ELECTIONS
Mailing It In? Experts Doubt USPS Can Get a Handle on Ballots This Fall
ELISE KLINE 08/13/22

http://www.thelandesreport.com/votingsecurity.htm

There is no transparency to our current voting system. Under the U.S. Constitution and case law, qualified citizens have two constitutional rights: 1) to vote, and 2) to have their votes counted properly.  For that right to be enforced by federal and state authorities, the voting process must be observable.
U.S. elections are not transparent or observable. When Congress and state governments opened the door to increased voting rights, 'convenient' access, and secret ballots, they closed the door to effective transparency and meaningful oversight of the voting process. Now we have computer voting, early and mail-in voting, drop boxes, and electronic voting for the military...taken together they have destroyed any semblance of election integrity or legitimacy. Things weren't always this way.
BEFORE the Civil War, voting was a completely transparent process.  It was only during the Civil War, as the right to vote expanded to African Americans, that the voting process itself began to recede from public view and meaningful oversight.  It started with absentee voting for soldiers only in the 1860’s, secret ballots in the 1880’s, and voting machines in the 1890’s.  Today in America, more than 50% of all voting is by absentee, mail, or early, 95% of all votes are machine-processed, and 100% of all ballots are secret and anonymous. For the sake of convenience and 'alleged' voter protection, Congress has destroyed the transparency, verifiability, and integrity of America’s voting process.
The 'secret ballot' is a 'blank check' for vote fraud. It has had the biggest negative impact on our ability to truly verify election results. While our politicians are required to vote publicly and openly, we citizens are held to a different standard - a lower standard.  We vote remotely, privately and anonymously by machine, absentee, early, and secret ballot. It's an invitation to massive and undetectable vote fraud.  That is why, there should be only one standard of voting for both our political representatives and voters. All voting should be open and public - no machines, no absentee, no early voting, and no secret ballots. Secret ballots are really anonymous ballots that corrupt election officials can count any way they want. Why one standard of voting for politicians and another for the public?  Under current circumstances, the only thing candidates and voters can do  to find out how citizens really voted is to conduct their own CITIZEN AUDITS.
Making matters worse, our public voting system has been privatized and outsourced to a handful of domestic, foreign, and multi-national corporations. For the most part, our elections are counted by 3 major companies (ES&S, Dominion, and Hart Intercivic) whose owner(s) and/or technical staff could easily rig voting machines manually or wirelessly (either touchscreens or ballot readers); these companies and/or their subcontractors could also rig elections while inputting the candidates’ names for each new election, or simply write the software to tabulate more votes for one party over the other. See 2005 video: Danaher VP admits that they can rig an election
Can't we detect vote fraud through exit polls?  The major news networks refuse to report on vote fraud and have been implicated in it. Exit polling is conducted by one organization, currently called the National Election Pool (NEP), that is hired by the major news networks and the Associated Press. Since they first started "projecting" election night winners in 1964, at the same time computerized ballot scanners came into use, the major news networks have never provided any 'hard' evidence that they actually conducted any exit polls, at all.  In other words, the major news corporations broadcast their own pre-election surveys based on anonymous sources, collect vote totals on Election Day in a manner they refuse to disclose, and back-up those results with their own exit polls based on more anonymous sources.  The late authors of the book, VoteScam: The Stealing of America, James M. Collier and Kenneth E. Collier, concluded that some of the major news networks, including the polling organization that they hire for election night reporting, have been complicit in vote fraud.
In America, less than 1% of votes are hand-counted-paper-ballots at the polls on Election Day. Neither government-controlled audits nor official recounts (both can occur days or even weeks after the election) provide sufficient transparency to detect widespread election fraud by voting machines companies and/or election officials.  Moreover, the U.S. Justice Department (DOJ), under the 38-year reign of Craig C. Donsanto, refuses to seriously  investigate or prosecute electronic vote fraud.
“If you did it right, no one would ever know,” said Craig C. Donsanto, head of the U.S. Department of Justice’s Election Crimes Branch, Public Integrity Section (from 1970-2010) in a July 4,1989 Los Angeles Times article about electronic voting machines and vote fraud. (See DOJ & FBI complicity))At the highest levels, both political parties, the U.S. government, Big Tech, and major news media are well aware of this situation because they are complicit in it. (See Exit Polls) At the very least, election counting should be local and consist of only paper ballots and hand counts at the local polling precincts on election day - no machines, no computers, no absentee, no mail-in, and no emails. See Paper Ballots
For those who cannot make it to the polls on Election Day, designated teams of poll workers together with poll watchers should visit places such as nursing homes in order to conduct onsite elections and deliver those ballots to the local polling station to be counted on that day, Election Day, maintaining transparency and chain-of-custody requirements.  Similarly, polls could be set up at embassies, consulates, and military bases for citizens living overseas. And for those who don’t believe we can get enough people to count ballots, election officials have every right to draft citizens into service, as is done with jury duty. Hand counting isn’t rocket science. Other countries around the world do it for their elections.

Alexander Charns Supreme Court Freedom of Information Act Collection

This collection contains thousands of FBI documents procured by North Carolina lawyer Alexander Charns through the Freedom of Information Act over eight years.  His research reveals the extent of FBI Director J. Edgar Hoover’s secret activity to influence Supreme Court decisions and to discredit non-compliant Supreme Court Justices through wiretaps and disinformation.  In the process Charns filed hundreds of Freedom of Information requests and brought lawsuits against the FBI.  Charns was given special permission to research Justice Abe Fortas’ papers which showed Fortas had been an informer to the FBI and the White House during his tenure which ended in disgrace after an ethics scandal.  Charns' pioneering work was the first to expose this FBI constitutional violation of the separation of powers.

Cops kill dogs literally all the time. It happens so often even the DOJ has taken notice.
Laurel Matthews, a supervisory program specialist with the Department of Justice’s Community Oriented Policing Services (DOJ COPS) office, says it’s an awful lot. She calls fatal police vs. dogs encounters an “epidemic” and estimates that 25 to 30 pet dogs are killed each day by law enforcement officers.

The jury in Memphis also heard a tape recording of a two-hour-long confession Jowers made at a fall 1998 meeting with Martin Luther King’s son Dexter and former UN ambassador Andrew Young. On the tape Jowers says that the meetings to plan the assassination occurred at Jim’s Grill. He said the planners included undercover Memphis Police Department officer Marrell McCollough (who now works for the Central Intelligence Agency), MPD Lieutenant Earl Clark (who died in 1987), a third police officer, and two men Jowers did not know but thought were federal agents.

Young, who witnessed the assassination, can be heard on the tape identifying McCollough as the man kneeling besides King’s body on the balcony in a famous photograph taken right after the shooting. According to witness Colby Vernon Smith, McCollough had infiltrated a Memphis community organizing group, the Invaders, which was working with the Southern Christian Leadership Conference. In his trial testimony Young said the MPD intelligence agent was "the guy who ran up [the balcony stairs] with us to see Martin."

Jowers says on the tape that right after the shot was fired he received a smoking rifle at the rear door of Jim’s Grill from Clark. He broke the rifle down into two pieces and wrapped it in a tablecloth. Raul picked it up the next day. Jowers said he didn’t actually see who fired the shot that killed King, but thought it was Clark, the MPD’s best marksman.

In today’s NY Times, there is a report on a limousine company that was responsible for the death of 20 people in upstate NY–the driver, 17 passengers and two pedestrians. The first paragraph: “A driver with an improper license. A limousine company with a trail of failed inspections and ties to a scheme to illegally obtain driver’s licenses. And a limousine that had also been deemed unsafe.”
We learn that owner of the limousine company was an FBI informant named Shahed Hussain who participated in stings and who was known to his victims as “Malik”.
Mr. Hussain, the man whose name seems to be associated with the limousine company, posed as a wealthy Muslim radical and was the central prosecution witness in a 2004 federal sting focusing on a pizzeria owner and an imam at an Albany mosque. Six years later, Mr. Hussain, who posed as a terrorist, played a key role in the government’s case in a plot to blow up two synagogues in the Bronx.
He became an F.B.I. informant after being charged in 2002 with a scheme that involved taking money to illegally help people in the Albany area get driver’s

How the Media Enables Violent Bureaucracy

Before I get started on what I think is one of the most fascinating and underappreciated issues in copaganda, I hope you enjoy my latest flower mosaic

How the Media Enables Violent Bureaucracy

An important general theme of government propaganda is how bureaucracies shape narratives about their own failures in order to get more resources. In the copaganda context, these narratives are almost always targeted at getting well-intentioned but low-information people who feel bad about overt state violence to support various “reforms” that do not challenge the size or power of the punishment bureaucracy.

In our society, with the largest infrastructure of police, prosecution, and prisons in world history, an important part of this process is how the media manufactures the consent of well-meaning but low-information people to support this endless cycle.

Today, as we prepare for the public release of the video showing the brutal police murder of Tyre Nichols, I’m beginning a two-part series about the two main New York Times articles covering the police response to the George Floyd protests. These two articles are among the best examples of how police and their allies turn their own violence and failure into more money and power by shaping public narrative about the causes and solutions. It was my meeting with some of these reporters in 2021 that began my interest in working closely with journalists to change how our society talks about these issues, as well as my acute interest in publicly critiquing copaganda that poses a threat to our safety.

Background

Let’s start with a few questions:

How is it that U.S. police killed more people in 2021, the year after the mass public uprisings in response to the murders of George Floyd and Breonna Taylor, than they did in 2020?
How is it that U.S. police then killed even more people in 2022 than in 2021?
How is it that overall U.S. police budgets and revenues for related for-profit industries grew to records each year?
How is it that police training, surveillance technology, and weaponry reached all-time record spending levels each year?
How is it that police have used this technology and weaponry disproportionately against racial minorities and immigrants every year and in every city in which records are kept despite innumerable annual “reforms” to their internal policies?
How is it that police in nearly every U.S. city have disproportionately stopped, searched, arrested, beaten, tased, and killed Black people every year since records have been kept despite huge, continuous increased expenditures on “training”?
One of the core truths about the punishment bureaucracy is that police, prosecutors, prisons, probation, parole, courts, and the constellation of multi-billion dollar industries that evolve in symbiosis with them use their own violence, waste, and ineffectiveness to justify getting more resources in an endless cycle of “reform.” Each failure becomes a reason to spend more trying the same things harder. This cycle is not accidental. Luminaries from Michel Foucault to David Graeber to my one-eyed cat housemate have pointed out the connection between perpetual growth of bureaucracy and narratives around “reform.”

Most people would prefer a society with less state violence, surveillance, and fiscal waste, and yet they all keep increasing. How exactly does this happen? Let me give you a few concrete examples to get us grounded:

Body Cameras: In the wake of the police shooting of Michael Brown in Ferguson, one of the key liberal responses were coordinated national calls to get body cameras for police. A lot of news outlets and ordinary people—following the lead of Barack Obama, who ensured $100,000,000s in federal grants to pay for body cameras—championed these devices as a “reform” in direct response to Brown’s homicide. Body cameras were portrayed as a solution to make police more “accountable” and, as a result, as a solution for police violence.

What many people don’t know is that internal documents, public statements, and industry materials reveal that police (and the for-profit manufacturers of the devices and related software) had been desperate to get them for years.¹ Police were unable to get local governments, however, to spend the billions of dollars needed to outfit every cop in the U.S. with a mobile surveillance camera that the cops themselves control. Police and carceral tech companies were also unable to procure the money to fulfill their dream of integrating vast amounts of surveillance data into new cloud-based computing systems that would connect reservoirs of police surveillance data to sophisticated (and expensive) facial and voice recognition software.

But after Officer Darren Wilson killed Michael Brown, these sophisticated actors were smart, and the media was willing: they used the moment of public outrage and calls for change to get liberals in local government and well-meaning people in the general public to support the most expensive expansion of police surveillance technology in modern history. They did this by portraying surveillance infrastructure as some sort of promising “reform” for police violence, almost always cutting out of any media coverage the views of experts, social movement leaders, or directly impacted people who were warning that mobile surveillance cameras, cloud computing networks, and proprietary biometric algorithms controlled by police themselves would have no effect on police violence but instead usher in a new era of state repression.

Police and their allies used the media to focus on the need to capture events that police still created, curated, and controlled on video and relentlessly used talking points about how they simply lacked funding for appropriate technology that could hold them accountable and that could provide the public with answers. In reality, in addition to massive new surveillance tech, everyday police officers wanted body cameras because it gave them the most powerful new form of evidence: an outward looking camera that the officers themselves control both in terms of what it captures and when video is publicly released. These body camera videos are now routinely used in every courtroom in the U.S. as evidence to convict poor people of things like drug possession and trespassing and almost never used against police officers. It is exactly as police chiefs and corporate sales representatives from the companies discussed the devices over a decade ago when formulating their plans.

Most importantly, in the process, police were able to avoid the public asking deeper questions like: “Why are the police patrolling this neighborhood and not that one?” “Why are police only enforcing some "crimes" against some people and not other crimes against other people?” “Do we need police to deal with this wide range of social issues?” “Why is police violence, filmed or not, consistently for over 100 years targeted at progressive social movements seeking greater equality?” And so on.

Bail: When the much-heralded federal Bail Reform Act went into effect in 1984, about 24% of people charged with federal crimes were too poor to afford cash bail and were thus detained in jail even though presumed innocent. Liberal reformers from politicians to judges to prosecutors to law professors championed the Act because it largely eliminated money-based detention in federal court by containing language designed to prohibit setting cash requirements that resulted in detention. The liberal “reform” was to require courts to make transparent decisions about whether a person truly needed to be detained or not and to stop detaining people just because they were poor.

But by 2020, over three decades into the “reform,” 72.4% of people charged with federal crimes were detained in cages before being convicted of anything. The “reform” to cease jailing people just because they were poor, when left in the hands of punishment bureaucrats, had tripled the size of the pretrial detention bureaucracy in federal courts, and the people detained were even more disproportionately poor, more disproportionately Black, and more disproportionately immigrant. As if that wasn’t bad enough, whole new industries—like the multi-billion dollar jail/prison telecom industry—had even worked to get in-person visits and things like the ability to hug one’s child or spouse eliminated on the theory that it would result in more cash spent by desperate families on jail calls. That’s quite a “reform.”

Probation and Parole: These innovations were pitched as modern liberal “reforms” that would be alternatives to incarceration. It sounded great in the media and to well-meaning people who would prefer a society with fewer human beings in cages: instead of confining people in concrete cells away from their families for as long, we can give them a chance to be in the community subject to strict conditions. However, probation and parole have now become a leading cause of incarceration: 25% of all people in state prisons are there because of a technical violation of probation or parole—i.e. not even the commission of a new offense. And another 15% (so, a total of 40%) are there on minor violations of parole or probation.

Decades of research shows that probation and parole supervision do not serve any public benefit: they do not increase public safety at all. But, they have led to an absolutely massive, union-backed bureaucracy of hundreds of thousands of employees who regulate peoples lives in profoundly onerous and increasingly bizarre ways, including: watching people pee into cups, tracking people’s movements with GPS, forcing people to answer questions about their family lives or sexual interest under penalty of jailing them, excluding people from large geographic zones, requiring billions of dollars in fee payments, regulating how and with whom people can socialize, and even requiring people to behave according to particular Christian moral standards.

The New York Times and George Floyd

In my opinion, understanding this cycle of failure, “reform,” and bureaucratic expansion is vital to understanding how the corporate news media covered the 2020 racial justice uprisings, and how the media will continue to cover instances of rampant police violence like the recent murders of Tyre Nichols and Keenan Anderson. It helps explain how they framed the problem, which solutions they suggested for it, which sources and experts they chose to present to the public, and which points of view they excluded.

I have never before written about the woeful media coverage of the George Floyd protests. But in Part 2 of this post next week, I will use the following two examples from the New York Times to show how corporate media helps the punishment bureaucracy use its own violence to get more money and to prevent genuine public education and meaningful change.

The first article is about an official report concluding that LAPD “mishandled” the racial justice protests.

The second article appeared nine days later. It is about the release of numerous similar reports criticizing the police response to 2020 racial justice protests in “city after city.” Notice that I did not say the articles were about the police conduct. They were explicitly, as one of the reporters pointed out to me afterward, articles about what the official government reports said about police conduct. As we will see, this distinction matters.

As I will demonstrate with an analysis of the language, framing, sources, and naked ideological perspective, this reporting constituted an extremely harmful, misleading, ahistorical, head-in-the-sand view that the police who brutalized people in 2020 were just trying to do the best job they could to help people protest for equality. The problem, according to the news media? Police just didn’t have enough money, “training,” “preparation,” and fancy technology to do it.

To be continued…

Open AccessPublished:October 02, 2021DOI:https://doi.org/10.1016/
Across all races and states in the USA, we estimate 30 800 deaths (95% uncertainty interval [UI] 30 300–31 300) from police violence between 1980 and 2018; this represents 17 100 more deaths (16 600–17 600) than reported by the NVSS. Over this time period, the age-standardised mortality rate due to police violence was highest in non-Hispanic Black people (0·69 [95% UI 0·67–0·71] per 100 000), followed by Hispanic people of any race (0·35 [0·34–0·36]), non-Hispanic White people (0·20 [0·19–0·20]), and non-Hispanic people of other races (0·15 [0·14– 0·16]). This variation is further affected by the decedent's sex and shows large discrepancies between states. Between 1980 and 2018, the NVSS did not report 55·5% (54·8–56·2) of all deaths attributable to police violence. When aggregating all races, the age-standardised mortality rate due to police violence was 0·25 (0·24–0·26) per 100 000 in the 1980s and 0·34 (0·34–0·35) per 100 000 in the 2010s, an increase of 38·4% (32·4–45·1) over the period of study.

https://peopleforpoliceaccountability.com/what
What is Community Control of Police?
Community Control of Police is the idea that police must be held accountable for their actions, and that people should be empowered to hold the police in their communities accountable. This group, People for Police Accountability, is fighting for this idea in Burlington, Vermont. Starting in 2020, we worked with City Councilor Perri Freeman and hundreds of Burlington community members to create a proposal for Community Control of Police in Burlington. Our proposal to create a Community Control Board with disciplinary and investigatory powers is the only proposal that guarantees full independence from the police department and centers BIPOC and other historically marginalized members of our community.
Our goal is to create a new, independent Community Control Board to oversee our local police in Burlington, VT, with both investigatory and disciplinary authority.

Over 150 cities across the country have created independent oversight bodies that vary in the power they have over police departments, and thus their effectiveness in holding police accountable for misconduct and violence perpetrated against citizens. The proposed Burlington model is based off of models in Madison, WI and Chicago IL and is directly informed by the ACLU of Vermont’s criteria for an effective community control of police board. In order to be effective, the community control board and its investigative office must have the following:
1. Disciplinary power: The ability to hire, fire, and discipline police officers
2. Investigatory Power: The ability to conduct independent investigations, including the ability to subpoena witnesses and documents, and access to all records of the police department with the agency’s full cooperation
3. Independence: The ability to function entirely independently of BPD, with independent resources & legal counsel
4. Representation: The majority of the board should have diverse and representative membership, of affected and historically marginalized groups vulnerable to police misconduct such as BIPOC, and those who have lived experience with homelessness, mental health, substance abuse, and arrest or conviction records. It should exclude membership of those who currently are or who have ever been law enforcement personnel, including family or close affiliations to the BPD
5. Transparency: Full transparency to the public of which it serves, including oversight of a comprehensive complaint process.

Alec’s Copaganda Newsletter
Assembling A Crime Wave
An inside look at manufacturing the news
Alec Karakatsanis
Today, I want to talk about moral panics. Moral panics about different kinds of crime almost always lead to vast expansion of the machinery of state repression, whether they be this absolutely bizarre “crime wave” reported by the press in Victorian England or contemporary U.S. moral panics like the 1980s “crack babies,” the 1990s “super predators,” or the absurd 2021-2022 “organized retail theft.” They can also be acute creations of a particular news moment, such as when local and national media did 309 articles about a single Walgreen’s shoplifting incident in 2021.
So, how do moral panics happen?
I. Moral panics are creations of elites in journalism, politics, and the punishment bureaucracy
Because I have little else to do when I’m not in court other than play with cats, I have a lot of conversations with people about crime.
Many of my conversations are with my clients, community organizers we work with, and survivors of violence. But I also try to have conversations with elites who are in a position to shape how the punishment bureaucracy functions, including journalists, lawyers, judges, prosecutors, public defenders, politicians, philanthropists, researchers, lobbyists, non-profit employees, professors, etc. Because of how much propaganda there is in our culture about which social harms policymakers should treat urgently and what solutions to those problems we take seriously, it’s important to talk as much as possible about how we should think about holistic safety in order to counter some of the pathologies of mainstream propaganda.
One of many notable things from these conversations is how focused many professional class elites are, at any given moment, on their belief that there is some sort of “crime wave” happening. Professional elites are routinely in a state of panic about crime. (By this I mean a narrow range of crimes for which police arrest mostly poor people.) I have experienced this in city after city. I have also experienced it nationally, especially since 2020, when many journalists and politicians I spoke with invoked concepts like a “surge” in retail theft, “rampant” crime on public transit, crime generally being “out of control,” or fomenting a panic about “carjacking” in D.C. to get Congress to block new D.C. revisions of its code.
This state of moral panic is so self-evident to these professional news consumers that a common refrain among them is to accuse anyone raising skepticism about the moral panic du jour of being an “elitist” who is “out of touch” with the most marginalized communities. I have had so many conversations, both over email and in person, with fancy people who have never meaningfully participated in fighting state repression of vulnerable people accusing me of not caring about vulnerable people because I have questioned their urgent prioritizaion of a particular extant news narrative about crime. This is actually a go-to move for elite pundits: anyone not reaffirming the narrative that crime by poor people is “out of control” at any given moment—and anyone not responding to that problem with proposals of more prisons and police—doesn’t care about poor communities or communities of color.
The certainty of many elites in their perceptions about crime and safety reminds me of a passage from the best book on the subject of propaganda that I’ve ever read. It’s a 1950s book called Propaganda by Jacques Ellul, and I could not recommend it more highly. The introduction to the English translation of the book by another scholar explains why Ellul believed “intellectuals” to be:
“virtually the most vulnerable of all to modern propaganda, for three reasons: 1) they absorb the largest amount of secondhand, unverifiable information; 2) they feel a compelling need to have an opinion on every important question of our time, and thus easily succumb to opinions offered to them by propaganda on all such indigestible pieces of information; 3) they consider themselves capable of “judging for themselves.” They literally need propaganda.”
There is a lot to say about journalists and other professional class elites panicking about the morally dangerous behavior of poor people. Two preliminary points are important always to state, and so I say them again before getting to today’s main attraction:
1. The subjective view that there is an urgent “crime wave” is often accompanied by an irrational and contrary-to-the-evidence assertion that the “wave” or “surge” must mean we should tweak some kind of policy within the punishment bureaucracy. In fact, the “wave” or “surge” is often specifically manufactured by self-interested groups and complicit journalists precisely to have some political impact, whether it be the recall election of a DA whose policies they don’t like or blocking a bail reform bill or fear-mongering about slight shifts in budgets of police and prisons. It is utterly common, therefore, for the media to connect, without any empirical evidence, “surges” in crime with something like bail reform, defunding police, lower sentences, or slightly different prosecutorial charging policies. I see this news commentary every day, and the mere juxtaposition of these policy tweaks with statements about huge shifts in “crime” is itself like climate science denial. All of it is nonsense: these little tweaks in punishment policy pale in comparison as factors determining police-reported “crime” to root causes like: inequality, poverty, access to health care, early childhood education, housing, vibrant community programs, the number of guns manufactured, general alienation and disconnection of people in our contemporary society, etc…
2. Professional elites rarely experience a moral panic or subjective feeling of a “crime wave” or “surge” about crimes like wage theft, water pollution, foreclosure fraud, tax evasion, air pollution, building safety code violations, prison guard brutality, illegal police spying, political corruption, or other crimes that are rampant and cause objectively higher levels of harm. They seem only to obsess urgently about some crimes committed by some people, and this obsession is usually not correlated with any objective assessment of overall threat to well-being. I have written about how the criminal punishment bureaucracy largely ignores the crimes of powerful people while ruthlessly and selectively targeting poor and marginalized people, and I have written many times in this newsletter about how media coverage of crime distorts what we see as urgent. I recommend reading those pieces.
II. Why does the news repeatedly constructing moral panics matter?
In addition to the more qualitative problems I have discussed in the linked pieces above with our society’s mass delusions about what the greatest threats to safety are and how to solve them, we can see immediate, striking effects of the constant cycle of news coverage about “crime waves” and “crime surges” in the categories of crime for which police arrest only the poor.
One consequence of the views of elites on crime waves—particularly elites who control the curation of anecdote that passes for corporate daily news—is that the U.S. public has become dizzyingly uninformed. Take a look at the chart below. You’ll see that people consistently believe that crime is rising in the U.S.
These numbers are similar dating back to 2002—every year since then most people believed crime was up. But, in that 20-year period, actual police-recorded crime went down almost every year. Most people were wrong. But it’s actually much more interesting than that. When asked about crime in their own area, people were much more accurate. So, when relying more on their own social networks and first-hand experiences, people are less uninformed than when relying solely on secondhand information through the media.1
This is interesting background, but here in this post, I want to share with you a fantastic and relatively obscure story about how these moral panics come to be produced.
Background on moral panics
The seminal work on this subject is Stuart Hall’s 1978 book Policing the Crisis, in which some of the leading social theorists in modern English history dissected how the British police, courts, and news media manufactured a moral panic about “mugging” that resulted in increased punishment and prosecution of Black immigrant youth from British colonies. Even though the book was written 45 years ago, it is such a profound, necessary examination of the topic that I am constantly recommending to any journalist serious about understanding the broader forces that shape what they think about as public safety news. It’s so good, and so much better than anything I could ever write, that I can’t believe there are people who cover crime without having read it!
But another, much shorter and fun account is Mark Fishman's 1980 book, Manufacturing the News, which was recommended to me by journalism professor Jay Rosen. Because the book is online, I am able to reproduce a key passage below that tells one anecdote from Fishman’s ethnographic research inside newsrooms. If you are a journalist, please read it. Fishman describes in delightful detail how a group of newsrooms can simply manufacture a “crime wave” out of whole cloth, even with everyone acting in good faith:
I hope this was useful. The passage combines several themes from my recent writing, including why it is so important that police spend massive amounts of public money on public relations infrastructure, which has significantly increased since Fishman observed the utility to police of their PR teams in 1976. The passage also illustrates the groupthink that I have identified in contemporary newsrooms, and how that groupthink leads to objectively bizarre conceptions of what things about the world should be a news story and how those news stories should be told. It also captures well some elements of the social, cultural, burueacratic, and economic forces that lead journalists to focus on certain kinds of crimes and to ignore others.
People’s perceptions of crime in their general area are also far from accurate and subject to various forms of manipulation. This is especially true with the rise of apps and group discussion forums like NextDoor and Citizen, whose business model is to create engagement

Cheap Field Drug Tests Are Finally Getting Called Out By Courts As The Bullshit They Are
(Mis)Uses of Technology

Fri, Apr 28th 2023 03:33pm - Tim Cushing
Law enforcement loves cheap drug tests. First, they’re cheap, around $2/per. Second, they can turn a whole host of legal substances into probable cause for searches and arrests. Field drugs tests have converted everything from a deceased child’s ashes to bird poop (on a car hood, no less) into illicit substances justifying the removal of innocent peoples’ rights.
Also on the list of “illegal” substances deemed illegal by faulty field tests: donut crumbs, cotton candy, honey, aspirin, and diesel. People’s freedoms were lost and their lives ruined by tests even the manufacturers know will produce false positives

Another Los Angeles Sheriff’s Department Gang Member Admits The Department Has Plenty Of Gang Members
from the gang-members-first,-law-enforcement-officers-second dept
Mon, Jun 5th 2023 08:07pm - Tim Cushing
The Los Angeles Sheriff’s Department doesn’t have a great track record. In addition to the usual stuff expected from law enforcement agencies (biased policing, zero accountability, civil rights abuses, excessive force deployment), the LASD has been home to deputy gangs pretty much since its inception.
Its recent string of elected sheriffs hasn’t done anything to eliminate this problem. Sheriff Lee Baca ended his career facing federal criminal charges. Sheriff Alex Villanueva ran as a reformer but was run out of office after spending his tenure intimidating critics, threatening

1,200 people were killed by police in 2022.
Officers were charged with a crime in only 11 of these cases. One percent of all killings by police
Each year, fewer than 3% of killings by police result in officers being charged with a crime. Officers are disproportionately prosecuted by Black prosecutors — especially Black women. Representing only 1% of the nation’s elected prosecutors, Black women were 9% of prosecutors who charged officers for killing someone, 11% of prosecutors convicting officers and 19% of prosecutors charging officers in two or more deadly force incidents from 2013-2022.

Locked Out Of NSO Group’s Pegasus Spyware, DEA Purchases Exploits From Its Non-Union, Israeli Equivalent

Mon, Jun 5th 2023 01:35pm - Tim Cushing
First off, let’s just clear one thing up: the headline is a Simpson’s reference, not a dog whistle aimed at unions and/or the Jewish population of Israel.
Facts in evidence:
Let’s face it: the DEA doesn’t care what anybody thinks of it. It will continue to get funded. It will continue to say incredibly stupid shit. It will continue to gain the attention and support of alarmists. And it will continue to seek out the spyware it desires to carry out its mission, which appears to be “lose the war on drugs for decades in a row.”
The administration can blacklist, criticize, and strongly suggest federal agencies not do business with shady exploit hawkers. None of these things will have an effect on the DEA, which will

Judging by the number of very angry press releases that landed in my inbox this past Friday, you’d think that YouTube had decided to personally burn down democracy. You see, that day the company announced an update to its approach to moderating election misinformation, effectively saying that it would no longer try to police most such misinformation regarding the legitimacy of the 2020

Tue, Jun 6th 2023 09:28am - Mike Masnick
On Monday of this week, new CEO Linda Yaccarino officially became CEO of Twitter. Of course, basically no one believes that she’s actually the CEO. Everyone knows that Elon Musk, who in the past has mocked the “CEO” title anyway, is still in charge. He still owns the company and is executive chairman, meaning that he can still fire Yaccarino whenever he wants. And he’s still managing the company and its products. Any honest look at what’s happening here would recognize that Yaccarino’s role is somewhere between “VP of Marketing & Advertising” and “the person we sent to meetings when Elon has pissed
