Obviously, some conversations have an expectation of privacy, even when they’re held in police interrogation rooms. Those would be ones between the suspect and their legal representation. But that’s not really a Fourth Amendment issue as it is about privileged communications. The government isn’t allowed to eavesdrop on suspects as they work on a legal defense and/or make statements to their lawyer.

This is an interesting case with some very serious implications.
For the most part, anything discarded by a suspect fleeing from law enforcement officers can be searched or seized without a warrant. For years, this wasn’t necessarily a problem. The stuff discarded ranged from bags containing “substances” to wallets to the occasional backpack. The intrusion was limited and, in most cases, the evidentiary value (drug baggies, recently fired guns, etc.) was self-evident.
But in this case — one in which the ACLU has filed an amicus brief — the expectation of privacy is a bit more important. Previously, the Supreme Court rejected plenty of government arguments when it ruled that phones seized during arrests required a warrant to be searched. One of the many arguments rejected was this: that searching a phone was like searching a suspect’s pockets or the trunk

It’s a running joke here at Techdirt that many elected officials in charge of copyright policy seem wholly ignorant of the subject. But sometimes, it’s still shocking when people who should definitely know better brazenly parade their cluelessness.
Enter Jerry Nadler, the highest-ranking Democrat on the House Judiciary Committee, and a man who has been knee-deep in copyright policy for many years. His recent comments on intellectual property weren’t just ignorant, they were downright pathetic.
This one is from a month ago, but it’s been gnawing away at me for a few weeks. I figured it was still worth calling out. Last month, the House Judiciary Committee held a hearing on “Intellectual Property,” and ranking member (i.e., top Democrat) Jerry Nadler’s opening remarks were so far off-base and factually lacking that it deserves to be discussed.
Nadler has long been a reliable voice for copyright maximalism, and Hollywood has rewarded him accordingly. But, really, some of these comments were just beyond the pale:

The Wild West we all imagine contains two forms of law: the brave people who’ve decided to be sheriffs. And the vigilantes who perform frontier justice when not cashing in bounties while ignoring the enshrined civil rights (the Constitution came out ahead of the Wild West, non-American folks) of the people they beat, tortured, threatened, and (if my movie recollections are accurate) tied to the back of their horses and drug to the nearest town.
A couple hundred years later and nothing’s changed but the entities performing the majority of rights violations. Bounty hunters still exist but rarely make headlines. Sheriffs, however, are still treated as kings among men, capable of doing all sorts of evil while rarely being subjected to even the very low bar of accountability we apply to regular cops.
