Retired FBI agent Jim Feldkamp, who twice was the Republican nominee
to challenge Democratic Rep. Peter DeFazio in Oregon’s 4th
Congressional District, has been charged with secretly recording
himself having consensual sex with a university student in Arlington,
Va., according to local media reports.

Feldkamp, 53, a Roseburg native, ran twice for Congress, in 2004 and
2006, each time securing the GOP nomination. But he lost heavily
against DeFazio in the general election on both occasions.

Feldkamp has been an adjunct professor at George Mason University in
Virginia since 2008. He met the female student on campus but wasn’t
teaching her at the time of the alleged recording, according to the
media reports. They had consensual sex last August, but the student
allegedly didn’t agree to Feldkamp recording their encounter.

The student found the camera in Feldkamp’s apartment and saw the
video. After Feldkamp allegedly downplayed the recording, the woman
called police.

Feldkamp first was arrested in November, court records show. He’s
facing a charge of nonconsensually filming a person in the nude.
That’s a first-class misdemeanor in Virginia, punishable by up to a
year in jail and a $2,500 fine. Feldkamp is due back in court on Jan.
31, according to court records.

Feldkamp, a former Navy commander and FBI special agent, taught
courses on domestic and international terrorism at George Mason. But

Secret Service, Agents Settle Over Racial Discrimination Allegations

A long-running lawsuit accusing the Secret Service of discriminating
against black agents appears to be coming to an end without a trial.

The Department of Homeland Security, the Secret Service and more than
100 agents have reached a settlement agreement, the department says. A
court still needs to approve the settlement.

The Washington Post reports that the agreement calls for the Secret
Service to pay $24 million, including lump sum payments as high as
$300,000 per agent, but does not require the agency to admit
wrongdoing.

In a statement late Tuesday, Homeland Security Secretary

Why is the Deep State Fighting So Hard Against Trump? His treatment of
women, Mexicans, Muslims is the last thing they care about
From Mike Whitney at Counterpunch, what we all should consider, as we
seek to understand the craziness of the last several months :
"Trump wants to fundamentally change Washington’s approach to policy,
that is, he wants to abandon the destabilizing wars and regime change
operations that have characterized US policy in the past and work
collaboratively with countries like Russia that have a mutual interest
in establishing regional security and fighting terrorism.
This has not been warmly received in Washington, in fact, Trump’s
recommendations have triggered a firestorm among elites who now
believe that he is a serious threat to their interests. Recent attacks
in the media and preemptive provocations with Russia,
suggest that an effort to remove the new president from office
is already underway. We expect that these attacks will only intensify
in the weeks ahead. Here’s an excerpt from the speech Trump delivered
in Cincinnati on December 1 that is the source of the controversy:
“We will pursue a new foreign policy that finally learns from the
mistakes of the past…We will stop looking to topple regimes and
overthrow governments…. Our goal is stability not chaos, because we
want to rebuild our country [the United States]… We will partner with
any nation that is willing to join us in the effort to defeat ISIS and
radical Islamic terrorism …In our dealings with other countries, we
will seek shared interests wherever possible and pursue a new era of
peace, understanding, and good will.”
None of the major media published Trump’s comments, and for 'good'
reason. The statement is a straightforward repudiation of the last 70
years of US foreign policy during which time the United States has
either overthrown or attempted to overthrow 57 foreign governments
according to author William Blum. Removing governments that refuse to
follow Washington’s diktats has been a mainstay of US foreign policy
for the better part of the last century. Regime change is what we do.
And while GOP administrations have relied more on direct military
power (Re: Afghanistan, Iraq) as opposed to the more covert operations
(proxy-wars –Syria, Ukraine, Libya) preferred by the Democrats, both
parties fully support the violent and illegal ousting of foreign
leaders provided Washington’s geopolitical objectives are achieved.
Trump has charted a different course altogether, which is why the
media, the Intelligence Community, the political establishment and the
deep state puppet-masters who operate behind the curtain, have
abandoned all restraint and are doing whatever they can to
delegitimize him, back him into a corner and potentially remove him
from office. .."

Philly teachers encouraging week of lessons on Black Lives Matter

Teachers in Philadelphia plan a Black Lives Matter week
Inform

PHILADELPHIA — A teachers' organization in Philadelphia is encouraging teachers to wear Black Lives Matter T-shirts and buttons and provide lessons on the movement every day for one week.

The Caucus of Working Educators, a faction of the teachers union, is developing lessons plans and curriculum ideas for teachers of grades from kindergarten through high school for the week of Jan. 23. The plans, distilled from the movement's 13 guiding principles, such as embracing diversity and globalism, will be available online , organizers said Friday.

"The vast majority of students that we serve are black, and it's important to affirm the lives of our students," said co-organizer Charlie McGeehan, who is white and teaches high school humanities at The U School, where students work on solving real-world problems.

The organizers said more and more educators are signing on every day, but they don't hav

Dozens of wrongful conviction lawsuits still are pending against the city of Chicago, a high-level city attorney told aldermen Tuesday, even after a yearslong parade of settlements of such cases have already drained tens of millions of dollars from the pockets of taxpayers.

At least two of the pending cases involve allegations from the era of Jon Burge, First Assistant Corporation Counsel Jane Elinor Notz said, referring to the disgraced former police commander who is alleged to have led a team of detectives in the 1970s and 1980s that tortured false confessions out scores of African-American suspects

. And there are 25 other cases in which convictions were reversed and the people initially found guilty later accused police of misconduct, she said.

Notz spoke during a Finance Committee meeting at which aldermen recommended approval of a $4 million settlement in the lawsuit filed by Shawn Whirl, who spent nearly a quarter-century behind bars in a case linked to the Burge era.

Ald. John Arena, 45th, noted the human and financial costs of the Burge era and other police misconduct cases, saying it highlighted the need to implement the recommendations in a recent U.S. Department of Justice report that concluded the city does not effectively deal with police misconduct.

"Decades later, the city — the taxpayers of Chicago — are still trying to make restitution because of that approach to policing that hopefully collectively we can weed out from our police force," said Arena, referring to settlements surrounding the Burge era.

The Burge-era litigation and claims against the city and Cook County state's attorney's office have cost taxpayers more than $111 million, according to one tally. And all police misconduct settlements since 2004 have cost the city more than $500 million.

The numbers are relevant as some aldermen

L.A. to pay $5.2 million in wrongful imprisonment case

Los Angeles will pay $5.2 million to end a legal battle with a man whose murder conviction was tossed out.

The settlement with Reggie Cole is the latest in a string of legal payouts that are spurring the city to borrow at least $50 million to avoid dipping into its emergency reserve funds.

Cole and his friend Obie Anthony were convicted in the murder of Felipe Gonzales Angeles, who was shot to death outside a South L.A. brothel in 1994.

At trial they insisted they were innocent, and no physical evidence connected the pair to the crime. The two were later freed and both sued the city for wrongful imprisonment. Attorneys alleged that LAPD detectives had used illegal methods and concealed crucial evidence in the case.

Two years ago, the city agreed

Pending Lawsuit Seeks to Expose Trump’s Neo-Nazi Connections
Posted by Bill Conroy - January 29, 2017 at 9:40 pm
US President Donald Trump Has Surrounded Himself With Advisors Who Are Sympathetic to White Supremacist Ideology
A lawsuit pending in federal court in Kentucky since this past April may shed some light on the oppressive executive orders issued recently by President Donald Trump that target refugees worldwide as well as immigrants from seven Muslim-majority nations.
The executive orders ban Syrian refugees from entering the US, temporarily suspend all refugee entries into the country and block citizens from seven Muslim-majority nations from entering the US for at least 90 days, even if they are legal US residents. The president’s orders left hundreds of people stranded in airports, many fleeing war zones or government persecution in their home countries, sparked nationwide protests and prompted federal judges in four states to issue rulings blocking part of Trump’s orders pending further court review.
Pleadings filed in the Kentucky case contend that it is likely Trump and his inner circle have more than a coincidental relationship with the various white supremacist groups that frequented his election campaign rallies. Recently, Narco

Tuesday, February 7, 2017
US military has failed to publicly disclose potentially thousands of lethal airstrikes conducted since 2001 in Iraq, Syria and Afghanistan/ Military Times
The U.S. military under former President Barack Obama quietly hid “potentially thousands of lethal airstrikes” from the American public that likely killed hundreds of civilians in war-ravaged Iraq, Syria, and Afghanistan, the Military Times has found.
In 2016 alone, U.S. combat aircraft conducted at least 456 airstrikes in Afghanistan that were not recorded as part of an open-source database maintained by the U.S. Air Force, information relied on by Congress, American allies, military analysts, academic researchers, the media and independent watchdog groups to assess each war's expense, manpower requirements and human toll. Those airstrikes were carried out by attack helicopters and armed drones operated by the U.S. Army, metrics quietly excluded from otherwise comprehensive monthly summaries, published online for years, detailing American military activity in all three theaters.
Most alarming is the prospect this data has been incomplete since the war on terrorism began in October 2001. If that is the case, it would fundamentally undermine confidence in much of what the Pentagon has disclosed about its prosecution of these wars, prompt critics to call into question whether the military sought to mislead the American public, and cast doubt on the competency with which other vital data collection is being performed and publicized. Those other key metrics include American combat casualties, taxpayer expense and the military’s overall progress in degrading enemy capabilities...
U.S. Central Command, which oversees military activity in all three war zones, indicated it is unable to determine how far back the Army’s numbers have been excluded from these airpower summaries. Officials there would not address several detailed questions submitted by Military Times, and they were unable to provide a full listing of annual airstrikes conducted by each of the Defense Department's four military services.
Now why would the DOD want to publish false information?  Well, it helps in the effort to achieve "plausible deniability" --by denying a US mission took place when the US military commits a potential war crime, like deliberately bombing hospitals or bombing elite counter narcotics forces in Afghanistan, which the USG initially denied.  In fact, an unnamed Army official quoted in the article said he did not consider Apache helicopter attacks airstrikes! While according to Boeing, its manufacturer, “The Apache is the world's best armed, integrated and connected attack helicopter in production and in operational use today. It’s a flying weapons system that is fully integrated. It has options to have missiles, rockets or guns depending on what your enemy is."

If you have no report of thousands of air attacks, instead of bombing ISIS, you can bomb anti-ISIS targets and likely get away with it. There could be so many reasons to hide US military missions.
UPDATE:  From the Sept 7, 2015 Wall Street Journal, we learn that a US "friendly fire" airstrike in southern Afghanistan on Sept 6 "hit a 30 member elite counternarcotics police unit as they were on a mission..." [to stop opium trafficking.  We stopped them all right.]
At least 11 died in "one of the deadliest friendly fire incidents in the country in recent years." Here is the Reuters story. The US denied the strike in Helmand province, but admitted to airstrikes in the adjacent province of Kandahar. According to the Guardian, "The US is the only member of the NATO coalition known to have carried out bombing raids in Afghanistan this year." The AP/WaPo on 9/8/15 reported that, "Brigadier General Shoffner [Deputy Chief of Staff for Communications in Afghanistan] said 'based on information we received [on 9/8], we feel it is prudent to investigate the airstrike our forces conducted in Kandahar.'"
Deliberately falsifying the number of  US airstrikes in Afghanistan makes it impossible to know what was spent, how many Afghanis were killed, and what actually is being "accomplished" in Afghanistan.

It makes it harder than ever to know why we are in Afghanistan, Syria and Iraq, what our targets truly are, and what has been done in our name.  As I discussed here, the US presence in Afghanistan can only be explained as a grab for at least a trillion dollars' worth of oil and minerals, a pipeline, and a renewable resource called heroin.

Federal Court Hearing on FBI Clinton Records – Agency Wants Up to Two Years to Turn Over 35 Records

FEBRUARY 06, 2017
Hearing Set for Tuesday, February 7

(Washington DC) – Judicial Watch today announced a hearing will be held Tuesday, February 7, 2017, regarding Judicial Watch’s Freedom of Information Act (FOIA) lawsuit seeking records held by the FBI containing text messages and emails of former Secretary of State Hillary Clinton stored on the equipment of Datto Inc., a commercial data management company, as well as FBI records about the device and what materials were recovered on it (Judicial Watch v. U.S. Department of Justice (No. 1:16-cv-02369)). The case is before U.S. District Court Judge Randolph D. Moss.

At the previous hearing Tuesday, January 24, 2017, Trump administration lawyers for the FBI informed Judicial Watch and the court that it located 35 FBI records that concern the Datto device and that it may take up to two years to release the records. In addition, the FBI recovered approximately 10,000 messages from the Datto device. The messages were turned over to the State Department to be processed and released on its website.

Tomorrow’s hearing should address whether the Trump FBI will be able to slow walk the release of these records.

Judicial Watch’s lawsuit seeks:

All records, including but not limited to emails or text messages (SMSs, MMSs, BBMs, iMessages, etc.), discovered, recovered, retrieved from, or found on any Datto device, equipment, or hardware connected to or used to backup or support former U.S. Secretary of State Hillary Rodham Clinton’s clintonemail.com email system.
All records relating to the FBI’s efforts to discover, recover, retrieve, or find emails or text messages stored on the Datto device, equipment, or hardware …
Clinton reportedly was using an online backup service called Datto Inc. to create copies of her data during a time when she and her aides were improperly handling classified material. Datto’s website company promises data is “invincible, secure, and instantly restorable at any time.

Datto announced it had turned over a “hardware device” to the FBI, along with all Clinton emails the company had in its possession, possibly including Clinton’s deleted private emails:

“With the consent of our client and their end user, and consistent with our policies regarding data privacy, yesterday, Tuesday, October 6, Datto delivered a hardware device to the FBI containing all backed up data related to Platte Rivers Networks’ client known to be in its possession,” said the company.

The court hearing is scheduled for Tuesday morning:

An East Harlem cop with an “odd fetish” on the job illegally stuck his finger in a disabled man’s anus during a bogus search at a bodega, a new lawsuit claims.

John Hidalgo says he went to a deli on E. 106th St. between First and Second Aves. on Sept. 7 to buy his daughter candy.

After greeting the clerk, a plainclothes NYPD officer in the store told Hidalgo he had a “bulge” in his shirt — which Hidalgo explained was his cell phone in a belt holder. He showed the officer the device.

But the officer, identified in the suit as Officer Febres from the 23rd Precinct, insisted on conducting a search. Despite not finding contraband, he allegedly “slipped his hands up into Plaintiff's shorts, and reached his hand to his underwear and started fondling, squeezing, jerking and pinching Plaintiff's testicles through his underwear,” Hidalgo's Manhattan federal lawsuit alleges.

This is February? 80°F in Denver, 99° in Oklahoma, 66° in Iceland, 116° in Australia

By: Bob Henson , 4:17 PM GMT on February 14, 2017

The strong, recurrent Pacific jet stream that’s been delivering massive amounts of rain to California has also been pushing mild Pacific air downslope off the Rockies and eastward, keeping the southern two-thirds of the U.S. absurdly warm for early February. From New Mexico to Virginia southward to the Gulf Coast, trees and shrubs are budding out en masse up to three weeks ahead of schedule (see Figure 1). In Texas, Dallas-Fort Worth recorded its last freezing temperature on January 8. With no freezes expected into at least the last week of the month, there’s a chance that the Jan. 8 reading of 20°F will be DFW’s last freeze of the winter. That would eclipse the earliest final freeze of the season (Feb. 5, 2000), in records extending back to 1899. The February warmth comes after a three-month span that was milder in Texas than any Nov/Dec/Jan period since the 1930s Dust Bowl, according to state climatologist John Nielsen-Gammon.

The warm, moist air prevailing along the South has been teaming up with occasional jet-stream intrusions to produce severe thunderstorms, including an unusually large number of tornadoes for the year thus far. This includes six confirmed tornadoes across southeast Louisiana on February 7, with an EF3 twister causing more than 30 injuries and damaging or destroying more than 600 homes in and near East New Orleans (see the detailed National Weather Service survey report on all six tornadoes). As of February 13, NOAA’s Storm Prediction Center had tallied 163 U.S. tornadoes for the year thus far, not quite a record but far above average. On Tuesday morning, NOAA/SPC placed parts of the western and central Gulf Coast under a slight risk of severe weather, with a small enhanced-risk area along the central Texas coast near a large thunderstorm complex that had already produced several tornado reports west of Houston.

Close to the century mark in Oklahoma
While there’s been quite a few ups and downs to the national temperature picture in recent days, with frequent frontal passages, the low temperatures haven’t been all that low and the highs have been unusually high, as noted by WU blogger Steve Gregory. For the month to date through February 12, NOAA had compiled a preliminary total of 1207 daily record highs and 10 daily record lows, for a staggering ratio of more than 100 to 1. It’s a picture in line with recent months: November 2016 had the largest ratio of record highs to lows of any month in modern records. It’s also consistent with the inexorable effect of human-produced greenhouse gases in boosting temperatures to make record warmth more widespread and extreme than record cold.

One especially strong pulse of warm air jet pushed across the Southern Rockies and into the South from Friday into Sunday. As the already-mild air descended the Rockies, it warmed further due to downslope compression, leading to some eye-popping readings. Several stations in southwest Oklahoma soared into the upper 90s on Saturday. The town of Magnum hit an astounding-for-February 99°F, which tied the state record for any winter month (Dec/Jan/Feb) that was set at Arapaho on Feb. 24, 1918.

Here’s a sampling of the all-time February heat records set over the past several days. In many cases, you have to go to mid-March to find comparable warmth!

Friday 2/10:
Wichita Falls, TX: 94°F (next-earliest reading at least this warm was 98°F on 3/1/2006; records began in 1923)
Liberal, KS: 90°F (next-earliest 90° was 3/11/1989; records began in 1893)
Amarillo, TX: 89°F (next-earliest 89° was 3/10/1989; records began in 1892)
Goodland, KS: 87°F (next-earliest 87° was 3/10/1989; records began in 1895)
Denver, CO: 80°F (next-earliest reading at least this warm was 81°F on 3/16/2015; records began in 1872). A cooperative observing station at the site of Denver’s former Stapleton Airport, where official readings were taken until the mid-1990s, reported 83°F.

Saturday 2/11:
Lubbock, TX: 91°F (next-earliest reading at least this warm was 95°F on 3/11/1989; records began in 1911)

Sunday 2/12:
Norfolk, VA: 82°F (ties all-time monthly high set on 2/4/1890 and other dates; records began in 1874)

Cold enough to ski; too mild to ice-climb
The abnormally mild February hasn’t put a dent in Colorado’s bang-up ski season. The highest slopes are still more than cold enough to support a healthy snowpack even with above-average temperatures. At opensnow.com, Joel Gratz noted that the statewide snowpack as of Sunday, February 12, had already matched the level reached during the early-April peak of an average year. “What an awesome season so far with more to come!” exclaimed Gratz. Meanwhile, at Colorado’s lower elevations, those hankering for winter recreation felt the pinch of unseasonal warmth. The state’s Ouray Ice Park climbing venue was forced to close for the season on Friday, February 10, a full month earlier than average. “While we still hold a glimmer of hope for this season at the Park, that is fading fast,” said the park in a plaintive online statement.

Surges of warmth continue to funnel into high Arctic
The strong jet streams crossing the U.S. of late have spun up several powerful Northeast snowstorms (see embedded video below) and gone on to push very mild, moist air deep into the Arctic. One such spike arrived late last week, with temperatures of 50°F or more above average approaching the North Pole as reported by Capital Weather Gang and The Weather Network (Canada).

Well downstream from the nor’easter that was slamming eastern New England on Monday, a swath of low-latitude air pushed the temperature at Eyjabakkar, Iceland, up to 19.1°C (66.4°F). If validated, this will rank a full 1°C (1.8°F) above the previous national record for February, set at Dalatangi on Feb. 17, 1998, according to international weather records researcher Maximiliano Herrera. He adds that temperatures in the free atmosphere over central Sweden were analyzed above the freezing mark on Monday at heights of up to 11,000 feet.

Unsurprisingly, the extent of Arctic sea ice remains at record-low levels for mid-February. Moreover, the extent of Antarctic sea ice is on the brink of setting a record-low value for any time of year.

Eastern Australia blisters in all-time record heat
Another swarm of heat records invaded eastern Australia, where a brutal summer is unfolding. Port Macquairie, where records have been kept since 1910, broke its all-time record for any date on Sunday with a scorching high of 46.6°C (115.9°F). That’s an incredible 3.3°C (5.9°F) above the city’s previous all-time high. “You don’t break [100-plus-year] records by 3C,” noted Andrew Watkins (@windjunky). An even older all-time high fell at Toowoomba, Queensland, where a maximum of 40.3°C (104.5°F) was the first reading above 40°C (104°F) since records began at Toowoomba way back in 1869. Fire danger across parts of tinder-dry New South Wales has been at near-

DEA Removes Misleading Information about Marijuana from Its Website

The DEA has removed from its website information deemed inaccurate about marijuana following months of public pressure.

Americans for Safe Access, a national nonprofit dedicated to making cannabis legal, filed a legal request with the Justice Department last year in hopes of forcing the DEA to remove factually inaccurate information, the L.A. Daily Post reports.

The nonprofit claimed there were more than 25 false statements on the DEA’s website, including inaccuracies about marijuana causing psychosis and irreversible cognitive declines.

“The DEA’s removal of these popular myths about cannabis from their website could mean the end of the Washington gridlock” said Steph Sherer, executive director of Americans for Safe Access. “This is a victory for medical cannabis patients across the nation, who rely on cannabis to treat serious illnesses. The federal government now admits that cannabis is not a gateway drug, and doesn’t cause long-term brain damage, or psychosis. While the fight to end stigma around cannabis is far from over, this is a big first step.”

FBI Informant Ahned Salem confirned as creator of 1993 World Trade Centee bombing

http://www.nydailynews.com/news/nationa ... -1.2976439

Few Americans will mourn sheik Omar Abdel-Rahman, who died after two decades in prison for conspiracy to overthrow the U.S. government.

To most, the blind sheik was the cartoon-caricature jihadist who masterminded the first World Trade Center bombing.

Having represented him for a short time, with the late William Kunstler, I have a different view of the case and the man.

The sheik was convicted entirely upon the content of conversations he had with a federal informant, an agent of the hated Mubarak regime. There was no evidence that he ever participated in orders, or directed others, to commit any crime against the U.S. or against Americans.

Indeed, Abdel-Rahman liked being in the United States. From a modest apartment in New Jersey, he recorded and sent cassettes of his teachings to his followers in Egypt, without fearing arrest and torture.

FBI Crime family authorized some informants to engage in unlawful activity at refuge

FBI Informants engaged in unlawful activity

While Bretzing was questioned further about the FBI's use of informants or if he gave any approval for them to engage in unlawful activity while at the refuge, he said he didn't have direct knowledge.

Bretzing said he would have been "briefed on the activities of informants,'' but wasn't familiar with them by name, other than that of informant Mark McConnell. He said he couldn't say whether or not an FBI informant had participated in guard duty or fortifying the refuge.

"I'm not familiar with each place the confidential human source may have been at,'' Bretzing said.

In contrast, FBI Special Agent Ronnie Walker, who was called by the government as a witness later in the day, was very clear. He testified that some informants were authorized to engage in "otherwise unlawful activity'' during the occupation.

Prosecutors have said there were nine informants sent into the refuge during the occupation.

Walker, the FBI's trial agent for the case, said informants' range of stays at the refuge ran from two hours to 23 days.

Fabio Minoggio, who was outed by the defense in the first Oregon standoff trial, was the last informant to leave the refuge on the night of Jan. 26, 2016, after the fatal police shooting of occupation spokesman Robert "LaVoy" Finicum on U.S. 395 between Burns and John Day.

Some informants, including Minoggio, were allowed to carry guns when they went to the refuge, Walker testified.

If one was asked by occupier Ryan Payne to do guard duty at the refuge, "I would encourage the informant to do so, simply to maintain credibility,'' Walker told jurors.

Under cross-examination by defense lawyer Jesse Merrithew, Walker confirmed that Payne asked an informant to lead one of the security teams of occupiers.

Walker said he didn't know if the informant directed others to do guard duty or take other security measures, but said it would be "fair to infer'' that the informant would delegate responsibilities to others.

Asked if he knew Minoggio was training those at the refuge in hand-to-hand combat, Walker responded, "Oh yes, of course."

Merrithew continued, asking Walker if he knew Minoggio trained people at the refuge in the use of weapons. "That's one way of putting it,'' Walker said.

During redirect, Assistant U.S. Attorney Geoffrey Barrow asked the FBI agent if any informant participated in the initial occupation of the federal refuge. Walker said no.

"Did any informant initiate the idea of security teams'' at the refuge, Barrow asked.

"No,'' Walker answered.

Why, Barrow asked, was informant Minoggio allowed to train people.

Walker said it was done "to make the place safer.''

Minoggio heard shooting by the boat launch and went to check it out, Walker said.

"He saw firearms behavior that was unsafe,'' Walker said, so Minoggio "interjected himse

Taking Back Our Lives

The World is Laughing at America

On a Sunday at the end of January, a Dutch television program aired a satirical video with a voice-over pretending to be Donald Trump. The TV host, Arjen Lubach, began by showing a clip of Trump saying at his inauguration, “From this day forward, it’s going to be only America first.” Lubach said about Trump, “He had a clear message to the rest of the world: ‘I will screw you over big time.’”

Then he played the video, supposedly an official Dutch government introduction of the Netherlands, in English, to the new American President. “We speak Dutch. It’s the best language in Europe. We’ve got all the best words. All the other languages failed. Danish – total disaster. German is not even a real language. It’s fake.” The video shows a Dutch dike: “This is the Afsluitdijk. It’s a great, great wall, that we built to protect us from all the water from Mexico.” The video made fun of the crowd at Trump’s inauguration, his negative comments about NATO, and his attitudes toward blacks. The Dutch politician Jetta Klijnsma is shown using a walker: “We also have a disabled politician for you to make fun of.”

The video ends, “We totally understand it’s going to be America first. But can we just say, the Netherlands second? Is that okay?” The clip was downloaded 42 million times from the show’s Facebook page.

A German late-night TV host reacted to the viral video about a week later. Jan Böhmermann said he was furious that the Netherlands wanted to be second. “Stop, Holland! We want to be number two. Germany wants to be second, because we are strong, we are big. And who, if not us, deserves a third chance?” So he presented a similar video, saying he wanted to make it as simple as possible for our President, who “reads nothing”. “Mr. President, this is for you.”

The German video is more pointed. There are photos of Hitler, who “made Germany great again. Steve Bannon absolutely loves him.” “Germany hosted two world wars in the last 100 years. They were the best world wars in the world, and we won both of them. Bigly. Anyone who says anything else is fake news.” “We built a great German wall. And we made the Russians pay for it.” The video referenced Trump’s comments about being backstage at the Miss Universe pageant and about grabbing women. It’s very funny.

By that time, similar videos were being produced by late-night shows across Europe. They all poked fun at their own nation’s histories and politics, and at their neighbors, by references to Trump. Most of them are not as funny, perhaps because they are less subtle. Serbia: “Mr. President, just like you, we also like to grab women by the genitals.” Poland: “You want to destroy the EU, we’re already doing it from the inside.” Switzerland said the KKK were Trump’s friends. “We also love to treat our women badly. Love it. We didn’t let them vote until 1971. In some places, even until 1990. We grabbed them by the civil rights. And they let us do it. It was great.” Norway: “We might even award you the Nobel peace prize. You’ve already done more than Obama to bring people of the world together. Against you.”

Soon the viral video craze spread beyond Europe. A version from India said, “We know you love grabbing women by the [cat meows]. We have an ancient manual, the Kamasutra, which lists more than 245 ways to grab someone by their [cat meows].” Mexico: “We build walls. Nobody builds walls better than us.” An Israeli one was very funny, saying that Jews controlled Hollywood, but that Alec Baldwin was not Jewish. It contained frequent references to sexual assault and making fun of the handicapped. The website collecting the videos displays 29 of them, mostly from Europe, but ranging to Australia and Namibia. A bit of web surfing reveals many others.

The idea seemed so good that non-nations got into the act. A video from the 566 sovereign nations of the USA, meaning Native American tribes, said, “We know all about cleansing, immigrants coming in, destroying your communities, taking your water, taking your land, taking your women.” Others came from Mars, Mordor (the evil empire in the Lord of the Rings trilogy), the Galactic Empire, former East Germany, and the North Pole, which stresses all the different white animals there. “Everybody is white for sure.”

These videos typically make fun of insignificant issues, like the size of Trump’s hands or the way he combs his hair. But they all address in a joking way much more serious issues. His most important policy ideas, his demeaning behavior towards the handicapped, and his prejudices about blacks, Mexicans and Muslims are treated in his own words, seemingly in his own voice. Trump’s comments about grabbing women come up in all of these videos.

The whole world is invited to laugh at, and simultaneously disdain, the American President. After showing the video, Böhmermann said in English: “When the whole world is standing up to make fun of you, you really achieved something truly great.”

America has become the laughingstock of the world. That’s not so great.

Cop still collecting salary after downloading child porn

In September 2016, an undercover Wahoe County Sheriff's Sgt. Dennis Carry in Reno, Nev. spotted nearly two dozen computer files containing child pornography available on a sharing site for download from a computer with an IP address leading to Trenton home of 29-year Detroit Police Officer Miguel A. Martinez, according to the complaint filed in Detroit's federal court Wednesday.

The videos showed prepubescent children engaged in sexual acts with each other and adults, according to the complaint.

In response to a subpoena, AT&T provided the officer's home address and further investigation revealed 100 or more files on his computer containing suspected child pornography. The federal complaint says the number of files were increasing through January.

On Feb. 21, Martinez agreed to an interview and admitted to investigators he frequented a peer-to-peer, bit torrent website and "may have seen" child pornography files.

Congress correctly ended gun background check rule

February 23, 2017
The writer of the letter to the editor referring to Rep. Charlie Dent's vote on the HJ Resolution 40 (requiring Social Security to report all persons receiving disability benefits, due to mental illness, to the FBI) suggests the mass shootings at Virginia Tech in 2007 could have been prevented by such Social Security reporting on folks receiving benefits for mental illness.

Unfortunately, it does not appear that the shooter at Virginia Tech ever received any benefits from Social Security for treatment of mental illness. Though I've not made any exhaustive search, it appears that none of the other mass shooters, who were considered as suffering from some sort of mental illness, received Social Security treatment benefits at the time of the shootings.

No doubt there exist many shortcomings concerning the need for better cooperation between those providing care for the mentally ill and law enforcement. Nevertheless, such arbitrary Social Security requirement is even opposed by the ACLU, not a usual supporter of gun-rights folks.

Prosecutors move to dismiss charges against former Scout leader

January 3, 2007

NEW HAVEN, Conn. --Federal prosecutors have moved to dismiss charges against a retired FBI agent who was indicted on child sex charges dating back more than a decade when he was a Boy Scout leader, in response to the death of his accuser.

William Hutton, 63, of Killingworth, was arrested in February on charges he enticed a member of his Scout troop to Maine for the purpose of sexual activity in 1994 and 1995.

Former Scout leader, FBI agent indicted on child sex charges
News-Times, The (Danbury, CT)
Saturday, February 4, 2006

NEW HAVEN- A retired FBI agent was indicted Friday on federal child sex charges dating back more than a decade when he was a Boy Scout leader.
William Hutton, 63, of Killingworth, was arrested Friday. The federal grand jury indictment accuses Hutton of enticing a member of his Scout troop to Maine for the purpose of sexual activity in 1994 and 1995.

"It's obviously devastating. He was an FBI agent in this district and was reputed in this district," defense attorney Hugh Keefe said.

"The people who worked with him in the U.S. attorney's office and FBI respected him."

Keefe said the investigation has been going on for years. He would not discuss the details of the case or how the allegations surfaced.

Investigators asked anyone who knows anything about the case to call the FBI. U.S. Attorney Kevin O'Connor said that's standard practice whenever there might be more victims.

"In any case that's a concern," O'Connor said. "Whether that's the situation here I can't say."

If convicted on all four charges, Hutton faces up to 30 years in prison and up to $250,000 in fines.

Hutton was released on a $200,00 bond. He may not own any firearms or have any unsupervised contact with children. He was also ordered to stay away from playgrounds, schools, arcades or anywhere children congregate.

Announcements
* The results of the survey of last week’s Pentagon debate listeners were announced: 10 voted that Craig McKee made the stronger case (that no plane was destroyed at the Pentagon), 2 concluded that Barbara Honegger was more effective (in saying that a plane was destroyed), 1 found that both were equally effective, and 1 found that neither party was effective.
* Richard Gage of AE911Truth contacted the teleconference about his concern that Barbara Honegger had indicated during the Jan. 18 debate that he had endorsed her theory or theories about what happened at the Pentagon. He asked that this statement be read: “AE911Truth does not endorse any particular theories or researchers regarding what happened at the Pentagon on 9/11. And while I have been initially impressed by various presentations on this subject, and offered quotes implying such, these quotes should in no way be construed as an endorsement of any presentations, theories or researchers.”
* Ken Freeland added that he, too, did not intend for his supportive comments about Barbara’s overall research efforts to be construed as support for “any particular theories or conjecture on Barbara’s part regarding explanations of elements of her research.”
* Barbara congratulated Craig for the debate result and added that she had not implied in any way that Richard Gage had supported any specific theory about the Pentagon.

Call began at 8 p.m. EST and adjourned at 9:40 p.m. EST/5 p.m. to 6:40 p.m. PST

5 top Russian diplomats die in 3 months--plus Putin's chauffeur died in freak car wreck in September--and former CIA Acting Director Mike Morell told Charlie Rose he would assassinate Russians "to make them pay a price"

100 Strange Russian deaths

Vitaly Churkin, Russia's UN ambassador since 2006,  died unexpectedly at age 64 in the consulate, two days ago.  And while it was said initially that Churkin died of a heart attack, that is not the case, according to his autopsy.

He is the fifth Russian diplomat to die unexpectedly in 3 months.  Turkish ambassador Karlov was shot at an art exhibition in December, Soviet Foreign Ministry officer Polshikov was shot in his Moscow apartment in December, Indian ambassador Kadakin died "from illness" in January, and Greek consul Malanin's death in January is unexplained.

Putin's chauffeur is the sixth politically important Russian to die recently and suspiciously.

Don't forget that on Christmas day, a Russian military jet went down over the Black Sea, killing 60 members of the Red Army choir and 33 others.

Sergei Krivov, said to be a security officer, died in the Russian consulate in NY on election day 2016 from an undisclosed cause, possibly head trauma.

The video of Putin's chauffeur crashing and dying (passenger less) looked like no ordinary wreck.

And here is another odd coincidence:  none of the western mainstream media have reported this spate of Russian diplomat deaths, at least not with my Google search.

Churkin's autopsy did not show a heart attack, stroke or pulmonary embolism (all generally easily identifiable).  These are the 3 usual (non-drug) causes of sudden unexplained death. Following the autopsy, the NY Medical Examiner said that toxicology and other studies will need to be performed to determine why Churkin died.

This looks suspiciously like the Deep State (aided by rogue intelligence officers) trying to provoke Russia.  Or at least, send (several) messages to Putin, while sending another interesting message to Trump.

Six ways from Sunday

It appears that Trump may not be in control of his intelligence services, and furthermore, Churkin's death happened in Trump's home town.  Which is also the home of Senate Minority Leader Chuck Schumer, who said Trump was "really dumb" to threaten the CIA. “Let me tell you, you take on the intelligence community, they have six ways from Sunday at getting back at you,” Schumer told MSNBC's Rachel Maddow on January 3, 2016.

Since when do Senators threaten Presidents in such an open manner?  These are no ordinary times.

Who is in control of assassinations of US 'enemies'?  Who designates who our 'enemies' are? Recall that after JFK fired CIA Director Allan Dulles, and said he would destroy the CIA, it was Kennedy who got killed, while the CIA prospered.

Please watch this short Charlie Rose interview with former CIA Acting Director Michael Morell--it is really scary.  Morell talks about his plan to assassinate Russians ("to make them pay a price") and kill Iranians, and destroy Assad's helicopter or plane, on the ground, to send Assad a warning. The interview was broadcast August 8, 2016. And now, his threats have come true. Will Schumer's also come true?

Last month, on "Meet the Press" Senator Lindsey Graham said Trump should "make Russia pay a price for trying to interfere" in the election.  Are assassinations the price, despite no evidence being proffered that Russia hacked the election--and who is extracting the price? Who is calling the shots?

Putin will have to do something about this. He has been patient, until now. Who will have to pay the next price?

Fed Judge in Detroit Compared Illegal Immigrants to Insects

U.S. District Judge Robert H. Cleland

DETROIT — The language from the federal bench in Detroit was stark and unsettling.
U.S. District Judge Robert H. Cleland compared illegal immigrants to an insect and menacing Japanese beetles in 2013 while sentencing a 21-year-old undocumented immigrant from Mexico. A couple years later, a fellow judge called that analogy disturbing.
“One little attractive iridescent emerald beetle from Japan is not really any threat at all,” Judge Cleland said. “But when it multiplies and hundreds of millions of its offspring or relatives emerge and devastate the ash tree population in the continental United States and elsewhere, it’s a serious problem.
“So the one very attractive little insect is nothing more than interesting, but it’s an example of a very large problem. And I think that’s what I have here.”
The colorful remarks, contained in a transcript recently obtained by Deadline Detroit, seem germane at a time when immigration is a hot-button issue and more criminal cases are likely to end up before federal judges like Cleland, who continues to serve on the bench.
“It’s very offensive and racist,” comments Brent A. Wilkes, national executive director of the League of United Latin American Citizens in Washington, who was contacted by Deadline. “I feel anyone coming before him would not get a fair hearing because of that racist mentality.”

TSA Warns Local Police about More Invasive Physical Pat-Downs at Airports

ticklethewire.com
The TSA is beginning to conduct more invasive physical pat-downs at airports nationwide, but it’s not entirely clear what that will entail.
But the agency informed local police of the new procedures because of suspicions that passengers will complain about “abnormal” federal frisking, Bloomberg reports.
Bloomberg wrote:
The decision to alert local and airport police raises a question of just how intimate the agency’s employees may get. On its website, the TSA says employees “use the back of the hands for pat-downs over sensitive areas of the body. In limited cases, additional screening involving a sensitive area pat-down with the front of the hand may be needed to determine that a threat does not exist.”
Now, security screeners will use the front of their hands on a passenger in a private screening area if one of the prior screening methods indicates the presence of explosives, according to a “security notice” Airports Council International-North America (ACI-NA) sent its U.S. members following a March 1 conference call with TSA officials

Why I Couldn’t Wait To See Them Go
I wrote in this space about the advisability of eliminating the Bureau of Alcohol, Tobacco, Firearms and Explosives in the aftermath of several scandals, including a semi-secret lawsuit over cigarette smuggling and the well-known “Fast and Furious” debacle.
That post drew thoughtful responses from two former border patrol officers and a former FBI agent. The commenters wrote to underscore a position I have long held: that, in the Obama administration, malfeasance by insiders at all levels went unpunished while innocent outsiders were routinely prosecuted for political purposes.
The former FBI agent, John Shipley, wrote that he was wrongfully convicted in a case related to a firearm recovered in Mexico. I do not have firsthand knowledge of Shipley’s case, so I am not prepared to weigh in on whether the jury’s verdict was incorrect or unsupported. But I can observe that his story fits an all-too familiar pattern in the previous administration’s actions. Behavior that is not commonly thought to be criminal, but which was undesirable in the administration’s opinion (or unpopular with its political base), was prosecuted as a crime in order to make a point. In Shipley’s case, the result was a conviction.
Shipley says he was an amateur gun collector who bought and sold guns to finance his hobby. Prosecutors said he was an arms dealer, and therein lay his alleged offense. How many full-time FBI agents have time to run a gun dealership on the side? And how many individuals in law enforcement, at all levels, buy and sell guns from time to time because they like to trade or collect them?
As a reminder, Eric Holder was held in contempt of Congress in 2012 over his failure to turn over documents related to Fast and Furious. He claimed the contempt citation was “the regrettable culmination of what became a misguided – and politically motivated – investigation during an election year.” Considering Holder’s record by the time he left office, the criticism was deeply ironic.
Nor was the administration’s tendency to turn undesirable behavior into criminal behavior confined to the ATF. Howard Root of Vascular Solutions did not think he was committing a crime – for the simple reason that he wasn’t, as a jury found last year. But lack of wrongdoing did not stop the Obama Justice Department from trying to label him a criminal because, as CEO of a medical device company, he made an appealing target.
The government’s case hinged on whether and to what

Judge Knocks FBI on Secrecy in Old FOIA Battle
– A murder investigation that has supposedly been closed for a quarter-century is at center of a federal court battle over old records that the FBI still keeps secret.

Hyram Kitchen, dean of the veterinary school at the University of Tennessee, was killed in 1990. Ambushed in his driveway while on his way out for an early morning meeting, the doctor was shot eight times – twice in the back of the head.

Police could not connect the murder to militant animal-rights activists but did acknowledge that there were rumors about extremists on a witch hunt for individuals like Kitchen.

The FBI closed its investigation of Kitchen’s murder more than 25 years ago, but his assailants remain unknown.

While fielding a request for its records on the case by Ryan Noah Shapiro, however, the FBI invoked exemption 7(A) of the Freedom of Information Act, which permits a law enforcement agency to withhold records whose exposure could interfere

Lying cop doesn't know Uber driver is actually a lawyer
March 9, 2017
When defense attorney Jesse Bright was pulled over in North Carolina while moonlighting as an Uber driver, he began filming the encounter. Allegedly, he had been pulled over for picking up a passenger from a known 'drug house,' but that didn't stop Bright from continuing to film, despite the police officers incorrectly telling him that it was illegal to do so. Jesse Bright shared the video on his Facebook page.

From Canada to Siberia, Permafrost Thaw Produces ‘Hell’s Mouth’ Craters, Sinking Lands, and 7,000 Methane Pockets Waiting to Blow
In places like Canada and Siberia, a memory of ice ages long past is locked away in the very soil. There, dig about three feet down, and you’ll encounter a layer of frozen earth running from 200 feet to almost a mile deep in some places. It’s like a great glacier secreted away underground and covering about 19 million square kilometers of the Northern Hemisphere. We call this frozen ground permafrost.

An Enormous Pile of Sequestered Carbon

Permafrost generally forms in regions where the mean annual temperature is below zero degrees Celsius. And the presently large expanse of permafrost has formed over the past 2-3 million years in which long, cold ice ages and short, and somewhat warmer interglacial periods have dominated.

(Recent research indicates that up to 120 billion tons of carbon could release from thawing permafrost this Century due to the warming that is now being caused by human fossil fuel burning. Such a release would roughly equate to 12 years of present fossil fuel burning adding approximately 40 ppm of CO2 equivalent gasses to the Earth’s Atmosphere [adding about 0.4 C to medium term warming and 0.8 C to long term warming]. The risk posed by this additional carbon feedback coming from the Earth System highlights the need to halt fossil fuel burning as swiftly as possible. Image source: The Impact of Permafrost Carbon Feedback on Global Climate.)

Locked away in all that permafrost is a massive store of carbon. Including peat, methane and methane hydrates, permafrost is estimated to have sequestered some 1,400 to 1,700 billion tons of a material that, if released as gas, could considerably contribute to the volume of heat trapping substances (like CO2 and CH4) already held aloft in the Earth’s atmosphere in a process that scientists call an amplifying climate feedback.

Evidence of Thaw and a Building Carbon Feedback

But now, human fossil fuel burning is causing the Arctic to rapidly warm — at about 3 times faster than the rate of warming for the rest of the globe (0.6 C per decade in the Arctic). And with atmospheric CO2 concentrations presently above 400 parts per million (and CO2e concentrations above 490 parts per million), the world is now starting to thaw out of the icy period of the last 2-3 million years. As a result, the permafrost is melting.

(Thermokarst lakes near Hudson Bay. Image source: Commons.)

When permafrost melts it changes the land around it. Often times, land subsides and deforms as the icy permafrost below collapses when it thaws. The resulting underground cavities can also telegraph to the surface in the form of sink holes. In places where microbes or hydrates are present, the cavities can fill with gas — which can sometimes erupt in a methane blow hole or ‘hell’s mouth’ crater. In Canada, a new study recently discovered that 52,000 square miles of northwestern permafrost is already thawing. The thaw is producing large sink holes, causing coastlines to rapidly erode, and proliferating the round ponds known as thermokarst lakes.

But it’s not just Canada that’s feeling the thaw. In Siberia, warming is also eating away at the permafrost. And what is happening there is arguably on a much grander and more disturbing scale than what we presently see in Canada. In East Siberia, for example, a 100 meter deep, 1 kilometer long crater has formed in the sagging Permafrost. It is officially called the Batagaika crater. But the locals know it as the Gateway to the Underworld. The crater began as a small deformation during the 1960s when permafrost thaw in the region initiated. It has, over the decades, grown considerably larger — with the growth rate accelerating along with permafrost melt during recent years.

(Time lapse of Batagaika Crater expansion from 1984 to 2016 as provided by Google’s Earth Engine.)

Further west, the Yamal region of Russia is seeing strange bulges dispersing across the land. The bulges, according to Russian scientists and to reports in the Siberian Times, are being caused by bubbles of methane gas beneath the surface. The scientists state that these formations are likely being triggered by warming — in which either methane hydrates trapped within the permafrost are thawing or where microbes have come in contact with thawed permafrost carbon to break it down and produce methane. And in recent years, this region of Arctic Siberia has seen some very warm temperatures — with readings hitting as high as 35 C (95 F) during the summer of 2016.

These same researchers now note that some 7,000 underground methane bubbles exist in this region and that warming is pushing them to erupt. When the pressure below the land surface reaches a critical point, the Siberian Times report suggests that the land above can be displaced — bursting outward. The Siberian Times went on to note that large holes forming in the Yamal region during 2014 and 2015 were caused by just this kind of methane eruption.

(The Yamal Crater was one of the first indications that methane pockets forming beneath the Siberian Tundra were starting to erupt due to human-forced warming. Image source: The Siberian Times.)

Touchy Subject Scientifically and Politically

Permafrost thaw producing high volumes of feedback carbon release can be a touchy subject in the sciences and politically. The reason is that rational responses to this threat moves decision points forward on human carbon emissions cuts and it adds to the concern that atmospheric carbon capture will be needed later this century and on through many centuries to follow in order to prevent a scenario in which carbon feedbacks cause a form of warming runaway.

It doesn’t help that the science on permafrost carbon feedback is also new and rife with uncertainty — generating a kind of gray area in which rumors and misinformation can multiply. And there also appears to be some indication that the fossil fuel industry is attempting to use the issue to push gas extraction and burning in the Arctic — falsely claiming that all of the gas is going to release anyway. Which is not true — a portion of the permafrost carbon and related methane would remain sequestered even as human extraction efforts, if they continued indefinitely, would ultimately result in the release of a much larger portion of this carbon to the atmosphere than mere feedbacks alone.

It is worth noting that presently accepted science indicates that the present rate of atmospheric carbon release due to fossil fuel burning is likely many times that of the potential annual carbon release coming from the permafrost even under the worst case warming scenarios. And because that realized rate of permafrost carbon release is directly tied to how much fossil fuel we ultimately burn, we should be very clear that the urgency to cut these emissions couldn’t be higher.

Here's what Jimmy Breslin wrote about Donald Trump decades ago
Updated: Monday, March 20, 2017, 2:55 PM

Jimmy Breslin took a look at one of New York’s biggest characters, Donald Trump, and saw a chump.

The legendary columnist, who died Sunday, was an original champion of the working class, using his space in the Daily News and other papers to spotlight heroes and villains for ordinary New Yorkers.

And many years before Trump’s unprecedented rise to the presidency, Breslin summed up the fellow Queens boy as an enemy of the people.

In the ‘80s and ‘90s, Breslin saw through Trump’s worst instincts — his bullying and bragging, his cheapskate scams, his abuses of the press and the public — while most metro media marveled at the real estate mogul as a symbol of success.

Legendary Daily News columnist Jimmy Breslin dead at 88
One of Breslin’s earliest mentions of Trump avoided even using the name that would soon be screamed from front pages and skyscrapers worldwide.

In a 1982 Daily News column, Breslin brushed past “a young builder named Junior with a Big Ego,” who had recently made a famous but fruitless bid to buy the newspaper.

“His civic responsibility in the past consisted of getting tax abatements,” Breslin mused about the man who would become a daily fixture in the city’s tabloids.

Jimmy Breslin died Sunday at 88.
In a series of Newsday columns years later, which the paper republished Sunday, Breslin unleashed harsh truths about Trump that have only gained more currency since the tycoon took the White House.

Jimmy Breslin to join N.Y. Journalism Hall of Fame
“Trump, in the crinkling of an eye, senses better than anyone the insecurity of people, that nobody knows whether anything is good or bad until they are told, and he is quite willing to tell them immediately,” Breslin wrote in a 1988 column about Trump’s purchase of an airline, which turned out to be one of his biggest business failures.

Breslin saw Trump as a Queens guy running “crap games” while a hungry public admired him for “t

The hottest story about Trump and Russia you never heard

.This season of “Homeland,” the TV espionage thriller that continues to grip me, is particularly dark and twisted. But it has nothing on real life, as President Trump’s regime and the deep state continue to wrap their oily tentacles around each other’s throats. In season six of the Showtime series, brilliant bipolar spook Carrie Mathison (Claire Danes) thinks she has safely escaped the CIA vortex, only to be dragged into the whirlpool of a violent Washington power struggle that pits a female president-elect (yes, the show’s writers were just as fooled by Hillary Clinton’s “inevitability” as the rest of us) against a ruthless CIA faction aligned with a vast Breitbart News-type fake news operation. Nuclear peace in the Middle East hangs in the balance. Ho-hum. Like I said, art pales before reality in today’s Washington.

There’s so much political drama and intrigue unfolding by the hour in the nation’s capital that not even news junkies can keep up with it. In the latest reality episode of Trump’s Washington, FBI Director James Comey emerged as the liberal media’s hero. The towering, 6-foot-8 lawman is now portrayed as the only one with the power to bring down the clownish, orange-haired villain — by laying bare the truth about his corrupt pact with Russian archenemy Vladimir Putin. Now that’s entertainment!

But sorry, I’m not buying this story line. James Comey? The same wily Washington operator who tipped the election to Trump in the final days of the presidential race by reviving Clinton’s email issues? He’s no hero of mine.

Tishomingo Police Officer Russ Robinson committed suicide March 24 after admitting to authorities he had molested minors.

His admission came after the Alcorn County Sheriff’s Department, with assistance from the Mississippi Bureau of Investigation, questioned the 53-year-old officer about allegations he molested a 17-year-old boy after flashing his headlights to get the teen to pull over.

RELATED:x-deputy gets 40 years for sex crimes against children

It was not the first time molestation allegations had arisen against Robinson, but it was the first time authorities took action to address them.

Several years earlier, Robinson, a deputy then for Tishomingo County, left his part-time job at Brooks Grocery in Iuka following another such accusation.

Asked if Robinson had been fired, owner Davis Brooks replied, “I don’t want to comment. That’s private information.”

Asked if Robinson had been fired because he allegedly molested a young male there, Brooks replied, “I told you before, that’s private information.”

Robinson left the Tishomingo County Sheriff's Department after a new sheriff was elected in 2015 and began working for the Tishomingo Police Department.

Tishomingo Police Chief Mike Kemp said he was aware that authorities on March 23 were questioning Robinson about molestation allegations.

“(The allegations of molestation) happened in another county,” Kemp said. “I knew he wasn’t charged.”

He said Robinson was still working for the police department at the time of his death.

Asked about Brooks Grocery, Kemp said Robinson was never fired from there.

“There were some innuendoes,” Kemp said. “We determined that he resigned from Brooks Grocery. I don’t think there was any molesting. Certainly no charges were made.”

The rumor, Kemp said, was that Robinson had said something inappropriate.

“Nobody ever contacted us or said anything,” he said. “I had heard the rumor, but until I had concrete information, there was nothing I could do.”

Asked if he questioned Robinson about this, Kemp said no.

He explained that he was never approached by anyone with any information.

But Kemp was working at the sheriff’s department several years ago with Robinson and then-narcotics officer Jeff Palmer.

Palmer’s estranged wife, Leigh, recalled him coming home several years ago and talking about a surveillance video from Brooks Grocery, which supposedly showed molestation by Robinson.

She said he worried this matter could "come back and bite them” since no criminal action was taken against Robinson.

Palmer denied all of this, saying it was a lie and that his wife has admitted under oath to lying in the past when she was mad.

Documents show Jeff Palmer's veracity was called into question when he failed a polygraph test in which he was asked about using drug buy money for personal use.

Palmer, who is no longer in law enforcement, had been suspended from the state Bureau of Narcotics after he was accused of falsifying and forging vouchers “for the purchase of information and evidence

Paul Ohm: Internet bill could give FBI massive power
By Paul Ohm The Washington Post Apr 2, 2017

Many are outraged about congressional efforts to eviscerate Internet privacy regulations set by the Federal Communications Commission under President Barack Obama. But a frightening aspect to the current bill remains underappreciated: If signed, it could result in the greatest legislative expansion of the FBI’s surveillance power since 2001’s Patriot Act.

Don’t believe anyone who suggests that the law merely returns us to the state of the world before the FCC finalized its landmark privacy rules in October. The obvious reason Internet service providers (ISPs) burned through time, money, political capital and customer goodwill to push for this law was to ask for a green light to engage in significantly more user surveillance than they had ever before had the audacity to try.

This must be the reason, because on paper, the law accomplishes little. President Trump’s handpicked choice to head the FCC, Ajit Pai, already began work to roll back these rules in a more orderly fashion. Make no mistake: ISPs aren’t just asking for relief from a supposedly onerous rule; they want Congress’s blessing. With Trump’s signing of the bill, diminishing the FCC’s power to police privacy online, ISPs will feel empowered — perhaps even encouraged — by Republicans (no Democrats voted for this measure) to spy on all of us as they never have before. And spy they will.

How, then, does this law — which would directly affect only private behavior — benefit the FBI? From 2001 to 2005, I worked for the Justice Department and spent a lot of my time advising law-enforcement agents and prosecutors who wanted to track Internet behavior. Many of our investigations led directly to a specific IP address — the identifier for a particular computer or device — which then prompted a request to an ISP for more information. Tens of thousands, if not hundreds of thousands, of these requests arrive at ISPs around the country every year.

Many — perhaps most — of these requests do not involve criminals; instead, they lead to victims of crimes, mere witnesses or otherwise innocent people. These requests have typically sought only information about the identity of the person associated with the IP address because the FBI understands that this is the only information ISPs tend to

F.B.I. KEPT A FILE ON SUPREME COURT
Special to the New York Times
Published: August 21, 1988
The Federal Bureau of Investigation kept a confidential file on the United States Supreme Court from 1932 until at least 1985, according to recently obtained F.B.I. documents.

The 2,076-page file, much of it compiled during the tenure of Director J. Edgar Hoover, contains everything from suspicions about possible Communist influences on the Court in the 1950's to the use of Court employees as F.B.I. sources. The file was obtained by Alexander Charns, a Durham lawyer and freelance journalist, under the Freedom of Information Act.

Other F.B.I. documents, obtained by earlier freedom of information requests, show that the F.B.I. wiretapped or monitored conversations involving four men who served on the Court: Earl Warren, William O. Douglas, Abe Fortas and Potter Stewart.

It is not clear from the documents whether all the conversations occurred while the four were on the Court. Nor is it clear, in most instances, whether the F.B.I. listened to actual conversations of the four Justices, or conversations involving them. Stewart's Voice Is Heard

Justice Stewart, who served on the Court from 1959 to 1981, was heard in two monitored conversations. He was not the target of the wiretap, the bureau documents show. The dates of the conversations and the target of the investigations that occasioned the wiretaps were not revealed.

Ramsey Clark, who was Attorney General from 1967 to 1969 and as such officially in charge of the F.B.I., said he had not been aware of such a file on the Supreme Court.

Told of the file, whose existence was first reported last week in The Durham Morning Herald, Mr. Clark described the disclosure as worrisome ''considering the history of the F.B.I. and its ideology.'' Mr. Clark said he did not recall ever being asked to authorize electronic surveillance of a Justice or being told of a wiretap involving a Justice.

Spokesmen for the F.B.I. repeatedly declined to comment. Material Changes With Years

Kenneth O'Reilly, professor of history at the University of Alaska at Anchorage and author of ''Hoover and the Unamericans,'' said that wiretapping was so pervasive from the 1940's to the 1960's that ''virtually everyone was overheard'' who was important in Washington politics.

The documents, which include newspaper articles, clippings from The Congressional Record and internal F.B.I. memorandums, show the F.B.I.'s relations with, and changing attitude toward, the Court from 1932 to 1985.

The earlier material includes references to personal favors, such as help with travel arrangements, that the bureau furnished the Justices and their families. Much of the material after Mr. Hoover's death in 1972 includes references to security checks for prospective Court employees that the F.B.I. furnished at the Court's request.

In the late 1950's, the F.B.I. became increasingly concerned about what it believed were pro-Communist decisions by the Court. F.B.I. records previously released show that Justice Douglas's loyalty was questioned by Mr. Hoover and his top aides in that era because of his views involving the Constitutional rights of Communists. Rosenberg Case Is Mentioned

Also, according to the file, select Court employees served as F.B.I. sources of information during the Rosenberg atomic spy case in the early 1950's.

The chief of the Supreme Court police, Capt. Philip H. Crook, was described in a 1953 memorandum as having ''furnished immediately all information heard by his men stationed throughout the Supreme Court building. He kept special agents advised of the arrival and departure of persons having important roles in this case.''

An F.B.I. memorandum states that Harold B. Willey, then Clerk of the Supreme Court, made suggestions to F.B.I. agents as to the best places to be in order to ''know at once what action individual judges, or the court as a whole, was taking. They also advised as soon as legally possible any action contemplated by the defense lawyers.''

A few days after the execution of Julius and Ethel Rosenberg in 1953, an F.B.I. memo recommended that Mr. Willey; T. Perry Lippitt, the

CAN HACK BUT NOT SHOOT? FBI MAY EASE ENTRY FOR CYBER AGENTS

WASHINGTON -- Aspiring federal agents who can hack a computer with ease but can't shoot their way out of a paper bag could soon find the FBI to be more welcoming.

In a series of recent speeches, FBI Director James Comey has hinted the bureau may adjust its hiring requirements to attract top-notch cyber recruits, the better to compete with private sector companies who can lure the sharpest technical minds with huge salary offers.

He's floated the idea of scrapping a requirement that agents who leave the FBI but want to return after two years must re-enroll in the bureau's storied but arduous Quantico, Virginia, training academy. He's also lamented, half-jokingly, that otherwise qualified applicants may be discouraged from applying because

WHY DO FBI AGENTS NEED TO BOOST THEIR IMAGE ?

CBS News April 13, 2017, 4:38 PM
Comey announces FBI cooperation in new documentary series

FBI Director James Comey announced Thursday that he allowed producers Dick Wolf and Marc Levin to have access to the bureau’s New York offices for a year to film a new TV series.
“We have to care what people think about us,” Comey explained during an interview at the Newseum in Washington, D.C. “The faith and confidence of the American people is the bedrock.”
The series will be called “Inside the FBI: New York” and is produced by Dick Wolf, the creator of “Law and Order”, along with documentarian Marc Levin.

He hopes that the new documentary series will boost the FBI’s image, an understandable wish following a campaign season in which the FBI played an

How the Media Conned the Public into Loving the FBI: Book Review

FBI Director J. Edgar Hoover Photo credit: The White House / Wikimedia.
A review of “Hoover’s FBI and the Fourth Estate: The Campaign to Control the Press and the Bureau’s Image” by Matthew Cecil, University Press of Kansas, 355 pages, $34.95
Matthew Cecil, a communications professor at Wichita State University, has resolved a conundrum that’s bedeviled me since 1970, when I was a fledgling investigative reporter.
I had just completed my first interaction with the Federal Bureau of Investigation, the supposedly crackerjack national law enforcement agency. But the crackerjack part escaped me. My initial experience suggested an agency that produced inaccurate information inefficiently, failed to respect the constitutional liberties of U.S. citizens, and often resorted to intimidation and lies to get their way. Yet many of my journalistic “betters” told me I was misguided.
Smart people who think they are well informed about a subject—say, the Federal Bureau of Investigation’s role as the nation’s elite law enforcement agency—usually “know” what they think they know based on exposure to mass media—television, radio, newspapers, magazines, books. But when mass media have been corrupted, the reliability of the “knowledge” becomes suspect. That’s the case with the FBI.
As “Hoover’s FBI and the Fourth Estate: The Campaign to Control the Press and the Bureau’s Image” shows, the performance of supposedly first-rate FBI agents has been dismal time and again when the citizens of the United States needed them most, including perhaps most notably the run-up to the events of September 11, 2001.
Readers of WhoWhatWhy will be familiar with our frequent reports of problems with FBI operations (see for example this, this and this). And may be asking themselves: why don’t I see this in the media? The answer is in this book.
What the FBI excelled at, especially under its long-time chief J. Edgar Hoover, was a non-stop public relations campaign that portrayed the agency as a heroic band of G-men who skillfully tracked and felled dangerous criminals.
“Tales of the FBI’s infallible laboratory and army of honest and professional agents became part of popular culture,” Cecil writes. Thanks to mass media, “the FBI was widely considered to be an indispensable government agency.”
In fact, in all too many cases, dangerous criminals were eluding capture, while that “infallible” forensic laboratory wrongly analyzed evidence again and again, leading to the pursuit and convictions of innocent individuals.
J. Edgar’s 48-Year Reign
The publicity juggernaut to gild the FBI’s image began during the directorship of J. Edgar Hoover. He died in 1972, after 48 years at the helm. But the campaign he initiated was so pervasive, and the propaganda he peddled so appealing, that the image of incorruptible, invincible agent-heroes lives on in perpetuity.
Only gradually, since Hoover’s death, has the true story of the FBI begun to emerge. As Cecil explains, the course of events and countless investigations have exposed “a lawless and uncontrolled Bureau that expended enormous amounts of time and resources policing political thought rather than investigating violations of federal law… Hoover had ultimately transformed the Bureau into an American secret police force, even as he convinced the public and many in the news media that he was a trustworthy defender of civil liberties.”
Cecil says he wanted his book to reveal “how, in a nation so proud of its watchdog press, a high-profile federal agency managed to hide the reality of its activities for so long. The answer is as complex as the FBI’s decades-long deception, but it surely includes failings entrenched in the ideology of journalism and in readers’ and viewers’ often uncritical acceptance of news as truth.”
The reference to the “watchdog press” is central here. Yes, starting in the first decade of the twentieth century, what today we call “investigative reporting” began to take root in the U.S. media. But no more than a handful of media organizations ever practiced serious investigative journalism. The vast majority of journalists were too untrained or lazy or gullible or corrupt to seek the truth behind the FBI’s public-relations façade.
Unfortunately, as Cecil points out, many, probably most, consumers of news cannot or will not distinguish the excellent journalists from the untrained, lazy, gullible and corrupt ones and therefore have no idea whom to believe about the FBI. Through wise choice of media outlets and via pure luck, some consumers of mass media inevitably learned the ugly truth about the FBI—while most never did.
In the book’s Introduction, Cecil renders the abridged history of the FBI public relations campaign:
“After a few tentative steps into the realm of publicity during the late 1920s, the Bureau became a key element of FDR’s New Deal war on crime in the mid-1930s. Two journalists, independent author Courtney Ryley Cooper and Neil (Rex) Collier, collaborated with Hoover and his top lieutenants to create a template for FBI news stories emphasizing responsibility and science and featuring Hoover as America’s always careful and reliable top law enforcement officer. With the creation of the public relations-oriented Crime Records Section in 1935 and the establishment of clear lines of public communication authority, Hoover had both a public relations message and a management team to amplify and enforce it.”
During the mid-1930s, Collier, a Washington Star reporter, oversaw a comic strip called “War on Crime” that ran for two years in 80 newspapers across the United States.
Cecil summarizes the first six weeks of the strip: “Week one of ‘War on Crime’ focused on Hoover, who, Collier wrote in the comic strip’s text, ‘had the vision of a man twice his age.’ Hoover had cleaned up the Bureau, and ‘now he had men of unassailable integrity’ in the field.”
After touting the agents’ grueling training regimen and the cutting-edge science of the FBI’s crime-fighting laboratory, the strip focused on the Agency’s success in capturing criminals: “In the morgue of the Fingerprint Division are the cancelled records of criminals removed from circulation such as Dillinger, Floyd, and Nelson.”

J. Edgar Hoover (left) with Sumner Blossom, Editor of The American Magazine, and journalist Courtney Ryley Cooper
Cooper had worked as a publicist for a circus before turning to newspaper feature writing. He met Hoover in 1933, while rewriting a profile of the FBI chief for American Magazine. After completing the rewrite, Cooper suggested a more permanent arrangement to Hoover. Soon, articles ghost-written by Cooper about the FBI began appearing in magazines and newspapers under Hoover’s byline. Other pieces appeared under Cooper’s name after FBI staff had carefully vetted them. Among the influential periodicals that published such public relations material as “news” were the respectable magazines Cosmopolitan and Saturday Evening Post.
Cecil notes:
“At a time when Americans were desperate for government to do something right, the FBI’s pursuit and elimination of John Dillinger and the other ‘Robin Hood’ outlaws of the Midwest provided a compelling hook on which to hang the Bureau’s reputation. Hoover built on that narrative, erecting an FBI built not only on real law enforcement innovation but also on a manufactured public relations foundation that hid mistakes and excesses from public view for nearly 40 years.”
Accused bank robber Bennie Dickson, for example, died on a St. Louis street during 1939 after he supposedly threatened to unload his weapon in the direction of four FBI agents. Cecil, relying in part on previously undisclosed FBI reports, shows that Dickson was actually trying to flee the scene when a trigger-happy agent shot him in the back.
The evidence appears overwhelming that in the aftermath of Dickson’s death, FBI agents coordinated their accounts, offered perjured testimony and threatened a key witness into silence after she had told the truth.
Cecil says that holes first began to appear in the FBI’s holier-than-thou image around 1940. Media accounts of agents falsifying testimony, conducting illegal wiretaps and raiding homes of Americans involved in the Spanish Civil War brought the agency unwanted attention.
Hoover found ways to fight back. His staff maintained lists of hundreds of journalists, and categorized each as friend or foe. Foes were denied access to FBI information, while friends, like famed columnist Walter Winchell, got “insider” tips they could use, often unattributed, to spin coverage of specific investigations and to burnish the FBI’s overall reputation.
While most major media outlets willingly joined the pro-FBI chorus, low-circulation intellectual magazines like The Nation and The New Republic probed deeper.
Fred Cook’s critical reporting about the FBI filled the entire 58 pages of The Nation magazine for October 18, 1958. Cook questioned the American public’s “worship” of an agency that was “part heroic fact” to be sure, but also “part heroic myth.” Cook would expand the magazine tour de force into a 1964 book, “The FBI Nobody Knows.”
While trying without success to refute Cook’s facts, Hoover and his supporters accused him, and other critics, of being un-American—a charge that bore considerable weight during the Communist-hunting hysteria of the 1950s.
***
But even Fred Cook’s hard-hitting expose could not come close to neutralizing the Bureau-friendly “journalism” of Don Whitehead.
Whitehead had established his credentials as a newspaper reporter and war correspondent by the time he completed an “authorized” history of the FBI in 1956. “The FBI Story: A Report to the People” became a big seller. Whitehead had no qualms about FBI censors vetting his manuscript. In discussing the agency’s propensity for tapping telephones and bugging private homes and offices, Whitehead compared these actions to a potential employer examining “every possible source for information as to the honesty and reliability of a prospective employee.”
As Cecil sees it, “Whitehead sold out his own journalistic credibility to the heroic history of the FBI. Hoover counted on the public’s logical conclusion that a famed, objective journalist had reviewed the evidence and verified the Bureau’s history as it had always been told.”
In 1959, Whitehead’s book “became the basis for a popular motion picture, also titled ‘The FBI Story,’ starring Jimmy Stewart. And when Hoover moved the FBI story into television in 1965, carefully selected scriptwriters were provided copies of Whitehead’s book.”
Under press liaison Louis B. Nichols, FBI staff “edited and rewrote news, feature, and magazine stories produced by cooperative reporters…[plus] rewrote scripts for radio, television, and film.”
In 1965, the hour-long television drama “The F.B.I.” started airing on the ABC network, a co-production of Warner Brothers and Quinn Martin. The dramatization of FBI cases reached millions of viewers each week, 241 episodes over a nine-year period, not including re-runs and syndication showings. An FBI agent worked on the set. FBI employees reviewed and rewrote the scripts line by line. The agency had the right to approve production crew members, performers and advertisers.
The FBI censors objected to scenes in which agents killed criminals, because that seemed to indicate a lack of responsibility. “In addition to limiting violence…FBI reviewers rejected scripts that showed agents drinking alcohol, using diet pills to make their weight requirements, exercising poor judgment, losing their composure, and…demonstrating excessive compassion for criminals.” The censors insisted any reference to wiretapping be omitted.
I watched episodes of the television drama while in my final year of high school and during my freshman year of college, and swallowed whole the idealized image of the FBI. But in the years since 1970 when I began my career as a professional journalist, I have cast a skeptical eye on all kinds of institutional glorification. I now know that much of the FBI story I bought qualified as… bullshit.
In this book, Cecil spells out how Americans were sold an image of an FBI beyond reproach. It’s not only a solid, fascinating work of history, it’s a cautionary tale against current and future attempts to mold public opinion about government actions in the face of inconvenient facts.

Abstract
Of all federal government agencies in the U.S. from the 1930's to the 1980's, the Federal Bureau of Investigation probably had the most successful media relations program. The Bureau's leaders seemed to be masters at getting good publicity and avoiding bad.By describing a quantitative analysis of the FBI's publicity over that 50-year period, this article attempts to show why those efforts were so successful. It identifies the themes that typified the verbal component of Bureau publicity, and the broad spectrum of mass communication channels that were tapped.

Internal State Department instructions to implement President Donald Trump's temporary travel ban on citizens of six Muslim-majority nations help demonstrate that the ban violates the constitution, the American Civil Liberties Union argued in court filings late on Thursday. The ACLU made the argument as part of its lawsuit in federal court in the Northern District of California on behalf of three student visa holders against Trump's March 6 executive order barring travelers from Iran, Libya, Somalia, Sudan, Syria and Yemen from entering the United States for 90 days and refugees for four months. New privacy protocol designed to protect undocumented students
by Annika Hom / Beacon Correspondent • April 12, 2017

Concerns about the safety of undocumented students led the Office of the General Counsel to release a protocol this month that guides Emerson employees on how to interact with government officials.
The protocol outlines for administrators what to do if a government official of any rank asks them for private information about students, staff, or faculty.
The protocol was drafted two months ago in response to faculty and students who were concerned that immigration officials would ask administrators and faculty for students’ citizenship papers, said Deputy General Counsel Meredith Ainbinder. Students without documentation could possibly be deported under the current presidential administration.
Freshman political communication major Matthew Enriquez Manrique said he believes the protocol is a necessary step for undocumented persons on campus.
“It’s a significant group on campus that no one really pays a lot of mind to,” Enriquez said.
Deep reporting professor and senior journalist-in-residence Cindy Rodriguez said she is also nervous about immigration officials asking for student information.
“We’ve seen outrageous acts by [U.S. Immigration and Customs Enforcement],” Rodriguez said. “I do worry about [raids]. I feel horrible knowing that students need to have that burden, that stress put on them.”
Ainbinder said the protocol helps faculty determine the legitimacy of both the claimed government official’s identity and the need for the information they are requesting.
“It’s so people don’t have to ask what to do if [an information request] happens to them for the first time,” said Ainbinder.
The protocol does not specifically address undocumented persons because the OGC wanted a draft that could apply to any situation involving third-party information

Why won't the Department of Justice (DOJ) investigate electronic vote fraud? Is it because the DOJ and FBI have long been involved in it, themselves?
“If you did it right, no one would ever know,” said Craig C. Donsanto, head of the U.S. Department of Justice’s Election Crimes Branch, Public Integrity Section (from 1970-2010) in a July 4,1989 Los Angeles Times article about electronic voting machines and vote fraud.

READ:
• PROSECUTION OF ELECTION OFFENSES (see: DOJ/DonsantoElectionManuel.pdf) January 1999, Sixth Edition, by Craig C. Donsanto, Director, U.S. Department of Justice, Criminal Division, Public Integrity Section -- This manual is a study in how NOT to investigate election crimes. There is little mention of voting machines or the threat they pose to the process. Check out page 62 and see democracy.ru article (at bottom of this page) that tipped this editor off as to the existence of the manual, and is a good summary of the manuel --Excerpt: "Since the voting process is at bottom primarily a state-regulated activity, federal authorities should not interfere with it. This means that until the votes have been canvassed and the outcome of all the election contests on the ballot certified by the competent state authority, the documentation generated by the election process must remain in state hands. Also, while this may not be possible in all situations, it is preferable that the predication of federal voter fraud investigations above «preliminaries» await the conclusion of the election and the certification of results. Again, close consultation with Public Integrity is encouraged." (In other words, after the fox has left the henhouse, Donsanto allows his agents to investigate.)
• A FEDERAL OBSERVER REPORT (See: FederalObserverReport.pdf) Once again, this report is a study in how NOT to effectively observe the election process. No meaningful information is collected as a result of federal observers filling out these reports.

The Cincinnati Bell-FBI scandal: Leonard Gates, a Cincinnati Bell employee for 23 years, testified that in the late 1970's and 80's, the FBI assisted telephone companies with hacking into mainframe election computers in cities across the country. He spoke with agents from both the DOJ (U.S. Attorney Kathleen M. Brinkman) and FBI (Agent Love), but to his knowledge, neither agency took further action. Leonard Gates 1987Deposition, plus 1985 Background Material from Jim Condit, Jr. //Pandora's Black Box & http://www.votefraud.org/expert_strunk_report.htm (contains case number)
• Gates testified, P. 28, "He (Gates's supervisor, Mr. Jim West,) said the programming was obtained out of California, and that the programming had been obtained through the FBI, and all this kind of stuff, and that was about it."
• Page 34 excerpt: "And I knew that we did do certain things under certain court direction, under certain court orders, and I just didn't see where they would have a court order to get into that, and I expressed my concern to Mr. Dugan (President of Cincinnati Bell). Mr. Dugan said it was a very gray area, and that they were into like New York and Atlanta, Georgia, and to the other computers, you know. This was just small compared to what was going on."
• Page 39, "...and I said, "Well, do you (Mr.Fedrich, vice president of Cincinnati Bell) have a blanket court order on this or what?" And he kind of weasel-worded me, to be honest with you. He said "Well, our relationship with the FBI is very, very close."
Excerpt from Nov 1996, Pandora's Black Box by Philip M. O’Halloran of Relevance, The Cincinnati Election Wiretapping Scandal:
Lewis and other skeptics of the vote-fixing scenario like to insist that there has never been any evidence of a "conspiracy" to fix elections by computer. But then, most of those we interviewed on both sides of the issue had never heard of the case of Leonard Gates of Cincinnati, Ohio. An employee of the Cincinnati Bell telephone company, Gates was watching a local t.v. news story, in which a Cincinnati man named Jim Condit was charging that the election system was vulnerable to vote fraud in the Hamilton county election process.
He based his charges on his experience as a candidate for city council in 1979, when, after an election night computer crash, Condit and seven other "feisty challengers" had suddenly "fallen to the very bottom of the heap" of 26 candidates. Gates called the station and later contacted Mr. Condit, telling him he knew firsthand how his votes were robbed. They met and shared information and ultimately Gates testified in Condit’s Cincinnatus PAC (political action committee) lawsuit against the Hamilton County Board of Elections.
The suit had earlier been decided against the plaintiffs and Gates took the stand during the appeal. He swore under oath that he was ordered by his Cincinnati Bell superiors to wiretap the election headquarters’ phones lines to provide a link-up between the county’s vote-counting computers and parties unknown on another phone line somewhere in California.
The following are excerpts from the Cincinnati Post of October, 30th, 1987:
Cincinnati Bell security supervisors ordered wire-taps installed on county computers before elections in the late 1970s and early 1980s that could have allowed vote totals to be altered, a former Bell employee says in a sworn court document.
Leonard Gates, a 23-year Cincinnati Bell employee until he was fired in 1986, claims in a deposition filed Thursday in Hamilton County Common Pleas Court to have installed the wire-taps. Cincinnati Bell officials denied Gates’ allegations that are part of a six-year-old civil suit that contends the elections computer is subject o manipulation and fraud.
Gates claims a security supervisor for the telephone company told him in 1979 that the firm had obtained a computer program through the FBI that gave it access to the county computer used to count votes. [Emphasis added].
The FBI refused comment and Cincinnati Bell spokesmen vehemently denied the allegations, claiming Gates was a "disgruntled ex-employee", yet, according to Condit, the company ultimately admitted that one of its vans was involved in the wiretapping, although it claimed they were commandeered without the company’s knowledge. The Post continued:
In the deposition, Gates claims he first installed a wire-tap on a telephone line to the county computers before the 1977 election at the instruction of James West, a Bell security supervisor.
Gates contends both West and Peter Gabor, security director, told him to install wire-taps in subsequent elections. Both men declined comment Thursday.
In the 1979 election, which is the focus of the deposition – Gates said he received instructions in the mail from West about installing wire-taps on county computers in the County Administration Building at Court and Main streets.
The wire-taps were installed on the eve of the election at Cincinnati Bell’s switching control center at Seventh and Elm Streets and terminated in a conference room in the building, Gates alleges.
In the deposition, Gates described in great technical detail installation of the wire-taps.
At about 8:30 p.m. on election day – Nov. 6, 1979 – Gates said he was called by West and told something had gone wrong, causing the elections computer to malfunction. At West’s instructions, Gates said he removed the taps.
The elections computer shutdown for two hours on election evening due to what was believed to be a power failure, Condit Sr. has said.
Gates said West told him they "had the ability to actually alter what was being done with the votes."
Gates said West told him the Board of elections did not know about the taps and that the computer program for the elections computer "was obtained out of California, and that the programming had been obtained through the FBI..."
Shortly after the 1979 election, Gates said he met with the late Richard Dugan, former Cincinnati Bell president, to express his concerns that the wire-taps were done without a court order.
"Mr. Dugan said it was a very gray area... This was just small compared to what was going on. He told me just, if I had a problem, to talk to him and everything would be okay, but everything was under control," Gates said [Emphasis added].
[Editor’s Note: This scandal’s alleged FBI connection raises the possibility of U.S. law enforcement and/or intelligence involvement in electronic vote-rigging.]
Another Cincinnati Bell employee, named Bob Draise, admitted to being involved in a second phase of the illegal operation, which involved wiretapping several prominent Cincinnati political figures including a crusader against pornography named Keating and the Hamilton County commissioner, Allen Paul.
Jim Condit told Relevance that, as a result of the ensuing scandal, Draise was convicted and five Cincinnati police officers, who were allegedly involved in the wiretapping operation, abruptly resigned. The alleged involvement of the FBI was never pursued and the Bureau itself did not follow up on the Gates allegations. In spite of all the evidence, the appeal by the plaintiff failed and the issue was laid to rest.

FEDERAL COMPLICITY IN VOTE FRAUD - excerpts from Lynn Landes's 2007 'REPORT TO CONGRESS'
The unique vulnerability of electronic voting technologies has been long known to federal authorities.
“If you did it right, no one would ever know,” said Craig C. Donsanto, head of the U.S. Department of Justice’s Election Crimes Branch, Public Integrity Section (from 1970-present) in a July 4,1989 Los Angeles Times article about electronic voting machines and vote fraud.
So, why hasn't Donsanto sounded the alarm and informed Congress of this threat?
Donsanto has the reputation of a gatekeeper. He was featured in the Colliers' book, VoteScam, for his unwillingness to investigate evidence they collected over the years of rampant vote fraud involving voting machine companies, the news networks' exit polls, and election officials in Florida and other states.
Furthermore, Donsanto made it official department policy that no federal investigator should enter a polling precinct on election day, nor should they begin any serious investigation of the voting process until after the election results are certified. It is this policy that gives those who commit vote fraud ample opportunity to destroy evidence and cover their tracks. (See official policy: http://www.thelandesreport.com/Donsanto.htm)
There is more to be concerned about than obstruction of justice within the DOJ. It appears that elements within the FBI may have not only been aware of computer vote fraud, but participated in it. The following are excerpts from the Cincinnati Post of October 30th, 1987:
"Cincinnati Bell security supervisors ordered wire-taps installed on county computers before elections in the late 1970s and early 1980s that could have allowed vote totals to be altered, a former Bell employee says in a sworn court document. Gates claims a security supervisor for the telephone company told him in 1979 that the firm had obtained a computer program through the FBI that gave it access to the county computer used to count votes." (See: Pandora'sBlackBox.htm)
No state could match the staggering number of Voting Rights complaints due to voting machines and other election irregularities as Florida did in the 2000 presidential election. Yet the Bush Administration's DOJ under Attorney General John Ashcroft did not send federal observers to Florida to monitor the voting process in 2002, although federal observers were sent to several other states. This was surprising news to many people and organizations who were told by DOJ officials that "Justice" would be down there in force.
Even if federal observers had been sent to Florida, how would they 'observe' the accuracy of the voting machines there?
"They wouldn't know that," says Nelldean Monroe, Voting Rights Program Administrator for the U.S. Office of Personnel Management (OPM) in a phone interview. Her agency is responsible for the recruiting and training of federal observers who are sent by the DOJ to monitor elections if violations of the Voting Rights Act are suspected.
In a November 21, 2002 e-mail Monroe elaborated, "The only observance of the tallying of the votes is when DOJ specifically requests observers to do so. This rarely occurs, but when it does, it is most often during the day following the election when a County conducts a canvass of challenged or rejected ballots. In this case, federal observers may observe the County representatives as they make determinations on whether to accept a challenged or rejected ballot. Federal observers may also observe the counting of the ballots (or vote tallying) when paper ballots are used." (See e-mail: http://www.thelandesreport.com/nelldeanmonroe.htm)
In other words, federal observers can only observe people, not machines, counting paper ballots. Monroe confirmed that there is no training and no opportunity for federal observers to observe the accuracy of voting machines.
Under Section 8 of the Voting Rights Act, 42 U.S.Code § 1973f, federal observers may be authorized to observe "... whether persons who are entitled to vote are being permitted to vote ...(and) whether votes cast by persons entitled to vote are being properly tabulated..."
America's nontransparent voting process (i.e., voting by machine, absentee, early, or secret ballot) violate those provisions. Federal observers cannot observe "whether persons who are entitled to vote are being permitted to vote” (and) “whether votes cast are being properly tabulated."
Under "Prohibited acts" in §1973i, the "Failure or refusal to permit casting or tabulation of vote"...can result in civil and criminal penalties. "No person acting under color of law shall fail or refuse to permit any person to vote who is entitled to vote...(and) Whoever...knowingly and willfully falsifies or conceals a material fact... shall be fined not more than $10,000 or imprisoned not more than five years, or both."
Requiring voters to use voting machines, rather than allow them to mark and cast their own votes, constitutes "failure or refusal to permit casting". Any result produced by a machine is circumstantial (i.e., not direct) evidence of the intention of the voter.
Fundamentally, nontransparent voting makes the role of the federal observer moot and the Voting Rights Act une

Castillo was one of several San Juan police officers and Border Patrol agents who responded to a traffic accident near Stuart and Moore Road back on August 27.
Inside an abandoned vehicle, officers and agents found narcotics.
The drugs were taken to the San Juan Police Department before being handed over to the DEA.
In December, DEA agents interviewed all agents and officers involved in the case. Castillo told the DEA that he didn’t see or touch the drugs until they were at the police station.
Video shows otherwise.

It was a scene that has become familiar to those who follow the ATF, the agency that enforces federal gun laws and regulates the firearms industry. In the quarter century since four ATF agents were killed trying to execute a search warrant at the Branch Davidian compound in Waco, Texas, the agency has repeatedly been called before Congress to answer for alleged transgressions, including, in the past year, hiring people with intellectual disabilities to run phony guns shops as part of sting operations and failing to oversee its network of paid informants.
In March, the Justice Department’s Inspector General determined that the ATF’s Dallas office could have arrested some of the men involved in Zapata’s death before he was killed, but had failed to act.
Lawmakers, especially Republicans, have seized on these missteps with a zeal that critics in the law enforcement community say is not entirely justified, given their scope. The fallout over a botched operation known as “Fast and Furious,” in which agents knowingly allowed straw buyers to traffic guns, led to a standoff between Congress and the Obama Justice Departmen

FBI Says No Need For Top FBI Official To Recuse Himself From Trump-Russia Probe

A top FBI official whose wife received political donations from an ally of Hillary Clinton’s last year does not need to recuse himself from the ongoing Trump-Russia investigation, the bureau said Wednesday.
The Senate Judiciary Committee inquired last month about FBI Deputy Director Andrew McCabe’s role on the Trump probe, which is looking into potential collusion between the Trump campaign and Russian government.
Iowa Sen. Chuck Grassley, the Judiciary Committee’s chairman, had expressed concerns about a potential conflict of interest given that McCabe’s wife ran a state campaign in Virginia that received $700,000 from Virginia Gov. Terry McAuliffe, a close friend of Clinton’s.
Grassley noted in a March 28 letter to FBI Director James Comey that the McCabes met with McAuliffe

Washington (CNN) -- An FBI employee shared confidential information with his girlfriend, who was a news reporter, then later threatened to release a sex tape the two had made.
A supervisor watched pornographic videos in his office during work hours while "satisfying himself."
And an employee in a "leadership position" misused a government database to check on two friends who were exotic dancers and allowed them into an FBI office after hours.
These are among confidential summaries of FBI disciplinary reports obtained by CNN, which describe misconduct by agency supervisors, agents and other employees over the last three years.

NYPD sergeant gets 28 years for sexual abuse of children
Wednesday, April 19, 2017, 4:02 PM

Disgraced NYPD sergeant Alberto Randazzo, who a prosecutor called one of the worst child sex abusers ever to pass through Brooklyn federal court, was sentenced to 28 years. (ANTHONY DELMUNDO/NEW YORK DAILY NEWS)
A disgraced ex-NYPD sergeant who a prosecutor called one of the worst child sex abusers ever to pass through Brooklyn federal court was sentenced to 28 years in prison.

A judge sentenced Alberto Randazzo Wednesday after he pleaded guilty in July to receiving child pornography and conspiring with at least five women - sometimes the children’s own mothers - to sexually exploit the young victims.

Federal guidelines recommended Randazzo serve upwards of 80 years.

Though Brooklyn Federal Judge Pamela Chen called Randazzo's crimes “heinous and depraved,” she said 80 years was too severe. She let out a deep sigh before announcing the sentence length.

NYPD cop pleads guilty to boy sex abuse on Skype
Randazzo met the women on sites like Match.com and Ashelymadison.com, then groomed them to prey on children. Randazzo watched the abuse on Skype calls and traveled to hotel rooms at least twice in the hopes of watching the abuse up front.

The victims ranged from under 1 to 8 years old. The sick spree started as early as 2010 and ran through early 2013, prosecutors said, when Randazzo was a supervisor in the Midtown

FBI agent's teaching license suspended because of how he quit to join FBI

April 17, 2017 at 1:04 PM, updated April 17, 2017
WAYNE -- A former chemistry teacher lost his teaching license for one year because he didn't give enough notice when he quit his job to pursue a career with the FBI, the state recently ruled.

Chae Hyuk Im was required to give at least 60 days' notice before leaving his tenured position at Wayne Public Schools. He didn't, and as a result, the Office of the Commissioner of Education suspended his teaching certificates for one year in a decision dated April 6.

Hyuk Im initially asked the district to let him take a one-year leave of absence to enter FBI training. The district approved it, but he failed the required physical test and he told the district he would start the 2014-15 school year as usual.

But he was later offered another opportunity to enter FBI training and was accepted in October 2014. Hyuk Im again

ACLU sues LAPD over 'systemic violation' of public records law

The American Civil Liberties Union has joined with a journalist, a college professor and an activist to sue the Los Angeles Police Department over what they describe as a “systemic violation” of California’s public records law.

The lawsuit, filed Tuesday, accused the LAPD of failing to comply with the California Public Records Act by not responding to requests within the time frame mandated by the law or by ignoring inquiries altogether.

The civil complaint documents nearly a dozen examples of such requests, including some that were allegedly made years ago and have yet to be answered.

“More and more, police departments throughout the United States acknowledge the value of transparency — to increase public trust, promote better law enforcement, and facilitate effective oversight,” the lawsuit stated. “The LAPD’s pattern and practice of violating the [state’s records act] and ignoring requests for public information is not only unlawful, but also out of step.”

The suit asks the court to compel the LAPD to follow the law and order the department to track — and report publicly — how it responds to public records inquiries for at least three years to en

With President Trump denouncing “illegal leaks,” whistleblowers are in the line of fire.

We’ve got to support whistleblowing and boost public outreach -- to counter the demagogic messaging from the top of the U.S. government.

To help that happen, please support NSA whistleblower Thomas Drake and CIA whistleblower John Kiriakou, the co-chairs of the Whistleblowers Public Education Campaign.

Here at the RootsAction Education Fund, we just got an update from John that we’d like to share with you.

“I had the pleasure of participating in a panel discussion in early April on national security whistleblowing hosted by the American College of Trial Attorneys,” John said. “A prominent Washington attorney and Matt Apuzzo of the New York Times were the other two participants.”

The gathering sounds like it was bittersweet for John. He told us: “It was nice, refreshing really, to be among like-minded individuals. The room was packed with trial attorneys, including some of the biggest names in Washington's white-collar criminal defense industry, all of whom support whistleblowers as necessary to the national security.”

John went on: “The problem, though, is that President Trump and Attorney General Sessions are determined to continue the war on whistleblowers begun nearly a decade ago by President Obama and Attorney General Holder. Indeed, Trump told the press last month that he will hunt down ‘the low-life leakers’ in his administration. ‘They will be caught!’ he tweeted. We ought to take him at his word.”

Telling difficult truth from inside the U.S. government has gotten harder than ever, with a president who has scorn for facts -- and hostility for anyone who reveals facts that expose what he wants to hide.

Tom and John know firsthand what’s at stake. As an NSA whistleblower, Tom was dragged through years of Espionage Act prosecution. As a CIA whistleblower, John went to prison for two years.

With the Trump regime now in power, the stakes are higher than ever. You can provide vital support now with a tax-deductible donation; half of every dollar will go directly to John and Tom, while the other half will go to the Whistleblowers Public Education Campaign that they coordinate.

At the RootsAction Education Fund, we remain deeply concerned that -- while people of all ages need to hear John Kiriakou and Tom Drake -- their personal finances were wrecked by legal persecution. That’s how the government planned it.

But we have very different plans. We want the voices of John Kiriakou and Thomas Drake to be heard far and wide.

“Like I said,” John told us a few days ago, “it's great to sit in a room of like-minded people, speak, and just agree with one another. But that's not what our goal is. Our goal is to get our stories -- our experiences -- into the public domain.

“As you know, Tom and I speak at every opportunity, whether it's on college campuses, to civil liberties groups, or even to foreign governments. And we usually do that for free or for reimbursement of our expenses.

“We can only continue to do it with your help.”

Can you help?

John says: “I fear for the country, for whistleblowers, and for those considering bringing to light evidence of waste, fraud, abuse, and illegality in government.”

We need to show whistleblowers and potential whistleblowers that they’re not alone -- that there’s vibrant life after whistleblowing -- and that difficult truth-telling is imperative for democracy.

Please support the Whistleblowers Public Education Campaign.

“Tom and I were both charged with espionage -- one of the gravest crimes with which an American can be charged, one that can include the death penalty -- for blowing the whistle,” John says. “Others like us will not have an easy time of things during the Trump administration.”

John adds: “This is what we're up against. This is the fight that we have to prepare ourselves for over the next four years. We can't do it without your help.”

Please help John Kiriakou and Tom Drake remain out there, in the public, speaking, writing, and shouting from the rooftops that whistleblowers must be protected, that whistleblower protection laws must be comprehensive, and that when a person makes the right moral, legal, and ethical decision -- to blow the whistle on waste, fraud, abuse or illegality -- he or she will not risk house and home.

We hope you can take a minute now to make a tax-deductible contribution in solidarity with John Kiriakou, Thomas Drake and the Whistleblowers Public Education Campaign. Thank you for your generosity.

What’s Wrong With Iowa?

We often drive through eastern Iowa on our way from central Illinois to Minnesota. The landscape is peaceful and prosperous. The farmhouses are well kept, and the roads smooth and wide. When we stop, Iowans are friendly and helpful.

Iowa is doing very well. The Census Bureau ranks Iowa #4 in lowest housing costs relative to income, and that cheap housing is near to the workplace: average commuting time is 19 minutes. Iowa is one of the safest states. The cultural scene is thriving: Forest City’s country music festival is ranked second in the country by Country Living magazine, and Broadway shows go straight to Des Moines. CNBC ranked Iowa 9th among the 50 states in its annual survey “Best States for Business”, with a similar ranking for quality of life.

So why does Iowa send a racist to Congress? Even before he was first elected to Congress in 2002, Steve King was clear about his disdain for immigrants of all kinds. As a state legislator, he proposed a law requiring Iowa students to be taught that the United States is the undisputed greatest nation on Earth. He sued his own Governor for providing ballots in languages other than English, despite the federal law that requires such ballots.

After election, King became known for his nasty characterizations of immigrants. In 2013, he generalized about undocumented immigrants: “For everyone who's a valedictorian, there's another 100 out there who weigh 130 pounds, and they've got calves the size of cantaloupes because they're hauling 75 pounds of marijuana across the desert.”

Do immigrants pose a particular problem in Iowa? Iowa has one of the lowest proportions of foreign-born residents, less than 5%, compared to 13% for the US, and only 7% speak a language other than English at home, compared to 21% in the whole country. Iowa is one of the whitest states, with 85% non-Hispanic whites, more than all but 5 other states. King’s district is even whiter: 96% white.

Here is what King has done in this current Congress since January. He proposed to repeal the Sixteenth Amendment to the Constitution, which created the federal income tax. He found one co-sponsor. He proposed a bill to terminate the EB-5 program, part of the Immigration Act of 1990 signed by President George H.W. Bush. That program offers green cards for permanent residence to entrepreneurs and their families, if they invest in a commercial enterprise in the United States and plan to create or preserve 10 permanent full-time jobs for qualified American workers. He found one co-sponsor. He proposed a bill to use federal funds to support private schools, and to repeal federal nutritional standards for school lunch and breakfast programs that increase the availability of fruits, vegetables, whole grains, and low-fat milk, and reduce sodium, saturated fat, and trans fat. He managed 3 co-sponsors for that. King proposed to end our national policy of giving citizenship to anyone born in the US, even if their parents are not citizens, as he has done in previous years.

Is King perhaps just very conservative? No, some recent comments show that he is a white supremacist. In July, he said about non-whites on a cable news show, “I'd ask you to go back through history and figure out, where are these contributions that have been made by these other categories of people that you're talking about, where did any other subgroup of people contribute more to civilization?” Just before the Dutch election, he tweeted about the far-right candidate Geert Wilders, “Wilders understands that culture and demographics are our destiny. We can’t restore our civilization with somebody else’s babies.” The former KKK leader David Duke understood what King meant, and responded “GOD BLESS STEVE KING!” On CNN, King reaffirmed his idea of a white America: “I meant exactly what I said. I’d like to see an America that's just so homogeneous that we look a lot the same, from that perspective.”

Why do the people of northwestern Iowa keep electing King to Congress? It’s not because he does anything useful there. Since he was elected to Congress in 2003, he has sponsored over 100 bills and not one of them even got out of committee, even though Republicans controlled the House for most of those years. He was named the least effective member of Congress in 2015 by non-partisan InsideGov.

Are most people in Iowa’s 4th district racists? Not necessarily: in 2008, they voted for Obama over McCain for President.

Steve King, along with other politicians who have made openly racist statements, exemplifies an unhappy characteristic of many white American voters. Electing a conservative is more important than not electing a racist. As long as their choice is between a Democrat and Steve King, northwestern Iowans will keep voting for King, no matter how ineffective or prejudiced he is.

That’s how we end up with racists in Congress.

FBI present' at multiple government buildings in Laredo
April 26, 2017

The FBI confirmed Wednesday that they were at multiple locations in Laredo 'conducting law enforcement activity.'
While it was not immediately clear what the activity was, Special Agent Michelle Lee confirmed to KENS 5 that the agency was 'lawfully present' at multiple locations including Laredo City Hall, Public Works Office, Utilities, and Webb County offices.
Special Agent Lee said that the buildings were not being evacuated and that there was no public safety threat at any location. "The buildings were not being evacuated as some concerned citizens may have reported, rather employees working in certain areas were asked to leave," Lee said in a statement.

Executive Summary
In a review of nearly 2,500 pages of documents released by the Federal Bureau of Investigation as a result of litigation under the Freedom of Information Act, EFF uncovered alarming trends in the Bureau’s intelligence investigation practices. The documents consist of reports made by the FBI to the Intelligence Oversight Board of violations committed during intelligence investigations from 2001 to 2008. The documents suggest that FBI intelligence investigations have compromised the civil liberties of American citizens far more frequently, and to a greater extent, than was previously assumed. In particular, EFF’s analysis provides new insight into:
Number of Violations Committed by the FBI
• From 2001 to 2008, the FBI reported to the IOB approximately 800 violations of laws, Executive Orders, or other regulations governing intelligence investigations, although this number likely significantly under-represents the number of violations that actually occurred.
• From 2001 to 2008, the FBI investigated, at minimum, 7000 potential violations of laws, Executive Orders, or other regulations governing intelligence investigations.
• Based on the proportion of violations reported to the IOB and the FBI’s own statements regarding the number of NSL violations that occurred, the actual number of violations that may have occurred from 2001 to 2008 could approach tens of thousands of possible violations of law, Executive Order, or other regulations governing intelligence investigations.1
Substantial Delays in the Intelligence Oversight Process
• From 2001 to 2008, both FBI and IOB oversight of intelligence activities was delayed and likely ineffectual; on average, 2.5 years elapsed between a violation’s occurrence and its eventual reporting to the IOB.
Type and Frequency of FBI Intelligence Violations
• From 2001 to 2008, of the nearly 800 violations reported to the IOB:
o over one-third involved FBI violation of rules governing internal oversight of intelligence investigations.
o nearly one-third involved FBI abuse, misuse, or careless use of the Bureau’s National Security Letter authority.
o almost one-fifth involved an FBI violation of the Constitution, the Foreign Intelligence Surveillance Act, or other laws governing criminal investigations or intelligence gathering activities.
• From 2001 to 2008, in nearly half of all NSL violations, third-parties to whom NSLs were issued — phone companies, internet service providers, financial institutions, and credit agencies —contributed in some way to the FBI’s unauthorized receipt of personal information.
• From 2001 to 2008, the FBI engaged in a number of flagrant legal violations, including:
o submitting false or inaccurate declarations to courts.
o using improper evidence to obtain federal grand jury subpoenas.
o accessing password protected documents without a warrant.
Introduction
EFF’s analysis of recently disclosed documents provides new insights into the Federal Bureau of Investigation’s unlawful surveillance of Americans during intelligence investigations conducted between 2001 and 2008.
In response to EFF FOIA requests issued in 2008 and 2009, the FBI released reports of violations made to the Intelligence Oversight Board (IOB) — an independent, civilian intelligence-monitoring board that reports to the President on the legality of foreign and domestic intelligence operations. The nearly 2,500 pages of documents EFF received include FBI reports to the IOB from 2001 to 2008. The reports catalog 768 specific violations arising from FBI monitoring of U.S. citizens, resident aliens, and non-residents.
Following a series of government investigations into FBI intelligence abuses, EFF submitted FOIA requests in an effort to obtain the FBI’s IOB reports. In 2007, the Department of Justice, Office of Inspector General released a report (pdf) documenting the FBI’s abuse of its National Security Letter (NSL) authority:2 the report found, in an audit of only 10% of national security investigations, that the FBI may have committed as many as 3000 NSL violations and had failed to report many of those violations to the IOB.3 A 2008 OIG report (pdf) confirmed and expanded the earlier report’s findings and critically assessed the steps taken by the FBI to address the abuse of NSLs.4
Following the second OIG report in 2008, EFF submitted FOIA requests to eleven federal agencies and agency components requesting all reports of intelligence violations made to the IOB from 2001 to 2008. EFF submitted subsequent requests the following year for violations reported to the IOB from 2008 to 2009. In July 2009, after many agencies failed to respond to the request, EFF filed suit against seven defendants — including the CIA, NSA, Department of Defense, Department of Homeland Security, Department of Justice, Office of the Director of National Intelligence, and Department of State — demanding the agencies comply with the law and produce the requested documents. In December 2009, the Court ordered the agencies to begin processing EFF’s request. In July 2010, two years after EFF’s initial FOIA request, the FBI began its release of documents. Over three separate installments in July, August, and October 2010, the FBI released nearly 2,500 pages of documents related to reports of intelligence violations to the IOB.
The documents released to EFF constitute the most complete picture of post-9/11 FBI intelligence abuses available to the public. Among other findings, EFF’s analysis of the documents shows that, from 2001 to 2008, significant delays occurred in the reporting of FBI violations to the IOB. The analysis also provides new insights into the type and frequency of violations committed by the Bureau. Most violations fell into one of three broad categories: first, FBI failure to comply with oversight guidelines; second, abuse of the FBI’s authority to issue National Security Letters; and, third, the FBI’s failure to carry out investigations within the bounds of the Constitution or other federal statutes governing intelligence-gathering. Finally, EFF’s analysis concludes that the FBI may have committed as many as 40,000 violations in the 10 years since the attacks of 9/11.
The Intelligence Oversight Board
The Intelligence Oversight Board "was created in 1976 by President Ford in response to recommendations made by the Rockefeller Commission calling for a Presidential-level body with specific oversight responsibilities for the legality and propriety of US intelligence activities.”5 The Commission’s recommendations came in the wake of a series of congressional reports that revealed illegal and abusive intelligence activities targeting American and foreign citizens. These reports found that intelligence agencies had intercepted and read Americans’ mail, performed surveillance on civil rights leaders and other dissidents, and had orchestrated assassination attempts on foreign leaders.
In light of the Commission’s recommendation, President Ford established the IOB to provide an independent review of intelligence activities to better safeguard citizens’ civil liberties against these types of abusive practices. The IOB consists of five civilian members, all with top-level security clearances, selected by the President to serve on the IOB from the larger intelligence-monitoring body, the President’s Intelligence Advisory Board (PIAB).6 The IOB’s mission is to "oversee the Intelligence Community’s compliance with the Constitution and all applicable laws, Executive Orders, and Presidential Directives."7 The IOB must then report to the President those violations the Board believes "may be unlawful or contrary to an Executive Order or presidential directive." 8 Since its creation, the vast majority of the IOB’s reports and investigations have remained secret.
Slight modifications to the IOB’s authority and structure have occurred since its creation in 1976, but the IOB’s oversight capacity remained largely unchanged for nearly 30 years. In the years following the attacks of 9/11, however, the Board’s role within the intelligence community was diminished in several ways. First, from 2001 to 2003, President Bush failed to appoint advisers to serve on the IOB.9 Even when advisers were appointed, however, the IOB continued to provide little real oversight: the IOB did not for
