Marcy Park, Virginia, Plaintiff reported to authorities what he
had seen in the park approximately 70 minutes before the
discovery of Mr. Foster's body.
4. In April and May, 1994, Defendant Monroe, then an FBI
agent detailed to the Office of regulatory Independent Counsel
Robert Fiske, interviewed Plaintiff. Plaintiff repeatedly told
Monroe that the Arkansas Honda he saw in the Fort Marcy lot,
found parked in the same space as Mr. Foster's was later found,
was older than Mr. Foster's 1989 Honda. And the two car color
panels that Plaintiff identified to Monroe as being the same
color as the car he had seen at the park correspond only to
Hondas and only for the year models 1983 and 1984.
Notwithstanding these facts, Monroe falsified Plaintiff's account
and misreported that Plaintiff identified the car he saw as a
"1988 to 1990" year-model, which coincided with Mr. Foster's 1989
car. Because Mr. Foster was dead by the time Plaintiff visited
Fort Marcy Park, Plaintiff's information refutes the official
conclusion that Mr. Foster drove his car there.
5. Shortly after Plaintiff learned from a reporter that
Defendant Monroe had falsified his account, Plaintiff's account
of what he had witnessed at Fort Marcy and contradic

and practice of COINTELPRO – the purpose of which was to maintain the existing social and political order by the use of techniques carrying a serious risk of physical, emotional, and economic damage. For a while now, thanks in part to the reporting of the Washington Post’s Spencer Hsu, it’s been known that something was not quite right with the FBI’s hair forensics unit in the past. But only but only recently has the FBI admitted that failings within the unit led to hundreds, maybe thousands of questionable convictions before 2000.

Police sexual abuse of women includes a disturbing pattern of police officer exploitation of teenage girls. The majority of these cases, moreover, involve girls who are enrolled in police department-sponsored Explorers programs designed to give teens an understanding of police work.
** A San Bernardino, California sheriff’s deputy was sentenced to 120 days in jail in April, 2003 for the statutory rape of a 16-year-old Explorer scout.
** A Clackamas County, Oregon sheriff’s department lieutenant was demoted in July, 2002 for having a sexual relationship with an 18-year-old Explorer scout.
** In June, 2003 an Anaheim, California officer charged with oral copulation with a 17- year old Explorer fled to his native England. California authorities are seeking to have him extradited.
** A Philadelphia, Pennsylvania police officer with the department mounted patrol unit was sentenced to prison in 2003 for over 100 sexual acts with a 13-year old girl enrolled in his riding club.
** In the most high profile case, Los Angeles Police Department Deputy Chief David Kalish was suspended after being accused having molested a male Explorer in the 1970s. Deputy Chief Kalish has been suspended and the case is being reviewed by the Los Angeles District Attorney.
** Five of the 32 Explorer-related cases (including the Kalish case) involved sexual molestation of boys.

He was born on April 7, 1946, in Binghamton, New York, the son of Frank and Harriet De Luca.
At age one, Peter moved with his family to Twin Falls, Idaho, where he spent his youth. After graduating high school, he attended the College of Idaho, where he received a degree in Political Science and made many lifelong friends. After graduation, he joined the United States Air Force and served as a Sargent with the 13th Air Force unit during the Vietnam War. He spent a year serving in the Philippines, a deployment which he said changed his life. He then returned home to serve in the Air Force Law Office in Las Vegas. While serving, he wrote a letter to J. Edgar Hoover, arguing that the actions of the FBI at the time had encroached upon the basic principles of freedom upon which our country was founded. He wrote that Hoover should be removed from office, and President Nixon should be impeached. He was very proud that his letter resulted in the creation of his own FBI file and being flagged for monitoring by his superiors in the Air Force. Nearly 340,000 cases of homicide and non-negligent manslaughter went unsolved from 1965 to 2021, according to the FBI’s Uniform Crime Report data studied by The Murder Accountability Project. Below are the total number of homicides reported in each state, the rate at which homicides are cleared and the estimated number of unsolved homicides.

 September reverted back to being a noticeably warmer than usual month that kept it in line with most of the other months of 2023 so far.  This was especially true of the average mins which ended up being 5.3F degrees warmer than usual for a typical September.  This compared with the average maxes which were “only” 2.7F degrees warmer than usual.  Part of the reason had to do with the extended summer-like warmth than occurred during the first third of the month and which also had summer-like humidity.  But even when the general pattern cooled off during the middle of the month when we tended to get more Canadian or north Atlantic air, nightly temperatures and humidity levels continued to be noticeably milder than usual since both Canada and the north Atlantic continued to be much warmer than usual.  We also had a peculiar precipitation pattern throughout the course of the month which could be broken up into thirds.  The first third was hot and humid with a lot of tropical air coming up the east coast; the second third was seasonably cooler but still humid as a number of moisture-laden storms passed by, including a near miss by Hurricane Lee; and finally, the last third of the month remained seasonably cooler, but also much drier with no rain at all for the whole period.  I should point out that strong high pressure that had become stuck over Quebec during the latter part of the month blocked the advance of a very wet low pressure system that caused record flooding in the New York City area along with lesser amounts in southern New England.  But that’s as close as the rain came to our region since the high pressure remained stuck in place over us; all we saw were some broken clouds as well as some high level haze from the continuous wild fires that were still burning across much of Quebec under that blocking high pressure system.  We ended up with 15 cooling degrees rather than the 105 heating degrees that a more “normal” September would have had because of the excessive warmth that persisted all month.  This compares with 112 heating degrees for last year which was a bit cooler than usual.

While it’s not ultimately a factor in the court’s decision, it’s nice to see a court call out biased policing while discussing the merits of the case. It’s futile to believe biased policing isn’t the norm in the United States. There’s simply too much data to dispute. In this decision, even more data is presented that makes it clear “driving while black” (DWB) is considered reasonable suspicion for a traffic stop and, often, a vehicle search by far too many US law enforcement officers.
This one starts with a pretext: a minor traffic violation three officers hoped to convert into a search of the vehicle the black man was driving.
Deshaun Carpenter was driving an “older model” Dodge Nitro with one broken taillight and a small object suspended from the rearview mirror when three officers curbed the car, ordered Carpenter out, and asked whether “narcotics” or “weapons” were in the vehicle.
As courts have often noted in cases like these, any pretext will do as long as the pretext holds up. In this case, it didn’t. As soon as the officers were questioned in court during the trial, the pretext fell apart.
An officer admitted on cross-examination that a single broken taillight was not a lawful basis for a stop.

The FCC is expected to vote to restore net neutrality rules on April 25. And while there’re early indications that the rules may be slightly weaker than those stripped away by the Trump administration — and absolutely no indication the rules could meaningfully impact telecom revenues — telecom giants have already begun their whining about “burdensome regulation” in earnest.
Revolving door poster child Michael Powell, who once led the FCC but now lobbies for the cable industry, was quick to once again insist that the basic net neutrality rules would result in a parade of horribles:
Powell, the CEO of cable lobby group NCTA-The Internet & Television Association, was the FCC chairman under President George W. Bush. Powell said the FCC must “reverse course to avoid years of litigation and uncertainty” in a reference to the inevitable lawsuits that industry groups will file against the agency.
The NCTA said in another statement that the FCC “is pushing unnecessary regulation that will slam the brakes on Internet for all and deny millions—especially in rural areas—the important opportunities that high-speed Internet brings.”
As is usually the case with net neutrality fights, none of that is actually true. The courts have already ruled that it’s well within the FCC’s right to impose or repeal net neutrality rules provided their arguments are based in factual reality. The only thing the FCC can’t do is abdicate its federal consumer protection authority, then try and tell states what to do (something the Trump FCC tried and failed to accomplish).

There are few groups of people cops like less than people who don’t like cops. But it’s not that these people don’t like cops, per se. It’s that they’re tired of cops doing whatever they want whenever they want with near-zero accountability.
Cops continue to bad things, like murder unarmed people while “effecting arrests.” These actions prompt protests. Police are asked to oversee these protests to prevent things like further violence and/or property damage. Because they’re asked to police anti-police protests, they far too often choose to treat protected First Amendment expression as a criminal act.
It’s very much human nature to respond to antipathy with some of your own. The problem is cops are expected to rise above this human response to carry out their directives: keeping the peace and ensuring laws are respected by protesters.
But they don’t respect protesters, much less their rights. So, even if protesters are respecting the laws, law enforcement officers are going to do what they want to do, no matter how violent or unconstitutional it is. That’s the upshot of slew of documents obtained by the Brennan Center following several public records requests, as well as the inevitable litigation it took to force the Washington DC Metro Police to comply with the district’s public records laws.

Supreme Court Says It’s Fine For Cops To Dick Around For Months Or Years After Seizing People’s Cars

The Supreme Court has recognized there’s something definitely wrong with asset forfeiture. But, so far, it has yet to attempt to put a full stop to it.
A recent case dealt with criminal asset forfeiture. In that case, the nation’s top court ruled it was unconstitutional for the government to seize assets worth far more than the maximum fine it could levy for the criminal charges accompanying the seizure. In that case, cops took a $42,000 Range Rover in exchange for a sale of $260 worth of heroin to an undercover officer. Given that this crime had a max fine of $10,000, the Supreme Court said taking the Range Rover was an “excessive fine” — something that violates the Eighth and Fourteenth Amendments.
But the justices said this also applied to civil asset forfeiture. And in civil cases, criminal charges usually aren’t filed, which means any forfeiture would be an “excessive fine” because the applicable fine in cases with no criminal charges is always going to be… $0.
Unfortunately, the 2019 ruling changed little about forfeiture programs. Most still operate the way they always have and will likely continue to do so until another legal challenge reaches the upper levels of the court system.
This case did manage to make it to the top court in the land. But there’s no win to be had here for people whose property is taken by opportunistic cops who operate in locales with permissive forfeiture laws. Here are the facts of the case, as reported by Adam Liptak for the New York Times.
The court ruled in two cases. One of them started after Halima Culley bought a 2015 Nissan Altima for her son to use at college. He was pulled over by the police in 2019 and arrested when they found marijuana. They also seized Ms. Culley’s car.
That same year, Lena Sutton lent her 2012 Chevrolet Sonic to a friend. He was stopped for speeding and arrested after the police found methamphetamine. Ms. Sutton’s car was also seized.
Alabama law in effect at the time let so-called innocent owners reclaim seized property, and both women ultimately persuaded judges to return their cars. It took more than a year in each case, though there was some dispute about whether the women could have done more to hasten the process.
Ms. Culley and Ms. Sutton filed class actions in federal court saying that they should have been afforded prompt interim hearings to argue for the return of the vehicles while their cases moved forward. Lower courts ruled against them.

Is Google signaling the end of the open web? That’s some of the concern raised by its new embrace of AI. While most of the fears about AI may be overblown, this one could be legit. But it doesn’t mean that we need to accept it.
These days, there is certainly a lot of hype and nonsense about artificial intelligence and the ways that it can impact all kinds of industries and businesses. Last week at Google IO, Google made it clear that they’re moving forward with what it calls “AI overviews,” in which Google’s own Gemini AI tech will try to generate answers at the top of search pages.
All week I’ve been hearing people fretting about this, sharing some statement similar to Kevin Roose at the NY Times asking if the open web can survive such a thing.
In the early days, Google’s entire mission was to get you off their site as quickly as possible. In a 2004 interview with Playboy magazine that was later immortalized in a regulatory filing with the SEC (due to concerns of them violating quiet period restrictions), Larry Page famously made clear that their goal was to quickly help you find what you want and send you on your way:
