NYPD: Hillary Clinton 'Child Sex Scandal' About To Break

New York Police Department (NYPD) detectives have uncovered evidence of a 'child sex ring' on Anthony Weiner's laptop that they say could "put Hillary Clinton away for life".

According to NYPD sources, files found on Weiner's newly found laptop which he shared with his wife Huma Abedin, show evidence of a political pedophile ring operating within Washington, involving members of Congress as well as numerous top Clinton aides and insiders.

According to reports, a folder on Weiner's laptop named "life insurance" contains explicit evidence that both Hillary Clinton and Huma Abedin helped run and cover-up a Washington pedophile sex ring.

NYPD detectives and a NYPD Chief, the department's highest rank under Commissioner, said openly that if the FBI and Justice Department fail to garner timely indictments against Clinton and co- conspirators, NYPD will go public with the damaging emails now in the hands of FBI Director James Comey and many FBI field offices.

"What's in the emails is staggering and as a father, it turned my stomach," the NYPD Chief said. "There is not going to be any Houdini-like escape from what we found. We have copies of everything. We will ship them to Wikileaks or I will personally hold my own press conference if it comes to that."

The NYPD Chief said once Comey saw the alarming contents of the emails he was forced to reopen a criminal probe against Clinton.

"People are going to prison," he said.

Meanwhile, FBI sources said Abedin and Weiner were cooperating with federal agents, who have taken over the non-sexting portions the case from NYPD. The husband-and-wife Clinton insiders are both shopping for separate immunity deals, sources said.

"If they don't cooperate they are going to see long sentences," a federal law enforcement source said.

NYPD sources said Weiner or Abedin stored all the emails in a massive Microsoft Outlook program on the laptop. The emails implicate other current and former members of Congress and one high-ranking Democratic Senator as having possibly engaged in criminal activity too, sources said.

Prosecutors in the office of US Attorney Preet Bharara have issued a subpoena for Weiner's cell phones and travel records, law enforcement sources confirmed. NYPD said it planned to order the same phone and travel records on Clinton and Abedin, however, the FBI said it was in the process of requesting the identical records. Law enforcement sources are particularly interested in cell phone activity and travel to the Bahamas, U.S. Virgin Islands and other locations that sources would not divulge.

The new emails contain travel documents and itineraries indicating Hillary Clinton, President Bill Clinton, Weiner and multiple members of Congress and other government officials accompanied convicted pedophile billionaire Jeffrey Epstein on his Boeing 727 on multiple occasions to his private island in the U.S Virgin Islands, sources said. Epstein's island has also been dubbed Orgy Island or Sex Slave Island where Epstein allegedly pimps out underage girls and boys to international dignitaries.

Both NYPD and FBI sources confirm based on the new emails they now believe Hillary Clinton traveled as Epstein’s guest on at least six occasions, probably more when all the evidence is combed, sources said. Neal Wagatsuma, warden of Kauai community correctional center, began testifying in Honolulu on Wednesday in a trial for a lawsuit that accuses him of retaliating against a former jail social worker who alleged he subjected female inmates to sexual humiliation and discrimination.

Ever since the mid-1990s there have been rumors that he shows pornography to inmates at the mixed prison, but the videos are not porn, he said: “I would never do that.”

In an open letter, the young woman whose sexually explicit online conversations with disgraced former Congressman Anthony Weiner ignited a national firestorm blasted FBI Director James Comey for his role in politicizing her plight and subjecting her to unwanted scrutiny from the media.

The PBS documentary series tonight peeps into the bedroom and other seamy aspects of the man who guided the FBI for almost a half-century. Two wrongs might not make a right, but they do make for an explosive and deliciously scandalous hour.

Frontline contends that Hoover was ``personally corrupt, sexually compromised and tainted by ties to organized crime.``

It also alleges Hoover used surreptitiously obtained evidence of John F. Kennedy`s womanizing to blackmail him into offering the vice presidency to Lyndon B. Johnson, a Hoover ally.

Frontline also repeats and elaborates on the belief that Hoover, who labeled homosexuals ``sex deviants,`` had a homosexual relationship with his aide Clyde Tolson. In addition to the hypocrisy involved, Hoover`s sexual orientation is significant because organized crime found out about it and used the threat of exposing him to keep the FBI off its case.

Anthony Summers, author of the Hoover biography Official and Confidential, said notorious mob figure Meyer Lansky was one of those who had pictures of Hoover and Tolson in a compromising situation. ``Lansky controlled the pictures and he had made his deal with Hoover to lay off,`` Summers said.

A fashion model who, with her date, socialized with Hoover and Tolson one New Year`s, said she saw Hoover and Tolson holding hands in the backseat of a car. Later that evening, she says she heard Tolson express a desire to dance with Hoover at the Cotton Club in Harlem. The irony is, Hoover was livid at the time because he saw an interracial couple on the dance floor, according to the woman.

Susan Rosenstiel, wife of Louis Rosenstiel, who is identified as a mob- connected bootlegger, says she went to a party at New York`s Plaza Hotel, where she was promised a surprise. She was greeted at the door by a man in ``a black chiffon dress, very short with ruffles, and black lace stockings and high-heeled shoes and a black curly wig and black eyelashes.``




The person was introduced to her as Mary. ``It was clearly J. Edgar Hoover,`` she says.

Later, two teen-aged boys arrived, according to Susan Rosenstiel, and Hoover, Roy Cohn and her husband went into the bedroom and had sex with them.

``I heard (her husband Louis) Rosenstiel say that if Hoover ever brings pressure against Lansky or any of us, we`ll use this as blackmail.``

Throughout his career, Hoover claimed there was no such thing as a national crime family. He insisted organized crime was a local problem, which put it outside the jurisdiction of the FBI.

Ralph Salerno, head of the New York Committee on Organized Crime, says the hands-off policy had dire ramifications. ``If they (the mob) could have been attacked before they grew, before they got the wealth, before they got the knowledge, organized crime could have been nipped in the bud ... (the mob) never would have grown as strong as it got to be in later decades.``

Another reason Hoover might have gone easy on the mob, it is offered, is that he liked to play the horses, and the bookmakers he used to place bets were all mob backed. What`s more, it adds, Hoover had the kind of arrangement gamblers dream of.

According to Mrs. Rosenstiel, ``(My husband) would call the boys up and they would make the bets. If Hoover won, he got paid. If he didn`t win, they would just forget it.``

Gambling debts evidently were not all Hoover didn`t pay. He reportedly never picked up a check.

Also, John Dowd, head of the government`s Organized Crime Strike Force, says, ``Four years after Hoover died, I was assigned to conduct an investigation of 40 years of fraud and corruption by J. Edgar Hoover, in which he had taken at taxpayers` expense, goods and services provided to him by employees of the FBI.``

These perks included elaborate vacations disguised as business trips; using his government limos -- he had three -- for personal pleasure; using FBI personnel to service his lawn and to embellish and furnish his home.

GARLAND (CBSDFW) – The security guard who survived last year’s ISIS terrorist attack on the Culwell Center in Garland said not only are the terrorists responsible but so is the FBI for his injuries and the attack itself.

“I feel like they are not coming clean,” said Bruce Joiner about the FBI.

Joiner, 59, was the Garland school district security officer, shot in the leg by Elton Simpson and Nadir Soofi. The two ISIS recruits drove to the Culwell Center and started firing before they were killed by Garland Police. Joiner managed to help them stop Simpson and Soofi before they ever got close to the ballroom with about 200 people at a contest for cartoons of the Muslim prophet Muhammad. Joiner was treated at a hospital and released hours after suffering a lower leg wound.

But Joiner said there’s more to what happened that day. He has now claimed that three officers told him an undercover FBI agent was following terrorists in another vehicle.

“I know that there was a third person. I know he had his life saved by claiming he was an FBI agent,” said Joiner.

Joiner said Garland officers had guns pointed at the man dressed in Middle Eastern attire and quickly taken away by federal agents.

“He was detained put in the back of a squad car,” said Joiner. “They put a bag over his head and took him away to another location.”

But both the FBI and Garland Police have refused to confirm or deny that account.

Still Joiner is using that information as the basis for a possible lawsuit, accusing the FBI of allowing the violent plot to go forward.

“I think they allowed it to go too far,” said Joiner.

“They are responsible… they have an intentional tort on their hands,” said Trent Roberts, Joiner’s attorney.

Roberts said the government has stonewalled him about its undercover activities before the attack.

The FBI arrest affidavit stated that an undercover agent was tracking the terrorists for weeks even sending a text urging them to quote “tear up Texas.”

FBI Director James Comey said Garland was sent a bulletin three hours before the attack warning that someone could be on their way.

Joiner believes and may soon try to prove in court that the FBI could have stopped it but chose not to.

“I don’t know of any undercover agent that can allow their fellow officers and citizens to be fired upon in the course of an investigation you have to stop that before that happens,” said Joiner.

The Theory That the FBI Is Out to Get Clinton Is Becoming More Plausible


When Democrats reacted to FBI Director James Comey's letter to Congress about the sort-of-reopened investigation into Hillary Clinton's private server by accusing Comey of trying to meddle in the election on behalf of the Republican Party, the accusation seemed far-fetched. Comey was, until last Friday, generally despised by Republicans for his earlier decision to recommend against prosecuting Clinton. But while there's been of yet no evidence revealed that Comey himself has an ax to grind, a number of data points have emerged indicating the presence of a politically motivated anti-Clinton faction within the agency.

For one, leaks keep coming out of the FBI that are unflattering to Clinton. First there was the revelation that the Clinton emails the FBI is currently checking for classified info came from Anthony Weiner's computer. (A good rule of thumb is that no political candidate wants his/her name anywhere near a headline that also involves the notorious A-Weens.) Then there was a story on Fox News (and a much more measured one in the Wall Street Journal) about the existence of an investigation into potential corruption at the Clinton Foundation. And the FBI also tweeted about a document release related to Bill Clinton's controversial pardon of Marc Rich.



On a parallel track, there was a report Thursday in the Guardian about FBI agents actively supporting Trump:

“The FBI is Trumpland,” said one current agent ... The currently serving FBI agent said Clinton is “the antichrist personified to a large swath of FBI personnel,” and that “the reason why they’re leaking is they’re pro-Trump.”
Longtime Trump expert Wayne Barrett wrote Thursday in the Daily Beast, meanwhile, about the connections between Trump and the FBI. The FBI Agents Association—a unionlike 13,000-member group—has close ties to Rudy Giuliani, a top Trump surrogate, and Giuliani has said on Fox News that he's in touch with current agents who are upset about Comey's decision not to prosecute Clinton. A former agent named Jim Kallstrom has appeared on Fox several times saying the same thing; Kallstrom's Marine Corps Law Enforcement Foundation has received funding from Trump and the Trump Foundation, and one of its directors is Rush Limbaugh.

The Guardian piece notes that other sources besides its quoted agent "dispute the depth of support for Trump within the bureau." And Barrett is writing only about Trump allies making claims of connections to current agents; we don't know whether those connections are in fact as strong as Giuliani and Kallstrom make them out to be, or whether said agents are upset about the Clinton email situation specifically because they support Trump. Why We Should All Fear the Rot Inside the FBI

When a black church burned in Greenville, Mississippi, leaving charred walls and roof and the words “vote Trump” scrawled on the side of the building, local authorities called in the FBI. Its offices in Jackson, the state capitol, and Washington D.C. were put on the case.
The Federal Bureau of Investigation has been doing that kind of work for decades. It was the FBI, under pressure from Attorney General Robert F. Kennedy, that sent scores of agents to Philadelphia, Mississippi in June of 1964 to investigate the disappearance of three civil rights workers: Michael Schwerner, Andrew Goodman and James Chaney, who had themselves been investigating the firebombing of a black church that was to serve as a “freedom school,” in preparation for registering black Mississippians to vote. When the three men were found dead—lynched and discarded in an earthen dam—it was FBI agents who made the discovery, acting on an informant’s tip.
The FBI has had its dark days, too. It was the federal law enforcement agency, under director J. Edgar Hoover, that tried to harass Dr. Martin Luther King Jr. literally to death; and that infiltrated, sabotaged and set up members of the civil rights movement, anti-war movement, the Black Panthers, and more; from COINTELPRO to infiltrating and spying on groups opposed the 2003 invasion of Iraq. The most recent target of massive surveillance by the FBI: protest movements organized under the broad banner of Black Lives Matter, which collectively are aimed at reforming policing, to reduce often fatal violence against unarmed black civilians.

Americans have, at various times, leaned on the FBI for a measure of justice that local and state police couldn’t be counted on to deliver, and recoiled in fear at their exercise of raw federal power. That uneasy trust; the combination of need and dread, is the lot that FBI agents live with day to day.
The events of the past two weeks have made it all but impossible to have much faith in the FBI now. The agency has, through the actions of a minority cell of unknown size, been severely tainted, potentially dragging down the reputations of even the finest agents in its ranks.
After all, how can we trust the nation’s foremost federal law enforcement agency now that it has become clear that a faction of its agents used a conspiracy theory-hawking political book to launch a partisan probe into a presidential candidate?

Although he supported Bernie Sanders in the primaries, Michael Moore couldn’t allow himself to sit on the sidelines of the 2016 election. In September, over 11 days, he shot a secret documentary, “TrumpLand,” in an Ohio auditorium, urging voters to elect Hillary Clinton as the next president. And he’s been a vocal critic of Donald Trump on Twitter, blasting his policies and criticizing FBI director James Comey for trying to hurt the Democratic nominee by publicly re-opening an investigation into her email server.

Moore talked to Variety about “TrumpLand,” which is playing in theaters and iTunes, as well as the election.

When you made this movie, the word “TrumpLand” meant something else — it described the region of the country where you shot the film. Now people are using it as a code word for the FBI.  
Yeah, I saw that today. It was The Guardian that broke the story of the FBI agent inside, saying the agency was so pro-Trump and anti-Hillary, that they call it “TrumpLand.” I texted the guy at iTunes to see if there was an uptick [in my movie’s sales]. I think what Comey did was disgraceful.

Why?
The national police are trying to tip the election. It is one of the things that begins to happen when you have a real police state, which we don’t have yet. When you have federal police trying to affect the outcome of an election, trying to scare people into not voting for her, implying she’ll be under investigation for her entire term. You have a very dangerous situation. You have people trying to thwart democracy. The same thing happens when Trump says he may not accept the results of the election if it goes against him. The difference between liberals and conservatives is that liberals don’t think that way. Somebody said to me the other day, these theaters showing your movie should be showing another movie, it should be equal-time. I said, “You’re implying there’s right-wing art.” Go ahead, tell me the right-wing movies, the right-wing directors.

FBI Director James Comey’s 9.0-magnitude political earthquake, announcing in a vague letter to Congress 11 days before the election that new evidence of unknown importance had surfaced in the investigation of Hillary Clinton’s email server, has shined a bright light on the bureau’s unique role in Washington. Here are some myths about its culture and power.

MYTH NO. 1
The FBI isn’t political.
One of J. Edgar Hoover’s first acts when he became director of the FBI in 1924 was to clean house of the bureau’s political appointees — and ever since, directors have proudly bragged that the FBI is completely nonpartisan. It’s simply a “fact-finding agency,” Hoover often promised. This summer, Comey himself assured that the Clinton server investigation had been conducted “in an entirely apolitical and professional way.”


But while the FBI may technically be nonpartisan, it has long been one of the most politically astute institutions in the government. Its files have regularly been deployed as political weapons, from the 1948 election — in which Hoover backed Thomas Dewey over Harry Truman — to Watergate, where leaks from then-Deputy Director Mark Felt helped bring down Richard Nixon. Moreover, the bureau spent much of the 20th century as something akin to America’s “morality police,” shifting resources decade by decade to combat perceived threats to the nation’s social fabric, from Harlem Renaissance authors in the 1930s to antiwar activists in the 1960s to “deadbeat dads” in the 1990s. During his 48-year tenure, Hoover used the power of the traditionally conservative bureau to cozy up to powerful politicians and to bludgeon, publicly and privately, civil rights leaders, political dissidents, gays and especially communists.

Comey has made a point to try to stand against that era: FBI recruits visit the Holocaust Memorial Museum to understand, Comey has said, “in a palpable, nauseating and gut-wrenching way, the consequences of the abuse of power on a massive scale.” He’s ordered new recruits to learn about the bureau’s history with the Rev. Martin Luther King, whom Hoover tried to blackmail into giving up his efforts. But the bureau (and particularly its director) retains a black belt in behind-the-scenes political judo: It skillfully navigated the politics of the 9/11 Commission, halting a move to break it apart following its failure to prevent the Sept. 11 attacks. It uses its reputation for integrity, moral authority and justice to push presidents and lawmakers to back its programs and budget requests. Presidents know: You don’t want to be on your FBI director’s bad side.

MYTH NO. 2
The FBI director can’t be fired.
While many national security roles, such as CIA director, typically turn over at the beginning of a presidential term, the FBI directorship over the past 40 years has been seen as an apolitical post. Ever since director-for-life Hoover died in May 1972, FBI chiefs have been appointed to a congressionally mandated, nonrenewable 10-year term. When Comey’s predecessor, Robert Mueller, reached the end of that term, President Obama asked him to stay an additional two years — a move that required a special act of Congress.

But that fixed term doesn’t limit how or why a president can remove an FBI director, and, according to U.S. law, a firing doesn’t have to be “for cause.” When Bill Clinton took office in 1993, Director William Sessions was already under siege for mismanagement. A scathing 161-page inspector general report said he misused government transportation and engaged in other abuses of his office. Clinton, with the recommendation of Attorney General Janet Reno, fired Sessions outright after the director refused to resign.


MYTH NO. 3
The White House controls the FBI director.
The FBI is part of the Justice Department, so technically the director reports up through the attorney general and to the White House itself — which is why this summer’s “social” meeting on the tarmac at a Phoenix airport between Bill Clinton and Attorney General Loretta Lynch

Donald Trump's astonishing victory has turned the world of climate action upside down, setting back U.S. environmental policy and threatening the international drive to cut carbon pollution and slow global warming.

The stunning upset by Trump, who has routinely suggested that climate change is a hoax, threatens to unravel President Obama's climate action agenda, built on executive orders and regulations, including the Environmental Protection Agency's carbon clampdown at power plants. Trump has vowed to "cancel" the Paris climate agreement, but could cripple it by merely retreating from the U.S. commitment. As the world's second-biggest emitter of carbon dioxide pollution, the U.S. could render the global treaty meaningless, at a time when scientists are urging nations to quickly raise their ambition, or risk an escalating climate crisis.

Leading up to the election, the gulf between Trump and Hillary Clinton on climate and energy was wide and the stakes couldn't have been higher. But the campaign was not fought on those issues. And despite environmental groups pouring an enormous amount of money and people power into the race, they were unable to break through with the message that climate action is urgent.

The result sent shockwaves through the global climate talks now happening in Morocco, known as COP 22, that aim to turn the Paris agreement's promises into action. Many there expressed deep concern and disappointment.

"We are all stunned at the COP," said Saleemul Huq, a climate expert at the International Institute for Environment and Development. "No one had anticipated this result, and hence there was no plan B. We will have to think about what happens next."

In another disappointing outcome for climate advocates, Republicans maintained their control of the Senate, winning eight of 11 key races, as well as keeping their majority in the House of Representatives. Both chambers are strongly opposed to climate action policies.

The nation's climate leaders were left stunned, somber, angry and reflective. They had already prepped their wish lists for Clinton that included a massive clean energy spending program, a moratorium on fossil fuel leases on federal lands and other rules to curb the coal, oil and gas industry's impact on the atmosphere and water.

Most environmental groups had backed the Democratic nominee, despite reservations among progressives about her all-of-the-above energy approach. In her, they believed they had a leader who understands the risk of climate change and respected the science. Clinton had been challenged from the left by her primary opponent, Sen. Bernie Sanders, but climate activists were confident they would have been able to influence her policy and push her to further commitments to action. Most of all, she wasn't Trump.

Now, with little chance to have their agenda heard in Washington, environmental groups will be forced to play defense. At first, that will mean an effort to block Trump's plans, perhaps by convincing Senate Democrats to block appointments or use the filibuster. Legal challenges are another avenue, but Trump will be able to quickly make his mark on the judiciary, with his appointment of a Supreme Court justice.

Trump has signaled plans to populate his cabinet with oil industry executives and allies, to eliminate the EPA, and to cut all federal spending on the United Nations climate process. Trump has claimed that he will save $100 billion over eight years, which appears to be based on a plan to end federal funding for solar and wind energy, efficiency, batteries, clean cars and climate science, wrote Joe Romm, a former Energy Department official and founder of the Center for American Progress' Climate Progress blog.

Basically, Trump has promised an America-first, drill-baby-drill energy policy. He has promised unfettered production of coal, oil and natural gas and to "bring the coal industry back 100 percent."

Trump said he will rescind any regulations that unduly burden energy development, including the Clean Power Plan, which, if it survives legal challenges, was to have been the cornerstone of Obama's climate action legacy and the main policy for realizing the nation's Paris goals. He also said he would abolish the Waters of the U.S. rule, which the fracking industry in North Dakota has opposed. Trump said he would urge TransCanada to renew its permit application for the Keystone XL pipeline. Within his first 100 days, Trump said he would lift moratoriums on fossil fuel production in federal areas, which could clear the way to new coal leasing in the West as well as coastal oil drilling, not only in the Arctic but also the Atlantic and potentially, the Pacific.

November Cases and the Continued Search for the Evolving Standards of Decency in Criminal Punishment
Ross Parker was chief of the criminal division in the U.S. Attorney’s Office in Detroit for 8 years and worked as an AUSA for 28 in that office.

With only a pair of criminal cases on the Oral Argument docket in November, the Court will primarily focus on civil and administrative cases. One of the criminal cases, Beckler v. United States, involves a question of interest probably only to some prosecutors and judges: whether the career offender sentencing guidelines defining a “crime of violence” warranting a sentence enhancement is unconstitutionally vague. The Court last year invalidated a similar clause (violent felony) in the Armed Career Criminal Act on that ground.

The other case, Moore v. Texas, involves yet another 8th Amendment Cruel and Unusual Punishment issue on the permissible medical standards for intellectual disability regarding a defendant’s fitness for execution.  The case involves another question which will probably not be resolved because of the absence of a Justice to fill Antonin Scalia’s seat. That question is whether long term solitary confinement on death row is itself unconstitutional as cruel and unusual.

In 1980 Bobby James Moore, age 20, shotgunned a grocery clerk to death in a robbery attempt. He was convicted and sentenced to death. Since that time he has spent more than 35 years in solitary confinement in a 60 square foot iron cell for 22 and ½ hours a day. He has no TV or association with other inmates. The medical and psychological effect of this kind of incarceration has been studied extensively, and some of the results show a deterioration ranging from mild mental disability to psychosis. In short some experts consider this to be a modern version of torture.

But can the time expended on repeated postponements caused by the defendant’s own pursuits in the Byzantine appeals process in capital cases be equated with government “torture?”

Secret Service Slammed
for IT Management Problems


The Secret Service has computer systems that are neglected and rife with bad management, according to a report by the Office of Inspector General (OIG) at the Department of Homeland Security.

The OIG launched an investigation into the Secret Service after employees breached the computer systems and leaked personal information about Rep. Jason Chaffetz, R-Republican, in retaliation for investigating agents’ misconduct, the Washington Post reports.

“Despite past warnings, USSS (U.S. Secret Service) is still unable to assure us their IT systems are safe,” Chaffetz said, citing the report.

The problems went well beyond the Chaffetz case.

According to the report, the “audit uncovers a myriad of problems with Secret Service’s IT management including inadequate system security plans, systems with expired authorities to operate, inadequate access and audit controls, noncompliance with logical

Donald Trump has said climate change is a Chinese hoax. His presidency raises the prospect of a climate denier atop the Environmental Protection Agency and an oil and gas billionaire running the Energy Department. He could pull the U.S. — and its 15 percent of all global carbon emissions — out of the Paris Agreement.

This information has made his supporters happy and his detractors furious. This information also matters not one iota to the climate.

FEW COMMENTATORS seem to understand the potential for a Donald Trump presidency to profoundly undermine American democracy. In his Nov. 9 column (“Shocking, yes. Dictatorship? No.Jeff Jacoby argues that the new president will be held in check by “entrenched constitutional prerogatives.” Not necessarily.

Many of Trump’s campaign proposals are clearly unconstitutional — for now. But Trump will have the opportunity to choose at least one or more new Supreme Court justices. It seems clear that these choices will make the late Justice Antonin Scalia look like a centrist on the issue of executive power.


With a new Trump-picked Supreme Court in place, what is unconstitutional today could easily become standard administration policy tomorrow. This is just one of many changes that will mark the end of the American era.

“The Bering Sea has been off-the-charts warm. We’ve never seen anything like this. We’re in uncharted territory. We’re in the midst of an extraordinary time.” Nate Mantua, an ecologist at NOAA’s Southwest Fisheries Science Center in Santa Cruz, California in this National Geographic article.

Some have claimed that the effects of global warming are only gradual and mild. That the impacts to the Earth’s weather systems, its oceans, its lands, its web of life do not now represent a crisis that risks global catastrophe and mass human tragedy. That, somehow, the growing die-offs now inflicted on key species amounts to some kind of pleasantly quiet background noise that we should rationally, coldly, consider, but that should not increase our level of concern or, perish the thought, alarm. And when the very real harms that are now escalating as a result of climate change are realized more fully by human civilization, the fact that these voices did not warn us more strongly, that some of these voices attacked those of us who were rationally concerned, will stand in history as stark evidence to the harms of pandering to the false comfort of an unwarranted reticence.

If they could speak, a lovable breed of northern bird would tell us their own tale of tragedy and loss at the hand of global heat. And if we could hear the sad tale of their own great plight, our hearts and minds might not be so hard or so cold. For in and near the Arctic there is every indication that winter is dying and along with it, the Puffins.

Mass Puffin Die-Off Underway

Northern waters are rich with life. Or they were, at least, until recently. High oxygen content, cold water, high nutrient content all help to form a basis for the teeming life of this region. However, as atmospheric carbon levels increase and as oceans warm, these waters become less able to support life. They hold less oxygen. They become more acidic. And they tend to become more stratified. The food chain is disrupted and winnowed down. And such a winnowing can have a terrible impact on all kinds of life forms.

For the Puffin, such ocean warming related food losses have become a subject of growing alarm among researchers. In the Bering Sea between Alaska and Russia, both National Geographic and Digital Journal have compiled reports of severe loss of life to both adult birds and young. In parts of the Bering sea, adult Puffins are dying at 200 times the normal mortality rate. Nesting rates, normally at 60 percent, have plummeted to 12 percent. And the few chicks that do manage to hatch from eggs are emaciated.

Over on the Atlantic side, a similar mass die off of Puffins has occurred in the Gulf of Maine even while stresses to the birds have been increasing into Scotland, the Barents Sea and Iceland. Die offs further south in Maine began to become widespread during 2014 as the waters off the US East Coast hit extreme levels of warmth. By 2016, the mass mortality had extended to Iceland where more than 80 percent of Puffin chicks were reported dead.

To researchers, there’s no mystery as to what’s killing the birds. They’re starving. But the root cause of the great loss among Puffins is even more disturbing. Julia Parrish, a University of Washington professor who coordinates a West Coast volunteer bird-monitoring network noted to National Geographic:

“Clearly something very weird is going on. It’s basically every year now we’re getting some huge mass-mortality event. It seems that the bottom-up changes provoked by the atmosphere are creating massive, massive changes in marine ecosystems. And the forage fish that everything depends on are taking it in the shorts.” (Emphasis added)

In other words, the fish that Puffins feed on are dying due to global climate change and so the Puffins are dying too.

Conditions in Context — We All Rely on Bountiful Oceans

If we are unable to escape the stresses of our own lives, or step back from our own individual difficulties to take account of the larger trajectory of our race, the plight of Puffins starving in the North Atlantic or Bering Sea may seem a remote or minor concern. However, when one realizes that, like the Puffins, human beings also rely on the bounty of the oceans as a primary food source, the matter strikes much closer to home. And in this case, Puffins join a long list of ocean-dependent wildlife — corals, seals, fish, polar bears, walruses, lobsters and so many more — who are sending us an increasingly loud warning as they perish.

Life in the world’s waters is in peril due to the warming we are causing. And because life on land is ultimately connected to what happens in the waters, not paying attention, not responding to what’s happening by halting the fossil fuel emissions that have created this terrible extinction pressure, is a wretched road to follow.

November 3, 2016: Apologies in advance for such a stress-inducing headline, but let’s talk about the 900 pound orangutan in the room: What if we wake up on Wednesday to Donald J. Trump as president elect of the United States of America?
 
Since everyone is on pins and needles about it, let’s have this conversation.
 
The first thing: Life as we knew it and expected it to unfold will never be the same. American fascism will have arrived and the worst, most violent elements in society will feel emboldened to harm everyone they consider as “the other” with impunity. The burning of the Hopewell Missionary Baptist Church in Greenville, Mississippi this week by Trump supporters is merely the opening salvo. The internal conflict within the FBI in public view right now will afflict every police agency, federal, state and local, as openly authoritarian elements attempt to seize control. Hate crimes will rise against women, people of color and the LGBT communities precisely as law enforcement turns a blind eye to much of it. Look for entire new demographic groups to be targeted, too: Those 20 million who newly have health care, many of whom had preexisting conditions, people living with disabilities and others will be added to the list of national scapegoats. The attempt to repeal Obamacare will be a literal death sentence for many of us.
 
Those of us who have lived in countries under authoritarian rule have spent recent months having our own conversation about what is happening in the USA. We do it in whispers because most of you will not believe us no matter how loudly we shout about what a Trump election would bring down the ‘pike. We shake our heads and feel a great wave of pity for most Americans who have no idea what tyranny really looks or feels like. Tyranny – contrary to popular myth – is asymmetric. It hits from all sides, crevices, nooks and crannies, from the dark places, the shadows. The figurehead’s power above merely provides it cover. It has the same paramilitary logic of what was endured in Latin America’s dirty wars and the dictatorships across the sea that gave rise to the Arab Spring. When Donald J. Trump praises strongmen leaders across the globe he is giving his “tell” of how he would govern – with a clenched fist.
 
Worse, the response from that part of America that defines itself as “the left” (I am speaking of the white and academic “left” since so few organized people of color are foolish enough to claim an already discredited mantle) is totally unequipped to address it yet they will attempt once again to place themselves at the vanguard of resistance without any lived experience leading an actual resistance, much less winning one. Senator Sanders’ “Our Revolution” PAC will seek to fundraise off every injustice as aggressively as it has over the Native American resistance to the pipeline in the Dakotas. The remnants of “Occupy” now under a thousand new names will call for demonstrations without guidelines, training or discipline and that in the name of “diversity of tactics” allow any asshole who wants to call himself “Black Bloc” to don ski masks and toss trash cans through store windows. President Trump is gonna love those demonstrations because it will allow him to sell all kinds of repression to his base. White men will vault to the front of these groups saying, “follow me!” Yet they have not a clue as to how a real movement is built or won. They feel entitled to it anyway. It will be more of the same attempts to re-center whiteness and maleness with the cheerleading of Jacobin magazine, some writers at The Nation, Democracy Now and Reddit dudebro forums.
 
The election of Trump will mark the exact moment of failure of manhood in America. The only possible new leadership will have to come from women, especially women of color, who already live in Trump’s America and have more experience navigating such a world, far more than we guys can learn in the short time we’ll have to build an authentic resistance. Mexican-American and Muslim-American women will be the first hit and instead of letting the dudebro aspirants set the tone it will be up to all of us to follow those women into battle instead.
 
The only authentic resistance to the policies of a Trump presidency will make nonviolence its watchword, and unapologetically so. To participate, you’re going to have to get training in nonviolent civil resistance. I’m not speaking of the “express trainings” by dudebro groups like “Democracy Spring” with fawning celebrity dilettantes like Susan Sarandon and Tim Robbins, but, rather, sessions that last a minimum of eight hours or, ideally, an entire weekend or more and are led and organized by women of experience at it and especially women of color.
 
Many of these will have to take place in Mexico, which will take on a special role as a Trump-free zone with the support of the general population. Learning Spanish would be a real good idea for any American who really wants to chase dictatorship back down its rabbit hole.
 
The resistance will not be led by the Green or Libertarian Parties, “Occupy” activists or any similar fringe: Their brands of “leadership” are what got us into this mess in the first place.
 
The revolution will be authentically multi-racial, a true partnership, women-led and nonviolent or there will be no chance of success at all.
 
Finally, we’re going to have to say goodbye to some former “allies” who spent this election dragging down the one woman who stood in the way of a Trump presidency. I can say, for example, that the School of Authentic Journalism we hold in Mexico won’t ever be inviting any of them down: that would disrespect our Mexican hosts whose families will bear the biggest brunt of an America under Trump. (Thankfully, out of five hundred to whom we have given scholarships over the past thirteen years, only three have jumped that shark, and one just loudly recanted, begging people to disregard every asinine thing he’s written over the past year about this election! That happened today.)
 
Me? I’m ready to play an auxiliary role in a women and women of color-led resistance to a Trump’s America. They’re the only reason we have a candidate with a chance of defeating him on Tuesday. They’ve saved America once already this year. It’s time for us boys to start taking orders instead of barking them while wagging our finger at the gals. And it’s the only possible guarantee against Trumpism infecting the movement against his policies. Real men – like President Obama – will know just how to play that supportive role. He’ll be doing it from an organizing academy out of the coming Obama Museum in Chicago – and win or lose this election I expect to see y’all there, too.
 
If you’re reading these words and thinking, “Gee, Al makes it sound so much fun, maybe we need a Trump regime to kick our asses!” Nope. Millions of lives will be ruined, many ended prematurely. One of them might be yours. People you love will be crushed under it. This scenario is the most un-fun thing imaginable. And the chances of success will be greatly stacked against us. The American people are not prepared to be soldiers in a nonviolent war to reclaim the country. It would take decades, probably generations, to turn back the tide. In the meantime, there will only be pain and suffering.
 
Americans have it pretty damn good today. That’s why people from all the other lands want to come and live and work in it. Don’t blow it, America, out of a misguided and purely academic theory that things have to get worse before they can get better. That’s children’s talk. And history has never happened that way.
 
If you don’t like the truths I’ve just thrown at you, there are still four days of phone banking, door knocking, data entry and driving people to the polls left to make for a different and better reality, one in which fascist law enforcement agents don’t run amok and where black churches and Muslim and Jewish and Spanish language temples don’t get regularly burned to the ground. I can think of no clearer imagery to visualize what a Trump presidency would be like. Forewarned is forearmed. Vote. The country – and world – you live in will be decided on Tuesday.

Parkinson, a former FBI special agent and Iraq war veteran. More than a half century later, John F. Kennedy’s assassination still resonates not only because of its historical importance but because the investigation was more a cover-up than a pursuit of truth, says researcher Gary Aguilar.

November 22 marks the 53rd anniversary of John F. Kennedy’s assassination. If history is any guide, it’s likely some mainstream outlet will commemorate that dark day with reassurances that the Warren Commission was right that Lee Harvey Oswald did it alone, and that most doubters, who have been in the majority since the mid-1960s, are randy conspiracy theorists. That is the essential message by one of the experts likely to be cited this year, attorney Howard Willens.

One of the few still-living Warren Commission staffers, Willens followed up his 2013 book, History Will Prove Us Right, with a spirited defense of the Commission in the summer, 2016 issue of the journal, The American Scholar, which he co-wrote with another Commission staffer, attorney Richard Mosk. The piece, “The Truth About Dallas,” is a celebration of the work and conclusions of the original investigation.

But Willens’s and Mosk’s defense of the work of the Warren Commission they served on is more notable for what they omit from the official record than what they include. “What the critics often forget or ignore,” they write, “is that since 1964, several government agencies have also looked at aspects of our work,” (p. 59) as if the Church Committee and the House Select Committee on Assassinations (HSCA) had reviewed and applauded the Commission’s work.

Indeed, they did look at it. But rather than plaudits, they issued stinging rebukes, principally for the Commission’s having been rolled by FBI Director J. Edgar Hoover, and to a lesser extent, by the CIA and the Secret Service.

“It must be said that the FBI generally exhausted its resources in confirming its case against Oswald as the lone assassin,” the HSCA concluded, “a case that Director J. Edgar Hoover, at least, seemed determined to make within 24 hours of the of the assassination.”

In essence, the experienced investigators concluded that Hoover had divined the solution to the crime before starting the inquiry, and then his agents confirmed the boss’s epiphany. The intimidated Warren Commission went right along.

And with good reason, only part of which Willens and Mosk tell. They admit that the “FBI had originally opposed the creation of the Warren Commission” and that Hoover “ordered investigations of commission staff members.” But they don’t tell that Hoover deployed one of his favorite dirty tricks to deal not only with support staffers, such as Willens and Mosk, but also with the commissioners themselves.

“[D]erogatory information pertaining to both Commission members and staff was brought to Mr. Hoover’s attention,” the Church Committee reported. (emphasis added)

Willens and Mosk also forgot to mention that Hoover had a personal spy on the Warren Commission, then Rep. Gerald Ford, who tattled on Commissioners who were (justifiably) skeptical of the Bureau’s work.

“Ford indicated he would keep me thoroughly advised as to the activities of the Commission,” FBI Agent Cartha DeLoach wrote in a once secret memo. “He stated this would have to be done on a confidential basis, however he thought it should be done.”

At the bottom of the memo, Hoover scrawled, “Well handled.” The success of Hoover’s machinations was obvious to subsequent government investigators. (Ford, of course, later became President upon the resignation of Richard Nixon in 1974.)

The HSCA’s chief counsel, Notre Dame Law Professor Robert Blakey, a criminal investigator and prosecutor with vastly better credentials than either Willens or Mosk, was impressed with neither the Commission’s vigor nor its independence.

“What was significant,” Blakey determined, “was the ability of the FBI to intimidate the Commission, in light of the Bureau’s predisposition on the questions of Oswald’s guilt and whether there had been a conspiracy. At a January 27 [1964] Commission meeting, there was another dialogue [among Warren Commissioners]:

“John McCloy: ‘… the time is almost overdue for us to have a better perspective of the FBI investigation than we now have … We are so dependent on them for our facts … .’

“Commission counsel J. Lee Rankin: ‘Part of our difficulty in regard to it is that they have no problem. They have decided that no one else is involved … .’

“Senator Richard Russell: ‘They have tried the case and reached a verdict on every aspect.’

“Senator Hale Boggs: ‘You have put your finger on it.’ (Closed Warren Commission meeting.)” [Blakey & Billings, Fatal Hour– The Assassination of President. See also: North, Act of Treason]

Testifying before the HSCA, the Warren Commission’s chief counsel J. Lee Rankin shamefully admitted, “Who could protest against what Mr. Hoover did back in those days?” Apparently not President Lyndon Johnson’s blue-ribbon commissioners.

The HSCA’s Blakey also reported that “When asked if he was satisfied with the (Commission’s) investigation that led to the (no conspiracy) conclusion, Judge Burt Griffin (a Commission staff member) said he was not.” [Blakey & Billings, Ibid.]

And author Gus Russo reported that Judge Griffin also admitted, “We spent virtually no time investigating the possibility of conspiracy. I wish we had.” [Russo, Live by the Sword]

Clear Misgivings

Thus, despite their clear misgivings, the Commissioners bowed to the imperious FBI chief rather than conduct a thorough investigation. Notably, the Commission never once employed a rudimentary investigative tool. “The Commission,” the HSCA reported, “failed to utilize the instruments of immunity from prosecution and prosecution for perjury with respect to witnesses whose veracity it doubted.” [US Cong. House of Reps. Report of Comm. on Assassinations, 1979]

This policy had serious repercussions when the Commission confronted two key issues: published claims that Lee Harvey Oswald had been an FBI informant, and the possibility that Jack Ruby was mobbed up.

“The Commission did not investigate Hoover or the FBI, and managed to avoid the appearance of doing so,” the HSCA determined. “It ended up doing what the members had agreed they would not do: Rely mainly on the FBI’s denial of the allegations (that Oswald had been a Bureau informant).”

Hoover merely sent the Commission his signed affidavit declaring that Oswald was not an informant and also “sent over 10 additional affidavits from each FBI agent who had had contact with Oswald.” And with that, case closed.

Regarding Jack Ruby, the FBI had his phone records, yet failed to spot Ruby’s obvious, and atypical, pattern of calls to known Mafiosi in the weeks leading up to the assassination. After performing the simple, obvious task of actually analyzing those calls, the HSCA determined that, if not a sworn member of La Cosa Nostra, Ruby had ongoing, close links to numerous Mafiosi.

Thus the HSCA roundly rejected the Warren Commission’s conclusion that, “the evidence does not establish a significant link between Ruby and organized crime.”

The list of Warren Commission shortcomings that the HSCA assembled is not short. A brief summary of them runs some 47 pages in the Bantam Books version of the report (p. 289–336), which outlines what required much of the 500 pages of HSCA volume XI to cover (available on-line).

“The evidence indicates that facts which may have been relevant to, and would have substantially affected, the Warren Commission’s investigation were not provided by the agencies (FBI and the CIA). Hence, the Warren Commission’s findings may have been formulated without all of the relevant information.”

The Church Committee said that the problem was that “the Commission was perceived as an adversary by both Hoover and senior FBI officials.” “Such a relationship,” the Committee dryly observed, “was not conductive to the cooperation necessary for a thorough and exhaustive investigation.”

But the FBI did more than just withhold evidence from the Commission. Although they admit that the FBI destroyed a note Oswald wrote to Agent Hosty, and withheld that information from the Commission, Willens and Mosk don’t mention that Agent Hosty reported that his own personnel file, and other FBI files, had been falsified. Nor that author Curt Gentry learned from assistant FBI director William Sullivan that there were other JFK documents at the Bureau that had been destroyed. [Gentry, J. Edgar Hoover– The Man and His Secrets]

Perhaps one of the reasons the public has remained mistrustful of the government’s conclusions, and the mainstream media reassurances, is the sort of selective presentation of evidence by ax grinders like Willens and Mosk who get heralded by our “responsible” media.

Gary Aguilar is one of the few physicians outside the government ever allowed to see the still-restricted JFK autopsy photos and X-rays. He has published and lectured on the topic of the JFK assassination for many years.

Fast and Furious:Time
for decisive action

“Silence in the face of evil is evil itself. God will not hold us guiltless. Not to speak is to speak. Not to act is to act.” 

That soul-searching quote by the German Lutheran pastor, anti-Nazi dissident and martyr Dietrich Bonhoeffer hopefully will now serve as a clarion call – finally – for decisive action regarding the illegal weapons-running debacle known as Fast and Furious that left hundreds of dead in its wake, including Border Patrol agent, former police officer and Marine veteran Brian Terry.



As relayed previously, Brian Terry had reported corruption associated with government personnel regarding weapons-running. A source who was a close friend of Brian’s stated during a recent conversation that Brian described how he discovered some of his government co-workers were getting paid by not just a cartel but the Sinaloa Cartel.
Agent Terry confronted the government authorities, calling them out regarding their actions. He was cautioned by them to get involved or else “watch his back.” 

When he asked them to explain what they meant, they warned him there would be a “bounty on his head.” On that fateful night Agent Terry was called to respond to alleged ground sensor activity in the proximity of Peck Canyon, he confided in his friend, “I don’t think I’m coming back.” 

As was reported on her Sunday show, “Full Measure,” the esteemed investigative journalist Sharyl Attkisson – one of the first to break the Fast and Furious story - reports on illegal activity she uncovered regarding Customs and Border Protection officers on the take – corrupted by drug cartels and human traffickers. Some of the questions which need to be answered:

- Was Brian Terry wearing his bulletproof vest or not? This is relevant in determining the type of round that killed Brian. There is conflicting testimony and facts surrounding this important question.

- Why won’t the Government provide Brian Terry’s vest for the family to examine? The family has repeatedly requested this critical piece of evidence.

- Why was Brian Terry placed in a Border Patrol vehicle for transport to a local fire department instead of calling in a MEDEVAC helicopter, as would normally be standard procedure with such a grave wound? Again, the family simply would like an answer.

- Was Brian Terry shot with a 9mm round or with a 7.62mm (AK-47) round? If it were a 9mm round, from what weapon was it discharged? Again, there is conflicting information, and the family is still requesting clarification.

- Why hasn’t the family been provided data from the ground movement sensors collected the night of December 14, 2010? This data would confirm the alleged foot traffic of the illegals who Brian was sent out to interdict and who allegedly killed him.

- Why did it take the Government over four and one half years to return the personal cell phone of Brian Terry? When the family queried the FBI Tucson office, they were told it was “overlooked” in Brian Terry’s vest (the same vest the family is asking to examine).

- What legal justification was used by the Government to search and ransack Brian Terry’s residence after his murder, removing all electronic devices? The family was told Brian’s residence was not a crime scene.

- Why wasn’t the House Oversight and Government Reform Committee provided the three emails Agent Brian Terry wrote to the National Border Patrol Council, the union which represents Border Patrol agents? The family was told this would happen years ago, yet Kent Terry received a call earlier this year from Rep. Jason Chaffetz stating the Committee never received nor knew of the subject emails.

- Was Operation Fast and Furious part of a larger, international weapons sales program?

- Have both the House Oversight and Government Reform and Senate Judiciary Committees requested and/or subpoenaed the above? If not, why not?

Sources who have been willing to talk and have offered to assist both the House Oversight and Government Reform and Senate Judiciary committees have relayed previously undisclosed insights into the gun-running operation: “One of the safest and most secure ways contacts and those with them would run the guns and other military-related equipment into Mexico was as if out of a movie plot.

Once they became friends with the informants and the suspected ‘dirty’ ATF agents, gaining their trust, it became easy for them to purchase, run and deliver large loads of weapons.

Several of the contacts, along with the informants and an ATF agent or two, would drive toward the Arizona-Mexico border in Nogales, following each other in their own vehicles. They would go to specific locations at the border fence at which large holes were cut. They didn’t use simple plyers or a hacksaw; no, they had a much more sophisticated tool. They utilized plasma cutters. 

At precise locations, they would cut holes in the border fence with plasma cutters, enabling them to run weapons through quickly. An even more telling aspect was some with another U.S. government agency were integrally involved in this weapons-running operation: The U.S. Border Patrol.

Some agents in U.S. Border Patrol, in their vehicles, would routinely take tactical positions up on a small hill overlooking the gun-running operation across the border. These Border Patrol agents would provide surveillance and be ready to alert the ATF agents and others, should the need arise. These agents were routinely the ‘eyes’ for this aspect of the Fast and Furious operation, providing combat overwatch in effect.

A significant fact people, including the press, didn’t know was the contacts, agents and the informants would pass through the plasma cut hole in the border fence the weapons and military-related equipment to the cartel member(s) on the Mexican side of the border; the cartel member(s) would pass back through to the U.S side cash and drugs. This cash and drugs – marijuana and cocaine mostly - would be specifically used to purchase even more weapons.

Another way weapons were run across the border was in tool boxes. They would break down the guns and mix the gun parts up in the many draws or compartments in a large, red tool box.

They had many of the gun parts hidden in plain sight. Other parts, such as the stocks, they had hidden in the back area of the tool box. To get access there, one would have to pull out all the draws. They had the magazines and the clips under the draws, utilizing a space between the bottom of the draw and the sheet metal that was the shelf between each draw.

An additional way weapons were secreted across the border was where one contact would sneak over into Mexico, near Nogales or Lukeville, AZ, and the other would stay on the American side of the border.

They used cheap, two-way radios they bought at Walmart to communicate. When they were right across from each other at the border, the contacts on the U.S. side would through a rope over, and then they would proceed to tie a box full of the gear and weapons to the rope. The other contacts in Mexico would pull it over into Mexico.

The contacts stated they needed to do this rather quickly due to sensors that would alert the U.S. authorities. Border Patrol would never get there in time. The contacts would be long gone and the weapons were delivered to the designated cartel member(s) or gang(s).”

Considering the above, one must inquire as to why haven’t investigations to date regarding Fast and Furious focused on the very group of people agencies in the Executive Branch leveraged and/or exploited to affect the weapons-running associated with the operation? Sitting down with a former Member of the House of Representatives in the early afternoon of late November 2014, this former Member informed me, “House leadership was squashing the investigation into Fast and Furious.”

Again, one must inquire as to why? It is somewhat reassuring, however, to hear from sources that the Department of Justice Office of Inspector General (DOJ OIG) in the southwest has, perhaps, very recently started the process to reopen the investigation into Fast and Furious.

Having myself suffered a physical attack on the night of March 22, 2015 during which the attacker cautioned me, “Obviously, you aren’t getting the message. Keep your [expletive deleted] mouth shut,” it is understandable why some – perhaps many – have chosen to remain silent out of fear for their careers, their pensions, themselves and/or their families. 

The next morning this attack was officially reported to the local police and then to the FBI. This event, contrary to the intended result, perhaps, redoubled my desire and efforts to do all I could to ensure truth, accountability and justice were realized – including potential Department of Defense and defense contractor(s) nexus.

After privately meeting with Kent Terry and his sister, Michelle Terry-Balogh, following his primary victory in Michigan, President-elect Donald Trump, who was surprisingly well versed on Brian Terry, promised to take decisive action, assuring the Terry family answers and closure. In all of this there are more questions than answers; more people willing to “Let ‘em through” than to thoroughly investigate and more hollow words than meaningful action. 

Witnesses exist, President-elect Trump, who are willing to share their information with government authorities, but currently it seems there’s no one there to listen.

Hopefully, on January 20, 2017 you will become that decisive action the nation and the long-suffering Terry family have so patiently waited for.

Two researchers affiliated with Stanford University have asked the federal district court for the Northern District of California to unseal multiple requests made by law enforcement authorities for technical assistance from private parties in association with electronic monitoring and surveillance activities.  The researchers are attempting to analyze the scope of law enforcement reliance on technical assistance from private parties for electronic surveillance.  Their ultimate goal is reportedly to provide the public with greater visibility into the extent to which technology companies and other private organizations are compelled by law enforcement authorities to facilitate and to conduct electronic eavesdropping activities.

The researchers note that a substantial number of court cases now involve some form of electronic surveillance, monitoring or content access.  They contend that, in many of those cases, law enforcement authorities request assistance from private parties or compel those private companies to facilitate, enable or conduct the necessary electronic activities.  The researchers note, however, that there seems to be little publicly accessible information regarding the scope of those activities or the interaction between the government authorities and the private parties involved, as many of those requests are made under seal and thus shielded from public disclosure.

Four Texas women known as the "San Antonio 4" were declared innocent Wednesday after they served nearly 15 years for child sex crimes they did not commit.

The majority opinion issued by Texas Court of Criminal Appeals states that Elizabeth Ramirez, Kristie Mayhugh, Cassandra Rivera and Anna Vasquez did not sexually assault two young girls, and as a result the four women could become eligible for millions of dollars in state compensation.

"We can't believe it!" Vasquez said, reacting to the ruling on Wednesday, according to News 4 San Antonio.


"It's going to be a very good Thanksgiving for all four of them," said lawyer Mike Ware of the the Innocence Project. "The court has issued a very well-reasoned and excellent opinion. Really a courageous opinion."

Ware said he will ask the court to quickly issue a formal mandate, after which the women would be able to file a claim that could pay each of them $80,000 for each year spent in prison.

The "San Antonio 4" were convicted in 1998 after two of Ramirez's nieces, ages 7 and 9, accused them of sexually assaulting and threatening to kill them four years earlier. Ramirez was sentenced to at least 37 years in prison, and the other three received 15 years.

Massachusetts trooper convicted of punching girlfriend gets probation

SALEM, Mass. — A suspended Massachusetts state trooper who was convicted of punching his former girlfriend in the head has received probation.

A Salem Superior Court jury convicted Thomas Downs of assault and battery Tuesday after a five-day trial.

Prosecutors said the victim was attempting to leave the Salisbury home she shared with Downs on Feb. 22, 2015, when he blocked her car from leaving and punched her in the head several times. She suffered multiple contusions.

When several investigators approached Sanford police Chief Cecil Smith earlier this year about violent activity they were seeing in the city, the veteran law enforcement officer had an idea about who might be able to help stop it: The feds.

He couldn't have predicted, though, that his idea would eventually prompt the U.S. Attorney's Office in Orlando to create a special prosecution unit aimed at ridding Central Florida of violent criminals.

Or that it would lead to partnerships for other local law enforcement agencies throughout the area.

Smith said his investigators had noticed there were a few small groups of people involved in the majority of violent crimes in Sanford. Some had been arrested before, but they rarely stayed off the streets for long.

"One of the big problems we were having was getting the prosecutions done and getting the longer jail sentences," Smith said.

Smith needed help getting the most dangerous suspects out of the community.

So, he reached out to Roger Handberg, chief assistant U.S. Attorney in Orlando, and the Bureau of Alcohol, Tobacco, Firearms and Explosives about working together on some of the cases that might involve a federal crime. He then contacted Seminole-Brevard State Attorney Phil Archer's office and everyone decided it'd be in their best interests to start working together.

Several months and 65 arrests later, Sanford officers had recovered 56 guns and the U.S. Attorney's Office had charged four people with federal gun crimes. The other 61 suspects faced various state charges and as of earlier this month, more than 20 have already been sentenced.

Handberg said the partnership was working so well it only seemed logical to keep it going, and to open it up to other agencies in Central Florida. He assigned four prosecutors — unofficially dubbed the "gun unit" — to focus on crimes involving firearms and especially dangerous criminals.

In May, the unit reached out the Orange County Sheriff's Office and Orlando Police Department about partnering, and during the past few months have been working on cases with Volusia County officials. Handberg said the number of gun-crime prosecutions his office has done this year is already up more than 50 percent over last year.

'Long-term problem' arrested

Jesse Ingram has been arrested more than 40 times in Florida on charges ranging from aggravated assault with a weapon to shooting into a vehicle, but has spent no more than three years in state prison after a burglary arrest in the early 2000s, records show.

The 34-year-old Apopka resident is a registered felon and accused street gang leader who has several times been accused of illegally carrying a weapon, Orange County court records show. More than once, though, including after an arrest in January 2015 when he was accused of threatening and trying to bribe a witness into not testifying against him, prosecutors ended up dropping the charges.

"Over 40 times, he had been in-and-out of the state system and every time he would be back," FBI Supervisory Special Agent Justin Crenshaw said. "...He was a real long-term problem for Apopka PD."

And, he's the exact type of person Crenshaw said officials are hoping the gun unit will remove from the community.

On this past Monday evening, outside of a Dollar General Store in Charleston, West Virginia, 15-year-old James Means, was shot and killed by William Ronald Pulliam, 62, police said.


Means, like Emmett Till and Jordan Davis and Trayvon Martin before him, did nothing to ever even warrant a confrontation from Pulliam. Witnesses claim that what set Pulliam off was that Means accidentally bumped into him while entering the store.

After Pulliam left the store, the two exchanged words a second time, and Pulliam shot the teen twice in the abdomen, leaving him to die, then proceeded to go home, eat dinner, then go hang out at a friend's house, according to a criminal complaint.

A judge tossed a lawsuit Thursday brought by an Upper West Side high school teacher who said she was fired for teaching her class about the Central Park Five.

English teacher Jeena Lee-Walker had said in her suit that administrators at High School for Arts, Imagination and Inquiry railroaded her after she talked to students about the controversial case.

Her bosses asked the lessons on the Central Park Five should be more “balanced” and worried they could “rile up” black students” and cause “riots,” she alleged in her suit.


But Manhattan Federal Judge John Koeltl ruled that Lee-Walker’s suit failed on legal grounds because her speech in the classroom was not protected by the First Amendment.

“The plaintiff’s speech was the speech of a public employee pursuant to her official duties,” Koeltl wrote.

The Louisiana politician who refused to step down following a sexting scandal with a 17-year-old boy admits he made a "stupid" mistake, but insists that there was no sexual contact and that he is not gay.

Jefferson Parish President Michael Yenni, who is married, told WVUE in an extensive interview that texting with the teen was "one of the stupidest decisions that I've ever made."

"This is a mistake that I made that I shouldn't have done, being a married man, being a father and being an elected official," he told reporter Lee Zurik.


Yenni, a Republican, was mayor of Kenner when the improper behavior took place. The FBI is investigating the texts, and officials in the area have called for Yenni to resign.

A very wise man once wrote, "The great enemy of truth is very often not the lie— deliberate, contrived, and dishonest — but the myth-persistent, persuasive, and unrealistic. Belief in myths allows the comfort of opinion without the discomfort of thought."

This "wise man" was none other than John F. Kennedy, the 35th President of the United States. And though he wasn't talking about his own death, he could have been, based on the mythical dialogue that was perpetuated to the American public within a few short days after he died on Nov. 22, 1963.

Distortions of what truly happened permeated instantly after FBI director J. Edgar Hoover first advocated the "Oswald Alone" theory when he called White House aide Walter Jenkins and told him, "The thing I am most concerned about and so is (Assistant Attorney General) Mr. Katzenbach is having something issued so we can convince the public that Oswald is the real assassin."


Hoover then instructed aide Clyde Tolson to "prepare a memorandum to the attorney general setting out the evidence that Oswald was responsible for the shooting that killed the president."

Soon Hoover's edict was conveyed to the American people and the myth spread far and wide despite the presence of a viable motive: Lee Harvey Oswald had singlehandedly shot and killed JFK.

The FBI Hacked Over 8,000 Computers In 120 Countries Based on One Warrant

In January, Motherboard reported on the FBI's “unprecedented” hacking operation, in which the agency, using a single warrant, deployed malware to over one thousand alleged visitors of a dark web child pornography site. Now, it has emerged that the campaign was actually an order of magnitude larger.

In all, the FBI obtained over 8,000 IP addresses, and hacked computers in 120 different countries, according to a transcript from a recent evidentiary hearing in a related case.

The figures illustrate the largest ever known law enforcement hacking campaign to date, and starkly demonstrate what the future of policing crime on the dark web may look like. This news comes as the US is preparing to usher in changes that would allow magistrate judges to authorize the mass hacking of computers, wherever in the world they may be located.

“We have never, in our nation's history as far as I can tell, seen a warrant so utterly sweeping,” federal public defender Colin Fieman said in a hearing at the end of October, according to the transcript. Fieman is representing several defendants in affected cases.

Those cases revolve around the FBI's investigation into dark web child pornography site Playpen. In February 2015, the FBI seized the site, but instead of shutting it down, the agency ran Playpen from a government server for 13 days. However, even though they had administrative control of the site, investigators were unable to see the real IP address of Playpen's visitors, because users typically connected to it through the Tor network.

In order to circumvent that anonymity, the FBI deployed what it calls a network investigative technique (NIT), or a piece of malware. That malware, which included a Tor Browser exploit, broke into the computer of anyone who visited certain child pornography threads on Playpen. It then sent the suspect's real IP address back to the FBI.

According to court filings, the FBI obtained over 1,000 IP addresses of alleged US-based users. Over the past year, Motherboard has also found that the FBI hacked computers in Australia, Austria, Chile, Colombia, Denmark, Greece, and likely the UK, Turkey, and Norway too.

But, those are only a tiny handful of countries in which the FBI was hacking computers. According to the newly published transcript, the FBI hacked computers in at least 120 countries.

Dating drug dealers, harassing ex-boyfriends with naked pictures, and pointing guns at pet dogs: these were just a few of the offences committed recently by serving FBI agents, according to internal documents.
The US provided officers from the Egyptian secret police with training at the FBI, despite allegations that they routinely tortured detainees and suppressed political opposition.

Disciplinary files from the Bureau's Office of Professional Responsibility record an extraordinary range of transgressions that reveal the chaotic personal lives of some of America's top law enforcers.

One male agent was sacked after police were called to his mistress's house following reports of domestic incident. When officers arrived they found the agent "drunk and uncooperative" and eventually had to physically subdue him and wrestle away his loaded gun.

A woman e-mailed a "nude photograph of herself to her ex-boyfriend's wife" and then continued to harass the couple despite two warnings from senior officials. The Bureau concluded she was suffering from depression related to the break-up and allowed her to return to work after 10 days.

BUFFALO, NY - A Special Agent working in the Buffalo office of the FBI is due in Eden Town Court later this month, after being arrested by New York State Police last Friday night, charged with exposing himself to a fellow motorist on the New York State Thruway.

State Police Lt. David Denz confirmed for WGRZ-TV that John A. Yervelli Jr., 48, of Lakeview, was charged with Public Lewdness, a class B misdemeanor, punishable by up to 90 days in jail.

According to Denz, a truck driver from central New York was traveling in the right lane while east bound on the Thruway near mile marker 442, between Exits 57 and 57A, when he noticed a grey minivan pull alongside him in the passing lane.

The trucker told police that when he looked down, he noticed the driver of the other vehicle (who had turned his dome light on) was not wearing pants.

"At that point the complainant stated that the driver of the minivan was exposing himself and making lewd gestures," Denz told 2 On Your Side.

Denz says the trucker called police, who then intercepted the minivan at the Hamburg toll plaza, where the trucker also went to identify Yervelli. Denz said it appeared Yervelli was wearing pants when he was pulled over.

"He denied exposing himself," Denz told Channel 2, but added that "inconsistencies" in the account given by Agent Yervelli lead State Police to file charges.

A source says Yervelli insisted to the trooper who pulled him over that he was attempting to relieve himself into a bottle while he was driving. However, the location where he said that occurred was within a few miles (or minutes) of the exit he was headed to, and even closer to a Thruway rest stop.

"I don't want to give you too many specifics as far as what he stated, but he made statements that would lead you to believe that the truck driver's story was credible," Denz said.

NEW HAVEN (AP) - A retired FBI agent was indicted Friday on federal child sex charges dating back more than a decade when he was a Boy Scout leader.
William Hutton, 63, of Killingworth, was arrested Friday. The federal grand jury indictment accuses Hutton of enticing a member of his Scout troop to Maine for the purpose of sexual activity in 1994 and 1995.

"It's obviously devastating. He was an FBI agent in this district and was reputed in this district," defense attorney Hugh Keefe said.

"The people who worked with him in the U.S. attorney's office and FBI respected him."

Keefe said the investigation has been going on for years. He would not discuss the details of the case or how the allegations surfaced.

Investigators asked anyone who knows anything about the case to call the FBI. U.S. Attorney Kevin O'Connor said that's standard practice whenever there might be more victims.

"In any case that's a concern," O'Connor said. "Whether that's the situation here I can't say."

If convicted on all four charges, Hutton faces up to 30 years in prison and up to $250,000 in fines.

Hutton was released on a $200,00 bond. He may not own any firearms or have any unsupervised contact with children. He was also ordered to stay away from playgrounds, schools, arcades or anywhere children congregate.

Two daughters of former state and federal law enforcement official Edward Rodgers were awarded $2.319,400 yesterday, after a Denver judge and jury found that the women suffered years of abuse at the hands of their father.

The award to Sharon Simone, 45, and Susan Hammond, 44, followed testimony of Rodgers’ four daughters in person or through depositions, describing repeated physical abuse and sexual assaults by their father from 1944 through 1965.

Rodgers, 72, who became a child abuse expert after retiring from the FBI and joining the colorado Springs DA’s office, failed to appear for the trial. But in a deposition taken in March, Rodgers denied ever hitting or sexually abusing his children.

MOBILE, Ala. - Mobile Police arrested 52-year-old Phillip Kent Baxley on child indecency charges. Baxley is a local attorney in Mobile, but he's also a former coach and acting president for the Mobile Soccer Club.

"I'm surprised to hear it," said Mobile Soccer Club Director, Mohammed Elzare. "He's a former FBI agent and attorney. So we're definitely saddened to hear this."

Baxley was arrested at his Dauphin Street office on a fugitive felony warrant out of Harris County, Texas.

Texas police officers say Baxley was involved in an incident with a nine-year-old girl in 2004.
Investigators say it happened at a family member's house in a Houston suburb, but the girl waited some time before saying anything.

"When the victim, the nine-year-old made the outcry she was interviewed in another county and all of the information was forwarded to us and the investigation went from there," said Lt. Wade Conner with the Deer Park, Texas Police Department.

Mobile Soccer Club Board Members say they were blind-sided by the news on Monday. For now, the board likely plans to distance itself from Baxley.

"Stopping ties until this situation is resolved and hopefully it comes out to a good outcome," said Elzare.

But Texas investigators are confident the charges will stick, despite Baxley's background. "If they're a pedophile then we deal with them all the same," said Wade. "It doesn't matter what they do for a living."

Baxley is locked up in the Mobile County Jail. That's where he'll stay until he's extradited to Texas.

WASHINGTON (AP) - The former chief internal watchdog at the FBI has pleaded guilty to sexually assaulting a 6-year-old girl and has admitted he had a history of molesting other children before he joined the bureau for what became a two-decade career.

John H. Conditt Jr., 53, who retired in 2001, was sentenced last week to 12 years in prison in Tarrant County court in Fort Worth, Texas, after he admitted he molested the daughter of two FBI agents after he retired. He acknowledged molesting at least two other girls before he began his law enforcement career, his lawyer said.

Former FBI analyst sentenced in child sex case


A 17-year veteran of the FBI will serve seven years in prison for having sexual relations with a young girl in Spotsylvania County, a judge ruled yesterday.

Anthony John Lesko, 44, entered an Alford plea yesterday in Spotsylvania Circuit Court to nine counts of felony indecent liberties upon a child.

Lesko, who later moved to Jacksonville, Fla., worked as an intelligence analyst at the FBI for 17 years, according to his attorney, James A. Carter II. He is a major in the U.S. Army Reserves and has received numerous military awards.

An Alford plea means Lesko doesn't admit guilt but believes there is enough evidence for a conviction. Under the terms of the plea, he was sentenced to seven years in prison with another 15 years suspended.

Lesko engaged in a sex act with a girl, 9 and 10 at the time, at least nine times in 2003-2004, according to evidence put forth by Spotsylvania Commonwealth's Attorney William Neely.

The girl told a member of the Spotsylvania Department of Social Services about the activity in February 2004, according to the evidence. Lesko at first denied the allegations, but later spoke with a U.S. Navy counselor about them.

Lesko told the counselor that he was the victim of the sexual assault; he said the girl initiated the contact, according to the plea. Lesko entered the plea partly to spare the girl the pain of a trial, his attorney said.

Two FBI workers are accused of using surveillance equipment to spy on teenage girls as they undressed and tried on prom gowns at a charity event at a West Virginia mall.

The FBI employees have been charged with conspiracy and committing criminal invasion of privacy. They were working in an FBI satellite control room at the mall when they positioned a camera on temporary changing rooms and zoomed in for at least 90 minutes on girls dressing for the Cinderella Project fashion show, Marion County Prosecutor Pat Wilson said Monday.

Former FBI agent files petition to enter guilty plea for child pornography charges


A local former Federal Bureau of Investigation (FBI) agent arrested on child pornography charges filed a petition to enter a guilty plea.

Donald Sachtleben was arrested in May 2012, following an investigation into the distribution of child pornography. Authorities said they were able to trace online activity back to Sachtleben’s Carmel home.

According to court documents, Sachtleben hid behind the email ‘pedodave69@yahoo.com’ and openly traded child porn. In one email he attached nine images of child pornography and child erotica and wrote:

“Saw your profile… Hope you like these and can send me some of (y)ours. I have even better ones if you like.”

Police obtained a search warrant on May 3. During an initial forensic examination of Sachtleben’s laptop computer, approximately 30 images and video files containing child pornography were reportedly discovered.

(CNN) -- A former supervisory FBI agent has been arrested and jailed on child pornography charges.

Donald Sachtleben was taken into custody and charged Monday after a nationwide undercover investigation of illegal child porn images traded over the Internet.



A federal complaint alleges 30 graphic images and video were found on Sachtleben's laptop computer late last week when FBI agents searched his home, about 23 miles north of Indianapolis.



Sachtleben is currently an Oklahoma State University visiting professor, according to his online resume. He is director of training at the school's Center for Improvised Explosives, but all references to his work have now been removed from the university's website. There was no indication from the school as to whether it had suspended him. Calls to the university and his Indianapolis attorneys were not immediately returned.

He had been an FBI special agent from 1983 to 2008, serving as a bomb technician. He worked on the Oklahoma City bombing and Unabomber investigations, according to his university biography.

A separate LinkedIn profile filled out by Sachtleben says he is an "accomplished investigator with more than 25 years of experience in FBI major case management, counter terrorism investigations, bombing prevention, post blast investigations and public speaking."

A 65-year-old former FBI employee from Prince William County was sentenced to nearly four years in prison Friday for possessing child pornography.

Samuel I. Kaplan, of Gainesville, who pleaded guilty June 2 in U.S. District Court in Alexandria, was sentenced to 46 months behind bars.

Kaplan was an information technology program manager at an FBI facility in Chantilly when authorities discovered that he had used the FBI's computer network to "facilitate sexually explict communications," the Justice Department said.

Investigators said they later found 10 to 20 images on Kaplan's home computer showing juveniles involved in sex acts.

An FBI agent who lives in Carroll County has been convicted of sexually abusing his daughters over a 14-year period.

The agent, as part of an agreement with prosecutors, pleaded guilty Friday before Circuit Judge Francis M. Arnold to two counts of second-degree sexual offense and two counts of child abuse.

The agent's name is being withheld to protect the privacy of the victims.

In exchange for the agent's plea, the state dropped 18 other counts against him, ordered a presentence investigation and agreed to let him remain free on $125,000 bond pending sentencing Sept. 10.

The agent was suspended from the FBI's Baltimore field office when he was arrested in December.

The original indictment also charged the man with fondling his oldest daughter's friend several years ago when the girl had slept over at the agent's home.

An investigation began after one of the man's daughters told a county child-abuse investigator of at least five incidents of molestation from 1980 to 1987, court documents said.

The victims said their father performed sexual acts ranging from fondling to intercourse beginning when each was preschool age. The abuse lasted until the girls were in their early teens, said Assistant State's Attorney Kathi Hill in a statement of facts presented in court.

In February, defense attorney John E. Harris Sr. tried unsuccessfully to have the case moved out of Carroll on the grounds that pretrial publicity had damaged the defendant's chance for a fair trial.

Ms. Hill said the state will recommend a sentence of 35 years in state prison, with 15 years suspended.

Although Ms. Hill said she once argued that the agent should be incarcerated until his trial, she said Friday she was not worried about whether he will return for his sentencing.

"Even if he'd take a walk, when he eventually comes back he wouldn't have to be tried again. He'd just be sentenced," Ms. Hill said. "There's not so much fear on our part, because we don't have to prove the case again."

In January, Motherboard reported on the FBI's “unprecedented” hacking operation, in which the agency, using a single warrant, deployed malware to over one thousand alleged visitors of a dark web child pornography site. Now, it has emerged that the campaign was actually an order of magnitude larger.
In all, the FBI obtained over 8,000 IP addresses, and hacked computers in 120 different countries, according to a transcript from a recent evidentiary hearing in a related case.
No need to sit back and wait for the DOJ's proposed Rule 41 changes -- including the stripping of jurisdictional limitations for search warrants -- to default their way into adoption on December 1st. This worldwide search, performed under the authority of a single warrant issued by a single judge in Virginia, is just the FBI acting first and asking for forgiveness codification later. From the day two transcript [PDF]:
Every time Your Honor grants a discovery request and we get new information, it's like -- to use an appropriate metaphor, like peeling an onion. There's just another layer of fact there that we did not know about. I mean, we did not know this was a truly global warrant before. There are 120 countries and territories listed outside the United States that the FBI hacked into, and they also hacked into something called a "satellite provider." So now we are into outer space as well.
It's not just the hacking of computers around the world. It's also the FBI's brief stint as perhaps the world's largest distributor of child porn. From the day one transcript [PDF]:
Your Honor, starting with Michaud, and what we know now is there was no discussion of trying to limit the distribution. There were no protocols for these agents for handling or limiting the distribution of child pornography. And the scale of the distribution now went out to at least 120 countries, at least 1 million images. And it is absolutely mind boggling, we have not seen something like this.
And for all the area covered by the investigation -- the number of computers scattered all over the world the FBI sent its NIT to -- there, so far, seems to be very little to show for the agency's efforts. Defense lawyer Colin Fieman:
We have never, in our nation's history as far as I can tell, seen a warrant so utterly sweeping. 100,000 potential targets. Something like 8700 IP addresses captured. At least 1152 open investigations. And now oddly enough only, about 214 arrests.

What's even more disturbing, even if they disagree about the efficacy of some of those methods, we now know from Agent Alfin's recent testimony which we cited, there was absolutely no discussion at the Department of Justice or the FBI about protocols in terms of handling this stuff or whether these methods of limiting, at least limiting the most egregious distribution were viable. Nobody cared.
Fieman quotes an earlier case dealing with the FBI's physical distribution of child porn in hopes of netting some arrests. The FBI actually created a child porn "catalog," mailed it to sting targets, and sent the targets the child porn they requested. The court in that case was not happy with the FBI's actions.
The Court took it upon itself to make these statements, because they were so troubled by it. So first they start "we are aware of the necessity of such tactics" -- in terms of undercover operations and baiting with contraband -- "we are aware of the necessity of such tactics in so-called victimless crimes such as drug offenses, but the use of these methods when victims are actually harmed" -- and they are talking about the children depicted in these images -- "is inexplicable."
And "moreover" -- this is again Sherman, continuing with the quote from 549 -- "the government's dissemination of the pornographic materials could hardly be described as a 'controlled' delivery." Well, if it's n

FBI Hacking Could Be Legalized December 1

Earlier this year, the Judicial Conference (the national policy-making body for the federal courts) approved changes to “Rule 41” that would allow the FBI and other law enforcement agencies to hack anyone in any jurisdiction in the U.S., and even globally. Fight for the Future, along with the EFF and other civil liberties groups, are calling on everyone to ask their senators to pass a law to stop the rule change from going into effect on December 1.
The FBI has recently started employing mass hacking tactics against thousands of computers at once as a “modern investigative technique.” The new tactic came to light during the recent Playpen case, which revealed that the FBI hacked over 8,000 computers in 20 countries.

According to Fight for the Future, anyone who uses encryption, a VPN, the Tor browser, disables location tracking, or is the victim of a botnet, could also become a target of FBI’s hacking efforts. That’s because the new rule 41 changes allow judges to issue warrants that would give law enforcement remote access and the ability to search, seize, and copy data when “the district where the media or information is located has been concealed through technological means.”
The EFF also argued that the real problem is the change allows any judge in the U.S. to issue warrants for any other jurisdiction in the country. Civil liberties groups believe that this would encourage law enforcement agencies to engage in “forum shopping,” which involves obtaining warrants from friendly judges, or from judges that may not fully understand the technical implications of the government’s requests.
The EFF has argued that the Rule 41 changes are not just the simple procedural changes that the Judicial Conference normally enacts, but changes that significantly expand FBI’s hacking powers. The EFF has argued that Congress, not the Supreme Court, should’ve decided this sort of hacking power expansion.
The new rule 41 changes go into effect on December 1 at midnight, which leaves little time for Congress to act and pass a law to stop the changes. However, the civil liberties groups recommend everyone could still contact their senators and ask them to vote yes on the “Stopping Mass Hacking Act.”

Dallas-Based Journalist, ‘Anonymous Hacktivist’ Released From Federal Prison

DALLAS– Dallas-born investigative journalist Barrett Brown was released from federal prison Tuesday morning after spending more than four years behind bars.

Barret The 35-year-old was sentenced to prison for threatening an FBI agent and helping share stolen data, marking the end of a criminal case criticized by free-speech advocates. He originally faced charges that carried more than 100 years in prison, but Brown pleaded guilty to greatly reduced charges: transmitting threats, aiding hackers and obstructing authorities from carrying out a search warrant. Supporters say Brown, was targeted by the federal government after sharing data hacked from the Austin-based defense contractor Stratfor.

Former National Security Agency subcontractor Edward Snowden tweeted his reaction to Brown’s new found freedom.


WikiLeaks also acknowledged Barrett’s release with a celebratory tweet and by publishing a searchable archive of more than 60,000 HBGary emails, which Barrett’s Project PM was investigating before he was arrested. Project PM is a crowdsourced investigation focused on research and analysis of leaked documents.


Brown was often quoted on the workings of Anonymous, a shadowy group of hackers that has staged several high-profile attacks on governments and businesses all over the world. He courted attention on the Internet with provocative tweets and YouTube videos – including a live chat he conducted while taking a bubble bath.

But some of those posts also landed him in trouble, including one in which he threatened an FBI agent that resulted in his arrest in September 2012. In the video [see below], Brown threatened the FBI agent by name, promising to “ruin his life and look into his (expletive) kids.” Three separate indictments followed, carrying a maximum sentence of more than century in prison.



Brown’s lawyers won the dismissal of most of a broad indictment related to his posting a link to the Stratfor data.

He eventually pleaded guilty to three counts: obstructing the execution of a search warrant, making Internet threats and being an accessory to an unauthorized access of a protected computer. The reduced charges carried a maximum sentence of more than eight years in prison.
According to plea agreement documents he signed, Brown admitted to sending online messages “threatening to shoot and injure” FBI agents.
Brown also acknowledged helping someone access the stolen data and obstructing the execution of a search warrant at his home. His mother pleaded guilty to helping Brown hide laptops during a March 2012 raid, and was given six months’ probation.

The case drew attention as the U.S. Justice Department sought in recent years to subpoena reporters’ phone records and force some to testify in criminal cases. Among Brown’s supporters is Gle

A Delaware man, who told the FBI in late 2014 he was communicating with a high-ranking ISIS commander, said an omission in court filings by federal agents of their months-long correspondence led to his 13-month incarceration and a diagnosis of delusional disorder, according to a form filed last week that sets the stage for him to sue the federal law enforcement agency.

Lopez, a former used car salesman from Wyoming, was arrested in February 2015 on a single charge of communicating a threat to an FBI agent and spent more than a year being shuffled between psychiatric wards and solitary confinement around the country. The lack of information filed in the arrest document and the silence practiced by FBI agents during his detention were an abuse of process, malicious prosecution and denied his right to a fair trial, according to a document that Lopez's attorney sent to the FBI.
"Because of the FBI's actions and misleading affidavit, Lopez was incarcerated for thirteen months," according to the form obtained by The News Journal. "Further, all of Lopez's contacts in the FBI, including Agents [Nile] Donahue, [Jeffrey] Reising and [Scott Austin] Duffey, stood silent ... while the Government jailed Lopez, diagnosed him with a mental disorder and attempted to medicate him against his will; all while they had evidence which corroborated Lopez' story and established his innocence."
The FBI office in Baltimore did not respond to requests for comment. Other than to confirm they were asking to sue the FBI, neither Lopez nor his attorney, William J. Sheppard of Jacksonville, Florida, would comment on the filing that seeks $100 million in personal injury damages.

MIAMI - German artist Ursula von Rydingsvard has been working with red cedar flagrant wood for decades. Her monumental sculptures are for the most part placed outdoors.

At 17-feet tall, her "Cedrus" sculpture defied gravity in the shape of a tornado. It made it to the FBI's new modern Miami field building, where the high ceilings offered plenty of space. And now it's in the middle of a scandal. 

Politico reviewed hundreds of documents revealing details of the "Cedrus" case. The government reportedly paid the artist $750,000 for the sculpture, but Politico reported that after it got FBI employees sick it actually cost tax payers about $1.2 million.

WASHINGTON — Congress had six months to debate granting President-elect Donald Trump’s FBI new legal powers to hack millions of computers, and Republican leaders objected to doing so on Wednesday.

That means that starting Thursday, a Department of Justice official will be able to go to a single judge, assert that a computer crime may involve millions of networked devices, and get a warrant that lets the FBI hack all of those devices.

According to three senators who tried to put the brakes on that new authority Wednesday so Congress could at least discuss it, there are no concrete assurances from law enforcement officials that privacy won’t be violated or that devices won’t be damaged. Nor was there any explanation of how authorities will hack Americans’ wired equipment.

Juror 'cannot convict' ex-cop Slager in death of Walter Scott

A lone juror nearly caused a mistrial Friday in the South Carolina murder trial of Michael Slager, a white ex-cop caught on video gunning down an unarmed black man in 2015.

The jury of 11 whites and one black man went through three days of deliberations before twice declaring on Friday that they were at an impasse.

“Yes, we are at a deadlock,” the jury wrote in a final note to state Judge Clifton Newman just before 5 p.m.


But the jury also made it clear the majority was prepared to convict Slager, a former North Charleston cop. He’s charged with shooting Walter Scott five times after a traffic stop on April 4, 2015.

Senate Judiciary Committee opens inquiry into Harry Morel case, suspension of local FBI agent

The suspension of an FBI agent who investigated former St. Charles Parish District Attorney Harry Morel has drawn the attention of the Senate Judiciary Committee, an influential panel of lawmakers that has opened an inquiry into the case. 

The committee's chairman, Sen. Charles Grassley, R-Iowa, sent a list of questions to FBI Director James Comey, Attorney General Loretta Lynch and other officials regarding the bureau's treatment of agent Michael Zummer, who was stripped of his security clearance after sending a lengthy letter to the federal judge presiding over Morel's criminal proceedings.

The FBI suspended Zummer without pay during the summer and escorted him out of the bureau's New Orleans field office pending the results of an internal inquiry to determine whether he mishandled "sensitive material."  


The suspension, Grassley wrote, "looks like it could be a misuse of the security clearance process to mask retaliation for protected whistleblowing."  

The agent had been pushing for prosecutors to pursue more serious charges against Morel, according to FBI records.

Morel was sentenced this year to three years in prison after pleading guilty to one count of obstruction of justice, a charge that stemmed from his efforts to derail a multi-year FBI probe into his sexual misconduct.

Though he was never charged with a sexual crime, Morel acknowledged, in pleading guilty, that he used his office to prey upon women who sought leniency in their criminal cases. He demanded sexual favors in exchange for his assistance. 

U.S. District Judge Kurt Engelhardt has declined to make public Zummer's 31-page letter, but he said he shares the agent's "legitimate concerns" about whether the U.S. Justice Department "is either unable or unwilling to self-police lapses of ethics, professionalism and truthfulness in its ranks."

Zummer's letter included the names of more than two dozen people involved in the Morel case and apparently outlined allegations of misconduct involving government officials.  

After his suspension, Zummer took his concerns to Congress, telling the Senate Judiciary Committee that the Morel case was tainted by a conflict of interest in the U.S. Attorney's Office. He alleged that Morel received favorable treatment from the U.S. Attorney's Office

Virginia State Police’s Stingray-like device captures voice communications – docs




Documents acquired from a Freedom of Information Act (FOIA) request show the Virginia State Police have a powerful cell-site simulator that can capture not only GPS location and metadata but voice communication.
In 2014, Virginia State Police upgraded their Digital Receiver Technology box, a cell site simulator, for a smaller more powerful model at a cost of over $500,000, according to documents acquired by Muckrock as part of a nationwide FOIA request and published Friday.
The DRT boxes, made by a Maryland company, are similar to other cell site simulators like Stingrays in that they can also intercept voice communication along with GPS location and other metadata, such as phone numbers and duration of call.
The device came with accessories and was installed in a Chevrolet Suburban outfitted specifically to run the device.
Cell-site simulators, or IMSI catchers, are devices that masquerade as a legitimate cell phone tower, tricking phones nearby into connecting to the device in order to log the international mobile subscriber identity (IMSI) numbers of mobile phones in the area or capture the content of communications.
The increased use of the devices by law enforcement had been kept from the courts and the public. In 2014, police in Florida revealed they had used such devices at least 200 additional times since 2010 without disclosing it to the court or obtaining a warrant.
The American Civil Liberties Union has filed multiple requests for the public records of Florida law enforcement agencies about their use of the cell phone tracking devices.
In some cases, police have refused to disclose information to the courts, citing nondisclosure agreements signed with the Harris Corporation, which manufactures Stingrays.
The FBI defended these agreements, saying that information about the technology could allow adversaries to circumvent it.
The ACLU said in 2014 that “potentially unconstitutional government surveillance on this scale should not remain hidden from the public just because a private corporation desires secrecy. And it certainly should not be concealed from judges.”
Among the documents acquired in the FOIA request is a utilization log from May 2015 that shows the unit was used 12 times. In five of the 12 instances, it was ineffective

A Charlotte man was pardoned after serving nearly 25 years behind bars for a crime he didn't commit.

CHARLOTTE, N.C. – A Charlotte man who spent over 24 years behind bars for a brutal rape and attempted murder has been pardoned.

Timothy Scott Bridges had been sentenced to life in prison but was pardoned by Governor Pat McCrory after it was shown that he was convicted at trial based on evidence that was erroneous.

Bridges had been convicted of raping an 83-year-old woman in her home off the Plaza in 1989, and attempting to kill her.

In court, prosecutors used hair sample and the testimony of an FBI-trained analyst to convict him, despite the fact that a palm print found on a door was not a match to Bridges.

An FBI review later found Bureau-trained analysts had overstated, or were simply wrong about hair samples in thousands of cases across the country including  the case of Bridges.

WASHINGTON – A retired Green Beret officer alleged Friday that Gen. James Mattis, who has been nominated to be the next defense secretary, hesitated to send medical evacuation flights and left soldiers to die during a 2001 friendly fire incident in Afghanistan.

 

Retired Lt. Col. Jason Amerine, in a Facebook post, said a delay by Mattis in sending rescue aircraft from a nearby base might have led to the deaths of Staff Sgt. Brian Cody Prosser and at least two Afghans after they were hit by a U.S. bomb outside of Kandahar.

Anonymous Leaks to the WashPost About the CIA’s Russia Beliefs Are No Substitute for Evidence

The Washington Post late Friday night published an explosive story that, in many ways, is classic American journalism of the worst sort: The key claims are based exclusively on the unverified assertions of anonymous officials, who in turn are disseminating their own claims about what the CIA purportedly believes, all based on evidence that remains completely secret.

These unnamed sources told the Post that “the CIA has concluded in a secret assessment that Russia intervened in the 2016 election to help Donald Trump win the presidency, rather than just to undermine confidence in the U.S. electoral system.” The anonymous officials also claim that “intelligence agencies have identified individuals with connections to the Russian government who provided WikiLeaks with thousands of hacked emails” from both the DNC and John Podesta’s email account. Critically, none of the actual evidence for these claims is disclosed; indeed, the CIA’s “secret assessment” itself remains concealed.

A second leak from last night, this one given to the New York Times, cites other anonymous officials as asserting that “the Russians hacked the Republican National Committee’s computer systems in addition to their attacks on Democratic organizations, but did not release whatever information they gleaned from the Republican networks.” But that NYT story says that “it is also far from clear that Russia’s original intent was to support Mr. Trump, and many intelligence officials — and former officials in Mrs. Clinton’s campaign — believe that the primary motive of the Russians was to simply disrupt the campaign and undercut confidence in the integrity of the vote.”

Deep down in its article, the Post notes — rather critically — that “there were minor disagreements among intelligence officials about the agency’s assessment, in part because some questions remain unanswered.” Most importantly, the Post adds that “intelligence agencies do not have specific intelligence showing officials in the Kremlin ‘directing’ the identified individuals to pass the Democratic emails to WikiLeaks.” But the purpose of both anonymous leaks is to finger the Russian government for these hacks, acting with the motive to defeat Hillary Clinton.

When Senator Lamar Alexander’s (R TN) Chief of Staff, Ryan Loskarn, was arrested, last year, for trading in the rape and torture of children, aka child pornography, not one journalist provided context to the story. The media reported Loskarn’s arrest, and subsequent suicide pending trial, as if it were a one-off event. As if, no other high-level government employees were being arrested on child porn charges.
So, I suppose I should be thrilled to see that both Paul Farrell, the Breaking News Editor for Heavy, and Shane Harris, Sr. Intelligence and National Security Correspondent for The Daily Beast and New America Foundation Fellow, tried to provide context to the State Department’s Director of Counterterrorism, Daniel Rosen’s arrest, 26 February 2015, on charges of computer solicit of a child under 15 years old for sex/sodomy.

At least Paul and Shane poked their heads up and said something like: Hang on. Seems to me I’ve heard this story before. Haven’t there been other recent arrests of high level government officials on child sex abuse charges? Nonetheless, both are far off the mark. A simple Google or Twitter search reveals far more than two or three government officials arrested on similar charges.
Research 101
As I have been documenting, for years now, by all accounts there is both a national child porn crisis and, within that, a crisis of American federal and state employees engaged in child porn. In what appears to be epidemic numbers men are down-loading child porn often on their work computers at The Pentagon, The Department of Homeland Security (DHS), The Department of Justice (DOJ), Immigration and Customs Enforcement (ICE), The Department of Transportation (DOT), The Transportation Security Agency (TSA), The Federal Bureau of Investigations (FBI), The Central Intelligence Agency (CIA) not to mention state-level police departments from Maine to California.
Maine’s Governor, Paul LePage, has recognized this crisis by issuing the first, to my knowledge, of its kind Executive Order, on 20 February 2015, prohibiting Maine state employees from accessing pornographic or sexually explicit material on both state computers or devices even when they were off-duty on personal time.
North Carolina’s Congressman, Mark Meadows (R) also recognizes the scope of the crisis and put forward the Eliminating Pornography from Agencies Act. This law, if passed, would stop federal employees from accessing, watching or sharing pornography on government-issued computers and devices. Congressman Meadows introduced this 18 September 2014. To date, he has not one co-sponsor. Not one other member of Congress cares about this issue? Apparently not.
Other Recent Arrests of Government Employees
Because the Department of Justice is not collecting data on child porn arrests, no one knows how many government employees have been arrested on child porn related charges, much less how many are engaged in the child porn industry who have yet to be caught.
The arrests listed here are, therefore, an incomplete data-set, gathered from the most rudimentary search method: simple Google and Twitter searches. On my other Medium postings I have listed recent arrests of police and military. So many police chiefs, for example, are being arrested for trading in brutal child rape and torture, I had to create a separate section.
From the record of the following arrests alone, we can speculate, child porn within our government agencies has reached crisis level.
A Few Highlights
• Acting Director of Cyber Security at the Department of Health and Human Services (DHHS), Timothy DeFoggi, age 56, was sentenced, January 2015, to 25 years in federal prison for “participating in a child pornography ring that sources say was so depraved, it even shocked veteran investigators.” DeFoggi was a registered user of an on-line child rape and torture, aka child porn, trading site. DeFoggi “expressed an interest in the violent rape and murder of children. DeFoggi suggested meeting one member in person to fulfill their mutual fantasies to violently rape and murder children.”
• Former Undersecretary of the Navy, 70 year old James Daniel Howard, arrested on child porn possession and reproduction charges in 2013. Howard had served as special assistant to President Ronald Reagan. He plead guilty to ten child porn counts and served only seven months in jail.
• Joint Strike Fighter Program Navy officer, Bruce Babchyck, arrested in 2014 for downloading “hundreds of gigabytes” of young girls and bestiality on government computers. He received a one year sentence.
• Anthony Mangione, 50 year old Director of Immigration and Customs Enforcement (ICE) for South Florida, was arrested on “extreme child abuse” charges on 28 September 2011. He was sentenced, November 2012, to nearly six years in prison. Mangione is a 1982 graduate of the University of Maine Orono (UMO) where former Senior Child Protection Services (CPS) Cynthia Wellman claimed, at the time, CPS was operating a child sex ring, on campus, with UMO’s involvement. “Little is known about Mangione’s time at UMaine. Originally from Rhode Island, he arrived in Orono in August 1978.”
• David Bourque, formerly the 51 year old Police Captain of Granby, Connecticut, was sentenced to ten years for child porn possession and distribution. He had more than 328,528 images and 4,000 videos on his police department computer including “sadistic and violent acts” against infants and toddlers. His “collection” was organized into more than 300 sub-folders named “photos — babies — men” and “6–10yo boys pics.” In this excerpt Bourque is D for defendant.

David Bourque’s Criminal Complaint
Prosecutors said the images were “extremely disturbing; some are especially horrific” including: (1) a boy between 1 and 3 years old being raped by an adult male penis in the child’s anus, (2) a boy between 3 and 6 years old with a “penis of what appears to be an adult male pressed against the child’s anus” and (3) a child, less than a year old, “performing oral sex on an adult male.” Bourque showed “callous disregard” for the children being abused telling people to “enjoy” themselves and “have fun.” Samples of his on-line chats include extensive discussions of rape and bondage of children. Bourque was a decorated officer with more than 31 years in law enforcement.
• Army prosecutor and judge advocate, Daniel Wollverton, father of two, convicted in 2011 for infant sodomy and possession of over 30,000 images and 1,000 videos of brutal child sex abuse including that of a three month old infant.
• Maine Assistant Attorney General, 52 year old James Cameron, was sentenced to just over 15 years in federal prison, December 2014, for seven counts of child porn possession, receipt and transmission. Cameron, widely recognized as Maine’s “top drug prosecutor,” had been trading in PTHC - pre-teen hard core. Images/videos that investigators seized included “images depicted prepubescent children, sadistic and other violent conduct.”
• Army Colonel, 55 year old Robert Joel Rice, a war game developer at Army War College, was charged with 130 child porn counts. He had more than 30,000 images/videos of child sex abuse when his wife discovered the files and notified local police. The Army War College had continued to employ Rice, and allow him supervised access to Army computers, while on bail pending trial. Col. Rice had been scheduled for a July 2013 arraignment; however, Rice’s federal hearing was delayed until February 2015. Rice’s preliminary county hearing had been set for April 2013.
• David O’Brien, America’s chief scientist responsible for monitoring global nuclear activity at Patrick Air Force Base’s Technical Applications Center, which operates our Atomic Energy Detection System, was arrested May 2013 and charged with ten counts of child porn possession and distribution.

O’Brien had a large child porn collection on his home and Air Force computers. On 17 October 2014 he was sentenced to five years in federal prison in exchange for a guilty plea to one child porn count. O’Brien had download videos of the sex abuse of children as young as three years old. He had taken pictures of his granddaughter and placed images of her head over images of children being sexually abused. He also had pictures of Air Force employees transposed over sex abuse images.
US Department of State
• Carl Carey, a 54 year Senior Project Manager in Information Technology (IT) at the US State Department, was arrested on ten counts of child porn possession, April 2012, by the Fairfax County Police.
• Gons Nachman, a 42 year old former US diplomat “admitted taping his sexual encounters with teenage girls while stationed in Brazil and the Congo” was sentenced, August 2008, to 20 years in prison. Nachman also plead guilty to child porn possession. One of his videos was titled “Congo 2004 Sexual Adventures.” His law degree is from the University of Pennsylvania, where he was president of the Naturist Student Association and “led demonstrations involving public nudity in 1995.”
• James Cafferty, 45 year old Special Agent with the US State Department’s Bureau of Diplomatic Security, pleaded guilty, 5 January 2012, to child porn charges and was sentenced, 26 April 2012, to 7 years in federal prison. Upon his arrest he had more than 30,000 images of child sex abuse. He “had shipped computer equipment containing many of those images from London to the United States when he returned home from his last official government assignment.”
• Timothy Towell, 75 year old former US Ambassador to Paraguay, was charged with “sex crimes” against an 18 year old in 2009.
• Howard Gutman, former US Ambassador to Belgium was accused of “routinely… soliciting sexual favors from both prostitutes and minor children” according to an Office Inspector General (OIG) investigation. Aurelia Fedenisn, a now former OIG investigator said her unit had found widespread evidence of “sex and drug scandals” but “were told not to look into it.” Fedenisn said “investigations into the allegations were called off by senior officials to avoid political embarrassment.”
Central Intelligence Agency (CIA)
• Andrew Warren, a 42 year old former CIA Chief of Station in Algeria, was arrested April 2010. Warren’s neighbors called Norfolk police when Warren exposed himself in public. “He had his genitals hanging out of his pants, over the top of ‘em,” said one witness. Warren reportedly said “Excuse me. I’ve had minor surgery so I get a little horny sometimes.” He had been terminated from employment with the CIA in May 2009, after he drugged the drink of a woman in Algiers and raped her. Warren plead guilty and, June 2009, was indicted on sexual assault charges. Diplomatic Security Service agents also found child pornography on Warren’s laptop computer in 2008. When he was the CIA’s Chief of Station in Algeria, he allegedly “drugged and raped multiple women before getting recalled home.” Warren was sentenced, on sex assault charges, among others, to more than five years in federal prison in March 2011. It appears Warren was not charged for the child pornography on his government computer.
Federal Bureau of Investigations (FBI)
• Donald Sachtleben, a 54 year old former FBI Agent was arrested, 14 May 2012, and charged on child pornography charges. He plead guilty to distribution and possession and was sentenced, 14 November 2013, to eight years in prison. He was also sentenced to unrelated charges of one count of disclosing and one count of possessing classified information. At the time of his arrest Sachtleben was Director of Training at the Center for Improvised Explosives at Oklahoma State University. He served the FBI from 1983 to 2008 as a bomb technician and counter terrorism investigator. Sachtleben had been using the handle pedodave69@yahoo.com when he was caught sending images of child sex abuse in an on-line forum. He wrote, “Saw your profile on (a file sharing network). Hope you like these and can send me some of ours (sic). I have even better ones if you like.”
• Keith Dietterle, a 28 year old FBI Analyst, was arrested, 23 November 2012, on child porn charges. He plead guilty to child porn possession and was sentenced, September 2013, to more than three years in prison. Dietterle was caught when he sent child sex abuse images/videos to an undercover Metro DC Detective. The detective was posing as a man sexually abusing his 3 year old nephew and 12 year old daughter. Dietterle described the rape of the children as “So hot man … how’d it start?” and discussed meeting the detective with the intention of sexually abusing the three year old boy. Upon his arrest, the FBI terminated Dietterle’s employment.

• Brian Doyle, Deputy Press Secretary for the Department of Homeland Security, was arrested “for trying to seduce online someone he thought was a teenage girl.” Doyle was charged with 23 felony charges related to sexually graphic conversations with a person he thought was a 14 year old girl who, in reality was, an undercover detective. On 17 November 2006, Doyle was sentenced to five years in prison with ten years probation thereafter. He is a registered sex offender and was released from prison on 11 January 2015.
• 31 year old Eric Higgins, a Homeland Security Customs and Border Protection agent in Michigan, plead guilty to child porn possession. Over forty images of a child previously identified by law enforcement were found on his laptop.
• Nicholas Bolden, a 40 year old Homeland Security Customs and Border Patrol agent, was sentenced for child porn possession on his government computer. Bolden had accessed a Russian child porn website while at work from his work computer. A child porn CD was also found at his workplace desk.
• Gilbert Lam, a 38 year old Homeland Security Customs and Border Protection agent who worked at San Francisco airport, was charged with child porn possession and distribution. Investigators said his electronic resources were “elaborate” and included “a whole closet… independent server, several computers, several hard drives…”
• Robert Rennie, a 43 year old Homeland Security agent who worked in the National Protection and Programs Directorate, was charged with attempting to solicit sexual acts from more than seventy young girls using a fake Facebook account and pretending to be both a male student at a Virginia middle schools as well as a college student at George Mason University.
• An unnamed Homeland Security agent with Customs and Border Protection and Byungki Koo an Air Marshal were arrested for trafficking “young women” from South Korea in a sex-trafficking ring in Queens, New York.
National Children’s Museum
• Robert Singer, 49 year old father of two and Chief Operating Officer for Washington DC’s National Children’s Museum, was arrested, 6 November 2007, and charged on five child porn distribution counts. He plead guilty and was sentenced, 16 July 2009, to five years in prison. Singer was caught sending child sex abuse images of children as young as five years old, including from his work computer, to an undercover New York Police Detective who was posing as a 12 year old girl and her 33 year old mother. Singer was pretending to be a 15 year old boy. He was using the online handle badboy2. Upon his arrest, the museum terminated his employment.
Police Departments & Military Staff
Police officers are, of course, also government employees as are US military staff. The arrests, alone, of both state government employed police officers and federally employed military staff are stunning. These arrests are so numerous, and my record is very incomplete, that it appears trading in child sex rape and torture is almost encouraged within some police departments and military units. Drug Enforcement Agency (DEA)
• 48 year old Scott Whitcomb, a former police officer, at the time of his arrest a Drug Enforcement Agent, was sentenced for child porn production. He had been producing and distributing sex abuse of boys under sixteen years old since 2007. Whitcomb lured boys to his house with video games and porn magazines and would turn violent if the boys didn’t submit to the sex abuse. He had been an Air Marshal and a prison guard.
• DEA agent Darren Argento was arrested for possession and distribution of child sex abuse of girls between seven and fourteen years old his work laptop.
Department of Energy
• David Busby, 61 year old computer technician who had worked for the National Energy Research Scientific Computing Center for 30 years, was arrested on child porn charges. He was sentenced, March 2014, to ten years in federal prison. He had been trading in child sex abuse on his US government computer. He was previously convicted for “lewd behavior” toward his 7 year old stepdaughter in 1990. At the time of his arrest, investigators found some 1,400 child sex abuse images/videos. Busby was also a Navy veteran who served in Vietnam.
Department of Agriculture
• James Spargo, a 66 year old employee with the Department of Agriculture in Florida, plead no contest plea to 20 felonies child porn counts and was sentenced, February 2015, to 10 years in prison. Spargo was arrested when investigators found child sex abuse images/videos on his government computer. Most of the children in the images/videos were infants and toddlers. “The activity we uncovered here was just was just horrible,” said Florida Department of Agriculture and Consumer Services spokesperson Erin Gillespie. “It was horrifying, it was disgusting, and we gathered all the evidence we could to make sure that this arrest was going to happen.”
Forest and Park Rangers
• Bobby Kelly, a 31 year old US Forest Ranger was sentenced to five years for more than two dozen child porn related charges.
• Derek Alan Lee, a 44 year old US Forest Service employee, was sentenced for child porn. Lee was sentenced with his 21 year old step-son Jeffrey McMillan. Their computers were found sending “several hundred files” of child sex abuse on the internet. Lee said he had been downloading child porn for ten years. At the time of his arrest his computer had 111 videos and 116 images of child sex abuse. He also had a collection of “incest stories.”
Department of Health & Human Services (DHHS)
• William Shaffer, a Child Protection Services (CPS) staff was arrested, July 2013, after he purchased nearly $7,000 of child rape and torture, aka child porn. According Shaffer’s criminal complaint “a 1987 police report alleged Shaffer sexually molested a boy between the ages of 8 and 9. The police report alleged the incident happened while Shafer was a Child Protective Services employee.” Investigators also seized “sexual stories” from Shaffer’s home. “One of them describes a seventh grade boy being abducted, molested and sodomized. It is not clear if Shaffer wrote the story — but refers to Michigan State University and 16 Mile Road. Shaffer’s residence is located just south of Maple Road.”
• Stanley Dorozynski, a 53 year old Child Protective Services (CPS) employee, was arrested, 21 December 2010, and charged with two counts, one each, of possessing and receiving child porn. Upon his arrest, Dorozynski possessed more than 2,400 child sex abuse images/videos including the abuse of children as young as four years old. Investigators also recovered 11 zip discs of child porn in a locked trunk, among other CDs. Doroszynski had been trading in child rape and torture since 1990. Dorozynski plead guilty, 27 July 2012, and was sentenced to six years in federal prison. His girlfriend found the child sex abuse images/videos and notified law enforcement. He had been a police officer in Utica, New York, before he went to work for Health and Human Services.
Air Marshals
• Michael McGowan, a 41 year old Air Marshal, was convicted for molesting three young boys, age eleven to thirteen, and child porn possession. He had 1,300 videos and images, along with fake FBI and CIA badges.
• Richard Castillo, a Houston Air Marshal, was indicted for indecency with a child after his daughter’s fourteen year old friend said he sexually assaulted her during a sleepover.
• Air Marshal Byungki Koo, who was mentioned under the Homeland Security section, received four years probation for participating in the sex trafficking of young women from Korea in Queens.
Transportation Security Agency (TSA)
• 59 year old Boston TSA agent Jose Salgado, charged with possession and distribution of child porn. As of this arrest April 2012, it was reported that a total of twelve child sex crimes in the previous sixteen months had been brought against TSA agents across America.
• Michael Wilson, 41 year old Baltimore TSA agent was indicated for child porn possession including videos “depicting a prepubescent female engaged in masturbation and anal sex with an adult male.”
• Andrew Smeal, 39 year old Florida TSA agent, was charged with twenty-five counts of child porn possession. An investigator said “…the living room was loaded with electronics, storage devices, hard drives.” I couldn’t locate information on how much child porn he had or what it was depicting; however, given he was charged with twenty-five counts, one can assume he had a large amount of child sex abuse videos and images.
• Thomas Gordon, a 46 year old TSA agent in Philadelphia, was sentenced for possession and distribution of child porn. He had over 600 images and videos of child sex abuse including children as young as six years old which were described as “horrific.” He had as many as six fake Facebook accounts he was using to distribute child porn.
• TSA hired 65 year old Thomas Harkin, a former Catholic priest who had been removed from the church for the sex abuse of an eleven year old girl, among possible other victims, to work at Philadelphia airport.
• TSA Agent, 38 year old Miguel Angel Quinones, who worked at Manchester airport in New Hampshire, was indicted on twenty counts of child porn possession. He had more than 1,000 child sex abuse images and videos. He kept his child porn in his airport work locker.
Bureau of Indian Affairs
• Jasper Neil Blair, a 27 year civil engineer with the Bureau of Indian Affairs, was arrested for child porn possession and plead guilty, 31 May 2012, “to knowingly possessing an image of a six-year-old girl being sexually abused,” and was sentenced, 4 October 2012, to two and half years in federal prison. Blair was using his government computer to trade in child rape and torture, aka child pornography.
Corrections and Probation Officers
• Former West Virginia Corrections Center Officer, 35 year old Joseph Roush, plead guilty to child porn possession and distribution. He had more than 500 image of child sex abuse.
• Leon Perry Brookes, a 39 year old a Corrections Officer for Jacksonville (Florida) Sheriff’s Office was arrested for child porn possession and distribution. Among others, he had child sex abuse files called “pthc- freaky latin parents and 5yr daughter.mpg” and “video-8yr orgasm and anal fuck hard ! new ! (ptch) 2007 new girl img.
• Gerald Silva, a 59 year old Rhode Island State Probation Officer, was convicted of child porn for his $1,589 USD purchase of 22 orders of child sex abuse from Azov Film’s website, spending a total of $1,589 on 75 different videos. He was caught by USPS Inspectors and Toronto Police investigation, Project Spade.
• Stuart Forrest, 62 year old Chief Probation Officer of San Mateo County, California, was sentenced for child porn possession that included the abuse of young bound boys. He had more than 400 images and videos of child sex abuse. This case was also part of Project Spade, run by the USPS and Toronto Police.
• Supervisor of Adult Probation and Parole and Sex Offender Unit in New Mexico, Larry Franco, 56 years old, was charged two counts of fourth-degree felony sexual exploitation of a minor by possession and one count of tampering with evidence. He had originally been charged with 26 new child porn counts. He was producing child porn.
• James Leone, a 50 year old Senior Parole Official in New York who supervised officers who monitored paroled sex offenders, was arrested for child porn possession. He had been downloading child sex abuse images in online searches for “preteen hard-core” including ten or twelve year old girls being sexually abused by their parents and a brother. Leone was a Child Abuse Investigator with New York City Child Welfare Bureau before he became a parole officer.
• Barry Porter Griffith, a 45 year old Parole Officer from Flint Texas, was sentenced for child porn possession after investigators noticed “significant Internet bandwidth being used by a state-owned computer to view pornography” including child sex abuse from his office computer.
• James Kriegner, a 43 year old Corrections Officer with Mercer County, New Jersey, charged with downloading more than 100 child sex abuse images.
Media Coverage of Ryan Loskarn’s Arrest
The media coverage of late Senate staffer Ryan Loskarn’s arrest for graphic and violent child porn, including the rape of a six year old girl in the woods by her father, ignored, entirely, the children in the videos. These are real children suffering real harm. Will the six year old girl raped in the woods by her father be rescued? No one asked. No one wanted to know.
John Harwood, for example, a DC reporter for CNBC and The New York Times, tweeted “Feeling so sad about Ryan Loskarn. Knew him a bit as a reporter and liked him. RIP.” I asked Harwood about the children in Loskarn’s child porn collection. Harwood’s response was “as father of daughters I’m horrified by that violent abuse. But I knew Ryan Loskarn & yes, I am sad for him & his family.”
I responded, “I appreciate that. As the father of daughters will you focus media attention on finding the 6 yr girl in Loskarn’s video? That’s all I am asking. It’s a simple & I think appropriate request. Given #Loskarn’s final words were to the children. No?”
Harwood never replied.
Child Porn as a National Security Threat
America has a child porn crisis. The disturbing number of federal and state employees arrested for child porn charges makes this a national security issue. Over the past few years, I’ve been documenting the scope of America’s child porn industry and the apparent level of involvement by America’s national security and federal employees. Forbes, The Washington Times and others have published my research. Fox News and Canadian TV (CTV) invited me for interviews. My CTV interview went mini-viral as did my Forbes article. I was the first to ask, in 2012, if White House staff might have been involved in the Colombia Secret Service scandal.
I am now researching and writing a book: Child Porn Nation: America’s Hidden Security Threat. My starting premise is men, and increasingly women, are raping children, very young children, including infants and toddlers, and sharing videos, images, and live-streaming of this abuse at epidemic levels. These criminals are, by and large, getting away with it because America refuses to move beyond our denial.
We are sustaining crisis-level numbers of seemingly normal, often powerful and successful men, and some women, involved in America’s child sex abuse industry; far too many of whom are federal or state employees.
It does not matter if the perpetrator is on the demand-side, with incessant appetites for graphic child abuse to achieve sexual gratification, or the supply-side of abusing children, often their own or children of friends and relatives, and selling this abuse on-line. Both supply and demand, which often cross over, have reached epidemic proportions and no one is talking about it.
My research is intended to be a wake-up call. The problem of child sex abuse, and its cover-up, is real. A generation of American children are being destroyed. If you think this only happens to other children, and your children are safe, you are sadly mistaken. Your children might be enduring sexual abuse right now while you remain dangerously ignorant. Ryan Loskarn’s parents never knew, until they read his suicide note, that he had suffered sex abuse as a child.
America’s appetite for child porn puts all our children at risk. Your children and mine. Whether you acknowledge it or not.
Dr. Paul Farmer, a humanitarian and personal hero, has said we must find the words to talk about the most painful subjects if we hope to have any positive impact on this world of ours. This is my attempt to find those words and open a subject no one wants to discuss.
That is, that while no one was watching, America has become a child porn nation and that puts us all at risk.

Hospital that fired workers for refusing annual flu shots must reinstate them with back pay--and exploring the odd mechanisms used to impose vaccine mandates on healthcare workers, while CDC claims there are "no legally mandated vaccinations for adults"
A hospital in Erie, PA fired 6 healthcare workers for refusing the annual flu shot.  Taken to the EEOC, the hospital has settled by offering them their jobs back with $300,000 in back pay.

The interesting piece to me is the acknowledgement that the hospital imposed its mandate (with over 99% compliance of its remaining workers) in order to get higher Medicare reimbursements.

Yet the federal government, via CDC, claims it does not impose mandates, and suggests that it is actually illegal to force US adult civilians to get vaccinated. (Cite below)

What is going on?  

The federal government has created and co-created a variety of organizations which are supposed to help determine how to improve the "quality of care."  These organizations are called 1) QIOs, established by Medicare https://www.cms.gov/Medicare/Quality-Initiatives-Patient-Assessment-Instruments/QualityImprovementOrgs/index.html?redirect=/qualityimprovementorgs/

and 2) organizations like the National Quality Forum, a federally-established, public-private health quality organization http://www.qualityforum.org/about_nqf/history/.

Medicare is used as a cudgel (while the federal government hides behind the “quality improvement” skirts of organizations it created) to forcibly impose a few cherry-picked "quality" measures on medical institutions, by threatening to lower reimbursement rates to institutions that do not comply with the “quality improvement" measures Medicare selected from the large palette of measures suggested by these intermediary organizations.

While at the same time, CDC wants you to think this has nothing to do with CDC.

“CDC does not issue any requirements or mandates for state agencies, health systems, or health care workers regarding infection control practices, including influenza vaccination. There are no legally mandated vaccinations for adults, except for persons entering military service. Yet  CDC elsewhere on its website acknowledges what is going on:

Saint Vincent settles federal lawsuit filed by workers who claimed religious discrimination.

Saint Vincent Hospital has agreed to rehire six former employees it fired after they refused to get flu shots in late 2013 and early 2014 due to their religious beliefs.
The Erie hospital also will provide about $300,000 in back pay and compensatory damages to the employees as part of an agreement to settle a lawsuit filed on behalf of the workers by the Equal Employment Opportunity Commission in September. A consent decree that ended the case and detailed the settlement terms was filed Tuesday in U.S. District Court in Erie.

The commission had claimed Saint Vincent violated Title VII of the Civil Rights Act of 1964 when it fired the six workers, who refused to be vaccinated after the hospital implemented a mandatory flu vaccination policy for all employees. The hospital granted medical exemptions to 14 other workers.
"The consent decree filed this week between the EEOC and Saint Vincent Hospital does not constitute any admission of violations by Saint Vincent or a finding on the merits of the case," Dan Laurent, a spokesman for Allegheny Health Network, Saint Vincent's parent organization, said in an email. "Although we have vigorously and respectfully disagreed with the EEOC's position and characterization of how employee claims outlined in this lawsuit were handled by the hospital, we have reached a resolution of the matter in the interest of avoiding the expense, delay and burden of further litigation on all parties."
As part of the consent decree, Saint Vincent must pay the following employees back pay and compensatory damages:
Bryan Nash - $81,712.86;
Aleksandr Gevorkyan - $81,814.81;
Aza Galustyan - $54,493.85;
Joshua Dolecki - $19,608.17;
Lisa Waller - $29,503.37;
Beth Theobald - $32,866.94.
In addition to providing the money, Saint Vincent must also offer to reinstate each former employee to their previous job with the same pay and benefits. If the job is not vacant, Saint Vincent must offer the employee a similar job if one becomes vacant over the next two years at any of the defendant's facilities within a 50-mile radius of Saint Vincent.

Saint Vincent implemented the mandatory flu shot policy to receive the maximum reimbursement for treating Medicare patients. At least 95 percent of the hospital's entire workforce had to be vaccinated to meet the requirements, Saint Vincent officials said in 2014 shortly after the policy went into effect. Saint Vincent said in February 2014 that 99.4 percent of its workforce had been vaccinated or received an exemption.
Those who sought a religious exemption for a flu shot were told they must provide proof of doctrine from an established religious organization. Several employees who provided letters from clergy were still denied exemptions by the hospital.
The consent decree states that Saint Vincent, from now on, "shall not require proof that an employee's or applicant's religious objection to vaccination be an official tenet or endorsed teaching of any religion or denomination."

The hospital also cannot conclude that a person's "religious belief, practice or observance is not sincerely held simply because (Saint Vincent) deems the belief, practice or observance unreasonable, inaccurate, unfounded, illogical or inconsistent in Saint Vincent's view."

Saint Vincent, which was founded by the Roman Catholic Sisters of St. Joseph of Northwestern Pennsylvania, stopped requiring all employees to get a flu shot after it joined Allegheny Health Network, Laurent said.

ATF Stays Mum on ‘Officer-Involved Death’ of Suspect in Milwaukee



The ATF is keeping quiet about an “officer-involved death” of a
suspect in Milwaukee last week.

“I apologize, I know it’s really confusing,” ATF media contact Ashlee
Sherrill of the St. Paul field office told the Milwaukee Journal
Sentinel. “But we don’t want to compromise the investigation.”

The Wisconsin Department of Justice is investigating the case.

The ATF was leading an operation Thursday that involved serving an
arrest warrant on Bruce Young, who was accused of possessing illegal
explosives. Young fled and was under pursuit when he shot himself,
according to the Department of Justice.

Some call it the ultimate breach of public trust.

Palm Beach County Sheriff's deputy Frantz Felisma faced a federal judge in West Palm Beach on Thursday, charged with stealing people's personal information from his department-issued laptop, and selling it.

Federal agents say the man to whom Felisma sold the information, then set up credit card and bank accounts, and ran up tens of thousands of dollars in fraudulent charges in the names of at least 15 victims.

"There is so much information contained within those databases," said former FBI agent Stuart Kaplan, who's now an attorney based in Palm Beach Gardens.

Kaplan said a law enforcement officer has access to the driver and vehicle information system, as well as the FBI's crime database.

"And if that information gets into the wrong hands, unfortunately it could have devastating consequences," said Kaplan.

Court documents indicate Felisma's alleged co-conspirator pled guilty to identity fraud this past summer. The man, according to agents, said he paid Deputy Felisma thousands of dollars for information on drivers of high-end cars.

"Ironically, what's kept in the National Crime Information Center (FBI database) is those people who have already been victimized by identity theft," Kaplan pointed out, meaning some have likely been victimized multiple times now.

CNN political commentator Angela Rye said she was subjected to an

San Bernardino County deputy accused of having sex with teen in Explorer program

A 14-year veteran of the San Bernardino County Sheriff’s Department has been arrested and booked on suspicion of having unlawful sexual intercourse with a teenage girl participating in the department’s youth Explorer program, authorities said.

Martin Bormann – A New Body of Evidence

When anyone mentions the name Martin Bormann most baby-boomers will know who he was, they will also be quick to tell you that even though there was a wild goose chase across the globe to find him, he certainly died in 1945, proved they say, by the finding of his bones in Berlin in 1972. Martin Bormann Hitler’s right hand man and chancellor, the man that controlled all of the vast Nazi loot was tried in absentia in October 1946 at the Nuremberg trials. Found guilty of war crimes and sentenced to death by hanging, Bormann evaded the noose due to his mysterious disappearance.

Two Nazi witnesses at the Nuremberg trials testified to the fact that they had seen Bormann and fellow Nazi, Dr Ludwig Stumpfegger dead, only hours after fleeing the bunker where Hitler had supposedly put a bullet through his brain. One going as far as to say that he had even seen Bormann’s dead ”moonlit face”.

From 1945 the hunt for Martin Bormann was on. During the confusion of those early post war years, the West German government kept the heat up, but UKUSA’s ‘hunt’ was only, If anything, luke-warm. A concentrated search effort had been made in 1945 around the site of the supposed ‘moonlit’ scenario of Bormann and Stumpfegger, with who he was last seen alive. With the advantage of hordes of allied troops on the ground to co-ordinate a thorough search, no stone was left unturned. The same was done independently by a Russian recon group, after Lieutenant General Konstantin Telegin, of the Soviet 5th Shock Army was delivered of a diary said to be of Bormann’s, found near the same site.

In those early post war years, it was not yet a ‘cold case’, with memories still fresh and the ground still soft. Any such corpses although decomposed, would have certainly been on, or near the surface and easily identifiable with the minimum of forensics; but not as much as a scrap of flesh was found of either man. At least they had some disputable charred remains of Hitler, but the bodies of Bormann and Stumpfegger had literally vanished into thin air, along with the Nazi loot.

But after construction workers came across human remains near the Lehrter station in Berlin in 1972, the world’s press gathered to hear if this was indeed Bormann. Bormann’s Nazi dentist Dr Hugo Blaschke was called and he recalled from memory his former patient’s dental physiology and gave testimony that they were one and the same, the case was closed. It was not until 1998 that due to modern science the remains were subjected to a DNA forensic study by the West German prosecutor. The reason for this new 1998 investigation was that in 1996 Christopher Creighton, aka John Ainsworth-Davis a former British Naval Intelligence agent and member of the covert British group C.O.P.P (Combined Operations Pilotage Parties) had published a book, OPJB(Operation James Bond). In the book, Creighton using a pseudonym claims that along with Ian Fleming, he was instructed by Winston Churchill and Desmond Morton the head of Secret British intelligence section V to rescue Martin Bormann from a burning Berlin in May 1945. The book, passed off as a novel to protect Creighton from serious breach consequences of the Official Secrets Act unsettled the German government so much that a thorough forensics and DNA investigation was carried out on the remains. The forensic results came back after the legal medical team matched blood from a Bormann relative, the match was positive.

A confirmation of the remains being those of Bormann was released to the world’s press, along with the statement that Martin Bormann had certainly died in 1945 at the site his remains were found.

Due to the 1998 DNA confirmation of the Skeleton, Modern historians teach their students that stories of Bormann escaping to South America are false, nothing more than the rantings of conspiracy theorists and madmen. Investigative journalists and even former intelligence agents have been continually slandered after they have released information to the contrary, that there has been a cover up by the western allies, that not only did Bormann escape, but his escape was orchestrated by the British intelligence services with the support of the United States government.

Anyone that dares to raise any questions as to the true dynamics of Bormann’s disappearance and death, are discredited based only on the DNA match which confirm the remains as being

Former FBI agent Grimm wants his law license back in southeast NY


Staten Island's former congressman, Michael Grimm, who was convicted for tax evasion has asked a federal appeals court to reinstate his law license.

STATEN ISLAND, N.Y -- Former Congressman Michael Grimm, who was convicted for tax evasion, is appealing a federal court ruling to reinstate his law license in the southern district of New York, where he was previously disbarred.

Attorneys for Grimm maintain that he should get a one-year suspension instead of disbarment from practicing law in the federal court system in the southern district of New York, said a source who requested anonymity.

Grimm voluntarily agreed to a two-year suspension of his law license in the state of Connecticut, and an interim suspension in New York state, as of September, said the source.

New York state's appellate division has yet to hand down a final disciplinary action against Grimm. But federal grievance officials in the southern district of New York disbarred him.

Grimm's lawyers argue others convicted of worse crimes have eventually been allowed to practice law again, and they want the federal court to hold off on its disciplinary action until the state rules on the case.

It has been over a decade since I first read Vonnegut’s Deadeye Dick, but I still remember that sentence jumping out at me. It made enough of an impression that I could almost recall it verbatim from memory, even as I discovered when trying to find the passage, that I had forgotten the novel’s major plot point. The sentence stood out to me, because while being aware of American history I knew of the relentless repression that members of the Communist Party faced, at sixteen years of age I could not not fathom how anyone could view attempting to join the Abraham Lincoln Brigade, a group of American volunteers who fought in the Spanish Civil War on behalf of the Republican government against fascists, fascist that were backed by Nazi Germany and Fascist Italy, as adverse information. 2

If one was to read Senator John McCain’s “Salute to a Communist” in last week’s New York Times, they would be left with a similar impression. After all, here we have a conservative Republican (of the US variety, not the Spanish) Senator writing fairly laudatory words about someone he concedes was an “unreconstructed Communist” because he joined the Abraham Lincoln Brigade. The Communist in question was Delmer Berg, who was the last known surviving member of the Abraham Lincoln Brigade and recently passed away at the age of 100.*

A Legacy of Repression

Yet, Vonnegut’s depiction of official attitudes to veterans of the Abraham Lincoln Brigade circa 1944 is fairly accurate. As Peter N. Carroll, author of The Odyssey of the Abraham Lincoln Brigade, told the Dissent NewsWire, “Senator McCain’s surprising tribute to the Abraham Lincoln Brigade showed a rare appreciation for the moral courage of those 2,800 Americans who defied US neutrality laws to fight against fascism during the Spanish Civil War. Unfortunately, he gives scant attention to the harsh response they received from federal and state agencies upon their return.”

There are times when I’m not sure why I ever actually expect more from our justice system.  Last February, a Waco, TX FBI agent, a sniper and member of the FBI SWAT team, Lovett Leslie Ledger, Jr. shot and killed a neighbor’s little 3-lb chihuahua named Sassy, with a pellet rifle and although indicted for felony animal cruelty the only ones who paid for this crime were the dog with its life and the family who lost their tiny little furry family member.

Cyndi Mitchell, who lives across the street from FBI agent, Lovett Leslie Ledger, told authorities that she witnessed Ledger shoot the dog in front of her house with a pellet rifle on Feb. 29.
Mitchell has said that her dogs were barking and she went to the door and saw Sassy walking on Estes Road in front of her house.
The dog lurched to one side upon being shot, then rolled into a yard where she died, she has said.
“I’ve never heard a noise like that from an animal,” Mitchell said, describing it as “a screaming sound.”
As neighbors gathered around the fallen dog, Ledger took the pellet gun, turned and walked inside his house with one of his children.
Initially when confronted by authorities about the crime, Ledger lied but changed his story when witnesses came forward.
He was later indicted by a grand jury for cruelty to animals, a state jail felony punishable by up to two years in a state jail and a $10,000 fine.

Pleading no contest, Judge Matt Johnson in 54th District Court sentenced Ledger to two years deferred probation and ordered to perform 300 hours of community service. Not only that, if he completes the term of probation, the conviction will be expunged from his record.

FBI spokesman Erik Vasys said Wednesday the agency will determine whether Ledger faces any sanctions, which could range from suspension to dismissal, after an internal inquiry is completed. Initially it was reported that if convicted of the felony, that would mostly likely be the end of his career, with Ledger getting deferred adjudication probation, the FBI will probably just let him get away with it too. After all, if the justice system doesn’t care, why should they. It was “just a dog” after all!

FBI settles eavesdropping lawsuit with wife of inside trader
NEW YORK – The wife of a convicted inside trader has chalked up a rare win over the FBI, with the agency agreeing to settle a lawsuit that claimed agents eavesdropped on her intimate conversations with her husband.
Arlene Villamia Drimal, wife of former Galleon Group LLC trader Craig Drimal, sued 16 FBI agents, claiming they “wrongfully intercepted” more than 180 private calls between her and her husband during the investigation. Terms of the settlement weren’t made public.
The Federal Bureau of Investigation doesn’t usually settle such lawsuits, but the bureau is coming under increasing scrutiny in white-collar crime probes. The settlement with Villamia Drimal comes as an FBI agent potentially faces criminal charges for leaking details of another insider-trading investigation to the New York Times and Wall Street Journal. In that case, Las Vegas gambler Billy Walters is attempting to have insider-trading charges thrown out because of the leaks.
Soon after a judge refused in July to throw out all of Villamia Drimal’s claims, settlement talks began, the two sides said in a joint court filing.
Villamia Drimal sued in 2012 the current and former agents who tapped her husband’s phone during an investigation that also brought down Galleon Group co-founder Raj Rajaratnam.
Villamia Drimal claimed the agents were required to stop listening once it became apparent the calls were between husband and wife. Such conversations are considered confidential and can’t be used in court.
The agents listened in anyway. The U.S. Attorney in New York later characterized one such incident as “indefensible,” Villamia Drimal said in her complaint. She didn’t make the content of the calls public, other than to say that many “involved deeply personal and intimate issues.”
A judge in 2011 said he was “deeply troubled” by the agency’s failure to stop listening to unrelated, personal calls.

U.S. prosecutors on Wednesday identified the FBI agent who they say admitted to leaking information to reporters about an insider trading probe involving a Las Vegas sports gambler and golfer Phil Mickelson.

David Chaves, a Federal Bureau of Investigation coordinating supervisory special agent, was named in court papers filed in Manhattan federal court as the agent prosecutors say leaked details about the probe of gambler William “Billy” Walters.

Prosecutors have said the agent, who they previously had not identified, admitted on Dec. 6 to being a “significant source” of information about the investigation in 2013 and 2014 for reporters at The Wall Street Journal and The New York Times.

Those newspapers published a series of reports beginning in 2014 about the investigation, two years before prosecutors in May brought insider trading charges against Walters, who has built a fortune as a sports bettor.

The leaks are now the subject of a criminal investigation by the Justice Department’s Office of the Inspector General, prosecutors disclosed Dec. 21. Walters’ lawyers are meanwhile expected to seek the case’s dismissal as a result of the leaks.

Chaves, who oversaw the FBI squad that conducted the investigation, has not been charged in connection with the leaks. His lawyer did not immediately respond to requests for comment. A lawyer for Walters declined comment.

Washington (CNN) -- An FBI employee shared confidential information with his girlfriend, who was a news reporter, then later threatened to release a sex tape the two had made.
A supervisor watched pornographic videos in his office during work hours while "satisfying himself."
And an employee in a "leadership position" misused a government database to check on two friends who were exotic dancers and allowed them into an FBI office after hours.
These are among confidential summaries of FBI disciplinary reports obtained by CNN, which describe misconduct by agency supervisors, agents and other employees over the last three years.

The reports, compiled by the FBI's Office of Professional Responsibility, are e-mailed quarterly to FBI employees, but are not released to the public.
And despite the bureau's very strict screening procedure for all prospective employees, the FBI confirms that about 325 to 350 employees a year receive some kind of discipline, ranging from a reprimand to suspension.
About 30 employees each year are fired.

Hudson Bay to Experience Periods of Above Freezing Temperatures, Possible Rainfall During January of 2017
Earlier this morning, warm winds rushing in from the south ahead of an extensive frontal system draped across central and eastern North America pulled 32 + degree Fahrenheit (0 + C) temperatures into the southern coastal area of Hudson Bay. These temperatures were around 30 to 35 degrees (F) above normal. An odd event to say the least. One that would have been far less likely to happen without the added kick provided by global warming in the range of 1.2 C above 1880s averages.

Such a kick has been pushing climate zones northward — sparking numerous instances of unseasonable weather. Meanwhile, some researchers have indicated that the Jet Stream has also tended to produce higher amplitude ridges and troughs as the Northern Hemisphere polar zone has warmed faster than the rest of the world. In these more extensive ridge zones, this climate change related alteration to atmospheric circulation provides big avenues for warm air to enter typically frozen regions during winter (please see Arctic Melt ‘Already Affecting Weather Patterns Where You Live Right Now’).

Similar ridging in the Jet Stream is expected to occur over Central Canada five to six days from now on Monday and Tuesday of January 16-17, again over extreme southern Hudson Bay on Wednesday, January 18, and once more over the southern half of Hudson Bay on Monday, January 23rd.

Warming during the 16th and 17th is expected to range from 30 to 38 Fahrenheit (17 to 21 C) above average. Meanwhile, the longer range forecast may see temperatures hit near 40 F (22 C) above average for some regions if the model guidance ends up being correct.

It’s worth noting that the five day forecast is rather uncertain and the longer range forecast at this time is highly uncertain. That said, the models do indicate a particularly strong tendency for Jet Stream ridging and associated anomalous warming for this region.

Today’s warming occurred in association with strong frontal storm system anchored by a 976 mb low. This coming Monday’s warming is expected to come in conjunction with a much less stormy warm front. The long range model for January 23rd shows an odd event where another strong frontal storm pulls a curtain of rainfall over much of southern Hudson Bay (which typically receives only frozen precipitation at this time of year).

Over the past two years, large ridges have tended to drive warm air into the Arctic over the Bering Sea, through Alaska and Northwest Canada, and up through the North Atlantic and the Barents. But during early 2017, ridging appears to be setting up for Central and Northern North America — which is providing the warmer middle latitude air mass with an invasion route toward Hudson Bay. And such periods of anomalous warmth will tend to have a weakening effect on sea ice cover in this vulnerable near-Arctic region.

WEST BATH, Maine — A charge of aggravated operating under the influence filed against the correctional administrator for Two Bridges Regional Jail in Wiscasset will be dismissed, and he will plead to a lesser charge if he abides by conditions set by a judge on Tuesday.

Mark Westrum, 56, of Bath must provide proof by May 1 that he has completed counseling and must continue regular attendance at Alcoholics Anonymous meetings to the satisfaction of the district attorney’s office, according to a deferred disposition signed by Westrum, his attorney, former Lincoln County Assistant District Attorney Andrew Wright, and Androscoggin County Assistant District Attorney Nathan Walsh.

If Westrum abides by the special conditions, as well as standard conditions that include refraining from further criminal conduct, no use or possession of drugs or alcohol, not being present in any business that serves alcohol and submitting to a search of his home or vehicle upon request of law enforcement, a complaint of aggravated operating under the influence with a blood-alcohol level of greater than 0.15 percent will be dismissed, and Westrum will plead guilty to the lesser charge of operating under the influence, according to court documents.

In that case, he will be sentenced to the mandatory minimum $500 fine and 150-day loss of license.


Westrum has been administrator of the jail, which serves Sagadahoc and Lincoln counties, for more than eight years, and he served as sheriff in Sagadahoc County from 1993 to 2008.

Westrum was arrested the night of Oct. 8, 2016, on Front Street after Bath police Officer Mike Lever spotted his vehicle operating without lights, according to police records.

Police declined to provide specifics of the arrest and did not take a mugshot

Garrett Brosnan was sentenced to a year and a day in prison after an Arizona girl's parents filed a complaint.

Garrett Brosnan, a Brunswick police officer who pleaded guilty to sending obscene material to a minor girl was sentenced to a year and a day in federal prison Wednesday in U.S. District Court in Portland.

Brosnan, 25, was arrested in June after an investigation that began in October 2015, when the parents of a 13-year-old girl in Arizona complained that someone had engaged in online conversations that were sexual in nature with their daughter. According to the allegations, a Department of Homeland Security agent, posing as a 14-year-old girl, then began having conversations via computers with Brosnan, who, they said, sent pictures of his genitals in June.

Prosecutors had sought at least 15 months for Brosnan and submitted a sentencing memo that included screen shots of the conversations between Brosnan and the person he thought was a 14-year-old girl, in which he pushes repeatedly to see pictures of the girl topless or nude, accusing her of being a “tease” when she hesitates. Brosnan also allegedly sent short videos in which he winks and blows kisses.


Assistant U.S. Attorney Craig Wolff said the exchanges clearly show that Brosnan thought the girl was 14 in their online conversations. At one point, the agent referred to the “girl” having an upcoming 8th-grade graduation ceremony. He also said that Brosnan pressured the girl for nude pictures, saying he loved her or would cut off the conversations if she didn’t send the pictures.

Brosnan’s attorney, Michael A. Cunniff, told District Judge Jon Levy that his client had taken responsibility for what he he had done by pleading guilty in June, getting counseling and resigning his position as a police officer.

In a brief statement to the court, Brosnan apologized for his conduct and said he was grateful to have gotten caught because it gave him an opportunity to turn his life around.

“The guilt will be with me until the day I die,” he said.

Cuniff also told the judge that Brosnan would be “vulnerable” in jail as a former police officer and he asked for a sentence of probation or a short jail term followed by home confinement.

Levy said he was unpersuaded by that argument, saying that Brosnan’s law enforcement background actually made his behavior “more inexcusable,” although Brosnan apparently did not mention to the undercover agent that he was a police officer or use that in trying to convince the “girl” he was conversing with to send nude photos.

Levy said federal sentencing guidelines, which take into account things like a prior criminal record, whether someone has taken responsibility for a crime and if there was a guilty plea instead of a trial, called for a term of 12 to 18 months in prison. But he said he lowered the severity level because it included the fact that the crime was committed using a computer. Levy said that the prevalence of computers in society, along with their frequent use for personal commmunications, made that provision calling for a longer sentence out-of-date.

South Florida Cop Stripped of Badge and Gun Six Months After Kidnapping Woman for Sex




Miami Gardens Police Sergeant Javier Romaguera was transporting a mentally ill woman to a home she had lived in last July when he checked her into a hotel and tried to have sex with her.

Romaguera fondled her breasts and tried to kiss her, but the 23-year-old woman declined his advances, so he left the room.

However, he filed a report saying he had dropped her off at a home where she had previously lived, which turned out to be a lie

Meanwhile, a friend of the woman, Jensen Mondesir, who had been trying to track her down, even notifying the Miami Gardens Police Department who told him they dropped her off at her prior residence, eventually received a call from her.

After the woman told Mondesir what had happened, he filed an internal affairs complaint against Romaguera.



They hired an attorney, who obtained a receipt from the Stadium Hotel, which confirmed that Romaguera booked a room that night under his name, listing the address of the police department as his address.

However, it was not until Local 10 investigative reporter Bob Norman began asking questions that the department suspended him. And even that took four months.

The incident began on July 11, 2016 when Romaguera was responding to a call of a woman running in traffic.

“I’m giving a transport to a black female,” Romaguera can be heard saying to dispatch according to a recording obtained by Local 10.

Mondesir filed his internal affairs complaint on July 15, 2016, but nothing happened until Norman began investigating the complaint in October, which resulted in the cop being placed on desk duty the following month.

According to Norman’s article dated November 12, 2016:

“She explained that the officer told her that she was beautiful, that he liked her, and that he was getting them a room at ‘his’ hotel,” Mondesir wrote in the complaint, filed July 15. “She told me that he came [onto] her, wanting to kiss her, and said she would not leave the room until they finished.”

Mondesir also wrote that she “blanks out from there.” Her attorney, Lopez, has taken a sworn statement from the alleged victim and sent a letter notifying the police department of his intent to file a lawsuit. Lopez believes Romaguera violated her Constitutional rights and much more.

“He committed armed kidnapping and he committed attempted sexual assault,” Lopez said. Romaguera “was armed. She didn’t run. She didn’t call police, because he was the police.”

Lopez said the case was made more egregious, because of the extreme vulnerability of his client.

“She comes into this country, she’s suffering from mental illness, this person is destitute, this person is alone,” Lopez said. “And Javier Romaguera knew that and that is why he preyed on her.”

Lopez said he expects Romaguera to try to use his client’s mental health issues against her.

“He’s hoping that he can just point the finger and say, ‘She’s crazy, she’s making it up,'” said Lopez, adding that the evidence overwhelms any such argument. “The evidence will support that he had no rhyme or reason to take any of the actions he took that night.”

But after two months of desk duty, Romaguera was stripped of his badge and gun, according to an article published by Norman on Monday, January 9, 2017.

He has also been barred from entering the Miami Gardens Police Department as the “investigation” continues, which sources told Local 10 is being conducted by the Florida Department of Law Enforcement.

Speaking of which, another Miami Gardens cop was fired in May 2016 after it was discovered he used his badge to coerce a woman to have sex with him.

But as of today, Deandre Morris has not been charged, even though the Florida Department of Law Enforcement has been investigating him for alleged sexual battery since March of last year.

Romaguera is one of a multitude of Miami Gardens police officers named in a lawsuit filed by Earl Sampson, who made national news in 2013 when it was discovered he had been arrested 56 times for trespassing in the convenience store in which he worked.

In 2015, Miami Gardens Police Chief Stephen Edward Johnson – who had been hired the previous year to repair the department’s negative image from the Sampson story – was arrested and fired for attempting to hire a prostitute through backpage.com, a site that announced this week it was shutting down its adult section after pressure from the government.

Unlike Romaguera and Morris, the chief did not try to use his badge and gun to coerce sex from the women, nor was he in uniform or on the clock at the time.

He merely wanted to pay $100 to have sex with two women, who turned out to be undercover cops, as you can see in the video below.

Border Patrol officials are accused in a lawsuit of destroying surveillance footage of poor conditions inside detention facilities in Arizona.

The National Immigration Law Center filed a motion Monday that alleged Border Patrol knowingly recorded over videos and handed over unwatchable footage, BuzzFeed reports.

“This is yet another example of an agency going out of its way to keep the horrible conditions in these facilities out of the public eye,” Karen Tumlin, managing attorney for NILC, told BuzzFeed News.

Great stuff, Donnie. And to prove you mean business, I know just the CEO you should target first: Her name is Ivanka. Yes, your daughter!

Ivanka's multimillion-dollar line of clothing and accessories are sold through major national retailers, ranging from Macy's to Amazon, and she pitches her Ivanka Trump-branded dresses, handbags, boots, blouses, etc. to America's working women. Yet, practically all of her products are made on the cheap in factories anywhere but America, with most coming from the low-wage bastions of China, Indonesia and Vietnam. Imagine the message it would send to runaway corporations and the integrity it would establish for The Donald if he slapped his first tariffs on Ivanka's goods!

But neither Daddy Trump nor his daughter wants to discuss the embarrassing conflict between his political bluster and her ethic of runaway capitalism. Instead, she's tried to dodge the issue by saying it doesn't matter, since she'll "separate" herself from the business if she becomes a White House advisor.

Nice try, Ivanka, but the stench of hypocrisy will only grow nastier if you're at your father's side while he castigates and punishes other corporations that have absconded from America. The only way to salvage even an iota of moral virtue is to repatriate the manufacturing of your brand-name apparel. And bringing those middle-class jobs home to the good ol' US of A would also make a powerful political statement.

But no, showing that money trumps both political savvy and the morality of simply doing what's right, Ivanka says her corporate brand will stay offshore. As a spokeswoman put it: "We want to make responsible business decisions."

Really? How does that "Make America Great Again?"

But take heed, for I have good news, folks : our new president says he's planning a tax holiday for you!

Well... not directly for you. Trump's trillion-dollar whopper of a tax break will go to only a handful of multinational corporations, such as Apple, GE, Johnson & Johnson and Microsoft. However, Trump and Congress will push for cuts in your name, insisting that the trickle-down effect will be to create thousands of new jobs for America's hard-hit working stiffs.

Here's the deal: The giants of Big Pharma, Silicon Valley and other global industries have dodged paying the taxes they owe to our country by stashing about $2-trillion worth of their profits in offshore bank accounts. Now they want to bring this pile of loot back here to their homeland — yet they want to be rewarded for doing so by having the taxes they owe to us slashed. Enter The Donald, who has delighted those scofflaws by offering a better deal than even they'd proposed: an income tax rate of only 10 percent, versus the 30 percent you and I pay for America's upkeep. Trust me, exclaims The Donald. They'll expand their business here and generate jobs for you!

I was born at night, but it wasn't last night. We've been suckered with this tax holiday scam before. In 2004, George W. Bush pulled it on us — and instead of creating jobs, the corporate tax-dodgers eliminated thousands more of our jobs!

Why'd that happen? Because they put their "repatriated" profits not into expanding business, but by buying back their corporation's stock, which jacks up the payout to top executives and the richest shareholders, and by shrinking the number of businesses by buying up competitors and firing duplicate workforces.

The way to know whether or not Trump's tax holiday will benefit workers is to see if it requires that corporations actually create the thousands of good jobs promised before they ge
