Order of the President
Order of the President of the Federal Constitutional Court of 1 December 2021 regarding entry to the court building for persons visiting the Court
On the basis of the powers of the President of the Federal Constitutional Court to enact and enforce house rules for the Court, I issue the following order with immediate effect. This order serves to prevent infections with COVID-19 (SARS-CoV-2) and implements the Ordinance of the Land Government of Baden-Württemberg on Measures to Control the Spread of SARS-CoV-2 (COVID-19 Ordinance). It applies in addition to the general rules governing entrance to the Court.
Anyone visiting the Court must be refused entry to the court building if they cannot provide proof of vaccination, recovery or a negative test within the meaning of § 2 nos. 3, 5 or 7 of the COVID-19 Ordinance. A negative test result must not be older than 24 hours (rapid lateral flow tests) or 48 hours (PCR tests).
In addition, anyone visiting the Court must be refused entry if they display visible symptoms that might indicate a possible infection with COVID-19 (particularly signs of respiratory illness, flu-like symptoms, fever, runny nose, sore throat and cough).
Anyone visiting the Court is required to disinfect their hands before entering the building. The hand sanitizer provided in the entrance area must be used for this purpose.
Anyone visiting the Court is required to wear a medical face mask while they are in the court building. Parties to the proceedings and visitors attending a court session must do so until they have taken their seats in the courtroom. The exemptions laid down in § 3(2) no. 2 of the COVID-19 Ordinance apply. The safety measures to be observed for the court session are determined by the order of the presiding Justice issued in exercise of their powers to maintain order in court. Medical face masks will be provided to visitors and anyone attending a court session who is not in possession of a mask.
Anyone visiting the Court who refuses to wear a medical face mask without falling under one of the exemptions in § 3(2) no. 4 of the COVID-19 Ordinance will be denied entry to the Court by the Director of the Federal Constitutional Court or a person authorised by the Director.
Once the court session has ended, all visitors and parties to the proceedings must leave the building promptly.
If persons wishing to attend an oral hearing or the pronouncement of a judgment are denied entry to the building, the presiding Justice of the competent Senate of the Federal Constitutional Court must be informed of this without undue delay.
This order is valid until revoked.
