amparán, one of three San Francisco lawyers representing Karr in the misdemeanor case. "It seems like a pretty embarrassing mistake for the Sheriff's Department to admit."<br>Scoufos, however, said there was no connection between the two developments.<br>Earlier in the day, prosecutors offered Karr a plea bargain with fewer charges that would require no further jail time but would force him to register as a sex offender for the rest of his life.<br>Amparán said he would discuss the offer with his client, but he insisted Karr is innocent of the child porn possession charges filed in 2001.<br>"We feel very confident we will ultimately be successful in exonerating him of these charges," he said.<br>Amparán said the loss of the computer could be just as damaging for the defense as for the prosecution. He said he'd hoped a defense expert in forensic computer examination would be able to use the computer to find evidence in Karr's favor.<br>"That computer had evidence that Mr. Karr was not only not guilty, but innocent of the charges," he said. He declined to be more specific until he consulted with his computer expert.<br>Other attorneys said the defense could move to exclude the evidence - the crux of the prosecution's case - because the defense cannot independently examine the source of the evidence.<br>Karr, briefly a substitute teacher in Petaluma and Napa in 2001, is facing five misdemeanor counts of possessing pornographic images of children, for which he served more than five months in the Sonoma County Jail in 2001.<br>Karr was arrested Aug. 16 in Thailand and brought back to the United States amid worldwide media coverage after his extraordinary admission in the Ramsey slaying.<br>After Colorado authorities said DNA evidence cleared Karr in the case, Sonoma County took the unusual step of extraditing Karr to face the 5-year-old misdemeanor charges.<br>In court Tuesday, prosecutor Joan Risse announced she was extending a plea offer for Karr: The District Attorney's Office would drop three of the charges if Karr admitted to two others. He would not be required to serve more time in custody, but prosecutors would seek three years of formal probation.<br>The plea agreement also would require Karr to register under the state's Megan's Law as a sex offender.<br>The missing computer raises serious questions about the viability of the prosecution's case, a former prosecutor said.<br>"It's not necessarily a case-killer, but it will make things difficult for the district attorney," said Roy Miller, a former Lake County prosecutor who received FBI training in forensic computer examination.<br>"If this case goes to trial, they're going to have to tell the jury they screwed up the most basic thing in this case - the computer evidence," said Miller, now a defense lawyer. "It's like showing up for a murder trial and saying, 'Oops, I lost the bloody knife, I lost the smoking gun.' It's not necessarily fatal, but it is a problem."<br>It was not immediately clear Tuesday precisely when authorities discovered the computer was missing. But during a court proceeding three weeks ago, on Aug. 29, prosecutor Risse told Judge Cerena Wong that the investigation had been reopened and that experts were examining the computer.<br>Her statement came as the District Attorney's Office was opposing efforts by The Press Democrat to unseal the 2001 search warrant that had led to the child porn charges.<br>"A lot of what's in the search warrant relates to the forensic computer exam; and that's being redone because there is newer equipment and newer procedures that we can obtain more off of the computer than we could back in 2001," Risse said in court.<br>"I'm really not sure if that's going to bring forth more material. So there is an ongoing investigation going on relative to the computer," she said, according to the official transcript.<br>Wong refused to unseal the court records, citing in part, the "reopened" investigation.<br>The Sheriff's Department moved into its new building in April 2002 - a year after Karr's arrest and about three months after original trial dates in Karr's case. Karr failed to appear for a hearing in October 2001 and a warrant was issued in December of that year.<br>Edmonds said the computer may have been accidentally thrown out with more than 40,000 other items of evidence purged from sheriff's storage when the department changed buildings. Each year, about 20,000 items of evidence are stored for active criminal cases.<br>Miller said Karr's defense may be able to argue for the suppression of the computer evidence because they will not have the opportunity to examine its original source.<br>The prosecution, including law enforcement and the District Attorney's Office, has an obligation until a case is resolved to retain evidence that will be used against a defendant in court, he said.<br>Edmonds said detectives haven't found evidence on Karr's other computers.<br>A laptop returned with Karr from Thailand is in the hands of federal authorities, and Sonoma County detectives are working with them to determine whether there may be any evidentiary value in it, Edmonds said.<br>Also Tuesday, Wong set Karr's bail at $200,000, saying he is a flight risk. They lost a computer, and Federal authorities have in their custody Karr's laptop? Makes me think perhaps Karr has images some people don't want seen. <p></p><i></i>

OK those parents' explanations were not exactly watertight,
or convincing..or possible.
