Charged Conduct Occurred Over the Course of Two Decades in New York, Connecticut, Illinois and California

A five-count superseding indictment was unsealed today in federal court in Brooklyn charging R&B singer Robert Sylvester Kelly, also known as “R. Kelly,” with racketeering predicated on criminal conduct including sexual exploitation of children, kidnapping, forced labor and Mann Act violations involving the coercion and transportation of women and girls in interstate commerce to engage in illegal sexual activity. Kelly is also charged with four counts of violating the Mann Act related to his interstate transportation of a victim to New York to engage in illegal sexual activity, and his exposure of her to an infectious venereal disease without her knowledge. Also today, Kelly was charged in a separate federal indictment unsealed in the Northern District of Illinois with federal child pornography and obstruction charges.

Kelly will appear this afternoon for a removal hearing at the federal courthouse in Chicago, Illinois. On a later date, Kelly will be arraigned on this superseding indictment in Brooklyn. This case is assigned to the United States District Judge Ann M. Donnelly.

Richard P. Donoghue, United States Attorney for the Eastern District of New York, Angel M. Melendez, Special Agent-in-Charge, United States Department of Homeland Security, Homeland Security Investigations, New York Field Office (HSI), and James P. O’Neill, Commissioner, New York City Police Department (NYPD), announced the charges.

“As alleged, R. Kelly, together with employees and members of his entourage, engaged in a racketeering enterprise that preyed upon women and girls who attended his concerts so that the victims could be available to engage in illegal sexual activity with him at a moment’s notice,” stated United States Attorney Donoghue. “Today that comes to an end. This indictment makes clear that fame and power will not shield anyone from prosecution, particularly predators who victimize vulnerable members of our communities for their own sexual gratification.”

“R. Kelly’s Enterprise was not only engaged in music; as alleged, for two decades the enterprise at the direction of R. Kelly preyed upon young women and teenagers whose dreams of meeting a superstar, soon turned into a nightmare of rape, child pornography and forced labor. The musician turned predator allegedly used his stardom to coax some victims into nefarious sex acts while certain members of his enterprise calculatingly facilitated the aberrant conduct. Today’s indictment charging racketeering is a clear indication of the extent of his criminal activity, which involves coercion and kidnapping. This investigation was built with the foresight of special agents and detectives assigned to the joint HSI and NYPD Public Safety Task Force, along with prosecutors of the Eastern District of New York. R. Kelly believed he could fly, but it will be justice to see his oppressive wings clipped,” stated HSI Special Agent-in-Charge Melendez.

“The NYPD is committed to ensuring that child predators are taken off our streets and prosecuted to the fullest extent of the law. I thank our skilled NYPD detectives and our law enforcement partners for their unified work to provide justice for the victims of these despicable crimes. Those who engage in these reprehensible offenses against our most vulnerable will be pursued relentlessly, and held accountable for the pain and suffering they cause,” stated NYPD Commissioner O’Neill.

According to the superseding indictment and other court filings, Kelly and individuals who served as his managers, bodyguards, drivers, personal assistants and runners, as well as members of his entourage, comprised a racketeering enterprise (the Enterprise) that operated for over two decades in New York, Illinois, Connecticut, California and elsewhere. Kelly, as leader of the Enterprise, used his fame to recruit women and girls to engage in illegal sexual activity with him and others. The superseding indictment alleges that Kelly identified these girls and women and then directed members of the Enterprise to escort them backstage or to events following his musical performances. Kelly also exchanged contact information with girls and women so that he and other members of the Enterprise could arrange travel and lodging for them to visit Kelly and engage in the charged illegal sexual conduct.

Kelly issued rules that many of his sexual partners were required to follow, including that the women and girls were to call him “Daddy”; they were not permitted to leave their rooms to eat or visit the bathroom without receiving his permission; they were required to wear baggy clothing when not accompanying Kelly to an event; and they were directed to keep their heads down and not look at other men. Kelly also isolated the women and girls from their friends and family, and made them dependent on him for their financial well-being.
Earlier today, federal agents executed a search warrant at Kelly’s residence.

The charges in the superseding indictment are allegations, and the defendant is presumed innocent unless and until proven guilty.

If convicted, Kelly faces a sentence of up to 20 years’ imprisonment for the Racketeering and two Mann Act Coercion and Enticement counts respectively, and up to 10 years’ imprisonment for each of the Mann Act Transportation counts.

One of the theories circulating about Jeffrey Epstein makes a certain logical sense on its face and yet, in practice – as something that really could be case as opposed to merely possible – it just seems too far-fetched. It goes like this. Running a procurement ring can’t make you billions or even hundreds of millions of dollars. Even an extortion ring couldn’t really put together those numbers. But maybe it worked something like this. Epstein does have some kind of money management fund. Maybe it’s not very successful. Maybe it’s just invested in an index fund or treasury bonds. But what if Epstein has the goods on a bunch of high rollers and for Epstein to stay silent they invest in his fund?

At least logically speaking, it works. It explains why no one can find anyone who invests in Epstein’s fund. It also explains why Epstein doesn’t seem to have the organizational footprint you would need to manage such a fund and perhaps why his trades would haven’t shown up on anyone’s radar.

As I said, the moving parts seem to fit together logically. But it’s simply too fantastical and cinematic to really be true. Indeed, as we noted yesterday, it seems clear that there’s just not a lot of evidence Epstein is as wealthy as the myth he’s woven around himself suggests. So maybe the fantastical scale of riches doesn’t have to be explained at all.

But Michelle Celarier reports in New York Magazine that a lot of real hedge funders in New York seem to think this was what was happening. Of course, perhaps they’re just speculating on the base of the false or at least unsupported premise that Epstein is fantastically wealthy. But Celarier flags something else which seems far more probative. Virginia Roberts Giuffre, one of Epstein’s accusers, said Epstein did pretty much just this in a 2015 affidavit.

Here’s the relevant passage from New York Magazine piece …

If the blackmail theory sounds far-fetched, it’s worth keeping in mind that it was also floated by one of Epstein’s victims, Virginia Roberts Giuffre. “Epstein … also got girls for Epstein’s friends and acquaintances. Epstein specifically told me that the reason for him doing this was so that they would ‘owe him,’ they would ‘be in his pocket,’ and he would ‘have something on them,’” she said in a court affidavit, according to the investigative series in the Miami Herald that brought the case back to the public’s attention late last year.

In the 2015 filing, Giuffre claimed that Epstein “debriefed her” after she was forced into sexual encounters so that he could possess “intimate and potentially embarrassing information” to blackmail friends into parking their money with him. She also said photographic and video evidence existed — an assertion that looms especially large now that federal investigators have found a trove of images in Epstein’s home safe.


How credible this claim is I don’t know. Ghislaine Maxwell, Epstein’s one-time girlfriend and alleged procurer/recruiter has made all sorts of claims about Guiffre’s lack of credibility in her own legal battle with Guiffre. Guiffre has also claimed that she had sex with Prince Andrew and Alan Dershowitz at Epstein’s and Maxwell’s behest. Both these men deny the claim.

The specific claims about gathering compromising information and debriefing the underaged girls recruited for Epstein and others we have to treat as unverified. But it is at least is a credible claim by someone in a position to know that some sort of organized blackmail – hard or soft – was part of Epstein’s MO – not just speculation by people trying to figure out what his racket was.

If Epstein’s wealth isn’t quite as fantastical as he wanted people to believe then there’s less to explain. Some good chunk of his wealth seems to have come from or been seeded through his Epstein’s relationship to clothing magnate Leslie Wexner. So maybe this method of coopting and compromising the extremely wealthy was part of Epstein’s MO but isn’t required to explain some fantastical level of wealth.

Jeffrey Epstein, the financier facing sex-trafficking charges in New York, was accused of witness tampering on Friday by federal prosecutors, who said he wired $350,000 to two people who were potential witnesses against him.

Mr. Epstein sent the money to the potential witnesses in late November and early December, 2018, shortly after the Miami Herald published an investigative report about a secret deal he had reached with the authorities in Florida to avoid federal prosecution, prosecutors said.

The United States attorney’s office in Manhattan made the new allegations in a court filing asking that Mr. Epstein be denied bail while he awaits trial, saying the payments were evidence that he might try to influence witnesses if he were not detained.

Mr. Epstein’s lawyers maintain their client has lived a law-abiding life for the past 14 years, since he pleaded guilty to state prostitution charges in Florida and served 13 months in jail. He has pleaded not guilty to the charges in New York.

But prosecutors said that Mr. Epstein had paid significant amounts of money to influence individuals who were close to him and who might be witnesses against him at trial.

The prosecutors said Mr. Epstein wired $250,000 to one of his employees and $100,000 to a second person. Both were identified in the government’s memorandum as possible co-conspirators.


The payments and their timing, the prosecutors wrote, suggests Mr. Epstein was trying to “influence co-conspirators” who might provide information against him in light of the allegations in the Miami Herald series.

Mr. Epstein, 66, was arrested on Saturday when his private jet landed at Teterboro Airport in New Jersey after a flight from Paris. He was charged with sex-trafficking and conspiracy in an indictment unsealed on Monday by the office of Geoffrey S. Berman, the United States attorney in Manhattan.


The indictment said that between 2002 and 2005, Mr. Epstein and his employees paid dozens of underage girls to engage in sex acts with him at his homes in Manhattan and Palm Beach, Fla.

Mr. Epstein is also accused in the indictment of encouraging some of his victims to recruit other underage girls for him to abuse. Prosecutors said he paid his “victim-recruiters” hundreds of dollars for each girl they brought him. “In so doing, Epstein maintained a steady supply of new victims to exploit,” the indictment said.

On Thursday, Mr. Epstein asked a judge to allow him to remain free on bond as he awaited trial. He pledged to put up his $56 million Manhattan mansion and his private jet as collateral.

He also proposed he be allowed to remain under house arrest in the mansion, offering to pay for round-the-clock security guards to ensure he did not flee. He said he would wear an ankle bracelet that monitors his location, surrender his passport and ground his jet.

The arrest of billionaire influence peddler Jeffrey Epstein for the alleged repeated and systematic trafficking and sexual assault of underage girls is more than an indictment of a sexual predator. It's also compelling evidence of corruption among the most powerful political and business interests in the United States. But public knowledge is, so far, founded as much on horrifying insinuation as actual evidence.

Who are the "potential co-conspirators" left unnamed and immunized in Epstein's 2007 non-prosecution agreement, negotiated by Trump's disgraced former Labor Secretary Alex Acosta? Why did Manhattan District Attorney Cyrus Vance's prosecutors intervene in an effort to downgrade Epstein from his Level 3 sex offender status, then fail to enforce—along with the NYPD—the court-mandated check-ins Epstein spurned? What are his connections to the intelligence community?

There is always the possibility that our institutions defer to the rich as a matter of course; that Epstein's treatment is only a particularly grotesque form of business as usual. But Epstein's penchant for installing security cameras throughout his homes, combined with dinner parties, allegedly stocked with underaged girls, leaves open the possibility of systematic blackmail, further hinted at when federal agents pulled "compact discs with hand-written labels" like "Young [Name] + [Name]" from a safe in his $77 million Upper East Side mansion. Is there, somewhere in this evidence, a video or videos, possibly from Epstein's "Lolita Express" or "Pedophile Island," capable of exposing the depravities of one or many of the politicians, celebrities and financiers in his orbit?

We search for reprieve from this dead air, where the entire moral constitution of some of the most powerful people in the country, including two presidents, hangs uncertain. In this zone, the darkest possibility—a world-spanning pedophile elite, safeguarded by institutions throughout society, by both witting and unwitting co-conspirators in a web of influence and silence—seeks a space in our imagination to unfold.

Art can suffice, by capturing the psychic sensation of an uncertain moment, so we might observe and improve our own fumbling efforts at reconciling ourselves to the world. But there is also the comforts of conspiracy theory: extrapolating from what's known to create an imagined order, built from clues inscrutable to most. Stanley Kubrick's final movie, Eyes Wide Shut, is embraced from both directions. Baffling critics and audiences in 1999, Eyes Wide Shut has become a defining movie of the Jeffrey Epstein era.

In Eyes Wide Shut, Dr. Bill Harford (Tom Cruise) and his wife Alice (Nicole Kidman), explore the possibilities of infidelity, newly possible with their entrance into high society, which lifts them from a state of childish naiveté, until Bill's explorations bring him to places he will never be allowed. In the movie's central sequence, Bill, stung by his wife recounting a sexual fantasy, follows an old friend to a secretive event at a Long Island mansion, where he gains entry to a masked orgy with a password. He is found and turned out. Because of his actions, or possibly not, a woman dies under suspicious circumstances.

In part because it is replete with occult imagery, like a pyramid-faced mask (oozing the same Illuminati energy as the dollar bill), Eyes Wide Shut is subject to the same kind of analysis that leads people to conclude Kubrick faked the moon landing, revealing his deception to everyone on a sweater in The Shining.

Kubrick's 1999 death of a heart attack, just six days after screening a completed Eyes Wide Shut, factors prominently into this conspiracy narrative, much of which relies on outright fabrication. One widely cited Nicole Kidman interview was made up by the fake news site NewsPunch. Equally false are descriptions of 24 minutes of lost footage, cut from Eyes Wide Shut to protect the elite. Photos exist of a deleted scene featuring Bill, Alice and their daughter rowing a boat in Central Park, but it's hardly a smoking gun. A dream sequence—which would have counterbalanced Bill's experience at the orgy with the sexual imaginings of Alice—was storyboarded, but never shot.

Those close to Kubrick are in agreement that Eyes Wide Shut is as close to Kubrick's vision as possible. In Eyes Wide Shut: Stanley Kubrick and the Making of His Final Film by Robert Kolker and Nathan Abrams, Kubrick's personal assistant Leon Vitali says "he had completed his final cut," sending the movie on to the studio with the simple message, "This is it." The book similarly documents how closely the post-production team hewed to Kubrick's notes and intentions for the music implementation and fine-tuning still needed at the time of his death. If Kubrick had intended to make specific allegations with Eyes Wide Shut, his close friends and collaborators weren't aware of it.

But if Eyes Wide Shut isn't a skeleton key for unmasking specific elite depravities, what is it?

Since the 1968 release of 2001: A Space Odyssey, Kubrick wanted to adapt Traumnovelle, or Dream Story, by Arthur Schnitzler. He held the rights from 1970 on. A 1927 German novella doesn't immediately suggest the movie's applicability to a modern understanding of sex crimes among the governing elite. That Kubrick's screenplay with Frederic Raphael hews close to the novella may suggest Kubrick had Freudianism on his mind (Freud, a fan of Schnitzler's, described the author as his "double" in a letter) more than politics, for Eyes Wide Shut.

Kubrick made his own interest in Traumnovelle known in several interviews, spread over decades. "Traumnovelle speaks of the fact that men have a desire for stability, security, repetition and order in their lives and that at the same time they have a tendency to want to flee, to meet the adventure, to destroy..." Kubrick told the French film magazine Positif in 1972.

In 1999 he described the book as an opportunity to "explore the sexual ambivalence of a happy marriage and try to equate the importance of dreams and hypothetical sexual relations with reality" to film critic Michel Ciment.

But reading Eyes Wide Shut narrowly, as a dreamlike parable for the complications of monogamy, is partly to blame for the movie's initial reception. After trailers promising a steamy thriller, there was no hiding how Eyes Wide Shut was rooted in 1920s sexual mores—the movie's frank conversations about infidelity and desire outside of monogamy sounded almost old-fashioned to viewers jaded by the 90s spate of high-profile sex scandals. Rather than underlining the different moral universe of a secretive elite, the mannered and abstract orgy scene lead the Washington Post to call Eyes Wide Shut "the dirtiest movie of 1958."

While subsequent years of child abuse cover-ups and political scandals—Epstein following the Catholic Church, Dennis Hastert, Operation Yewtree and Westminster's missing "paedophile dossier"—hasn't made Eyes Wide Shut any more shocking, the extremities of orgiastic ritual became more plausibly imaginable on a political and systemic level. Like the Yellow King of True Detective, Eyes Wide Shut's orgy came to stand for a whole complex of elite degeneracy.

Reality is catching up to political reads of Eyes Wide Shut, like Norwegian historian Håvard Friis Nilsen's essay "Deterioration of Trust: The Political Warning in Kubrick's Eyes Wide Shut," which sees the movie as a warning against "a society where the social fabric of trust deteriorates into a hermeneutics of suspicion, paving the way to an increasingly authoritarian political climate." Nilsen even compared the gilded inequality of Traumnovelle's 1920s with the inequality of finance capital blossoming in the 90s.

In Eyes Wide Shut, Bill is summoned to Ziegler's (Sydney Pollack) Billiards Room to be told barely disguised lies about a woman's death. In the face of Ziegler's brazen deception and the casual tone of the rich man's cast-off threats, Bill is held in limbo between the justified suspicion of a grand evil and the lies that will enable him to continue his striving life, now colored by the realization of its limits.

“Those were not just ordinary people there. If I told you their names—I’m not going to tell you their names. But if I did, I don’t think you’d sleep so well,” Ziegler tells Bill.

"There is no apparent heroic resistance against the secret society of the power elite," Nilsen writes of Eyes Wide Shut's ending. "What we see is an acknowledgment of the futility of control: they can neither control superior powers nor each other; loyalty is never guaranteed; they must be thankful for the moments in which they are awake."

Bill and Alice can only hope to achieve a moment of clarity. Newsweek is a weird one. Crashed out of a print edition, remember. It is a kind of multiplayer blog with a still-valuable brand draw. So lots of unexpected things have appeared in recent years. The origins of Jeffrey Epstein’s financial empire remain a mystery to even billionaires. But the investor’s former Wall Street mentor has one theory about how Epstein amassed his fortune: Fraud.

In a phone interview with Observer, Steven Hoffenberg alleged Epstein participated in a Ponzi scheme the two ran together in the 1980s, before using the ill-gotten gains to launch his investment company with the help of financial loans from Deutsche Bank.

“Its a very simplistic financial fraud that he concealed from everybody that gave him tainted money,” said Hoffenberg. “He never told anybody, and I literally mean anybody, that gave him any money since he left Towers, that he was part of Towers. And that’s a securities fraud because when you take money from people, you have to tell them your history.”

Hoffenberg oversaw Towers Financial, but was sentenced to 20 years in jail in 1997 for defrauding clients out of $450 million. Although Epstein was never charged in the case, a lawsuit filed last year by former Towers investors lists the financier as “an uncharged co-conspirator,” and alleges he “knowingly and intentionally utilized funds he fraudulently diverted and obtained from this massive Ponzi scheme for his own personal use to support a lavish lifestyle.”

“If Jeffrey Epstein was materially involved in the management of Towers Financial, as his former associate Steven Hoffenberg has alleged, or he substantially assisted and had knowledge of the Ponzi scheme through various corporate transactions with Towers Financial, then he would be subject to liability for that Ponzi, and further, may have committed securities fraud on his future clients by not disclosing his prior involvement,” Jeff Sonn, a securities attorney and founder of Sonn Law Group, told Observer. “The problem I see is that Hoffenberg waited some 20 years to come forward with these new allegations, and he may have reduced his 18-year sentence by implicating Epstein in the Ponzi scheme back in 1994 but didn’t do so.”

Hoffenberg said he did not tell prosecutors because he pleaded guilty at the time, but later came forward because he believed Epstein should pay restitution to Towers investors. Hoffenberg also told Observer that Deutsche Bank provided significant financial loans to Epstein.

“His lead bank is Deutsche Bank, Germany, that runs the lead on his financial trust company. They run the platform in the trading of the currencies for Epstein and with Epstein. He’s never disclosed to the investors that provide the money to Deutsche Bank his true legacy, that’s securities fraud,” said Hoffenberg. “And that makes the government available to seize all his money, literally all his money. He’s not going to be able to use his money because it’s got to go to a restitution fund because it’s tainted money.”

Representatives for Deutsche Bank declined to comment. An attorney for Epstein did not respond to Observer’s inquiry.

Long considered an investment platform for the rich and powerful, Deutsche Bank has been plagued with scandals since the 2008 Financial Crisis. In 2017, the bank reached a $7.2 billion settlement with the U.S. Justice Department over allegedly misleading investors on mortgage-backed securities, and was later fined $630 million for alleged involvement in Russian money laundering.

Last week, Deutsche Bank announced it would cut 18,000 jobs and downsize its investment operations.
