Question
What effect would a phaser set to kill have on Data?

Answer
It depends on how high into the "kill" setting it was. According to the Next Generation Technical Manual, 24th Century phasers have 16 settings. The lowest is a light stun setting and the intensity causes progressively more damage up to setting 16, which is listed as causing extreme explosive reactions or molecular disruption.

From the description(s) in the manual I think Data could withstand a phaser setting somewhere between 8 and 9. Setting 8 is where most biological materials begin to disrupt, and most non-organic materials.

More dense matter such as medium alloys or ceramic structural materials begin to disintegrate at Setting 9 so I think a phaser at that setting would begin to cause Data some damage.

Any higher than that I think he would experience massive structural damage and possibly impariment of his internal functions from the energy discharge.
