     The Federal Bureau of Investigation is the most powerful and secretive agency in the United States today. Despite the bureau's influence over a broad terrain of American life, independent examinations of the "B," as special agents refer to it, have been rare. (In the sixties The Nation published a special issue on the bureau by Fred Cook, which became The FBI Nobody Knows.) No Congressional committee has mustered the political will and staff to carry out a comprehensive review. With the bureau's political power greater than at any time in its eighty-nine-year history, an examination of the questions of how well it is performing its crime-fighting mission and safeguarding civil liberties is overdue. Beyond the recent series of F.B.I. problems—the tragedy at Waco, the shootout at Ruby Ridge, the Atlanta Olympic Park bombing, the flawed investigations by its scientific lab—are there broader kinds of defects that demand attention? We asked David Burnham, a reporter who has specialized in law-enforcement issues for thirty years, to review the current state of the F.B.I. With research support from The Nation Institute's Investigative Fund, Burnham availed himself of an entirely new kind of information—internal administrative data maintained by the Justice Department, which tracks every instance an investigative agency like the F.B.I. refers a matter for prosecution and the ultimate disposition of these referrals. Data tapes containing this detailed information, from the mid-seventies to fiscal year 1996, were obtained under the Freedom of Information Act by the Transactional Records Access Clearinghouse (TRAC), a research organization formed in 1989 by Burnham and Susan Long, a professor at Syracuse University. Even though the Berkeley city council enacted the recommendations from both the Fair & Impartial Policing program and the Reimagining Public Safety program, racial disparities for Black people in Berkeley worsened under Interim Police Chief Louis’ leadership.

In 2022, Black people were 7 times more likely per capita than white people to get stopped while driving, 4 times more likely to be stopped on a bicycle and almost 9 times more likely to be stopped on foot. Even though low-level offenses were supposed to be eliminated, the BPD continues to make low level stops (i.e. seatbelt, expired tags, faulty equipment) that especially target Black people. 
The majority of Berkeley residents support reimagining public safety, eradicating racism and classism from our community, focusing on care and not enforcement and upholding equity and justice.

Under the watch of Interim Chief Jen Louis, we have seen racist, anti-homeless text messages between BPD officers on duty, the alleged use of arrest quotas (illegal in California), the denial of Miranda rights to juveniles, an increase in racial disparities in police stops from 2018-2022, questionable overtime practices and Interim Chief Louis herself violating the police code of conduct with substantiated sexual harassment claims against her (that were later removed from her record by the city manager).

In fact, when City Manager Williams-Ridley tried to promote Interim Chief Jen Louis last November, the promotion was met with such opposition that Williams-Ridley withdrew the promotion and instead promised investigations into the text messages and arrest quotas. Those investigations are still ongoing.
 
Yet, Interim Chief Louis has given the city council an ultimatum: promote me now or I’ll quit. We say no to intimidation tactics and status quo racist policing in Berkeley. No Jen! Just Justice

Sirhan Sirhan was hypno-programmed using hypnosis drugs, and torture by. Among others, the Reverend Jerry Owen and CIA mind-control specialist William Bryan hypno-programmed Sirhan at a stable where he worked months before the shooting. Also working there, at the same time, was Thomas Bremer, the brother of Arthur Bremer who, in 1972, shot Presidential Contender George Wallace. I believe the present scope of surveillance by Federal intelligence agencies of the legitimate political and personal activities of our citizens represents a dangerous threat to fundamental constitutional rights. But this threat to our privacy and freedom has been shockingly and dramatically demonstrated to me in another way. I have recently read an FBI intelligence report written by an agent assigned to cover the Earth Day rally in Washington last year. Among those whose political actions were reported for the benefit of our criminal, military, and security intelligence agencies was myself. This FBI report mentions no hint of violence, no threat of insurrection, and no foreboding of illegal behavior.

What Can FBI Data Say About Crime in 2021? It’s Too Unreliable to Tell
The transition to a new data system creates huge gaps in national crime stats sure to be exploited by politicians in this election year.

Nearly 40% of law enforcement agencies around the country did not submit any data in 2021 to a newly revised FBI crime statistics collection program, leaving a massive gap in information sure to be exploited by politicians in midterm election campaigns already dominated by public fear over a rise in violent crime.

The gap includes the nation’s two largest cities by population, New York City and Los Angeles, as well as most agencies in five of the six most populous states: California, New York, Illinois, Pennsylvania, and Florida. (See if your local police reported.)

In 2021, the FBI retired its nearly century-old national crime data collection program, the Summary Reporting System used by the Uniform Crime Reporting (UCR) program. The agency switched to a new system, the National Incident-Based Reporting System (NIBRS), which gathers more specific information on each incident. Even though the FBI announced the transition years ago and the federal government spent hundreds of millions of dollars to help local police make the switch, about 7,000 of the nation’s 18,000 law enforcement agencies did not successfully send crime data to the voluntary program last year.

We’re getting a bit more clarity and commonsense applied to lawsuits involving constitutional violations by TSA agents.
As we’re all painfully aware, to fly is to spend some time in often uncomfortably close proximity to a TSA officer. That’s the bargain we make when we choose to board a plane. These searches are far from consensual. And these searches are, far too often, extremely intrusive.
And yet, despite being given certain law enforcement powers (including the ability to restrict someone’s freedom by disrupting their travel plans), federal courts treat TSA officers (TSOs in the courts’ parlance) as regular government employees who sit beyond the reach of the Federal Tort Claims Act.
That has changed in (extremely) recent years. A lawsuit filed by a passenger ended up in the Third Circuit Appeals Court. Twice. The passenger was frisked, handcuffed, and arrested

One of the most interesting features of the copaganda I’ve studied is how brutal things are laundered with progressive language to be sold under a new label.  This is what one of my clients once called “covering a turd with M&Ms.”
This happened last year when proponents of a failed recall campaign for the DA in Los Angeles tried to portray themselves as “progressive.” The idea that the Los Angeles Republican donors and carceral unions pushing the recall were also truly “progressives” was something that their public relations operatives repeated in nearly every interview I tracked. They knew that, whatever the content of what they are proposing and what they would implement if successful, in a city like Los Angeles, they couldn’t be seen as a purely right-wing effort even though funded by and organized by right wing money and police/prosecutor unions.  The campaign to entrench the same old policies that benefit (and harm) the same social groups only works in a place like Los Angeles if right-wing forces

The FBI has seen one of its key databases hacked, and it looks as though a major security failure on the part of the bureau is to blame.
As KrebsonSecurity reports, InfraGard is described by hackers as "a social media intelligence hub for high profile persons." The FBI describes InfraGard as connecting "owners and operators within critical infrastructure to the FBI, to provide education, information sharing, networking, and workshops on emerging technologies and threats." In other words, it's a database of high-profile, security-conscious people in the US.
That database is now up for sale on the Breached cybercrime forum for $50,000, offering access to the contact information of over 80,000 InfraGard members.

The indiscriminate shootings of Israelis by Hamas and other Palestinian resistance organizations, the kidnapping of civilians, the barrage of rockets into Israel, drone attacks on a variety of targets from tanks to automated machine gun nests, are the familiar language of the Israeli occupier. Israel has spoken this blood-soaked language of violence to the Palestinians since Zionist militias seized more than 78 percent of historic Palestine, destroyed some 530 Palestinian villages and cities and killed about 15,000 Palestinians in more than 70 massacres. Some 750,000 Palestinians were ethnically cleansed between 1947 and 1949 to create the state of Israel in 1948.

Israel’s response to these armed incursions will be a genocidal assault on Gaza. Israel will kill dozens of Palestinians for every Israeli killed. Hundreds of Palestinians have already died in Israel air assaults since the launch of “Operation Al-Aqsa Flood” on Saturday morning, which left 700 Israelis dead.

Prime Minister Netanyahu warned Palestinians in Gaza on Sunday to “leave now,” because Israel is going to “turn all Hamas hiding places into rubble.”

But where are Palestinians in Gaza supposed to go? Israel and Egypt blockade the land borders. There is no exit by air or sea, which are controlled by Israel.

The collective retribution against innocents is a familiar tactic employed by colonial rulers. We used it against Native Americans and later in the Philippines and Vietnam. The Germans used it against the Herero and Namaqua in Namibia. The British in Kenya and Malaya. The Nazis used it in the areas they occupied in the Soviet Union, Eastern and Central Europe. Israel follows the same playbook. Death for death. Atrocity for atrocity. But it is always the occupier who initiates this macabre dance and trades piles of corpses for higher piles of corpses.

This is not to defend the war crimes by either side. It is not to rejoice in the attacks. I have seen enough violence in the Israeli occupied territories, where I covered the conflict for seven years, to loathe violence. But this is the familiar denouement to all settler-colonial projects. Regimes implanted and maintained by violence engender violence. The Haitian war of liberation. The Mau Mau in Kenya. The African National Congress in South Africa. These uprisings do not always succeed, but they follow familiar patterns. The Palestinians, like all colonized people, have a right to armed resistance under international law.

Israel never had any interest in an equitable settlement with the Palestinians. It built an apartheid state and has steadily absorbed larger and larger tracts of Palestinian land in a slow motion campaign of ethnic cleansing. It turned Gaza in 2007 into the world’s largest open air prison.

What does Israel, or the world community, expect? How can you trap 2.3 million people in Gaza, half of whom are unemployed, in one of the most densely populated spots on the planet for 16 years, reduce the lives of its residents, half of whom are children, to a subsistence level, deprive them of basic medical supplies, food, water and electricity, use attack aircraft, artillery, mechanized units, missiles, naval guns and infantry units to randomly slaughter unarmed civilians and not expect a violent response? Israel is currently carrying out waves of aerial assaults on Gaza, preparing a ground invasion and has cut the power to Gaza, which usually only operates two to four hours per day.

Many of the resistance fighters who infiltrated into Israel undoubtedly knew they would be killed. But like resistance fighters in other wars of liberation they decided that if they could not choose how they would live, they would choose how they would die.

I was a close friend of Alina Margolis-Edelman who was part of the armed resistance in the Warsaw Ghetto uprising in World War II. Her husband, Marek Edelman, was the deputy commander of the uprising and the only leader to survive the war. The Nazis had sealed 400,000 Polish Jews inside the Warsaw Ghetto. The trapped Jews died in the thousands, from starvation, disease and indiscriminate violence. When the Nazis began to transport the remaining Jews to the extermination camps the resistance fighters fought back. None expected to survive.

Edelman, after the war, condemned Zionism as a racist ideology used to justify the theft of Palestinian land. He sided with the Palestinians, supported their armed resistance and met frequently with Palestinians leaders. He thundered against Israel’s appropriation of the Holocaust to justify its repression of the Palestinian people. While Israel dined out on the mythology of the ghetto uprising, it treated the only surviving leader of the uprising, who refused to leave Poland, as a pariah. Edelman understood that the lesson of the Holocaust and the ghetto uprising was not that Jews are morally superior or eternal victims. History, Edelman said, belongs to everyone. The oppressed, including the Palestinians, had a right to fight for equality, dignity and liberty.

“To be a Jew means always being with the oppressed and never the oppressors,” Edelman said.

The Warsaw uprising has long inspired the Palestinians. Representatives of the Palestine Liberation Organization (PLO) used to lay a wreath at the annual commemoration of the uprising in Poland at the Warsaw Ghetto monument.

The more violence the colonizer expends to subdue the occupied, the more it transforms itself into a monster. The current government of Israel is populated by Jewish extremists, fanatic Zionists and religious bigots who are dismantling Israeli democracy and calling for the wholesale expulsion or murder of Palestinians, including those who live inside Israel.

The Israeli philosopher Yeshayahu Leibowitz, whom Isiah Berlin called “the conscience of Israel,” warned that if Israel did not separate church and state it would give rise to a corrupt rabbinate that would warp Judaism into a fascistic cult.

“Religious nationalism is to religion what National Socialism was to socialism,” said Leibowitz, who died in 1994.

He understood that the blind veneration of the military, especially after the 1967 war that captured Egypt's Sinai, Gaza, the West Bank (including East Jerusalem) and Syria's Golan Heights, was dangerous and would lead to the ultimate destruction of Israel, along with any hope of democracy.

“Our situation will deteriorate to that of a second Vietnam, to a war in constant escalation without prospect of ultimate resolution,” he warned.

He foresaw that “the Arabs would be the working people and the Jews the administrators, inspectors, officials, and police — mainly secret police. A state ruling a hostile population of 1.5 million to 2 million foreigners would necessarily become a secret-police state, with all that this implies for education, free speech and democratic institutions. The corruption characteristic of every colonial regime would also prevail in the State of Israel. The administration would have to suppress Arab insurgency on the one hand and acquire Arab Quislings on the other. There is also good reason to fear that the Israel Defense Force, which has been until now a people’s army, would, as a result of being transformed into an army of occupation, degenerate, and its commanders, who will have become military governors, resemble their colleagues in other nations.”

He saw that prolonged occupation of the Palestinians would inevitably spawn “concentration camps.”

“Israel,” he said, “would not deserve to exist, and it will not be worthwhile to preserve it.”

The next stage of this struggle will be a massive campaign of industrial slaughter in Gaza by Israel, which has already begun. Israel is convinced greater levels of violence will finally crush Palestinian aspirations. Israel is mistaken. The terror Israel inflicts is the terror it will get.

Freedom of Information Act (FOIA) requests show that, even today, the Federal Bureau of Investigation (FBI) is withholding thousands of pages of documents relevant to intelligence obtained before Japan’s 1941 attack on Pearl Harbor. The files involved were not supplied to the nine subsequent official enquires into the disaster. As a consequence, even now, there has been no adequate investigation of how the Bureau and other agencies handled the pre-attack intelligence. Instead, the commanders in chief in Hawaii at the time, the Navy’s Admiral Husband E. Kimmel and the Army’s Lieutenant General Walter Short, bore the brunt of the blame.
Enough is known about two of the withheld files to establish that they relate to Japanese espionage in Hawaii. One, the FBI has told us, contains more than 2,500 pages relating to 1941 alone. A copy of a document from the file, which we discovered among released State Department files, may explain the withholding. It shows that an FBI source identified Japan’s most important spy in Hawaii, a consular official using the name Tadashi Morimura, nearly five months before the attack.
This crucial bit of intelligence, however, led to no breakthrough in divining the intentions of the Japanese military. Instead, Hoover’s agents squandered this and other opportunities to find out what Japan was planning:
More than a year before the attack, the FBI had identified a German resident in Hawaii, Otto Kühn, as a possible spy for Germany’s ally, Japan. It noted that Kühn was living beyond his means and often entertained US military personnel

In the war of words over who was to blame for the surprise Japanese attack on Pearl Harbor 41 years ago, fresh evidence is emerging that the late FBI director J. Edgar Hoover had a hand in the intelligence bungles that led the United States to heed none of the warnings that the invasion was imminent.
The new evidence is supplied by Michigan State University historians John F. Bratzel and Leslie B. Rout Jr., who write in the current issue of The American Historical Review that Hoover received a double warning more than three months before the attack that the Japanese were thinking of making a surprise aircraft attack on the American fleet in Pearl Harbor.

William Weyland Turner was born in Buffalo, New York, on 14th April, 1927. At seventeen he enlisted in the United States Navy. During the Second World War he served on board an LST in the Pacific.
After the war Turner enrolled at Canisius College, a Jesuit school, and in 1949 obtained a degree in chemistry. Turner also played semi-professional baseball and ice hockey.
Turner joined the Federal Bureau of Investigation (FBI) in 1951. He worked for the FBI for ten years but grew increasingly concerned with the way J. Edgar Hoover ran the organization. Turner became convinced that Hoover was placing too much emphasis on the dangers of the American Communist Party. Instead, he felt he should be using more resources to tackle organized crime. In 1961 Turner was dismissed from the FBI. He hired Edward Bennett Williams and sued the FBI but lost. However he did manage to get anti-Hoover testimony by other agents into the record.
Turner became a journalist. In 1963 he investigated the assassination of President John F. Kennedy and concluded that he was the victim of a conspiracy. Later he worked with Jim Garrison, the district attorney of New Orleans. Turner and Garrison argued that a group of right-wing activists, including Guy Bannister, David Ferrie, Carlos Bringuier and Clay Shaw were involved in a conspiracy with the Central Intelligence Agency (CIA) to kill Kennedy. A law passed last year has now taken effect in California. This attempt to limit pretextual stops and biased policing means California law enforcement officers will no longer be able to start every traffic stop with an impromptu Q&A session. They’ll have to get right to the point.
Here’s what the law says:
(a) A peace officer making a traffic or pedestrian stop, before engaging in questioning related to a criminal investigation or traffic violation, shall state the reason for the stop. The officer shall document the reason for the stop on any citation or police report resulting from the stop.
And this is what it would look like in practice, as stated late last year by a California law enforcement official:
“This is instead of the officer asking a driver, ‘Do you know why I pulled you over?’” LAPD Captain Steven Ramos told the commission. “Now, the onus is on the officer to tell the individual why they pulled them over.”
Which is the way it should always be everywhere. That question has always been stupid. You pulled me over. You tell me. It’s not a serious question.

Law enforcement officers learned long ago that if all they have is a crime scene and no likely suspects, there was no reason to wear out shoe leather beating the streets for alleged criminals. They don’t even need to leave the office. All they have to do is produce a subpoena for certain third-party records and/or convince a judge that the only “probable cause” they need to demonstrate is the probability Google houses the data they seek.

In his book Mein Kampf, written in the 1920s, Hitler said, “Whoever has the youth has the future.” Even before they came to power in 1933, Nazi leaders had begun to organize groups that would train young people according to Nazi principles. By 1936, all “Aryan” children in Germany over the age of six were required to join a Nazi youth group. At ten, boys were initiated into the Jungvolk (Young People), and at 14 they were promoted to the Hitler Youth. Their sisters joined the Jungmädel (Young Girls) and were later promoted to the League of German Girls. Hitler hoped that “These young people will learn nothing else but how to think German and act German. . . . And they will never be free again, not in their whole lives.”
Kogon argued that the SS was a homogenized entity, not only in terms of its operation but also the character of its members. SS officers, he wrote, were “maladjusted and frustrated… total social failures.” Psychologist Leo Alexander, who wrote part of the Nuremberg’s penal code, compared SS officers to common criminals. Rudolf Pechel, editor and resistance fighter, maintained you could recognize SS officers simply from the dull, lifeless look in their eyes. 
Christopher Browning found a particularly promising research topic in the form of Reserve Police Battalion 101, a paramilitary organization under SS leadership that carried out mass executions in The Police Battalion was unique among Nazi paramilitary groups because it consisted mostly of volunteers, less than one-fourth of which were members of the Nazi party. While these volunteers were given the choice whether or not to participate in the ongoing genocide, more than 80% of them agreed to follow orders. Browning’s book, Ordinary Men, influenced by the Milgram experiment, argues that the volunteers did so primarily out of pressure to conform to expectations from their peers.

Police officer Ayron Taylor, 24, of Moorestown, was charged with 97 counts in an indictment returned by a grand jury on Feb. 15, including distribution of child pornography because some of the photos of the approximately 20 women were taken when they were underage, Bradshaw said.
