true enough - you do have to be in a very particular position to try this as a lone gunman. However if you could get a critical mass of people in any given town to refuse to pay property tax or something, you'd maybe get some results.

for the record, I do realize that the OP was NOT about photographing the police. It just seemed like an interesting juxtaposition against the rise of laws that DO ban photographic police.

Photographers protest against ban from public spaces

Photographers in London descended on City Hall to campaign against “creeping restrictions of press freedom in the capital” that sees them banned from public spaces including Canary Wharf and Tower Bridge.

The ‘flashmob’ was organised by the I am a Photographer Not a Terrorist (PHNAT) campaign group, supported by the NUJ and the International Federation of Journalists (IFJ).

PHNAT said that around 50 photographers gathered outside City Hall on Tuesday, which was World Press Freedom Day. It is an area where it alleges police and private security guards have attempted to ban photographers

IFJ has supported the campaign by the NUJ to change anti-terrorism legislation - and in particular Section 44 of the Terrorism Act 2000 which was found by the European Court of Human Rights to breach Article 8 of the European Convention on Human Rights (right to respect for private and family life).


The section was suspended pending a review of counter-terrorism powers, including the use of terrorism legislation in relation to photography. The review was prompted by complaints from photographers over harassment by police using stop-and-search powers.

PHNAT claims the Coalition Government has now reintroduced remedial orders reinstating these measures which will impede their work covering public events, including the recent anti-cuts protests.

“The ban on photography is an arbitrary measure which frustrates photojournalists’ work and our colleagues are rightly dismayed that it is still in place,” said IFJ President Jim Boumelha.

“The event in London was a powerful message to the authorities to change course and lift all unnecessary restrictions on media work.”

Who will watch the watchers? In a world of ubiquitous, hand-held digital cameras, that's not an abstract philosophical question. Police everywhere are cracking down on citizens using cameras to capture breaking news and law enforcement in action.

In 2009, police arrested blogger and freelance photographer Antonio Musumeci on the steps of a New York federal courthouse. His alleged crime? Unauthorized photography on federal property.

Police cuffed and arrested Musumeci, ultimately issuing him a citation. With the help of the New York Civil Liberties Union, he forced a settlement in which the federal government agreed to issue a memo acknowledging that it is totally legal to film or photograph on federal property.

Although the legal right to film on federal property now seems to be firmly established, many other questions about public photography still remain and place journalists and citizens in harm's way. Can you record a police encounter? Can you film on city or state property? What are a photographer's rights in so-called public spaces?

These questions will remain unanswered until a case reaches the Supreme Court, says UCLA Law Professor Eugene Volokh, founder of the popular law blog The Volokh Conspiracy. Until then, it's up to people to know their rights and test the limits of free speech, even at the risk of harassment and arrest.

Who will watch the watchers? All of us, it turns out, but only if we're willing to fight for our rights.

MTA Officers Detain Man For Taking Pictures (Video)

BALTIMORE (WJZ) — The Maryland Transit Administration says more training may be called for after three MTA officers detained a man for taking pictures at a light rail station.

Pat Warren has more on the incident.

According to the ACLU, this isn’t the first time MTA Police have overstepped their bounds.

In a YouTube posting, Christopher Fussell left the camera rolling when he was confronted by three MTA officers for taking pictures at the Baltimore Cultural Light Rail Station.

“It is my understanding that I am free to take pictures as long as it’s not for commercial purposes but for personal use,” Fussell said in the video.

“Not on state property, not without proper authorization,” an officer said.

Fussell: “From who?”

Officer: “Nobody’s allowed to take pictures.”

The MTA admits the officers were in error.

“They can most certainly take photos of our system,” Ralign Wells, the MTA Administrator, said.

In addition to being wrong about MTA and state policy, the officer incorrectly cites the Patriot Act.

“Listen, listen to what I’m saying. The Patriot Act says that critical infrastructure, trains, train stations, all those things require certain oversight to take pictures, whether you say they are for personal use or whatever, that’s your story,” the officer said.

“So why don’t you have any signs posted to say I cannot take pictures?” Fussell said.

“Our officers have become very sensitive post 9/11 and we’re trying to see that they understand our passengers and citizens also have a right to take pictures,” Wells said.

The officer eventually threatened to take Fussell into custody.

“Do you have Maryland state identification on you?” the officer asked.

“I am not committing a crime,” Fussell said.

“Sir, I’m going to ask you one last time, then I’m going to take you into custody. Do we understand each other?” the officer said.

The ACLU considers it harassment by the MTA.

“This is not South Africa under apartheid and in this country, police do not have the right to walk up to you and demand you produce identification to them,” said David Rocah, ACLU.

The MTA acknowledges that additional training is in order.

“We’ll look at our training processes, we’ll look at whether any administrative situations need to occur with those officers,” Wells said.

The ACLU says it’s been working with the MTA on this very issue for five years, with no satisfactory result.

Fussell was detained for more than 40 minutes before MTA Police finally let him go on his way.

A federal lawsuit filed by local activist Antonio Buehler against the Austin Police Department has cleared a hurdle as a U.S. magistrate judge this week upheld his constitutional right to photograph and film police officers.

In an order filed Thursday, Judge Mark Lane denied motions to dismiss the case, finding that private citizens have the right to record officers in public places as they perform their official duties and that such a right had clearly been established in Buehler’s case.

The judge dismissed his claims of excessive force and malicious prosecution, but Lane said the officers were not immune from allegations that they had arrested and searched him without probable cause, according to the documents filed in the U.S. Western District of Texas.

Lane also declined to dismiss claims that the police department had failed to establish a policy and provide training addressing how officers should proceed when being videotaped or photographed by citizens.

The city can now appeal the judge’s decision to the 5th U.S. Circuit Court of Appeals. If the appeal is denied, the case moves forward until a settlement is reached or the parties go to trial.

Requests for comment to the city attorney representing the department were not immediately returned Friday.

Daphne Silverman, Buehler’s lawyer, said she and her client were pleased with Lane’s detailed analysis in support of his First Amendment and constitutional rights.

“This ruling is a clear signal to law enforcement that the public can now photograph and videotape police officers so long as they don’t interfere with the officer’s duties,” she said.

Buehler, a 37-year-old Army veteran and founder of the Peaceful Streets Project, has been in dispute with the department since officers arrested him New Year’s Day 2012 as he videotaped a woman getting arrested on Lamar and 10th Street. Buehler has alleged he was trying to capture the officers abusing the driver and her passenger, and he later founded Peaceful Streets, in which members record police encounters and post them online.

The National Press Photographers Association in May filed an amicus brief in support of his case, which the organization says is not an isolated incident but “part of a nationwide phenomenon where police have interfered with citizens’ rights to photograph and video-record officers engaged in official business in public spaces.”

“NPPA follows these cases closely, and strives to ensure that the crucial role that journalists and citizens play in promoting discussions of public concern is not diminished,” the brief states.
