so the entire charges are hanging on tetimonies of the family members ? its not a very strong case unless there is some corroboration, like bruises or neighbors hearing something. that's bizarre that he is held in custody for so long before trial. does he have prior convictions or complaints against him ? drunk driving ? anything ?<br><br>I think I read somewhere that he chose to go pro se, why ? that is not a good idea, usually. He is a lawyer so he should know that. Perhaps he is already distrustful but surely he can now get high profile firms, just for the publicity.<br><br>From what i've seen with people who fall into these pits, even if one is framed, it is better for him to treat it as bona fide mistake by the system, and address it as a problem to be dissected into little ones, try to minimize the legal liabilities, and then once he is out, he can address his family crisis. Her father will not live forever...and RIchard probably wants to win his kids back. that's what's really at stake, right ? <br><br><br><br><br><br> <p></p><i></i>

When Richard and Susan came voluntarily to the police--Susan had bad bruising, but she said it was from an attack by an associate of her father's. The police didn't believe her. They arrested Richard instead. After two days of the police grilling Susan and not believing her story and telling her that they believed her husband did it--she recanted. Yes, it is the kids that are at stake in this and that is my primary concern. Richard had a lawyer in the beginning, but that lawyer volunteered and wasn't getting paid, but also decided to do no work. We had to let go of him and Richard took on the case with co-counsel: Robert Banning. <br><br>Brad <p></p><i></i>

But now she claims he was beating her all the time. It's bizarre. We'll just have to see what other "proof" the police have mustered. It's really a very circumstantial case. I can at least testify that I never saw my brother hit or threaten Susan in any way during the 20 years or so I knew them as a married couple. When you're around a couple, and one of them is abusive, it's usually pretty obvious in the way the man treats the woman in general. I know they had arguments, like all married couple do, but I never even saw him yell at her. I've known guys that were really controlling and belittling to their wives--and it always makes you think--man, I bet that jerk hits his wife. With Richard, the thought of spousal violence never entered my mind. That of course doesn't mean it never happened, but certainly not to my knowledge, and they certainly had no history of abuse concerning each other. Richard has never been arrested before. He has no criminal record before his current situation, which could put him in prison for life.<br><br>Brad <p></p><i></i>

It is a difficult situation, and I suppose it all depends on her testimony and how well his co counsel cross examines her and the kids (if the testify at all). Did he consider getting an expert to testify on his behalf, a psychologist (preferably a female, I would say) ? that perhaps would be a good idea anyway, for the maintenance of his paternal relations with the kids. Isn't the prosecution his former colleagues ? and did he intentionally choose a PD for counsel of lack of funds ? <br>--<br>What is possible too is that she was severely abused by her father/cult and harrassed later by his associates, AND that in some incidents your brother lost his temper with her. Its not necessarily mutually exclusive. It sounds as if there's a "catch" here, that suddenly he has the burden to prove that her initial complaint is true (or sincere) or else he is guilty of beating/abusing her. PSychologically, it is not a good way to depict the credibility issue. She could be delusional about the abuse (and even self mutilating herself) and he could still be innocent of abusing her. there are lots of possibilities, and it was/is presented as an either/or situation and a "last match" challenge for him, to prove the cult issue. Perhaps he should change his strategy about it. Don't know. just thoughts. I don't know the particular charges. <br><br><br><br> <p></p><i></i>

I would think the prosecution would have to answer the question, "Why did Richard go to the police dragging along his wife if he'd just beaten her?" <br><br>Is there an answer to that other than he honestly believed someone else did it? Or was he going to "turn her in" because of the abuse of the kids? <p></p><i></i>

Susan told Richard that the cult was actively planning to murder him. Things were obviously getting out of control. So, they went to the police. He didn't go sooner because he wanted to collect evidence first, but the situation became too dangerous. Without a smoking gun to show the police--law enforcement went with what seemed normal. This guy's crazy and he beats his wife. <p></p><i></i>

No, I get why they actually went...but not how the prosecutors could explain it. Why would Richard go to the police if he was the abuser? He'd have to be crazy. Then why is this a criminal case. I think it's an important point.<br><br> <p></p><i></i>

He could have cooked all this up AFTER the fact to try to protect his brother. Looked at the web, come up with this angle. His short stories show ability in the area of very dark fiction. But since Dodger says Richard HATES Brad, that wouldn't make sense. <br><br>Dodger, why don't you come back and give us some evidence you aren't simply a nut. You've pretty much blown your anonymity anyway as how many people have been at a party in which Richard beat up Bradley on a front porch? (if that really happened.) <p></p><i></i>

If you don't want to provide any evidence, that's up to you, but if you believe that what you are saying is true, then I think you ought to. Or turn it over to the prosecutors. In fact, if you are that intimate with the Hamlins, I imagine you already have done so. If what you are saying is true, I certainly hope so. If what you are saying is false..<br><br>And what about Susan's original allegations? Diaries, etc? The only way I figure it, if they are in Susan's handwriting, wouldn't Richard (according to your theory) have had to force her to write those BEFORE he knew he was going to be arrested?
