I wanted to bring to your attention a crucial whistleblower bill that's awaiting action in the House-possibly the most important whistleblower anti-corruption legislation since the Dodd-Frank Act.

The bipartisan Anti-Money Laundering (AML) Whistleblower Improvement Act (Senate Bill 3316 and House Bill 7195) is critical to protecting whistleblowers who expose money laundering in the U.S. and abroad. The two reforms in the Act are modeled off provisions of the Dodd-Frank Act, which established the highly successful SEC and CFTC whistleblower programs.

The bottom line is that the AMl Whistleblower Improvement Act will empower money laundering whistleblowers to report financial crimes and incentivize disclosures about Russian oligarchs and their hidden wealth. This bill will directly help the United States' efforts in Ukraine and be instrumental in the fight against corruption worldwide.

The bill was passed in the Senate by a unanimous 100-0 vote during a lame duck session, and it is close to the finish line. All that is needed is for Representative Rosa DeLauro (D-CT), Chair of the House Appropriations Committee to support a vote in the House.

BPD Makes Little Progress After Overtime Audit
In March 2022, the Berkeley City Auditor published an audit of the Berkeley Police Department’s use of overtime, but BPD has not made substantial progress on the issues pointed out in the report.
Here are some highlights from that audit:
BPD exceeded its General Fund budget four out of the last five years, in large part due to overtime costs
* In FY 2020, BPD surpassed its $71.0 million allocation by $4.8 million.
* BPD does not adhere to its overtime controls. In FY 2020, 21% of sworn officers exceeded BPD’s overtime limit at least once. Without adequate enforcement and tools to manage overtime, BPD cannot mitigate risks of officer fatigue and mistakes.
* The audit also found that BPD contracts out officers as private security for businesses. In fact, 53% of police overtime hours logged in 2020 were working as private security for the Apple store.
Out of the eleven recommendations made in this audit, BPD has yet to start five.

Thanks to drug legalization, there’s a new “drug corridor” that Kansas law enforcement is taking advantage of. Colorado legalized recreational marijuana use in 2012. Ever since then, state troopers have camped out on I-70 to stop people heading to or from the weed-friendly state. One of the most prominent cases has been that of Birmingham, Ala., black Mayor Richard Arrington, a former college professor who says he has been the subject of FBI scrutiny since the early 1970s and was the target of several sting operations from 1987 through 1989.
Arrington’s attorney Donald V. Watkins, compiled a report detailing operations against other black officials, and submitted that report to the Justice Department’s Office of Professional Responsibility.
The report includes details from affidavits submitted by Atlanta attorney and former FBI undercover operative Hirsch Friedman. He testified in 1987 that the FBI had a policy called Fruhmenschen - a German term for ″primitive man″ - that selectively targeted African-American elected and appointed officials for investigation, according to the report.
The Friedman affidavits said the policy was based on ″the assumption by the FBI that black officials were intellectually and socially incapable of governing major governmental operations and institutions.″

It has been more than 1,800 days since the FBI said it would correct its incorrect total of (allegedly) uncrackable encrypted devices in its possession. Back in the glory days of its “going dark” narrative, the FBI claimed it had more than 7,800 impenetrable devices in its possession. Some congressional scrutiny, much of it spearheaded by Senator Ron Wyden, forced the FBI to actually take a look at its presumed totals. That additional scrutiny forced the FBI to admit its tracking software had vastly over-represented its supposed encryption problem.
The promised corrections have yet to arrive. Instead, we’re left with nothing but the footnotes added to every public statement/document the FBI misrepresented the encryption “problem.”
This nearly-six-year failure to correct the device count hasn’t prevented the FBI from continuing to claim (without even its own facts in evidence) encryption is doing

Barr McClellan studied at the University of Texas in Austin. As a student McClellan was a strong supporter of John F. Kennedy. After qualifying as a lawyer he went to work for the administration of President Lyndon B. Johnson. Initially he worked for the National Labor Relations Board but in 1964 he became an attorney for the Federal Power Commission.
In 1966 McClellan joined the legal firm of Clark, Thomas and Winters, based in Austin, Texas. At that time the firm was run by the partners Edward Clark, Sam Winters, Don Thomas and Frank Denius. The company was closely associated with Lyndon B. Johnson and the Democratic Party in Texas. McClellan's work included advising on political strategy, campaign contributions, media issues and labour disputes.
In 1972 McClellan became a full partner in the legal firm. It was only at this stage that he was told about the illegal activities of the firm. John Cofer explained how the partners dealt with criminal activity: "In short, we helped plan crimes and keep the clients out of trouble." Soon afterwards he discovered that one of the partners, Edward Clark, had been involved in planning the assassination of John F. Kennedy.

BPD Officer Accused of Racist Violence in Federal Lawsuit
Copwatcher with footage from 2017: "It's hard to believe that BPD had no idea that this guy has such a racism problem"
We are not surprised by allegations of racist violence and a federal lawsuit filed against Berkeley and Berkeley Police Sergeant David Marble. The recent lawsuit describes an incident on July 16, 2022, when Brian Lindhurst Jr was visiting a friend in Antioch, who happens to be a neighbor of Marble’s. The lawsuit alleges that Marble approached the men, used racial slurs, punched Lindhurst in the face and threatened him with a gun. 

Berkeley Copwatch has identified footage of Marble from 2017 that clearly demonstrates his racial animus as he interrupts a young, Black man to say, “Don’t give me that ‘Black’ crap.” He proceeds to escalate the situation and falsely arrests the man, who is eventually released after being threatened with force and arrest.

This video corroborates Lindhurst’s account of racist violence. The video shows a situation of false arrest becoming escalated and increasingly dangerous for the detained man. The man was outraged because he knew his rights, knew that it was a false arrest and knew that it was racially motivated. To our knowledge, no complaint or lawsuit was ever filed in this situation. 

According to Paul Kealoha Blake, the Copwatcher who recorded the original incident in 2017, “This is just one of the many times that I have encountered Marble on the street over the years. He is almost always messing with a person of color. It's hard to believe that BPD had no idea that this guy has such a racism problem.” 

In a recent Berkeleyside article, Matthai Chakko claims that there are “systems of review, investigation and discipline built into our police operations.” In fact, BPD and the civilian oversight board, the Police Accountability Board (PAB), are not protecting the community from racist police violence. The Berkeley police often refuse to report and share information with outside agencies. The BPD continues to prevent the PAB from its investigations by withholding necessary information and access. This prevents PAB from fulfilling its charter to provide oversight and accountability of the BPD. 

Berkeley Copwatch demands:   
• Officer Marble must be removed from the BPD so he can no longer intimidate, degrade and abuse our community. 
• The Berkeley City Council must address racism within BPD and release those who engage in it. 
• The Contra Costa District Attorney must review the incident and re-consider charging him with hate crimes as described by the plaintiff.

subpoenaed Patrick Knowlton to testify before Kenneth Starr's Whitewater grand jury. I had the honor of being Patrick's lawyer.
The evidence of murder cover-up comes from several sources, each of which
independently proves the crime. It is substantiated in an Associate Independent
Counsel's 30-page memorandum, in that prosecutor's resignation letter to Kenneth
Starr, and in surreptitiously taped telephone interviews with him. The proof also
appears in a 500-page analysis of Starr's Report on the Death of Vincent W. Foster, Jr., filed in federal courts including the U.S. Supreme Court. And evidence of murder cover- up even appears in the Appendix to Starr's Report on the death, by court order. The existence of that court-ordered Appendix proves unequivocally that the media had been apprised of the murder cover-up on September 26, 1997, when the Special Division of the U.S. Court of Appeals ordered Starr to attach evidence of murder cover- up—by Starr's own FBI investigators—to his Report. Starr had vigorously opposed that ruling. Murder. Vince Foster, Bill Clinton's deputy White House Counsel, was shot at close range, on Tuesday, July 20, 1993, between 2:00 p.m. and 4:00 p.m. The bullet entered on the right side of his neck, just below the jaw line, and into his skull, where it remained. The bullet was small-caliber. It was a "reload," with a light powder charge, used to minimize blowback onto the shooter. The location was a secluded area of a tiny national park just miles from the Whitehouse. The park was almost always deserted. 9-1-1 Call. The murderers would expect that the body would be "discovered" when the Park Police closed the park at dark. But something went wrong. A call went into 9-1-1 at 6:00 p.m. Two County Fire and Rescue arrived at 6:09 p.m., followed by nine more over the next ten minutes. One Park Police Officer was already there. County personnel observed, and reported, variously, somebody running away from the 8body site, the bullet wound in the neck, a place-holder

In fact, membership in the Gestapo was relatively small. This chapter discusses the local operation of the new police network wherein the routine enforcement of laws was central and focused. In this chapter the local operation of the police, its set-up and the people behind it are studied. Emphasis is placed on the history of the institution, its tasks and personnel, its relationship to the police network and the Nazi Party. Its members were not merely Nazi fanatics but were men placed after a thorough purge from the older political police. Most of its members as well were not originally members of the Nazi Party but were trained police men. The Gestapo was a small force comprised of experts without the omnipotence often attributed to it, but it relied on the collaboration of organizations and institutions and even on the German population itself.
