A coalition of 25 military and national security experts, including former advisers to Ronald Reagan and George W Bush, has warned that climate change poses a “significant risk to US national security and international security” that requires more attention from the US federal government.

The prominent members of the US national security community warned that warming temperatures and rising seas will increasingly inundate military bases and fuel international conflict and mass migration, leading to “significant and direct risks to US military readiness, operations and strategy”.

KENTWOOD, Mich. (WOOD) — After 34 years as a Grand Rapids police officer, including six as the department’s chief, Kevin Belk is returning to familiar territory.
Recently named the senior vice president at DK Security, he’ll be in charge of the agency’s Armed Division, Investigations and Special Operations.
“Another thing we’re looking at doing is creating an emergency response team so we can respond to a larger event — a problem, a crisis,” added Belk, who retired from his post as Grand Rapids police chief in February 2014.
Some of his duties may sound more appropriate for a big city police department than private security firm. But with traditional municipal police departments constantly looking for ways to do more with less, DK’s role and that of other private security firms is expanding.
“Public sector police departments across the country have been reducing their ranks over the last several years and more and more is going to continue to fall on the private sector,” Belk explained.
“Armed security is a whole different level than typical night watchman or guards. We’ve expanded that role,” said John Kendall, a retired U.S. Marshal for the Western District of Michigan, who along with retired FBI Supervisory Agent Bob DuHadway founded DK Security in 1994.
Kendall said he has talked with local police agencies about taking over some responsibilities, like providing K-9 units and crime scene investigation.
“There’s no reason for the police to be tied up with a fender bender for a half hour. We can direct traffic,” Kendall said. “Matter of fact, who do you think we hire? We hired retired police officers.”
Neighborhoods in cities like Detroit and Chicago have gone even further, hiring firms to pick up more of the work load from city police

FBI Analyst Sentenced In Underage Sex Case

A former FBI analyst has been sentenced for having sex with a young Spotsylvania County girl.

Forty four year old Anthony Lesko entered an Alford Plea to the charges in a Spotsylvania County Circuit to nine counts of felony indecent liberties upon a child.

The plea means that Lesko does not admit guilt but believes that there is enough evidence to convict him. Lesko was sentenced to seven years in prison with 15 years suspended under a plea agreement.

Lesko was also ordered to pay 10 thousand dollars in restitution to cover the girl's mental health counseling. According to police Lesko was engaged in nine sexual encounters with the girl, starting when she was nine years old.

In July, after approval from the Obama administration, Congress released a 28-page chapter of previously classified material from the final report of a joint congressional inquiry into the Sept. 11 attacks. Saudi Arabia's foreign minister, Adel al-Jubeir, said that the document had ruled out any Saudi involvement in the attack. "The matter is now finished," he declared.



But it is not finished. Questions about whether the Saudi government assisted the terrorists remain unanswered. Now, as we pass the 15th anniversary of the most heinous attack on the United States since Pearl Harbor, it is time for our government to release more documents from other investigations into Sept. 11 that have remained secret all these years.

The recently released 28 pages were written in the fall of 2002 by a committee of which I was a co-chairman. That chapter focused on three of the 19 hijackers who lived for a time in Los Angeles and San Diego. The pages suggested new trails of inquiry worth following, including why an al-Qaida operative had the unlisted phone number for the company that managed the Colorado estate of Prince Bandar bin Sultan, then the Saudi ambassador.

Some of those questions might be answered if the government released more of the findings of the Sept. 11 commission, the citizens inquiry that followed our congressional inquest. The commission said that it found no Saudi links to the hijackers. But it could satisfy lingering doubts by releasing more of its records. Parallel investigations were also conducted by the FBI and CIA. How much did they look into whether Bandar or other Saudis aided the hijackers?

The government also knows more today about the 16 hijackers who lived outside California than when the 28 pages were classified in 2003. Much of that information remains secret but should be made public. For example, the FBI for a time claimed that it had found

When the House convenes for the 115th Congress in January, it should update its rules to enhance opportunities for oversight by HPSCI members, by members of other committees with related jurisdiction, and by all other representatives. The House also should establish a select committee to review how it engages in oversight.

EFF has previously called on Congress [.pdf] to engage in a thorough review of intelligence community activities based on the model set by the Seventies-era “Church Committee,” and we continue to urge such large-scale review.  

But internal reform of House rules that currently make it exceedingly difficult for the vast majority of our elected representatives to know and understand what the intelligence community is doing can also pave the path to meaningful reform. 

For example, most HPSCI members lack a personal staffer for their HPSCI work, which requires a security clearance, and instead depend on committee staff—hired by and answerable to the HPSCI chair. Yet when eight HPSCI members sought funding ($125,000) to allow a staffer from each member's personal office to obtain sufficient clearance to assist with intelligence oversight, that request went nowhere, as far as we know.

Under our constitution of separated powers, access to information is essential to democratic accountability. We were fortunate that Snowden leaked significant information about surveillance abuses, but oversight by whistleblower revelations is not a sustainable strategy.  Without reform of excessive secrecy and overclassification, the window of transparency provided by the Snowden troves will close as the government creates new surveillance programs protected by secrecy and invulnerable to Congressional oversight.

Portland, Ore.— Senator Ron Wyden (D-OR) is calling for a review of a government surveillance program that allows postal workers to monitor the mail.

A KGW investigation found over the past decade, more than 3,000 Oregonians have been the target of a little-known surveillance program called "mail covers."

“Given this high volume, it is important to make sure there are strong controls on the program to ensure that this technique is not used improperly,” wrote Wyden in a letter to Postmaster General Megan Brennan.

Mail covers allow postal workers to record information from the outside of every letter that comes or goes from a particular address.  The information is then turned over the law enforcement agency that requested it.

Unlike other government surveillance programs, like wiretaps, the use of mail covers does not require a judge’s approval.    

Records obtained by KGW through the Freedom of Information Act showed the 3,114 requests for mail covers for Oregon addresses came from a variety of state and federal agencies including Alcohol, Tobacco and Firearms, Bureau of Diplomatic Security, Naval Criminal Investigative Service, U.S. State Department and U.S. Marshals Service. Local police and sheriff’s offices also called on postal workers to help snoop. 

A 2014 federal audit found the United States Postal Service failed to follow key safeguards while running the mail covers program.

Officer Gonsalves involved in fatal El Cajon police shooting was embroiled in sexual harassment lawsuit


According to the lawsuit, Gonsalves texted Officer Christine Greer with lewd messages, including an "obscene and indecent photograph of his somewhat-erect penis." Other messages included propositions for sex with Greer and her wife, court documents say.

"He was her sergeant and for about a year was texting her and propositioning her for sex," Gilleon said Thursday. "You can't text your subordinate a picture of your penis. He should have been fired."

 

Court documents say Gonsalves texted Greer multiple times with messages like "Uhm... 3 some?" and "U r too hot! U make everybody think about sex."

Other women were also harassed by Gonsalves, according to the lawsuit.

The FBI believes Russia is behind attempted hacks of voter registration sites in more than a dozen states.

FBI Director James Comey relayed his concerns to a House Judiciary Committee hearing Washington, CNN reports.

The FBI sent two agents to attend religious services at a Mormon church in Burns on Jan. 10 as part of its investigation into the takeover of the Malheur National Wildlife Refuge, according to court testimony Wednesday.

FBI Agent Ben Jones, who belongs to The Church of Jesus Christ of Latter-Day Saints, said

The ACLU of California has obtained records showing that Twitter, Facebook, and Instagram provided user data access to Geofeedia, a developer of a social media monitoring product that we have seen marketed to law enforcement as a tool to monitor activists and protesters.
We are pleased that after we reported our findings to the companies, Instagram cut off Geofeedia’s access to public user posts, and Facebook has cut its access to a topic-based feed of public user posts. Twitter has also taken some recent steps to rein in Geofeedia though it has not ended the data relationship.
Further steps are required if these companies are to live up to their principles and policies by protecting users of all backgrounds engaging in political and social discourse. So today the ACLU of California, the Center for Media Justice, and Color of Change are calling on Twitter, Facebook and Instagram to commit to concrete changes to better protect users going forward. We first learned about these agreements with Geofeedia from responses to public records requests to 63 California law enforcement agencies. These records revealed the fast expansion of social media surveillance with little-to-no debate or oversight.
But as we continued to comb through thousands of pages of documents, we saw emails from Geofeedia representatives telling law enforcement about its special access to Twitter, Facebook, and Instagram user data.
In one message, a Geofeedia representative tells police that the company has arrangements with Twitter and Instagram for user data. Right after that, the representative promotes a product feature that “covered Ferguson/Mike Brown nationally with great success.”


In another email from May 2016, a Geofeedia representative touts a “confidential legally binding agreement with Facebook.”

ST. LOUIS • Efforts to nix key evidence against accused members of a violent St. Louis drug ring have revealed a Justice Department investigation of claims that a Georgia DEA official had sexual relationships with paid informers.

The target, a DEA supervisor in Atlanta, allegedly was involved with two confidential informers and paid one of them $212,000 in agency funds, according to court documents obtained by the Post-Dispatch.

Much of the court material is under seal. The woman who received the funds testified for hours Monday in the closed courtroom of U.S. Magistrate Judge Shirley Padmore Mensah in St. Louis

The report, released Wednesday by the American Civil Liberties Union, analyzed law enforcement policies of 119 California school districts, including 50 of its most populous. It found that more than half of the districts — large and small — gave their staff broad discretion to summon police officers for small infractions, bullying and disrupting lessons.

GRAND RAPIDS, MICH. - An FBI agent is in custody after police say he shot at a Grand Rapids officer outside a gym.

It happened around 1:30 a.m. Tuesday, Dec. 6, at Planet Fitness on 28th Street in Grand Rapids. 

While investigating this incident, WZZM 13 found through Kent County court records that the 35-year-old suspect is FBI agent Rueben Hernandez. He was in town from Las Vegas on business. Court records indicate he arrived in Grand Rapids on Monday and was booked Tuesday into the Kent County Jail.

According to Grand Rapids police, Hernandez walked into the Planet Fitness gym and showed off a gun. Reports indicated that he fired three shots near Lake Eastbrook Boulevard.

At the time, about seven people were inside the gym -- no one was hurt. When Grand Rapids police arrived on scene, police say Hernandez fired at a Grand Rapids sergeant and the officer did not return fire.

Her name is Deborah Jeane Palfrey and she has Washington circles worried. Why are powerful and important people breaking into a sweat when they hear Palfrey’s name? Deborah Jeane Palfrey’s former company, Pamela Martin and Associates, was a prostitution service that was patronized by people high up on the American political totem pole . Furthermore, Palfrey is in a position to ruin a lot of political careers. Her lawyer, Montgomery Blair Sibley, claims he has:

been contacted by five lawyers recently, asking whether their clients’ names are on Palfrey’s list of 10,000 to 15,000 phone numbers. Some, Sibley said, have inquired about whether accommodations could be made to keep their identities private.

The Palfrey scandal has already cost one person his job. Randall L. Tobias resigned from his position as deputy secretary of state after admitting to ABC’s Brian Ross that he was a client of Pamela Martin and Associates . Deborah Jeane Palfrey is definitely in a position to blackmail the powerful and influential. This begs a question: Is Palfrey’s outfit part of an operation connected to the intelligence community that keeps politicians in line with the Establishment agenda through a system of sexual rewards and punishments?

In an interview with former NYPD detective James Rothstein, this author discovered that such operations do exist and go far back into America’s secret history. Rothstein is no conspiracy theorist. He is a legend in American law enforcement and speaks from experience. Furthermore, he gave me two notable examples from his time as a detective. Rothstein had an opportunity to have a sit-down with infamous McCarthy committee counsel Roy Cohn. During this sit-down, Cohn admitted to Rothstein that he was part of a rather elaborate sexual blackmail operation that compromised politicians with child prostitutes (Rothstein, no pagination). Cohn told Rothstein that this operation was being carried out as part of the anticommunist crusade of the time


Rothstein also had an opportunity to speak to infamous Watergate burglar Frank Sturgis. During this conversation, Sturgis revealed one of the reasons for breaking into the Watergate. According to Sturgis, there was a “Pedophile Book” hidden away at the Democratic National Committee headquarters The book was supposed to have a list of pedophiles on the American political scene . One can only imagine the power G. Gordon Liddy would have held over the government if he had such a book in his possession.

I asked Rothstein if Roy Cohn was a real anticommunist or just using the fear of communism to justify his sex ring. It seemed like a fair question. After all, Cohn had argued against homosexuals being schoolteachers when he himself was a homosexual. Perhaps Cohn’s hypocrisy extended to his anticommunism. Rothstein made it clear that Cohn was a genuine anticommunist . Anticommunist sentiments aside, evidence suggests that the sex ring operation started by Cohn was used for more than fighting the threat of domestic communists. Fugitive ex-CIA officer Frank Terpil has claimed that sexual blackmailing operations directed by the CIA were intensive in Washington during the Watergate era (DeCamp 179). Terpil also asserts that his former partner, Ed Wilson, was coordinating one of these sexual blackmail operations (179). In a letter to author Jim Hougan, Terpil revealed Wilson’s modus operandi:

L.A. can resume shipping sewage sludge to Kern County after judge overturns voters' ban




A judge has ruled that the Los Angeles Bureau of Sanitation can continue to ship tons of treated sewage to Kern County’s Green Acres Farm, seen on a chilly morning in 2006.

A judge has struck down a voter initiative passed in 2006 that banned dumping Southern California shipments of about 450,000 tons a year of treated human waste on Kern County farmlands.

Tulare County Superior Court Judge Lloyd Hicks, in a 48-page opinion issued Monday, ruled that Measure E “is invalid and void for all purposes, for the dual reasons that it exceeds Kern’s police power and is preempted by state law.”

He also ruled that “there is no evidence of risk to human health” posed by the shipments of treated waste used as fertilizer and soil amendment on Green Acres, a 4,700-acre farm the city of Los Angeles bought in 1999 for $15 million.

The sludge is tilled into the farm’s soil to fertilize crops, including corn and wheat.

Many of these deaths result not from painkillers, but from the DEA’s war on painkillers.

Heroin overdose rates doubled in 28 states between 2010 and 2012, according to the Centers for Disease Control and Prevention. A record-breaking 28,000 Americans died of opioid overdoses in 2014. In 2000, the age-adjusted drug overdose death rate was 6.2 per 100,000 persons. By 2014, it had more than doubled, to 14.7, according to the CDC.

What happened?

The truth is that many of those deaths are completely preventable and result not from painkillers, but from the Drug Enforcement Administration’s war on painkillers.

This week, the Senate is likely to pass the 21st Century Cures Act. Among other things, it allocates $1 billion to help states “combat heroin and painkiller addiction and recovery.” Policymakers would be wise to make sure that states don’t use that $1 billion to make the problem worse.

Watchdog wants FBI's notes from Obama interview in Blagojevich probe



A conservative watchdog group that made headlines hounding Hillary Clinton over her private email setup is renewing a fight over a former Illinois governor's efforts to receive favors in return for President Obama’s empty Senate seat.

In 2011, Rod Blagojevich (D) was convicted on more than a dozen corruption charges for trying to sell the president’s former seat in the Senate for campaign contributions and other perks.


As part of the federal investigation into the former governor, the FBI interviewed several high-profile figures, including Obama and his aides Valerie Jarrett and Rahm Emanuel, who is now mayor of Chicago.
On Monday, the watchdog group Judicial Watch filed a new lawsuit to make the FBI’s notes about those interviews public.

“The public should not be forced to wait any longer” to see the interview summaries, the group said in its filing.

Judicial Watch had previously filed a lawsuit to obtain the material, but the suit was tossed out as Blagojevich was in the midst of a resentencing process, following action by an appeals court. The former governor is currently ser

DEA refuses to release evidence backing Kratom ban
Agency responds to request for hard data with press releases and copies of federal laws

On August 30th, 2016, the DEA filed a notice of intent to temporarily designate Kratom (specifically its alkaloids mitragynine and 7-hydroxymitragynine) as a schedule 1 drug. That notice listed 33 footnotes/references, but the actual references themselves were not included in the document itself.

Later that day, I filed a FOIA request for all of the data and documents referenced in the 33 footnotes.

This is a fairly straightforward request. The DEA wants to make this stuff illegal, and I want the public to have access to the same information as the DEA. Tens of thousands of people signed the petition to keep kratom legal (over 100k in the first week), and as a result, the DEA opened up a comment period for the public to respond. But in order to respond fully, we need to know what we are responding to. This means we need to see the information referenced in their footnotes, which is the evidence they’re relying on to ban kratom.

In the case of some of the footnotes, I was asking for specific data they’d collected (from footnote (17 and 18, for example):

“abuse of kratom/mitragynine [17] were analyzed by Federal, State, and local forensic laboratories.[18] According to data from the System to Retrieve Information from Drug Evidence (STRIDE) and STARLiMS (a web-based, commercial laboratory information management system), from January 2006 through March 2016, there were 293 records for kratom and/or mitragynine”
In other words, I was asking for the actual data references in footnotes 17 and 18, respectively, i.e. if there are 293 records on kratom abuse from January 2006 through March 2016, and those records were considered when the DEA attempted to schedule kratom, then the public should be able to inspect them.

But the DEA has refused to provide us with their evidence. In fact, they provided absolutely none of the data they referenced. Instead, they provided documents that were already available (FDA press releases, copies of federal laws and regulations, etc), none of which I didn’t already

Los Angeles subway commuters were met by heavily armed deputies, dogs and bag searches Tuesday as authorities responded to a report of a possible terrorist attack on the Metro Red Line’s Universal City station.

Increased security was visible across the Los Angeles County transit system as the FBI, LAPD and Sheriff’s Department dealt with what they characterized as imminent threat of unknown credibility following a report from an overseas tip line.

Los Angeles Police Cmdr. Horace Frank, a top department counter-terrorism expert, said word of a potential attack came from a public tip line in Australia. Analysts are still trying to assess the credibility of the information, he said.

“It was very specific and detailed, and given it was imminent, the decision was made to make it public," he said, “If they are testing us or turns out not to be credible, we have shown we have the ability to gather information from overseas and respond rapidly in Los Angeles.”

At a hastily called news conference Monday night, the FBI as well as Los Angeles-area law enforcement leaders, said the threat was considered specific and imminent, but investigators were still examining its credibility

At the Universal City station, a sign warned riders they would not be allowed to use the Red Line subway system to downtown L.A. without their bags being searched.

Since early Tuesday morning, sheriff's bomb squad teams with K-9s have combed the station and other areas of the transit systems.

Los Angeles County Sheriff Jim McDonnell said beyond the visible presence, undercover deputies will be a presence on trains across the system.

On December 6th, the National Whistleblower Center filed an amicus brief in support of FBI whistleblower Darin Jones. Jones alleged he made whistleblower disclosures about an improper award of a $40 million contract and other improper procurement spending at the FBI. The FBI fired him from his position as a Supervisory Contract Specialist, which Jones alleges was done as an act of retaliation for his whistleblowing. The FBI argued that the current inadequate whistleblower protections at the FBI did not protect Jones because they require whistleblowers to report to the highest-ranking FBI official at their job site, rather than reporting to their immediate supervisor, which is consistent with FBI policy. Because Jones behaved in a manner consistent with standard practices at the FBI of reporting alleged wrongdoing through the managerial chain of command, he was written out of whistleblower protection for supposedly not reporting his allegations to the correct office and the retaliation against him has thus far been tolerated by the Department of Justice.


In an amicus brief filed in support of Jones this week, the National Whistleblower Center argues that the whistleblower protections do in fact apply to Darin Jones. The argument here is that if FBI officials have the authority to hire or fire personnel, they are necessarily acting in the shoes of the Attorney General of the United States. This means the Whistleblower Protection Act prohibits these officials from retaliating against a whistleblower if they are aware of the Whistleblower’s legal reporting activities because under current law FBI employees are protected if they disclose wrongdoing to the Attorney General. In Jones’s case the FBI officials who fired him were acting on behalf of the Attorney General and they were the very same officials to whom he reported his whistleblower disclosures. Georgia’s secretary of state alleges Homeland Security tried to illegally hack the state’s computer network that contains the voter registration database.

Georgia Secretary of State Brian Kemp claims in a letter to Homeland Security that his office discovered that a DHS Internet address tried to breach the computer system, the Hill reports.

FBI will increasingly rely on foreign help to stop hackers, Assistant AG says

The emergence of cybercrime as a global phenomenon is causing the FBI and Justice Department to increasingly rely on international law enforcement collaboration, legal treaties and informal agreements in addition to cooperation from the private sector, Assistant Attorney General for the Criminal Division Leslie Caldwell described, Thursday.

“We have greatly increased our international cooperation with international law enforcement partners all around the world, including in countries that just two years ago we had no relationship with,” Caldwell said. “As cybercrime proliferates so too does our relationships with countries around the world. We’ve got to continue to do build those international relationships and grow them and improve them because they are going to be more and more critical every single day.”

In an effort to fight these criminals, Caldwell said the Justice Department will be pursuing new legislative remedies next year in the same vein as recent changes made to Rule 41, which became effective as of Dec. 1.

These changes to Rule 41 — a mandate first designed in the scope of wiretap authorization procedures — enables investigators to secure warrants during the course of computer crime cases even while the suspect’s actual location is hidden. Critics believe the rule change will cause the FBI to expand its use of hacking techniques to access evidence on computers.

“There are other laws that we look to fix and to change and to update. As I have said, most of these proposed fixes are very technical and very narrow and they are designed just like the Rule 41 change to address very specific issues that we have encountered,” said Caldwell.

The Assistant Attorney General provided no further information regarding proposed, future changes to existing federal rules of criminal procedures and was unavailable for questions follow her public speaking event.

Caldwell’s comments — which were made during a speech at the Center for Strategic and International Studies, a D.C.-based think tank — come just one week after european law enforcement authorities disclosed multiple arrested associated with the dismantling of an international cybercrime network known as Avalanche.

“We’ve really developed our capabilities to disrupt criminal networks both here and overseas … working hand in hand with international partners to address technical threat like botnets, bulletproof hosts, darknet markets and international hacking forums,” said Caldwell.

The downfall of Avalanche is being trumpeted as a sort case study, showing how domestic law enforcement can combat digital crime through multi-stakeholder cooperation.

The Avalanche takedown operation included help from prosecutors and investigators in 40 different countries. It is believed that the criminal network caused more than $100 million in damages to a wide array of both public and private sector organizations — largely through the deployment of ransomware and banking trojans.

Broadly speaking, the advent and proliferation of hacking tools and anonymizing software are allowing cybercriminal to cause greater damage with less effort while seeing more of a return on their investment, Caldwell explained.

“We’ve seen a growth in global, very sophisticated cyberthreats. And there are some very significant loopholes in terms of our legal authorities, many of which have not kept pace with changes in technology,” Caldwell said.

She added, “in recent years and frankly since I have been on this job, there has been a drastic increase in warrant-proof encryption … [also] our access to offshore data and cross border access to data is very inefficient and very haphazard,” Caldwell said of the Justice Department’s challenges in prosecuting cybercrime.

While Caldwell — who said she plans to leave public service before the President-elect’s inauguration on January 20 — spoke extensively about the Bureau’s challenges to prosecute computer crimes on Thursday, it is also true that U.S. law enforcement is undoubtedly getting better at tracking down these types of criminals.

New FBI Headquarters Gets Green Light from Congressional Commitee



The long-delayed effort to build a new FBI headquarters has gotten the green light from the House Transportation and Infrastructure Committee to move forward.

But the GSA still needs to finalize the location of the new headquarters, Federal News Radio reports.

The committee approval was praised by chairman Rep. Bill Shuster, R-Pa.

“This will greatly improve the FBI’s security posture and its operations, and save money. But because of the size and complexity of the project, it will important to ensure there is strong congressional oversight to keep the project on time and on budget,” Shuster said.

The plan calls for the GSA and FBI to pay for the headquarters. President Obama’s 2017 budget proposal includes $1.4 billion for the project, which has already received $390 million under the fiscal 2016 omnibus spending bill.

Rep. Lou Barletta, R-Pa., said many challenges are involved.

“What makes this project challenging is it is not a simple construction project of a single building. The project will be a secure campus with separate visitor screening, its own utility plant and specialized security requirements,” Barletta said

Chip Roy, a key political strategist for U.S. Sen. Ted Cruz, will be Attorney General-elect Ken Paxton’s right-hand man at the Texas agency, Paxton announced Tuesday.
Roy, who will serve as Paxton’s first assistant attorney general, was Cruz’s chief of staff for almost two years before moving into an advisory role in September — a move some saw as positioning Cruz for a potential presidential run in 2016.

Roy also has close ties to Gov. Rick Perry, helping to write “Fed Up!” — a book that helped launch Perry’s unsuccessful presidential campaign in 2012 — and running the Texas Office of State-Federal Relations in Washington, D.C., after he was appointed by Perry in 2011.

At his confirmation hearing before the Texas Legislature, Roy promised to run the state-federal office in a way that would uphold “liberty and state sovereignty” while opposing federal regulations that are “destroying our nation and endangering the state.”

Roy has also served as a special assistant U.S. attorney in the Eastern District of Texas and as a senior staff member for U.S. Sen. John Cornyn, R-Texas.

“Chip is a longtime friend, and someone whose counsel I trust,” Paxton said in a written statement. “I am pleased that he will bring his strong legal mind, devotion to liberty and servant’s heart to the office of attorney general as first assistant.”

Several minutes before flight 103 took off from London's Heathrow airport, FBI Assistant Director Oliver "Buck" Revell rushed out to the tarmac and pulled his son and daughter-in-law off the plane.[1001]

How did he know?

Perhaps Revell's intimate knowledge derived from his relationship with Lt. Colonel Oliver North. In March of 1986, North advised Attorney General Edwin Meese to head off the FBI's ensuing investigation into Iran-Contra. Meese informed Revell. Consequently, North managed to keep abreast of the FBI's investigation by conveniently receiving copies of all FBI files.[1002]

Widely known for his inestimable and illegal support of the Contras, North (along with General Richard Secord and Iranian Albert Hakim) was a business associate of Syrian arms and drug runner Monzer al-Kassar. For his role in shipping Polish arms to North's mercenary army, al-Kassar became the recipient of North's undying gratitude [and laundered drug proceeds].[1003]

Like so many criminals, drug-dealers, and mass-murderers the CIA had cozied up to over the years, al-Kassar enjoyed the highly valued status of CIA "asset."

Al-Kassar was also closely aligned with Rifat Assad, brother of Syrian dictator Hafez Assad. Assad's daughter Raja was Kassar's mistress, and had once been married to Abu Abbas, a colleague of the notorious terrorist Abu Nidal. Rifat himself was married to the sister of Ali Issa Dubah, chief of Syrian intelligence, who, along with the Syrian army, controlled most of the opium production in Lebanon's Bekka Valley. The drug profits financed various terrorist groups, including the Popular Front for the Liberation of Palestine-General Command (PFLP-GC), run by former Syrian army officer Ahmed Jibril.[1004]


Al-Kassar also acted as middleman in the ransom paid by the French to effect the release of two hostages held in Beirut. Given his assistance in securing the release of those hostages, the CIA believed al-Kassar would prove invaluable in negotiating the release of the six American hostages then bein

Did Harry Morel Jr., the former St. Charles Parish district attorney now imprisoned for obstructing justice, get a sweetheart deal because of friendly ties between his defense attorney and a top prosecutor? That's what the chairman of the U.S. Senate Judiciary Committee wants to know. Sen. Charles Grassley, R-Iowa, sent letters inquiring into both issues on Nov. 15 to U.S. Attorney Loretta Lynch and FBI Director James Comey Jr. A spokeswoman for Grassley's office said Wednesday (Dec. 7) he had not received a response.

Morel, 73, was the top prosecutor in Louisiana's 29th Judicial District for 33 years. He pleaded guilty in U.S. District Court in New Orleans to obstruction of justice and is serving a three-year prison term in federal prison.

In his letters, Grassley said FBI agent Michael Zummer reported to the Judiciary Committee that a "relationship between then-First Assistant United States Attorney Fred Harper and defense attorney Ralph Capitelli may have resulted in a lenient plea agreement" for Morel. Zummer filed an ethics complaint in 2013 with the Justice Department's inspector general about Harper, who shared ownership in a condominium with Capitelli.

Harper later sold his share to his girlfriend, Grassley writes. Capitelli has dismissed Zummer's assertion of favoritism, and has described him as an overzealous agent whose investigatory tactics are questionable.

The FBI hosted an employment workshop on Buffalo's East Side Thursday, as it looks to further diversify its workforce.

To help spread the word about its job opportunities, the FBI invited about 70 community leaders to First Shiloh Baptist Church for a recruitment workshop. Pastor Emory Brown of Refreshing Springs Church says familiarizing more people with what the FBI does can help start to improve the relationship between the community and law enforcement.  



"Especially at a time like this, you know, when there's so many difficulties in the community and across the country, I think it's very important to be able to get facts and get insight and build relationships and bridges so that we can move forward as a country as a city," he says.

The goal of 24-year-old Stephanie Mejia is to become a special agent. Mejia, a social worker, says she thinks the FBI's effort to hire "more minorities is awesome."

"Because the more people you see that are similar to you in the community, the more people are willing to open up to you, if say you are in a situation where a crime has occurred and you can trust them," she says. "Like I think we definitely need more trust in the community between civilians and law enforcement and this is great that they're trying to reach out to minorities and others in the Buffalo community."  



But it is not all law enforcement. In fact more than half of the FBI jobs are non-agent positions. Adam Cohen, Special Agent in Charge in Buffalo, says there are a variety of opportunities, including auto mechanics, IT specialists, intelligence analysts, linguists, scientists, accountants and more.

F.B.I. AGENT ADMITS HARASSING BLACK FBI AGENT

WASHINGTON, A Chicago-based agent of the Federal Bureau of Investigation has acknowledged that he and other white colleagues planned a campaign of ''retribution'' against a black agent, Donald Rochon, whose case has prompted a national debate over racism in the bureau.

Newly released F.B.I. documents also show that the white agent, Gary W. Miller, has conceded that in 1985 he forged Mr. Rochon's signature on an application for death and dismemberment insurance for the Rochon family.

Mr. Rochon has described the unsolicited insurance policy as a death threat. Mr. Miller, who was suspended without pay for two weeks as a result of that incident and others aimed at Mr. Rochon, has denied that he was trying to harass the black agent. Agents Admit Harassment

The disclosures, contained in court papers filed here Friday, amount to the first public acknowledgment by the bureau that white agents may have participated in harassment of Mr. Rochon in Chicago, where he was assigned from 1984 to 1986.

The newly released documents are bound to cause further embarrassment for the bureau, which has been criticized by Congress over the Rochon case and over other discrimination claims involving black and Hispanic employees. More than half of the F.B.I.'s Hispanic agents have joined in a separate lawsuit against the bureau, charging that they faced discrimination in hiring and promotion.

Mr. Rochon has said that while he and his family were living in Chicago, their safety was repeatedly threatened in anonymous telephone calls and obscene, racist letters from white F.B.I. agents.

The Justice Department and the Equal Employment Opportunity Commission have found that Mr. Rochon was the victim of ''blatant racial harassment'' in the F.B.I.'s Omaha office in 1983 and 1984. In one incident, someone in the Omaha office taped a picture of an ape's head over a photograph of Mr. Rochon's son.

Shhhh – What The FBI Doesn’t Want You to Know About its Racial Profiling Program

The FBI is using a racial and ethnic mapping program to collect intelligence on American communities – and it doesn’t want you to know which ones it’s spying on, or how it’s using census data to do so. The ACLU and the ACLU of Michigan filed a brief in federal court on Friday to challenge the FBI’s secrecy over its profiling practices.

FBI documents we already secured show that the Bureau is profiling some communities for intelligence collection based on false stereotypes that ascribe certain types of crimes to entire minority communities. Targeted groups include Muslims and Arab-Americans in Michigan, African-Americans in Georgia, Chinese and Russian-Americans in California, and broad swaths of Latino-American communities in multiple states.

We obtained these FBI documents through the ACLU's “Mapping the FBI” campaign. As part of the campaign, 34 ACLU affiliates filed public records requests in 2010 to uncover how the FBI is collecting and “mapping” information about racial and ethnic groups around the country. Here’s just one troubling example: a 2009 Detroit FBI field office memorandum shows that the Bureau sought to collect information about Middle Eastern and Muslim communities in Michigan – without any evidence of actual wrongdoing and based on a generalized and entirely unsubstantiated threat assertion.

The public needs – and deserves – to know more about the FBI’s racial and mapping program. For that reason, the ACLU and the ACLU of Michigan brought a federal lawsuit in July 2011 to enforce our request for records about how the program is being used in Michigan. But the Bureau refused to disclose hundreds of documents – and most problematically, it fought to keep secret its use of information from public sources.

On Friday, we filed a brief in the Sixth Circuit Court of Appeals to challenge the FBI’s sweeping secrecy claims. Our brief makes a simple but important argument: the Freedom of Information Act doesn’t permit the FBI to hide its use of information about Michigan communities that is already publicly available, like U.S. Census and other demographic data.

This just makes sense. Congress passed the Freedom of Information Act to help uncover information about government programs – not to let the government claim secrecy over census statistics that are already public.

Our brief also raises another critical issue: whether the FBI (or any other government agency) can secure an entirely secret, one-sided judicial process to resolve a challenge to its potential use of the FOIA’s exclusion provision, 5 U.S.C. § 552(c). That provision allows a government agency to avoid confirming or denying the very existence of records in its possession in certain circumstances. The possibility of abuse is obvious, and that makes it all the more important that there be a meaningful process for FOIA requesters to challenge – and the public to know – whether a government agency is properly relying on the provision.

The details of this issue may sound technical, but in essence, it’s simple. The FBI proposed a one-sided, secret judicial process to decide whether its reliance on the provision was proper. We proposed to the court a fair and transparent alternative to secret process. We argue that the FBI’s proposal goes against a fundamental tenet of our judicial system: public access to courts and judicial opinions. It also undermines a critical purpose of the FOIA: to promote government transparency and accountability.

We hope the Sixth Circuit will adopt our process to resolve our claim and those of future FOIA requesters who fight back against government secrecy. And, ultimately, we hope to get the information we all need to know about the true impact of FBI racial and ethnic mapping on our civil rights and civil liberties.

OMAHA, Neb. — A lawyer who handled the final appeal of a man convicted in the 1970 bombing death of an Omaha police officer is entitled to attorney's fees, the Nebraska Supreme Court ruled Friday.
The state's high court found that Douglas County District Judge James Gleason abused his discretion when he refused to order payment to Timothy Ashford, an Omaha lawyer who claimed about $7,400 in fees for work he did on a post-conviction appeal for David Rice. Gleason had appointed Ashford to represent Rice, but later determined the appeal was frivolous and refused to order payment to Ashford.
But the high court said reasonable fees must be paid to a lawyer once he or she is appointed to a case. The high court ordered the case be sent back to Douglas County — but to a different judge — to determine the amount Ashford should receive.
Rice, who went by the name Mondo we Langa, was convicted along with fellow Black Panther Edward Poindexter in the death of officer Larry Minard. Authorities say they lured police to a house with a 911 call, then detonated a homemade bomb that killed Minard.

Man Wrongfully Convicted by Perjured FBI Testimony Freed After 28 Years in Prison; Donald Eugene Gates Released on Basis of New DNA Evidence

Summary: Donald Eugene Gates, who was convicted of the 1982 rape-murder of a Caucasian college coed, was released on the basis of new DNA evidence.

Donald Eugene Gates, a 58 year-old African American wrongfully convicted in 1982 of the rape-murder of Caucasian college coed Catherine Schilling, was freed by the D.C. Superior Court after a DNA test revealed that he could not be the culprit.

The prosecution of Gates was heavily dependent on the testimony of F.B.I. Crime Lab analyst Michael P. Malone, who testified that two hairs found on Schilling’s body came from an African American male. Schilling, who was a student at Georgetown University, was murdered in Rock Creek Park in Washington, D.C. in 1981.

Gates, who has always maintained that he was innocent of the crime, had been imprisoned for nearly 30 years until ordered release by Senior Judge Fred B. Ugast. Ugast had overseen his trial back in 1982.

In 1988, Ugast had ordered a DNA test of the evidence used to convict Gates, but DNA testing a generation ago was primitive. The more sophisticated DNA testing of the 21st Century proved that Gates was right: He was innocent.

Crime Lab Corruption

Since the Gates trial, former F.B.I. agent Michael Malone has become notorious as an unreliable and unethical expert witness who likely committed perjury in hundreds of trials. Dr. Frederic Whitehurst of the National Whistleblower Center’s Forensic Justice Project first revealed the widespread corruption at the F.B.I. Crime Lab back in 1993, when he, too, was an F.B.I. employee.  

Whitehurst charged that Malone and other F.B.I. Crime Lab employees were not only manufacturing evidence to support prosecutors and law enforcement agencies, but were engaged in providing perjured testimony at trials using their evidence. Malone had a profitable sideline in providing expert testimony favorable to the prosecution.

A 1997 report from the Department of Justice’s Office of the Inspector General validated Whitehurst’s charges, and cited Malone as one of 14 F.B.I. Crime Lab that conducted inaccurate tests and made false reports. Whitehurst had revealed that Malone had perjured himself and falsified evidence when testifying during the impeachment proceedings against federal judge Alcee Hastings (now a U.S. Representative from Florida’s 23rd Congressional District).

Facing Bureau discipline for his conduct in the Hastings case, Malone was allowed to retire. The Bureau apparently did not take any adverse action against him.

In contrast to the Bureau’s treatment of Malone, Whitehurst — the man who blew the whistle on Crime Lab corruption and illegal activities by Lab employees — was harassed by the F.B.I. and the Department of Justice. Whitehurst’s wife, who also worked for the Bureau, also was a victim of the F.B.I.’s smear campaign against her husband.

In a classic case of the king killing the messenger bearing unwanted news, Dr. Whitehurst was driven from the F.B.I. After years of litigation, the government settled lawsuits targeting its unlawful conduct against Whitehurst for $1.46 million.

Outrageous

Speaking from the bench, Judge Ugast termed the prosecution’s conduct in the Gates trial as “outrageous.” He demanded to know why it took the Office of the U.S. Attorney so long to investigate the use of phony evidence in the Gates case, in light of the knowledge that former Crime Lab analyst Malone has been revealed to be a serial perjurer who fabricated evidence.

Assistant U.S. Attorney Joan Draper defended the government by claiming that the Office of the U.S. Attorney had begun looking into the situation “as soon as it was brought to our attention.”

Ugast ordered that all convictions in the District of Columbia that were obtained with testimony from Malone be reviewed.

Righting a Wrong

“We are trying to right a wrong,” Ugast explained when he ordered that Gates be freed. Ugast’s order gives Gates his freedom, but does not exonerate him. The U.S. Attorney may decide to try him again, though in the light of the new DNA evidence, that seems unlikely.

Defending their conduct in the Gates case, federal prosecutors claimed that their case was based on more than Malone’s hair testimony. The government’s case included the use of a jailhouse informant, who was paid for his testimony that Gates has confessed that he had raped and murdered Schilling.

Jail-house confessions are among the most notorious, underhanded methods by which prosecutors seek to gain a conviction. Dr. Sam Sheppard, whose case provided the basis for the TV series and movie The Fugitive, was wrongfully convicted of murdering his wife in the Cleveland suburb of Bay Village, Ohio in 1954. The perpetrator of the murder was left-handed while the 30 year-old Sheppard, a highly respected osteopathic physician, was right-handed.

Sheppard claimed that his wife had been murdered by an intruder, whom he had tried to subdue but who had beaten him. The doctor had suffered injuries on the night of his wife’s murder which his defense attorney claimed, during his trial, could not be self-inflicted.

Sheppard was convicted of murder and sentenced to life-in-prison. The case became notorious, and by the late 1950s, it was widely suspected that Cuyahoga County court had convicted an innocent man, who was imprisoned for life.

In 1966, the U.S. Supreme Court upheld a federal district court decision on a writ of habeas corpus that had ordered that the State of Ohio to either release Sheppard or grant him a new trial. It is important to understand that Sheppard’s conviction was not overturned on the basis that he was innocent, which was irrelevant, but on the fact that there had been a great deal of negative, pre-trial publicity attacking Sheppard in the press that likely had led to his prosecution.

The High Court noted that the media campaign before and during Sheppard’s arraignment and trail created a “carnival” atmosphere that influenced the trial. It also cited the fact that the judge had failed to sequester the jury or insulate it from this ongoing media campaign against Sheppard. Furthermore, it cited the fact that the judge, on the first day of the trial, had said, “Well, he’s guilty as hell. There’s no question about it.”

The media-created “circus” atmosphere had poisoned his chances for a fair trial. The trial judge’s behavior and his failure to counter the effects of the anti-Sheppard media campaign violated his due process rights. The Supreme Court ruling effectively vacated his sentence, and granted a writ of habeas corpus that gave Sheppard his his taste of freedom in a dozen years. The state of Ohio improbably re-tried Sheppard for murder.

Sam Sheppard’s attorney, F. Lee Bailey, told the press during the second trial that he was going to have Sheppard take the stand in his own behalf. (Sheppard had testified at his first trial.) Bailey had learned that the Ohio prosecutors planned to use a jail-house informant as a rebuttal witness, after Sheppard took the stand. The informant would claim that the imprisoned Sheppard had confessed to him that he had murdered his wife.

Bailey did not let Sheppard testify, with the consequence that the Ohio prosecutors could not put the jail-house informant on the stand. While some saw this as a brilliant move on Bailey’s part, the fact was, Bailey revealed after Sheppard’s premature death in 1970, the wrongfully convicted doctor was in no shape, psychologically, to testify in court. Twelve years behind bars for a crime he did not commit had devastated him.

Within four years after being declared innocent at his second trial, Sam Sheppard was dead of liver failure due to acute alcoholism. He was 46 years old. Appearing on the Tonight Show With Johnny Carson soon after winning his freedom at his second trial, Sheppard had confessed to Carson during a commercial break that if he had been convicted again, he would have committed suicide.

Freedom?

Donald Eugene Gates was released from the federal prison in Arizona where he was serving his sentence. He was given a ticket to Ohio, where he has family, a set of winter clothes, and $75. Whether he will remain a free man, or will – like Sam Sheppard – be retired, remains to be seen.

A hearing to determine whether Gates should be exonerated is scheduled for December 23rd. At the hearing, prosecutors will examine the DNA testing of the evidence. If Gates is not exonerated, he will have to register as a sex offender – for a crime he did not commit.

Malone’s Legacy

Dr. Frederic Whitehurst first revealed Michael Malone’s malfeasance at the F.B.I. Crime Lab back in the 1990s. Now executive director of the Forensic Justice Project, he provided relevant information about Malone’s conduct at the Lab obtained via a Freedom of Information Act (FOIA) lawsuit to Gates’ attorney, Sandra Levick.

In the wake of the Office of the Inspector General report on F.B.I. Crime Lab corruption, the Department of Justice set up the Brady Task force to investigate all of the cases Malone and the other 13 lab examiners criticized in the OIG report. The testimony of Malone and the others resulted in hundreds of convictions, all of them suspect and many surely wrongful, like that of Eugene Gates.

The Brady Task force was terminated in 2002. No report was ever issued, and Congress was never informed of its findings of the Brady Task force. Apparently, in the wake of the 9/11 terrorist attacks on America, the F.B.I. was given a “pass” by the George W. Bush Administration and a Republican-controlled Congress, despite the fact that the incompetence and criminality revealed by whistleblowers like Whitehurst and former F.B.I. translator Sibel Edmonds show that such behavior actually undermines national security.

Ironically, after he retired under threat of disciplinary action that never came, Malone continued his relationship with the Bureau. As an F.B.I. contractor, Malone conducts security clearance background checks. Clearly, the Bureau intended to reward him for his falsification of evidence and perjury.

The message the F.B.I.’s continued employment of Malone sends to other wrong-doers in the Bureau and the national security establishment is unmistakable. It also sends a warning to those whistleblowers, like Sibel Edmonds, to think before they reveal corruption. The safety of the United States suffers as a result.

The Future

Though has been known for over a decade that hundreds of convictions obtained by prosecutors depending on the evidence of Michael Malone and the other 13 suspect F.B.I. Crime Lab employees have been tainted, those convictions have been allowed to stand. The federal government has not reviewed them, a situation highlighted by Judge Ugast’s remarks from the bench when freeing Eugene Gates.

The National Whistleblower Center has filed a FOIA seat to obtain the Brady Task force records, which come dribbling in on a monthly basis. Dr. Whitehurst has long contended that Malone manufactured evidence and that all of the cases in which he was involved in must be considered suspect. However, until the Gates case, nothing was done to uncover the truth in those cases.

Judge Ugast’s order that all cases in the District of Columbia involving Malone should be reexamined may be the first step towards obtaining justice for innocent individuals wrongfully convicted by manufactured evidence and perjured testimony provided by F.B.I. Crime Lab employees

Donald Trump hasn’t even taken office yet. But the war on climate science that he promised on the campaign trail has already begun. And in response, the good and necessary resistance is starting to form.

Last week, PEOTUS sent a chill through the scientific community when his transition team delivered a 74 question document to the Department of Energy asking for the names of all personnel who’ve worked on climate change or who attended U.N. climate talks within the last five years.

Almost immediately after the letter’s delivery, The Union of Concerned Scientists made the following response:

 “The Union of Concerned Scientists strongly condemns the effort by the President-elect’s transition team to seek the names of federal employees who have conducted climate research and worked on issues such as the social cost of carbon. We cannot imagine any legitimate purpose to this inquiry…

“This action should not be viewed in isolation. The Trump transition team is teeming with individuals with a proven history of attacking climate scientists and undermining climate science. Several transition team members now overseeing federal agencies have harassed scientists based on their research and have long signaled a desire to dismantle federal climate science research. Over the past few years, Congress has increasingly singled out specific government employees when their work is politically inconvenient.

“Creating lists of employees smacks of McCarthyism and should cease immediately. And Department of Energy employees should resist complying with any demands that would compromise the independence of the agency’s experts.”

The Department of Energy subsequently refused to provide the names requested. But the impact of the circulated questionnaire was profound — prompting protests and a swell of outrage from scientists, journalists and concerned citizens. Workers and officials at DOE expressed fears that Trump was developing an enemies list. And, considering the purges and attacks on scientists that occurred in numerous countries around the world following the election of climate change deniers during recent years, these fears were sadly quite valid.

Eliminating NASA Funding, Death Threats on Twitter

In a separate but related instance, Trump Administration officials reportedly stated that they intended to eliminate NASA’s climate research funding. Not only would this result in a purge of climate scientists from U.S. government offices. It would also precipitate the loss of climate monitoring satellites and the potential loss of decades of scientific data collected by some of the top researchers in the world. Concerned that scientists would be suddenly expelled and that critical data would be lost, as happened during similar purges that occurred in Canada and Australia under climate change deniers Stephen Harper and Tony Abbott, workers for various agencies began frantically copying data in order to ensure its preservation.

Meanwhile, instances of politically motivated threats against climate scientists mounted. Peter Gleick, a hydro-climatologist and co-founder of the Pacific Institute, a nonpartisan think tank, reported to the Japan Times that he received death threats in the form of pictures of guns posted to him after he tweeted critically about threats of violence to scientists made by Brietbart on Twitter.

Jerry Brown, Governor of California Vows to Fight Against Trump’s Anti-Science Agenda

Concern for scientists as a class increasingly victimized by political extremists like Trump hit a fever pitch this week at the American Geophysical Union Conference in San Francisco. There, hundreds of pro-science protesters marched outside as the meeting halls swelled with over 20,000 worried scientists and their supporters.

Among the attendees was Governor Jerry Brown of California who delivered this impassioned speech:

Brown highlighted the tremendous danger that human civilizations now face. The oceans are rising and acidifying, the weather is worsening, habitats, food and water sources are being destroyed. He also noted that in order to prevent climate harms, people would have to face down both “big oil” and “big financial structures that are at odds with the survivability of our world.”

Brown called on scientists and their ‘truth teller and truth seeker’ supporters to fight back.  And, in doing so, he pledged the aid of California’s scientific and legal communities saying: “We’ve got the scientists and we’ve got the lawyers and we’re ready to fight back. We’re ready to defend.”

Brown cited past major environmental achievements by California including 28 percent renewable power generation, a goal to hit 50 percent in the coming years, and zero emissions vehicle and mileage standards that became the benchmark for the nation. Unlike Trump, Brown pledged to fully support international climate agreements and to work with over 200 states to help to reduce harms from climate change. Touting California’s 2.1 trillion dollar economy, Brown stated — “We will persevere. We will prevail.”

But Brown’s highest points involved his pledge to launch satellites if Trump shuts down NASA climate monitoring systems and to pit California’s economic might as a renewable energy power against the old fossil fuel interests. Brown stated:

“Well, I remember back in 1978, I proposed a Landsat satellite for California. They called me Governor Moonbeam because of that. I didn’t get that moniker for nothing. And if Trump turns off the satellites, California will launch its own damn satellite. We’re going to collect that data. …

“We’ve proved in California that the economy grows… in part because of the rules and the climate policy that we’ve adopted… and California is growing a whole hell of a lot faster than Texas and we’ve got more sun than you’ve got oil.”

We Need Help Fighting The Banks


The other day I got a letter from my credit card bank, Citibank. It began, “We’re replacing your existing Card Agreement with a new version, which is enclosed.” They claimed that “It’s designed with you in mind,” but I doubt that.

The new Agreement is described in detail, without any indication of what is new, so I don’t know what they have changed. What hasn’t changed is the tilt of the Agreement toward Citibank. Interest rates for loans are very low these days. Rates for mortgages range between 2.5% and 4%. Auto loans are even cheaper, between 2% and 3%. My home equity loan from my local bank is 3.5%. When big banks borrow money, they pay close to zero interest.

But don’t borrow money from your credit card bank. My new Agreement, like the old Agreement, lists huge rates for money I “borrow” from Citibank. If I owe money on my card, the rate is 14.24%. If I get a cash advance, the rate is 25.49%, beginning the moment I get the money. There are also fees. A cash advance costs 5% of the amount, in addition to the interest.

These are the costs of having a credit card. We might think they are unreasonable, but getting a card means agreeing to one-sided Agreements like this one. If I didn’t like any of the changes to my Agreement, whatever they were, I could close my account.

But on one new provision in my new Agreement, I was given a choice. Citibank wants any disputes about my account to be subject to arbitration, meaning that the dispute is settled by an arbitrator, without recourse to the courts. Here’s why Citibank and other credit card companies like this idea.

An arbitration is an individual case, so consumers can’t band together in a class action suit. The result is purely monetary, so if the dispute is caused by fraud or other illegal action by the bank, they are not subject to legal penalty. The cost of arbitration is picked up by the bank and they typically select the arbitrator (do you know one?), steering lots of business to arbitrators who deliver verdicts they like. One big arbitration service, the National Arbitration Forum, had to get out of the business of consumer arbitration because it was so cozy with the banks that it was being sued by many city and state attorneys.

Wells Fargo, the current Dishonest Bank of the Year, defrauded countless customers by creating millions of fake accounts in their names. Now it is killing lawsuits filed by its customers by moving the disputes to arbitration. If successful, the bank might have to repay fees they charged to the customers, but would not be liable for penalties due to fraud. Although some judges have ruled that Wells Fargo’s fraud should be adjudicated in court, other judges have forced customers to go to arbitration.

The dishonesty of Wells Fargo over many years, cheating millions of customers for many years, and thus far escaping with no jail time for any employee, shows how insignificant we consumers are when we come up against giant corporations. Even well known people, like the Los Angeles music star Ana Bárbara, get crushed by their power. A Wells Fargo employee created sham accounts and credit lines in her name, took out more than $400,000 of her money, then regularly went to her house to steal her Wells Fargo statements from her mailbox. She had to cancel appearances, costing her hundreds of thousands of dollars. Instead of her day in court, Bárbara will have to go to arbitration.

Protection for the consumer can only come from the government. The Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 takes its name seriously. Dodd-Frank does not let banks force consumers into arbitration for the biggest loans we take out, mortgage and home equity loans. It created the Consumer Financial Protection Bureau to write regulations to implement that change. It also asked the CFPB to study credit card arbitration agreements and report to Congress.

The government effort to examine credit card “agreements” about arbitration is why my bank offered me the chance to opt out of arbitration. All I had to do was write a letter to them saying I rejected the arbitration provision of my “updated Card Agreement”. I did that. Thank you, Dodd-Frank.

Republicans have fought against Dodd-Frank since it was first discussed in Congress. They tried to prevent the CFPB from ever being formed. Donald Trump has said he would dismantle Dodd-Frank, saying, ““Dodd-Frank has made it impossible for bankers to function.” Trump’s selection for Secretary of the Treasury, who will oversee banking regulations, is Steven Mnuchin. Mnuchin worked for Goldman Sachs, a financial firm that got a $10 billion bailout from the federal government in 2008. He made billions by foreclosing on homeowners during that financial collapse. His main qualifications for running Treasury is that he was Trump’s campaign finance chairman.

Dodd-Frank makes it less possible for the big banks to push us into tilted arbitration when the banks act like Wells Fargo. It’s an equalizer for the little consumer dealing with the big banks. Without it, we’re at their mercy.

“In 1942, President Franklin D. Roosevelt appointed William Donovan as head of the Office of Strategic Services (OSS), an organization that was given the responsible for espionage and for helping the resistance movement in Europe. He was helped in this by William Stephenson and Britain’s MI6 chief, Stewart Menzies.

Donovan was given the rank of major general and during the Second World War he built up a team of 16,000 agents working behind enemy lines. The growth of the OSS brought conflict with John Edgar Hoover who saw it as a rival to the Federal Bureau of Investigation. He persuaded President Harry S. Truman that the OSS in peacetime would be an “American Gestapo”. At the end of the war, Truman ordered the OSS to be closed down leaving a small intelligence organization, the Strategic Services Unit (SSU) in the War Department.

After leaving the OSS Frank Wisner joined the Wall Street law firm, Carter Ledyard. However, in 1947, he was recruited by Dean Acheson, to work under Charles Saltzman, at the State Department’s Office of Occupied Territories. Wisner moved to Washington where he associated with a group of journalists, politicians and government officials that became known as the Georgetown Set. This included Frank Wisner, George Kennan, Dean Acheson, Richard Bissell, Desmond FitzGerald, Joseph Alsop, Stewart Alsop, Tracy Barnes, Philip Graham, David Bruce, Clark Clifford, Walt Rostow, Eugene Rostow, Chip Bohlen, Cord Meyer, Richard Helms, Desmond FitzGerald, Frank Wisner, James Angleton, William Averill Harriman, John McCloy, Felix Frankfurter, John Sherman Cooper, James Reston, Allen W. Dulles, Walter Lippmann and Paul Nitze.

The group often met at the home of Chip Bohlen on Dunbarton Avenue. Most men brought their wives to these gatherings. Members of what was later called the Georgetown Ladies’ Social Club included Katharine Graham, Mary Pinchot Meyer, Sally Reston, Polly Wisner, Joan Braden, Lorraine Cooper, Evangeline Bruce, Avis Bohlen, Janet Barnes, Tish Alsop, Cynthia Helms, Marietta FitzGerald, Phyllis Nitze and Annie Bissell.

The Office of Strategic Services provided a model for the Central Intelligence Agency (CIA) that was established in September 1947. Others have suggested that it was the British Security Coordination (BSC) that was really the important organisation. According to Joseph C. Goulden several of the “old boys” who were around for the founding of the CIA like repeating a mantra, “The Brits taught us everything we know – but by no means did they teach us everything that they know.” The role of the CIA was to evaluate intelligence reports and coordinate the intelligence activities of the various government departments in the interest of national security. Frank Wisner remained concerned about the spread of communism and began lobbying for a new intelligence agency. He gained support for this from James Forrestal, the Defense Secretary. In June 1948, George Kennan, drafted a directive that resulted in the Office of Special Projects.

Wisner was told to create an organization that concentrated on “propaganda, economic warfare; preventive direct action, including sabotage, anti-sabotage, demolition and evacuation measures; subversion against hostile states, including assistance to underground resistance groups, and support of indigenous anti-Communist elements in threatened countries of the free world”. Thomas Braden later recalled: “Wisner brought in a whole load of fascists after the war, some really nasty people. He could do that, because he was powerful. Harrison E. Salisbury commented: “He (Wisner) was the key to a great many things, a brilliant, compulsive man, of enormous charm, imagination, and conviction that anything, anything could be achieved and that he could achieve it.”

Later that year Frank Wisner established Operation Mockingbird, a program to influence the American media. Wisner recruited Philip Graham (Washington Post) to run the project within the industry. According to Deborah Davis (Katharine the Great): “By the early 1950s, Wisner ‘owned’ respected members of the New York Times, Newsweek, CBS and other communications vehicles.”

Rear Admiral Sidney W. Souers, who was the Deputy Chief of Naval Intelligence, was appointed the first Director of Central Intelligence. Walter Bedell Smith took over the post in 1950 and held it until being replaced by Allen W. Dulles in 1953.

According to Deborah Davis, the CIA operative Cord Meyer became the “principal operative” of Operation Mockingbird. One of the most important journalists under the control of Mockingbird was Joseph Alsop, whose articles appeared in over 300 different newspapers. Other journalists willing to promote the views of the CIA included Stewart Alsop (New York Herald Tribune), Ben Bradlee (Newsweek), James Reston (New York Times), Charles Douglas Jackson (Time Magazine), Walter Pincus (Washington Post), William C. Baggs (Miami News), Herb Gold (Miami News) and Charles Bartlett (Chattanooga Times). According to Nina Burleigh (A Very Private Woman) these journalists sometimes wrote articles that were commissioned by Frank Wisner. The CIA also provided them with classified information to help them with their work.

After 1953 the network was overseen by Allen W. Dulles, director of the Central Intelligence Agency. By this time Operation Mockingbird had a major influence over 25 newspapers and wire agencies. These organizations were run by people with well-known right-wing views such as William Paley (CBS), Henry Luce (Time Magazine and Life Magazine), Arthur Hays Sulzberger (New York Times), Alfred Friendly (managing editor of the Washington Post), Jerry O’Leary (Washington Star), Hal Hendrix (Miami News), Barry Bingham Sr., (Louisville Courier-Journal), James Copley (Copley News Services) and Joseph Harrison (Christian Science Monitor).

The Office of Policy Coordination (OPC) was funded by siphoning of funds intended for the Marshall Plan. Some of this money was used to bribe journalists and publishers. Frank Wisner was constantly looked for ways to help convince the public of the dangers of communism. In 1954 Wisner arranged for the funding the Hollywood production of Animal Farm, the animated allegory based on the book written by George Orwell. According to Alex Constantine (Mockingbird: The Subversion Of The Free Press By The CIA), in the 1950s, “some 3,000 salaried and contract CIA employees were eventually engaged in propaganda efforts”. Wisner was also able to restrict newspapers from reporting about certain events.

Another project started by Frank Wisner was called Operation Bloodstone. This secret operation involved recruiting former German officers and diplomats who could be used in the covert war against the Soviet Union. This included former members of the Nazi Party such as Gustav Hilger and Hans von Bittenfield. Later, John Loftus, a prosecutor with the Office of Special Investigations at the U.S. Justice Department, accused Wisner of methodically recruiting Nazi war criminals. As one of the agents involved in Operation Bloodstone, Harry Rositzke, pointed out, Wisner was willing to use anyone “as long as he was anti-communist”.

The Dumb American Presidents of The Past: Or Were They? The Ignoramus in Office.

It is hard to imagine that we have had so many dumb American presidents. I’m not confining this to one party but it appears this characteristic crosses both parties. For years now probably going back to John F. Kennedy, or perhaps even before him, all of those presidents have been engaged in an activity that is truly a waste of time. You would think they had better things to do with themselves.

I say they are dumb because the incoming president who says he is smart does not have to follow what they had to do. Trump said: “I don’t have to be told — you know, I’m like a smart person. I don’t have to be told the same thing and the same words every single day for the next eight years. It could be eight years — but eight years.”

You see the self-described smart person is not about to follow what all those other presidents did which can only mean they were dumb. Can you imagine what those prior presidents did? They received daily intelligence briefings.

Trump points it out: “But if they’re going to come in and tell me the exact same thing that they told me, you know, that doesn’t change necessarily. There might be times where it might change. I mean, there will be some very fluid situations. I’ll be there not every day but more than that. But I don’t need to be told, Chris, the same thing every day, every morning, same words. Sir, nothing has changed. Let’s go over it again. I don’t need that.”

Well, I’d suggest we are pretty lucky now that we have a president who is so clever. How did we ever survive all the years up to now with our other presidents being told the same thing over and over again? Were they really all retarded that each morning the intelligence briefing was carried on for a half an hour or more and it just consisted of “sir, nothing has changed. Let’s go over it again.”

But here is the problem that I see. If these presidents that preceded the Trump were not dumb but were clever and smart in their own right what are we supposed to make of all of them receiving daily intelligence briefings and the Trump deciding that he does not need them.

All I can conclude is that the Trump has no idea what the job of president involves. I’ve mentioned before that he is the first president ever to be elected who was not a general, politician or public servant with years of experience. He is a neophyte when it comes to working in the government. Yet at this early stage he has rejected the course followed by his predecessors to get daily briefings but has suggested because his underlings get them he does not have to receive them.

He said: “Now, in the meantime, my generals are great, are being briefed. Mike Pence is being briefed, who is, by the way, one of my very good decisions. He’s terrific. And they’re being briefed.” You have to wonder that if the Trump thinks the briefings are such a waste of time why are all these other people taking the time to listen to them. Is he suggesting that unlike him they are not smart and have to be told the same thing over and over again?

My take on the whole thing is that Trump wants to run the presidency like he runs his business. He knows what is involved in constructing a building, He does not have to be appraised of daily matters.

If he were smart he would know that he is woefully ignorant when it comes to running foreign policy. Things are fluid. They change by the moment, sometimes quickly, sometimes gradually. Even if they didn’t, no briefing should ever be the same.

The idea behind day-to-day briefings is to listen and then ask questions and propose solutions. The next day the briefing will answer the questions and discuss the solutions that should bring about more questions. The day after when they come back with answers more questions must be asked and solutions suggested. The next day they are discussed and more questions asked. It is an ongoing process so that the president will have thought about things, raised questions, and received answers. Solutions do not respond to quick judgments. They have to be thought about.

The Trump’s refusal to be briefed, to ask questions, to think about it, propose solutions and have the back and forth required to really understand something is disturbing. He does not understand his job. He is an ignoramus in office.

He will not only not be prepared when a crisis arrives he will have so alienated the intelligence agencies that their work will suffer. They will think if he doesn’t care and is going to act like a cowboy why should we put in all the work to get things right. Sadly America will suffer greatly.

New Government Studies Found That FBI Fails to Report Many Killings by Police



A new federal government study has found that the FBI has reported far fewer killings by police than actually happened.

The study found there were about 1,200 killings by police in in 2015, compared to the FBI’s official count of 442.

The discovery casts serious questions about the data collected by the FBI, which compiles what are supposed to be the official counts.

The study suggests tracking arrest-related deaths by using media reports and follow-ups with law enforcement and coroners’ offices.

“The revised … program methodology is designed to increase the reliability, validity, and comprehensiveness of the data collection,” the study repo

The US constitution flatly prohibits any “Person holding any Office of Profit or Trust under [the United States]” from accepting “any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State”.

Known as the emoluments clause, this provision was designed on the theory that a federal officeholder who receives something of value from a foreign power can be tempted to compromise what the constitution insists be his exclusive loyalty: the best interest of the United States. The clause applies to the president and covers even ordinary, fair market value transactions with foreign states and their agents that result in any profit or benefit. That a hostile government has gotten its money’s worth from our president is obviously no defense to a charge that he has abused his office.


Trump’s continued interest in the Trump Organization and his steady stream of monetary and other benefits from foreign powers put him on a collision course with the emoluments clause. Disentangling every improper influence resulting from special treatment of Trump’s business holdings by foreign states would be impossible. Former FBI Agent Calls for Clemency for Leonard Peltier

In a letter sent to President Obama, a former FBI Special Agent called for the president to grant clemency to Native American activist and federal prisoner Leonard Peltier, who has served over 40 years in prison after being convicted in a flawed trial for the deaths of two FBI agents.
Former Agent John C. “Jack” Ryan wrote in the letter “In my opinion…the circumstances surrounding the case in combination with the passage of 4 decades of time served support his request to live his final years at home.”
Peltier was convicted in 1975, and has remained behind bars despite concerns about political bias and injustice that have clouded his case. Now the 72 year-old’s health is failing, he has exhausted all appeals, and he is not up for parole until 2024. More than 100,000 people have signed an Amnesty International petition calling for him to freed.
Ryan was a charter member of the FBI Agents Association and was with the Bureau from 1966 to his removal in 1987, when he refused to investigate activists protesting U.S. involvement in Nicaragua because he believed that they had done nothing wrong. As an agent, he wrote in his letter, “we were taught to follow orders and we acted on good faith on the directions given, believing we were doing the right thing.” Of the events that led to the end of his FBI career, he said “I was faced with a moral dilemma and did what I thought was right.”
“The FBI's perpetual demonization of Leonard Peltier is an effort to poison public opinion and avoid self-reflection,” said Cynthia K. Dunne, a former federal prosecutor and co-counsel for Peltier. “Mr. Peltier's clemency petition is not a referendum on federal law enforcement. It presents a moral imperative which President Obama has the opportunity to address. By reckoning with the past and moving forward in the best interests of justice, reconciliation and compassion, we can become a stronger nation. It is time to free Leonard Peltier.”
“Leonard Peltier may die in prison unless the president acts before his term is up,” said Zeke Johnson of Amnesty International USA. “President Obama should seize the opportunity to grant clemency to Leonard Peltier as a humanitarian gesture that President-elect Trump cannot reverse.”
Last week, the former head of the prosecution team that convicted Peltier also wrote to President Obama calling for clemency. Former U.S. Attorney James H. Reynolds wrote that clemency for Peltier would be “in the best interest of Justice.” 
Chairman of the Standing Rock Sioux tribe, Dave Archambault II also sent a letter to President Obama about the case. Over 50 Members of Congress and others—including federal appellate Judge Gerald Heaney, who sat as a member of the court in two of Peltier’s appeals—have all called for his immediate release.

For one bright moment back in the late 1960s, we actually believed that we could change our country. We had identified the enemy. We saw it up close, we had its measure, and we were very hopeful that we would prevail. The enemy was hollow where we had substance. All of that substance was destroyed by an assassin’s bullet. – William Pepper (page 15, The Plot to Kill King)

The revelations are stunning. The media indifference is predictable.

Thanks to the nearly four-decade investigation by human rights lawyer William Pepper, it is now clear once and for all that Martin Luther King was murdered in a conspiracy that was instigated by then FBI director J. Edgar Hoover and that also involved the U.S. military, the Memphis Police Department, and “Dixie Mafia” crime figures in Memphis, Tennessee. These and many more incredible details of the King assassination are contained in a trilogy of volumes by Pepper culminating with his latest and final book on the subject, The Plot to Kill King. He previously wrote Orders to Kill (1995) and An Act of State (2003).



With virtually no help from the mainstream media and very little from the justice system, Pepper was able to piece together what really happened on April 4, 1968 in Memphis right down to who gave the order and supplied the money, how the patsy was chosen, and who actually pulled the trigger.

Without this information, the truth about King’s assassination would have been buried and lost to history. Witnesses would have died off, taking their secrets with them, and the official lie that King was the victim of a racist lone gunman named James Earl Ray would have remained “fact.”

Instead, we know that Ray took the fall for a murder he did not commit. We know that a member of the Memphis Police Department fired the fatal shot and that two military sniper teams that were part of the 902ndMilitary Intelligence Group were sent to Memphis as back-ups should the primary shooter fail. We have access to the fascinating account of how Pepper came to meet Colonel John Downie, the man in charge of the military part of the plot and Lyndon Johnson’s former Vietnam briefer. We also learn that as part of the operation, photographs were actually taken of the shooting and that Pepper came very close to getting his hands on those photographs.



Unfortunately, the mainstream media has ignored all of these revelations and continues to label Ray as King’s lone assassin. In fact, Pepper chronicles in detail how a disinformation campaign has featured the collaboration of many mainstream journalists over almost half a century. He says he suspects that those orchestrating the cover-up, which continues to this day, are no longer concerned with what he writes about the subject.

“I’m really basically harmless, I think, to the power structure,” Pepper said in an interview.

“I don’t think I threaten them, really. The control of the media is so consolidated now they can keep someone like me under wraps, under cover, forever. This book will probably never be reviewed seriously by mainstream, the story will not be aired in mainstream – they control the media. It was bad in the ’60s but nowhere near as bad as now.”

And the most stunning revelation in The Plot to Kill King – which some may question because the account is second hand – is that King was still alive when he arrived at St. Joseph’s Hospital and that he was killed by a doctor who was supposed to be trying to save his life.

“That is probably the most shocking aspect of the book, that final revelation of how this great man was taken from us,” Pepper says. (By the way, when I quote Pepper as having “said” something I mean in our interview. If I’m quoting from the book, I’ll indicate that.)

The hospital story was told to Pepper by a man named Johnton Shelby, whose mother, Lula Mae Shelby, had been a surgical aide at St. Joseph’s that night. Shelby told Pepper the story of how his mother came home the morning after the shooting (she hadn’t been allowed to go home the night before) and gathered the family together. He remembers her saying to them, “I can’t believe they took his life.”

She described chief of surgery Dr. Breen Bland entering the emergency room with two men in suits. Seeing doctors working on King, Bland commanded, “Stop working on the nigger and let him die! Now, all of you get out of here, right now. Everybody get out.”

Johnton Shelby says his mother described hearing the sound of the three men sucking up saliva into their mouths and then spitting. Lula Mae described to her family that she looked over her shoulder as she was leaving the room and saw that the breathing tube had been removed from King and that Bland was holding a pillow over his head. (The book contains the entire deposition given by Johnton Shelby to Pepper, so readers can judge for themselves whether they think Shelby is credible – as Pepper believes he is.)

In fact, a second invaluable source was Ron Adkins, whose father, Russell Adkins Sr., was a local Dixie Mafia gangster and conspirator in the planning of the assassination even though he died a year before it took place. Ron told Pepper he had overheard Bland, who was his family’s doctor, tell his father that if King did survive the shooting he had to be taken to St. Joseph’s and nowhere else. As Pepper describes it:

He remembers Breen Bland saying to his father, ‘If he’s not killed by the shot, just make sure he gets to St. Joseph Hospital, and we’ll make sure that he doesn’t leave.’

Ron, who was just 16 when the shooting took place, was apparently taken everywhere by his father in those days, and he was able to recount many details of what happened as the assassination was planned and carried out.

“I definitely found him credible,” Pepper says. “I found him troubled, I found him disturbed in a lot of ways by things that went on earlier in his life.”

His deposition is also contained in the book, which Pepper explains was important so that readers could judge the statements for themselves.

“What I wanted to do was to make sure that the entire deposition of these critical moments and this critical information was there, so that one could go and read the depositions and see that I was being accurate,” Pepper says.

Besides describing what he heard Bland tell his father, Ron Adkins described the many visits made to Russell Sr. by Clyde Tolson, J. Edgar Hoover’s right hand man. Known to Ron as “Uncle Clyde,” the high-level FBI official often delivered cash to the elder Adkins for jobs he and his associates would carry out on behalf of Hoover. Among those the younger Adkins said were paid to supply information about the activities of Martin Luther King were the reverends Samuel “Billy”  Kyles and Jesse Jackson.

The basics of the official story

If you seek out any information from a mainstream source about James Earl Ray, you’ll find him described as the killer of Martin Luther King, just as Lee Harvey Oswald and Sirhan Sirhan are labelled “assassins” in the murders of John and Robert Kennedy.

But once you read any or all of Pepper’s three books on the King slaying, you see very clearly that Ray is not a killer at all. Instead, he was a petty criminal who was a perfect “follower.” Like Oswald and Sirhan, Ray was set up to take the fall for an assassination that originated within the American deep state. In fact, Pepper says he’s convinced that knowledge of the plot went all the way to the top.

“The whole thing would have been part of Lyndon Johnson’s playbook,” Pepper says. “I think Johnson knew about this.”

As the official story of the shooting goes, at 5:50 p.m. on April 4, Kyles knocked on the door of room 306 of the Lorraine Motel to let King and the rest of his party know that they were running late for a planned dinner at Kyles’s home. Kyles then walked about 60 feet down the balcony where he remained even after King came out of the room at about 6 p.m. (Although Kyles has maintained ever since that he spent the last half hour in the room, Pepper has proven otherwise.)

Members of a militant black organizing group the Invaders, who were also staying in the motel because of King’s visit, were told shortly before the shooting by a member of the motel staff that their rooms would no longer being paid for by the Southern Christian Leadership Conference (SCLC) and that they had to leave immediately. When they asked who had given this order, they were told it was Jesse Jackson. At the time of the shooting, Jackson was waiting down by the swimming pool. Ron Adkins also identified Jackson as the person who called the owners of the Lorraine Motel and demanded that King be moved from a more secure inner courtyard room to an exposed room on the second floor facing the street.

The Memphis Police Department usually formed a detail of black officers to protect King when he was in town, but did not this time. Emergency TACT support units were pulled back from the Lorraine to the fire station, which overlooked the motel. Pepper also learned that the only two black members of the Memphis Fire Department had been told the day before the shooting not to report for work the next day at the fire station. And black detective Ed Redditt was told an hour before the shooting to stay home because a threat had been made on his life.

Just about a minute after King exited his room, a single shot was fired and the bullet ripped through King’s jaw and spinal cord, dropping him immediately. The shot appeared to come from across Mulberry Street. King was rushed to hospital, where he was pronounced dead just after 7 p.m.

According to the official story, the shot was fired by Ray from the bathroom of a rooming house above a bar called Jim’s Grill, which backed on to Mulberry and faced onto South Main Street. But, as Pepper’s investigation proves, the shot actually came from the bushes located in between the rooming house and the street.  In fact, the only “witness” who placed Ray at the scene was a falling-down-drunk named Charles Stephens, who later did not recognize Ray in a photograph and who cab driver James McCraw had refused to transport a short time before because he was too intoxicated.

The bushes that concealed the shooter were conveniently trimmed the day after the shooting, giving a false impression that a shooter could not have been concealed there. Several witnesses, including journalist Earl Caldwell and King’s Memphis driver, Solomon Jones, described seeing the shot come from the bushes and not from the bathroom of the rooming house as the official story states.

Another casualty of the King murder was cab driver Buddy Butler who reported that he saw a man running from the scene right after the shot, going south on Mulberry St., and jumping into a police car (this would turn out to be MPD Lieutenant Earl Clark). Butler reported this to his dispatcher and later to fellow cab driver Louie Ward. Butler was interviewed at the Yellow Cab Company later that evening by police. Ward was told the next day that Butler had either fallen, or was pushed, to his death from a speeding car on the Memphis-Arkansas Bridge.

The owner of Jim’ Grill, Loyd Jowers, would later admit to being part of the conspiracy to kill King, and he would be found responsible – along with various government agencies – for the killing in a 1999 civil lawsuit by the King family, which was represented by Pepper.

“The King family got enormous comfort out of the results of that trial and the evidence that came forward from that,” Pepper says.

Betty Spates, a waitress at Jim’s Grill and girlfriend of Jowers, says she saw him rush into the back of the Grill through the back door seconds after the shot, white as a ghost and holding a rifle, which he then wrapped in a tablecloth and hid on a shelf under the counter. He turned to her and said, “Betty, you wouldn’t do anything to hurt me, would you?” She responded, “Of course not, Loyd.” Spates, who didn’t come forward until the 1990s, also recounted that Jowers had been delivered a large sum of money right before the assassination.

James McCraw stated that Jowers had shown him a rifle the day after the shooting and told him it was the one used to kill King.

“We confronted Loyd,” Peppers explains. “We told him he was likely to be indicted if he didn’t help us, if he didn’t give more information. Jowers didn’t know there was no way the grand jury was going to indict him. All he knew was what he did, what he participated in, how much money he got for it – he got quite a large sum of money, built a taxi cab company with it, had his gambling debt with [local Mafia figure Frank] Liberto forgiven.”

Liberto, an associate of Louisiana crime boss Carlos Marcello, turned out to be involved in the assassination also. He owned a produce warehouse and one of his regular customers, John McFerren, was making his weekly shopping trip there when he overheard Liberto shout into the phone an hour before the shooting: “Shoot the son of a bitch on the balcony.” Nathan Whitlock and his mother, LaVada Addison Whitlock, who owned a restaurant frequented by Liberto, stated that Liberto had told them he was responsible for the King murder.

Our apologies for sending out this draft agenda a bit later than usual, but some last-minute arrangements delayed the process. We are happy to report that Wednesday night’s teleconference will feature our first visits by two first-rate scholars of the Truth community.

When asked to name academics who have graced the Truth movement, the name of Graeme McQueen is always near the top of the list. His earliest contribution was his monumental study of the anthrax attacks, but he also has published a number of treatises which help address larger philosophical issues of the 9/11 Truth movement, and help lend it academic respectability. He will be discussing his recent article (http://houston911truth.us5.list-manage. ... 91763ac879) on the implications of a recent poll in England which showed that only 4% of Muslims there accept the official story of 9/11.
My first encounter with A K (Kee) Dewdney was when an early copy of his New World Intelligencer mysteriously appeared one day in my inbox…chock full of useful links to 9/11 Truth material. Dr. Dewdney’s current research, which he will be discussion on Wednesday night, is a bit further afield, but we never know when such information might become terribly relevant: he is studying the likely mortality rate in extended local blackouts. This should be interesting!

Since Donald Trump’s Inauguration Day, more than 12,000 people have tweeted “assassinate Trump,” causing a headache for the Secret Service.

Some of the tweets are jokes or hyperbolic, but some are serious, Mashable reports.

But it’s unclear how serious the Secret Service is taking the tweets.

Radiation levels inside a damaged reactor at the Fukushima Daiichi nuclear power station are at their highest since the plant suffered a triple meltdown almost six years ago.

The facility’s operator, Tokyo Electric Power (Tepco), said atmospheric readings as high as 530 sieverts an hour had been recorded inside the containment vessel of reactor No 2, one of three reactors that experienced a meltdown when the plant was crippled by a huge tsunami that struck the north-east coast of Japan in March 2011.

The extraordinary radiation readings highlight the scale of the task confronting thousands of workers, as pressure builds on Tepco to begin decommissioning the plant – a process that is expected to take about four decades.

The recent reading, described by some experts as “unimaginable”, is far higher than the previous record of 73 sieverts an hour in that part of the reactor.

A single dose of one sievert is enough to cause radiation sickness and nausea; 5 sieverts would kill half those exposed to it within a month, and a single dose of 10 sieverts would prove fatal within weeks.

Tepco also said image analysis had revealed a hole in metal grating beneath the same reactor’s pressure vessel. The one-metre-wide hole was probably created by nuclear fuel that melted and then

Months before President Trump issued sweeping anti-immigration executive orders, he told U.S. Border Patrol employees that their union would play a critical role in cracking down on asylum seekers and refugees seeking to enter the United States.

In July, Trump appeared on the Green Line, the National Border Patrol Council’s (NBPC) podcast, promising Border Patrol agents they would be “given the tools” to patrol the border as they saw fit.

The weekly podcast is recorded at several Breitbart News Studios, which is owned by the white nationalist site Breitbart.

Trump has avid backers in the unions behind Immigration and Customs Enforcement (ICE) and Border Patrol that combined, represent 21,000 immigration officers. Shawn Moran, vice president of media relations for the Border Patrol union, representing 18,000 agents and support personnel in the U.S. Border Patrol, suggested in a recent Green Line episode that the NBPC should be credited with the president’s executive orders banning travelers from seven predominantly Muslim countries.


“This is not the result of anybody in the chain of command at the Reagan Building doing anything. … Don’t even think for a second this has anything to do with the commissioner [of Customs and Border Protection] or the chief of the Border Patrol, because it’s not,” said Moran, who in the podcast often conflates immigration with terrorism and charges that “illegals” are responsible for a number of social ills. “It’s because of the hard work of border patrol agents nationwide. We found somebody that was willing to listen, we supported him, he got elected, and now he is following through on what some people thought were just hyperbolic campaign promises.”

Like Trump, Moran often characterizes undocumented immigrants as criminals and murderers, often citing the case of Kathryn Steinle, who was shot and killed in San Francisco in 2015. An undocumented immigrant is charged with murder in Steinle’s death and is awaiting trial.

Trump during the 2016 campaign repeatedly referenced Steinle’s story, relying on unsupported and anecdotal evidence about the number of murders carried out by undocumented immigrants to justify draconian immigration laws. But according to studies conducted by the American Immigration Council and others, “immigrants are less likely to commit serious crimes or be behind bars than the native-born, and high rates of immigration are associated with lower rates of violent crime and property crime. This holds true for both legal immigrants and the unauthorized, regardless of their country of origin or level of education. In other words, the overwhelming majority of immigrants are not ‘criminals’ by any commonly accepted definition of the term.”

Trump is one of many anti-immigrant leaders to appear on the Border Patrol union’s Green Line podcast. Others include former Maricopa County, Arizona Sheriff Joe Arpaio, known for “terrorizing” undocumented immigrants; and Jessica Vaughan, director of policy studies at the anti-immigrant group Center for Immigration Studies, whose research was used as a reference on Trump’s campaign website for his formal immigration policies.

Moran said, “Thank God for Brandon Darby, thank God for Breitbart News.”

Darby is a former FBI informant and the managing director of Breitbart. He is responsible for articles such as, “Border Patrol Union: Feds Risking Agents’ Lives to Appease ‘Fringe’ Groups,” a reference to Border Patrol agents having their vehicles affixed with cameras after allegations of abuse and corruption. Darby has featured Moran in his work and has quoted him extensively. What happened?
This was not a protest. It was a clarification. A realignment.
It was not an aggrieved victim struggling to have her lonely voice heard as she implores power to hear truth.
It was power speaking to power. Legitimate power speaking to illegitimate power.
It was a global, universal tweet speaking to an arrogant twit.
The phoenix shaking off the ashes.
It was liberation speaking to domination. Diversity speaking to white patriarchy.
The heart of freedom speaking to the heel of oppression. Right to wrong.
When I watched footage of the hundreds of marches in cities and towns all across America and then discovered that there were masses of people in the streets in other countries, it was clear something significant was happening. The deadly gloom of despair was lifted by the joy of millions of colorful, exuberant, powerful people. The point was tipping. This was not like the massive protests against the lies of the Bush administration in 2003 which propelled us into the Iraq invasion. Consciousness wasn’t raised then in enough people. People now realize an arrogant demagogue surrounded by a covey of ego-bloated generals, billionaire bankers and smug CEOs full of fear-mongering and racism, sexism and war-profiteering, science denial and nature destruction is not the way forward. This was a clarification. A re-set. Howard Zinn said our problem is not civil disobedience, it’s civil obedience. This was the exhilarating freedom of disobedience.
Obedience is uniformity; disobedience is a declaration of new identity. This was the people of the world speaking not so much to power as to each other. We’re in charge. We can shape the future we want, not be prey to what they want. Let’s practice respect. Let’s try love. Let’s embrace peace. Let’s insist on justice. Let’s honor the reality of our place in nature. Let’s build an economy of decency rather than disaster. Let’s base diplomacy on the common good.
As Trump was pathetically obsessed with the size of his inauguration crowd, the world passed him by. On his first day in office, the world passed him by! He’s already an anachronism. Dangerous, but an anachronism. The power has shifted.
Trump is the rock in the river from which we can leap to the other side.

ANNAPOLIS — For several hours on Tuesday, state legislators in the House Judiciary Committee listened to sometimes excruciating testimony on various pieces of proposed legislation dealing with sexual assault. Then on Thursday, the committee heard more.
In fact, Maryland lawmakers have filed more than 40 bills this year that deal in some way with sexual offenses — ranging from processing evidence in child pornography cases to requiring local governments to audit the number of reportedly unfounded sexual assault cases.
But three bills in particular would fundamentally reshape the way Maryland deals with these crimes, meaning Washington County law enforcement and prosecutors might have to alter their me

Proof of resistance
On Thursday, the Maryland Senate unanimously approved legislation to remove a requirement that prosecutors show evidence that a victim physically resisted a sexual assault in order to prove a crime was committed. A companion bill was one of the 12 heard in the House Judiciary Committee last week.
The House bill's lead sponsor, Del. Kathleen Dumais, D-Montgomery, noted that "one of the things we often talk about when we're talking to young women, particularly at colleges or high school, is that if you are in one of these situations, we actually tell them not to resist if they are concerned about further physical injury or death. We tell them not to resist. … But if it is even a question in a law enforcement officer's mind, that in fact if you didn't resist it's not rape or it's not a sexual assault, we need to make it clear on our statute."
Lisae C. Jordan, executive director of the Maryland Coalition Against Sexual Assault, was blunt.
"Victims of sexual assault should never be required to physically resist the attack," she said.
During a recent review of 124 Baltimore County rape cases that were ruled "unfounded," Jordan said, there was "case after case after case of women saying, 'No, please stop,' crying, saying, 'Don't do that,' saying, 'Stop.' One woman who had vomited and then felt a little bit better, so the perpetrator started to sexually assault her, and she cried and said, 'Stop.' And the officer said to that victim — to all of these victims — 'Did ya hit him? Did ya kick him? What did you do to fight back?'
"And when she said, 'No, I didn't hit him or kick him,' or fight back physically, the officer said, 'Well, ma'am, Maryland's rape law doesn't cover this situation. You were not raped.'
A third of these cases involved this type of scenario, Jordan said.
"We don’t ask a robbery victim if they they resisted — 'Did you push the gun away? Did you tell him that he couldn't rob you?'" added Baltimore County State's Attorney Scott Shellenberger. "We never ask that of any other victim in the state of Maryland … except in the area of sexual assault."

Standing Up for Our Communities: Why We Need a Police-Free Future

We are living in terrifying times. With each passing day, the Trump administration unleashes new waves of humiliation, degradation and repression. Many of us fear deportation, the evisceration of the social safety net, imprisonment or detention, ecological calamity, war and similar disasters. For those of us fighting against the violence of policing, the context was already grim. The predominance of suppression policing -- sometimes called "broken windows policing" -- with its mainstays of racial-profiling, sweeps, stop-and-search, ticketing and psychological and physical coercion and abuse, has made day-to-day contact with law enforcement dangerous. Add to these mundane policing practices the very real threat of dying at the hands of law enforcement agents, and the picture becomes even more bleak. Under the current White House, promises to intensify and expand an already vicious system are a signal of very dark days ahead. In a statement released during the first week in office, the Trump administration communicated its law-enforcement priorities. According to this statement, "The Trump Administration, will be a law and order administration. President Trump will honor our men and women in uniform and will support their mission of protecting the public. The dangerous anti-police atmosphere in America is wrong. The Trump Administration will end it."

The Trump regime's authoritarian tendencies should give us pause. When we consider the ways in which law enforcement has historically been used by authoritarian regimes to suppress dissent, we need to take seriously the state responses we're likely to encounter in reaction to an increasingly large and dynamic anti-Trump protest movement. Whether we are considering the expansion of policing practices -- including profiling, stop and frisk, sweeps and militarized tactical engagements -- or crackdowns on protest and dissent, we know that the surest way to reduce the violence of policing is to reduce contact with the police.

If ever there were a time to fight for the elimination of policing from our communities it is now. Recent weeks have demonstrated just how powerful we are when we come together to resist repression. This groundswell of fight-back should embolden us to build the world we want to live in today, even in the face of violence and fear mongering.

I believe that we have a better chance of living healthy, stable, secure lives if we eliminate policing. Sometimes abolitionists are accused of having unrealistic visions of a future free of the prison industrial complex -- big dreams that may be beautiful but are not practical, visions that are idealistic but too far away from the here and now. My abolitionist praxis looks toward a policing-free future and is rooted in actions toward that end in the here and now.

Here are some ideas about ways to begin building for the abolition of policing today. These are not meant to be a set of prescriptive action steps and time frames. They are not comprehensive. They are simply one set of potential practical steps in a universe of good ideas to help us think about what is possible. And even for people for whom a world without policing is impossible to imagine, it is possible to take practical steps toward an ever-shrinking reliance on and relationship to law enforcement. The most important thing is to begin to take some steps today and to keep practicing moving in that direction.

Preventing Violence Against Police or Silencing Dissent?

President Donald Trump today announced a crackdown against violence aimed at police. His  Presidential Executive Order on Preventing Violence Against Federal, State, Tribal, and Local Law Enforcement Officers is one of three executive orders he signed today meant to promote “law and order,” which included a conflation of “illegal immigration,” drug trafficking, and violent crime.

While law enforcement officers–like all human beings–deserve to be protected, the immediate purpose of the order is at odds with reality.  In most states, there are already serious and stringent enhancements to sentencing, including the death penalty, if a homicide victim is a police officer. Further, in spite of a number of high profile killings of police officers, such killings declined both in 2016 and 2015. In fact, in spite of upticks in crime in three cities, violent crime remains at historic low.

So back on planet Earth, Trump’s assertions of carnage in America’s cities, and that America’s law enforcement officers are under siege just doesn’t comport with reality. So why then is Trump pursuing these matters?

For starters, a number of figures close to him, such as his Attorney General Jeff Sessions, are set on fighting the bi-partisan shift in policy around criminal justice that includes a détente in the failed War on Drugs and efforts to make a dent in mass incarceration. With increased attention being paid to the number of Blacks being killed at the hands of police, the issues of excessive force and racism have also been pushed to the forefront.

To Trump and Jeff Sessions, the Movement for Black Lives and campaigns for police accountability amount to a war on cops which is responsible for the non-existent increase in crime or attacks on law enforcement. During Ted Cruz’s bizarre “War on Police” hearing last year, Sessions stated that because of “marches and protests” police were “sitting under the shade tree.”

The logic here is clear, if you protest against the police, you have blood on your hands. Thus, you should keep quiet. And by equating protesters with violence against law enforcement, it opens the door for repression.

Blue Lives Matter

This isn’t just happening on the federal level. Given the stringent penalties for violence against law enforcement it may seem odd that some are positing that state statutes need to be amended to include law enforcement. Yet, a number of self-described “Blue Lives Matters” bills would do just that.

Blue Lives Matters is, of course, a direct reference to Black Lives Matter. It is an attempt to somehow equate the killing of a law enforcement officer, which carries some of the severest penalties imaginable, with the killing of Blacks by police, crimes that are often committed with impunity. Like Trump and Sessions, proponents of Blue Lives Matter laws have tried to blame the Black Lives Matter movement for placing law enforcement under a state of siege, a notion that is not only not based in fact, but serves to demonize political dissent.

Louisiana has already passed a Blue Lives Matter bill, Mississippi seems poised to enact one, and Wisconsin is considering. A federal version of the bill was introduced into Congress during the last session, and although it languished, a similar bill seems likely to reappear.

So what have Blue Lives Matter bills accomplished? In Louisiana, they have led to individuals who allegedly “resisted arrest” being charged with hate crimes. This means a relatively minor encounter with law enforcement can quickly lead to being charged with a hate crime. In October 2016, an individual was charged with a hate crime for yelling obscenities at police officers during his arrest, though the District Attorney declined to prosecute.

These bills have a number of critics. They have been opposed by the American Civil Liberties Union, the NAACP, and even the United Nations Special Rapporteur On The Rights To Freedom Of Peaceful Assembly And Of Association has raised concerns with them. He said,  “unintentional or accidental touching which may easily occur in a context of an assembly could be elevated to a hate crime. Again, such crime conceptions have chilling effects on the exercise of assemblies.”

Conclusion

It goes without saying that no one should ever be the victim of a violent crime, but violent crime is not out of control nor is there a spike in violent crime against police officers, who already receive a number of special protections from such offenses. At time when there is growing concern over systemic racism, unchecked police brutality, mass incarceration, and militarized police being used against protesters, as witnessed at Standing Rock, such claims are not merely factually wrong, they are attempts to create obfuscate the truth and repress social movements.

This rhetoric and the policies that stem from it are not about protecting law enforcement from violence; they are about silencing dissent.

     I can't imagine Oprah reading the Cross series, but in the 1990s she read a passage from Another Chance To Get It Right during an interview she was conducting with Vachss, and the book hasn't been out of print since then. She was, as were so many others, enthralled with this collection of original stories, poetry and allegory, combined with the gorgeous black & white art by Geof Darrow and others, all of it celebrating the potential of parenting.
     The rights and protection of children is a theme than runs through most of Vachss's books, but this is as clear a mission statement as you're going to get from the author, filled with beauty and despair, sadness and hope. It should be required reading for every new parent. It should be required reading for anyone who cares about kids and cares for kids. Andrew deserves our thanks for writing this book.
     This twenty-fifth anniversary edition features a new cover by Darrow and other new material but but the core thrust remains the same as when it was first published.
     Highly recommended.

FBI Director James B. Comey spoke at a ribbon-cutting for the agency’s new facility in Chelsea — its first in a stand-alone building for the Boston region’s headquarters.

FBI Director James Comey met with area law enforcement officials Tuesday, promising to strengthen partnerships between federal, state, and local authorities.

Comey met with about 40 law enforcement heads from Everett to New Hampshire over lunch before taking part in a ribbon-cutting to announce the opening of a new headquarters in Chelsea for the FBI’s Boston field office, which covers Massachusetts, Maine, New Hampshire, and Rhode Island.


It is the first time the FBI’s Boston office has been in a stand-alone building, and the first time it has been outside of Boston.

WikiLeaks’ release on Tuesday of a massive trove of secret CIA documents has reignited conspiracy theories which have swirled since 2013, with revelations the spy agency was attempting to remotely hack vehicles.
“As of October 2014 the CIA was also looking at infecting the vehicle control systems used by modern cars and trucks,” WikiLeaks writes. “The purpose of such control is not specified, but it would permit the CIA to engage in nearly undetectable assassinations.”
Hastings, an acclaimed war correspondent and vocal critic of government mass surveillance, died in the early hours of Tuesday, June 18, 2013, when his Mercedes C250 Coupe apparently lost control and burst into flames before slamming into a palm tree.

Body Cam Video Shows Drunk, Armed FBI Agent at Grand Rapids Police Department


A drunk and armed FBI agent walked inside Grand Rapids Police Department headquarters after his partner was arrested for shooting at officers.
Agent John Salazar hasn’t been charged, even though he was in possession of a gun while being drunk. He also appeared to drive to police headquarters, WoodTV.com reports.
His partner, Ruben Hernandez was in custody after firing at a Grand Rapids officer outside of a gym.
Body cam footage shows Salazar acting strangely.
Records obtained by 24 Hour News 8 show that Salazar and Hernandez bought 12 beers at a steakhouse before going to Sensations Showgirls nightclub for five more drinks.

Louisville mayor asks FBI to investigate police department after sex abuse allegations
SUNDAY, MARCH 26, 2017, 1:07 P.M.
LOUISVILLE – A former participant in a Boy Scouts-affiliated career apprentice program for teenagers has alleged that two Louisville Metro Police Department officers sexually abused him in their homes and vehicles while they were working with him, and the city’s mayor has asked the FBI to look into the police department’s actions.
The accuser has alleged that the officers assaulted and raped him from when the boy was 17 years old until he was 19, at times filming the sex acts. He also alleged that police department officials – including the police chief and the head of internal affairs – knew about and covered up the assaults, which allegedly occurred while the victim was taking part in the Youth Explorer program to learn about policing and criminal justice as a potential career path.
The investigation appears to have begun in September, when Louisville police executed a search warrant at the home of officer Brandon Wood. There, investigators found videos of a sexual nature that allegedly involved the victim and Wood. Another police officer, Kenneth Betts, is also accused of abusing the victim. Betts left the force in 2013; Wood remains a police officer and is on administrative assignment. No charges have been filed in the case.

Parker: Police Officer Liability in Shootings Argued Before Gorsuch’s Arrival

Ross Parker was chief of the criminal division in the U.S. Attorney’s Office in Detroit for 8 years and worked as an AUSA for 28 in that office.

The muddied area of the law in civil actions against police officers involved in a shooting is one where Justice Neil Gorsuch’s participation and vote could make a difference, most likely in favor of protecting the officers. The Supreme Court heard argument last week in County of Los Angeles v. Mendez, a Section 1983 action against the county and two LA Sheriff’s Deputies.
It is an old legal adage that bad facts make bad law. From a law enforcement perspective, the case presents that kind of context.
First the present atmosphere surrounding police shootings, particularly of minority members, particularly where a rule or policy violation is present, is very unforgiving of split second decisions by police officers in the heat of situations reasonably perceived to be dangerous. See The War on Cops by Heather Mac Donald. One publication has described the case as involving the question if the police can “troll you and then shoot you.”
Second the atmosphere was especially stacked where the victim was, after the fact, found to be an innocent who suffered serious injuries.
The deputies were seeking a parole violator in 2010 when they knocked and announced their identity at a house in Los Angeles and then entered and searched it. In violation of the 4th Amendment, they lacked either an arrest or search warrant. Finding no one, two of them were sent to check a dilapidated shack in the backyard behind the house. Without announcing their identity or purpose, they opened the door with guns drawn. Not knowing who they were, Mendez picked up a BB gun he used to kill rats but did not point it at the officers. The deputies opened fire with 15 shots wounding Mendez and his pregnant girlfriend. Mendez later had to have his leg amputated because of his injuries.
The “Provocation” Rule
At the conclusion of the federal bench trial, the judge sustained liability and awarded the plantiffs $4 million in damages. The 9th Circuit Court of Appeals upheld the judgment under the alternative theories that the officers had provoked the threatening situation and that their constitutional violation, under the circumstances, was the proximate cause of the excessive force causing the injuries.

The “provocation” rule is opposed by law enforcement because it ignores principles of qualified immunity and focuses on events prior to the reasonableness of the officers’ action at the time of the shooting. Such a rule would, they argue, encourage police to hesitate and thus result in increased danger to both them and the subjects. The legal analysis has been widely discredited by other appellate courts.
Plaintiffs argue that it is unfair to shield officers from liability for unreasonably dangerous situations which they created or contributed to by their own actions.
The wide gap in views on what legal principles and analysis should be employed by the parties and lower courts was reflected by the apparent attitudes by the 8 Justices during oral argument last week. Even the fundamentals of the law in this area are confusingly uncertain.
The case could very well end up in a 4-4 tie between the Justices who support a finding that an unconstitutional entry satisfied proximate cause for the injury (likely Kagan, Sotomayor, Breyer, and Ginsburg) and those who could discern no proximate cause between any constitutional violation and the result (likely Roberts, Alito, Thomas and Kennedy). A tie would uphold the 9th Circuit’s affirmance of liability and damages. Of course predicting individual votes in a murky area of the law is a perilous course taken only by the most stalwart of columnists (who have nothing to lose).
Ominously the 13 Amicus Curiae briefs are split almost equally divided in their support of the two sides of the case.
Almost Justice Gorsuch’s disciplined and conservative approach could bring clarity in this area. Of course it is likely to be a clarity very unhelpful to the victims of police shootings.
