FLORIDA PANHANDLE, June 21, 2005 (waynemadsenreport.com)—Experienced federal investigators, acting independently, have discovered a covert funding channel used by the 2000 and 2004 Bush-Cheney campaigns and the administrations of Jeb Bush in Florida and Bob Taft in Ohio to illegally funnel foreign and other questionable money into Republican coffers.

Ever since the brutal death of Florida Department of Transportation (FDOT) investigator Ray Lemme in July 2003, the focus of investigators in Florida and Georgia has been on the political scandal Lemme was uncovering. After his official investigation of contract fraud, money laundering, illegal immigration, and election fraud was shut down on orders of Jeb Bush, Lemme continued to investigate the use of FDOT to launder cash for the Bush brothers and their allies. Lemme's focus was on the use of the Florida Turnpike system to launder cash for the Jeb and George W. Bush campaigns. It was an investigation that would ultimately lead to Lemme's body being discovered in a motel room bathtub in Valdosta, Georgia. A two-state police cover-up of Lemme's death, threats directed at Florida and Georgia investigators, and a virtual media blackout indicates that the GOP administrations of Jeb Bush and Georgia's Sonny Perdue wanted the Lemme story to go away—and fast.

The reason for the cover-up of Lemme's reported "suicide" is simple. Investigators have now discovered that foreign cash, including Chinese, Saudi, and Nigerian money, was laundered via the biggest state-run cash cow in Florida—the Florida Turnpike system. Because most of the transactions involving Florida's toll roads involve cash and huge amounts of it, it was easy for foreign and other questionable money to be laundered via FDOT.

Lemme had reportedly become aware of the use of FDOT to commit criminal acts. Valdosta, where Lemme went to meet a still unknown source, is a key center for international organized criminal activity, including illegal foreign worker smuggling, involving close political allies of George W. and Jeb Bush.

Flashback: From Dec. 6. 2004 article "Texas to Florida: White House-linked clandestine operation paid for "vote switching" software," Wayne Madsen, OnlineJournal.com:

Yang's [Yang Enterprises] questionable billing activities with its Florida DOT contract came to the attention of Ray C. Lemme, a seasoned senior investigator with the Florida DOT Inspector General's Office and a combat veteran of the Vietnam War. Lemme had a lot of evidence to suspect that Yang was overbilling the DOT for "millions." After discovering Yang's dirty laundry, Curtis went to work for the DOT. Mavis Georgalis, the DOT's contracting officer for the Yang contract, was also aware of improprieties with the contract. As a result of pressure from the Florida State House, both Curtis and Georgalis were eventually fired by the DOT because of their complaints about the Yang contract. Someone was obviously trying to send Curtis a message when, on August 14, 2002, he discovered that someone poisoned his pet Pomeranian dog, Emily. Lemme was forced to stop his official investigation of Yang for similar reasons. However, he decided to continue an "unofficial" investigation of Yang and its practices on the side. It was a fateful decision.

According to DOT employees familiar with the Yang case, Lemme was aware that it was Jeb Bush who personally shut down his investigation of Yang. Lemme also leaked details concerning his investigation to the Daytona Beach News Journal. The investigator had previously requested a full audit of the Yang contract with the DOT, a request that was denied. Lemme also became aware of something else outside the framework of the DOT contract—that Yang had been involved in producing a prototype vote switching program for use with touch screen voting machines and that Tom Feeney was in on the scam. The last time Clint Curtis spoke to Lemme, he remembers the silver haired investigator excited about where his case was leading. Lemme told Curtis that the cover up of Yang was coming from "as high up as I could imagine" and that he had "proof" that was "shocking."

On Sunday, June 29, 2003, evidence indicates that Lemme drove from Tallahassee to Valdosta, Georgia, the home of Moody Air Force Base. A motel receipt indicated that Lemme checked in at the Knight's Inn off Interstate 75 at 6:49 p.m. Lemme's wife said that her husband left home for work on Monday, June 30, at 5:15 a.m., an hour earlier than usual. According to a Leon County Sheriff's report, Lemme's wife said she received a voice message after she returned home at 6:45 p.m. on Monday. The message was from her husband's supervisor, Bob Clift, who informed her that earlier in the day, at 6:15 a.m., Lemme called into work, left a message, and said he would not be coming to work that day. Clift said he was checking up on Ray Lemme. Mrs. Lemme called Clift and told him that her husband was not at home. Mrs. Lemme told police that her husband was working on a "big case." Mrs. Lemme filed a missing person report with the Leon County, Sheriff's Office. Clift later determined that Ray Lemme made his earlier call to work at 6:15 a.m., one hour after he supposedly left his home for work, from a pay phone at the junction of Interstate 10 and Highway 1 in Jefferson County, Florida. Shortly after 11:00 a.m. on Tuesday, July 1, the maid assigned to clean Lemme's room—132—received no answer when she knocked. The door was locked. There was no response when the maid called the room's telephone. The hotel manager then called the police.

The following is from the Valdosta Police Detective Report filed by Detective Craig Spencer and dated July 1, 2003: "On July 1, 2003 at approximately 1330 hours, I received a page advising me to be en route to Knights Inn at 2110 West Hill Avenue in reference to an unattended death." When Spencer and other police officers and detectives arrived at the motel, the manager told them that the occupant of Room 132, Ray Lemme, was to have checked out by 11a.m. The officers yelled through the slightly ajar door but received no answer and they discovered the upper swing latch was locked. The officers used a special tool provided by the motel to open the swing latch lock. Spencer said that one of the officers entered the room and found a suicide note and then proceeded to the bathroom where Lemme was found dead in the bathtub. Police also discovered that the inside of Lemmes's left elbow—the cubital tunnel—was slashed. There were spurts of blood on the wall but no blood found on the floor. A belt possibly used as a tourniquet and a double- edged straight razor blade were found on the side of the tub. A bath towel was unfolded and neatly placed on the floor next to the tub.

Later on July 1, the Georgia Bureau of Investigation Crime Laboratory in Moultrie informed the Valdosta Police that based on the "suicide" details, no autopsy would be performed on Lemme. Unlike Florida, Georgia does not perform mandatory autopsies. A doctor, with 25 years' clinical experience, who was interviewed for this story, claimed that the circumstances of Lemme's death appeared to him to be a classic "mob hit." If the Leon County Sheriff missing person report is to be believed, it is clear that someone other than Lemme checked into the Valdosta motel on Sunday evening using his name. Clearly, the Leon County Sheriff's report contains a number of details that directly conflict with facts found in the Valdosta Police report. In addition, the Lowndes County, Georgia, Coroner's report fails to indicate an estimated time of death based on a full medical examination—it surmised that the time of death was the same time as indicated on the suicide note: 8:10 a.m. on July 1.

An empty manila folder and a blank legal pad notebook were found on the hotel room's desk along with an undated and unsigned suicide note written on lined paper, which lacked any identifiable fingerprints, from Lemme's day planner. The note merely contained the time 8:10 a.m. with the following notation: "I love my family (family underlined once) with all my heart. I am sorry. I am depressed and in pain. Mary Ann (Lemme's wife), I love you." ("I love you" underlined twice). It was certainly not indicative of a person who was ecstatic that he was finally going to nail a long investigation that involved vote rigging, overbilling, and fraud abetted by the very top political leadership in Tallahassee. Interestingly, the last number on Lemme's pager (an 850 960-XXXX) ended with the number "911." It is also interesting that Lemme's watch, when discovered by the police, was stopped at 12:34 p.m. on June 30–a possible indication that Lemme was trying to convey the time of a possible in extremis situation. Also, Lemme's Florida driver's license was in his room while his wallet was in the glove box of his car, which was parked in front of the room. Two motel receipts were found in Lemme's room by the police. One was a check-in receipt dated June 29 and timed at 6:44 p.m. The other was a receipt, without a notation of check-in or check-out, dated June 30 and timed at 6:54 a.m. A witness told police that Lemme's car was parked in front of his room on the afternoon of June 30.

Sergeant Eugene Bell of the Valdosta Police Department interviewed a 39-year old female guest who was staying in Room 236 over the weekend. She and her daughter noticed three men standing in the parking lot across from Lemme's room at 8 a.m. on the morning of July 1. The behavior of the men made the guest suspicious enough that the woman initially believed the men were engaged in a drug deal. According to the police report, the camera used to photograph the crime scene was later discovered to have a defect in the flash memory card. The defect resulted in no usable photographs being submitted with the official police report.

Later, veteran GAO and FBI investigative specialist John Caylor discovered that the Valdosta Police story about a defective digital camera memory stick and the purported lack of crime scene photos of Lemme's motel room was a ruse. Caylor was able to obtain the crime scene photos of Lemme from the Valdosta Police. Lemme's body, found in Room 132 of the Knights Inn bathtub, clearly shows that he was brutally beaten and strangled prior to his death—reported by police to have been from a self-inflicted razor cut to his arm.

It is unlikely that Lemme, who told former FDOT and Yang programmer Clint Curtis that he was on the verge of cracking a huge case that went straight "to the top," would have traveled to a state like Georgia, where autopsies are not mandatory, to commit suicide. Moreover, Lemme drove a beeline route to Valdosta, an indication that he was anxious to meet with his "source." Lemme had been informed that a Chinese sub-contract programmer for Yang named Henry Nee (aka Hai Lin Nee), who had been busted by Immigration and Customs Enforcement officers for illegally transferring missile parts to China, had been given the Social Security number of an Iowa resident. Although Nee had only been in the United States for five years, his Social Security number from Iowa had been issued to another individual 24 years earlier. Valdosta is a center for illegal smuggling and it was this nexus of illegal alien smuggling and money laundering that attracted Lemme to the city.

After Lemme's death, Valdosta criminal activities and bribes paid to Florida politicians became the subject of a grand jury investigation run by US Attorney for Northwest Florida Greg Miller. Miller's investigation reportedly dovetailed with Lemme's probe of money laundering involving FDOT and Florida turnpike receipts. The chairman of the Florida Transportation Commission, who has control of FDOT and the turnpike system, is Earl K. Durden, a major GOP player in Florida who is close to both Jeb and George W. Bush. Durden was appointed to the Transportation Commission post by Jeb Bush. When Miller's investigation of money laundering was leaked, it was George W. Bush who personally flew to Florida from Washington to close down the entire probe.

Eight Florida Panhandle counties west of Tallahassee (Bay, Gulf, Okaloosa, Walton, Holmes, Washington, Santa Rosa, and Escambia) and the border counties of Georgia (Lowndes, Echols, Brooks, Thomas, Grady and Decatur) and Alabama (Houston, Geneva, Covington, Escambia, and Baldwin) have long been centers of illicit Bush activities dating back to the Iran-contra and savings and loan failures. Lowndes County, where Valdosta is located, is a major center for Bush-connected criminal activity. Gulf and Bay counties are centers for Jeb Bush-connected organized crime activity.

Now comes word that "Coingate" in Ohio is tied to the same criminal elements in the GOP that were responsible for turnpike toll money laundering in Florida. Durden's counterpart in Ohio, Tommy Noe, a Bush "Pioneer" contributor whom Gov. Taft appointed to the Ohio Turnpike Commission, is in the center of a major scandal involving missing state funds invested in rare coins and baseball cards. Shortly after the Toledo Blade began reporting on the Ohio coin scandal, Noe resigned from the turnpike commission.

An additional investigation of missing Ohio state revenue is focused on millions of state dollars invested in a hedge fund. Federal investigators are investigating charges that Noe laundered some of the missing $12 million from the state's coin fund into the Bush 2004 campaign. Mr. Bush has returned a mere $4,000 from Noe's contributions. Ohio and Florida were the scenes of major election fraud in 2004. It now appears that both states laundered hundreds of millions of dollars to engage in massive fraud involving all sectors of state government, from election officials and secretaries of state to state auditors and attorneys general.

Ohio and Florida have the highest turnpike toll rates in the nation coupled with the least oversight. Both states, rife with political corruption fostered by the patrician Republican Taft and Bush families, are now the center of Coingate scandals tied to political chicanery and money laundering.

Manhattan's veteran District Attorney Robert Morgenthau is on the verge of penetrating a major conduit for foreign money into the Bush family network and the American political system that parallels the campaign finance scandals in Ohio and Florida. Morgenthau's investigation of the notorious brothers, Sam and Charlie Wyly of Texas, the billionaires who spearheaded the Swift Boat disinformation campaign against John Kerry and a similar distortion effort against John McCain in 2000, is focused on a Wyly-controlled Isle of Man off-shore account tied to the Bank of America. In 1989, George H. W. Bush dispatched a Houston attorney to the Isle of Man to take charge of the secret Bush accounts. One of the accounts was Five Star Trust, a multi-billion dollar account used by the Bushes as a covert offshore money tranche for their political and business purposes.

FEMA Chief Brown Paid Millions in False Claims to Help Bush Win Fla. Votes

Michael Brown, the embattled head of the Federal Emergency Management Agency, approved payments in excess of $31 million in taxpayer money to thousands of Florida residents who were unaffected by Hurricane Frances and three other hurricanes last year in an effort to help President Bush win a majority of votes in that state during his reelection campaign, according to published reports.

“Some Homeland Security sources said FEMA's efforts to distribute funds quickly after Frances and three other hurricanes that hit the key political battleground state of Florida in a six-week period last fall were undertaken with a keen awareness of the looming presidential elections,” according to a May 19 Washington Post story.

Homeland Security sources told the Post that after the hurricanes that Brown “and his allies [recommended] him to succeed Tom Ridge as Homeland Security secretary because of their claim that he helped deliver Florida to President Bush by efficiently responding to the Florida hurricanes.”

The South Florida Sun-Sentinel uncovered emails from Florida Gov. Jeb Bush that confirmed those allegations and directly implicated Brown as playing politics at the expense of hurricane victims.

“As the second hurricane in less than a month bore down on Florida last fall, a federal [FEMA] consultant predicted a "huge mess" that could reflect poorly on President Bush and suggested that his re-election staff be brought in to minimize any political liability, records show,” the Sentinel reported in a March 23 story.

Hurricane Frances hit Hutchinson Island, Fla., about 100 miles north of Dade County, on Sept. 5. Miami-Dade officials described damage there from heavy rain and winds of up to 45 mph as ''minimal,'' according to the Post.

A May 14 story in the Sun-Sentinel said: “Miami-Dade County residents collected Hurricane Frances aid for belongings they didn't own, temporary housing they never requested and cars worth far less than the government paid, according to a federal audit that questions millions in storm payouts.

Responding to those allegations, Brown held a news conference Jan. 11 blaming the overpayments on a “computer glitch” …

On Sept. 2, 2004, Garcelon, wrote a three-page memo titled "Hurricane Frances -- Thoughts and Suggestions."

“The Republican National Convention was winding down, and President Bush had only a slight lead in the polls against Democrat John Kerry,” the Sentinel reported in its March 23 story. “Winning Florida was key to the president's re-election. FEMA should pay careful attention to how it is portrayed by the public, Garcelon wrote in the memo, conveying "the team effort theme at every opportunity" alongside state and local officials, the insurance and construction industries, and relief agencies such as the Red Cross.”

The DHS audit report found that, under Brown, FEMA erroneously distributed to Miami-Dade residents:

# $8.2 million in rental assistance to 4,308 applicants in the county who "did not indicate a need for shelter" when they registered for help. In 60 cases reviewed by auditors, inspectors deemed homes unsafe without explanation, and applicants never moved out.

# $720,403 to 228 people for belongings based on their word alone.

This is a thoughtful article. It mixes voting rights with civil rights. Why? Because there are huge implications for both parties based on where the New Orleanians vote. If they’re denied the vote in Louisiana, either de facto or de jure it will allow a David Duke event in Louisiana. Any analysis of Democratic victories, nationally, shows that Democratic candidates minus black voters equal a loss. There are exceptions, to be sure (Swietzer, D, MT Gov and Hackett, D OH 2nd who nearly won an all white district). But in Louisiana, you don’t get elected as a Democrat without New Orleans. Watch how this unfolds. The voting rights, election fraud, and civil rights movements are all one movement.

WASHINGTON — Government officials and legal experts have begun wrestling with an intriguing question posed by the evacuation of New Orleans: What happens to the politics of a region when a significant part of the electorate suddenly disappears?

The migration of hundreds of thousands of people from this urban center, many of them low-income and black, could have a dramatic effect on the political makeup of a state delicately balanced between the two major parties. If most of the evacuees choose not to return, Katrina's political legacy could be that it made Louisiana a more Republican state.

How Katrina may have rewritten the political map of New Orleans and of Louisiana is just one of many questions the Gulf states are pondering in the aftermath of a natural disaster of such scope that it may have permanently altered the region's demographics and economy.

Ernest Johnson, head of the Louisiana NAACP, called Friday for Congress to pass emergency legislation to extend special protections of the Voting Rights Act that expire in 2007. The law is meant to ensure access to the polls for black voters.

Johnson says the hurricane has potentially disenfranchised 1.5 million voters, many of them black.

"A lot of voters have been displaced, and they could be out of their voting jurisdiction, with toxins in the water, for a year or more," Johnson said. The expiring provision of the law requires jurisdictions in 15 states to clear changes in election laws with the Justice Department to ensure the changes do not disadvantage minority groups.

"We were going to fight for the extension anyway. Now, we want to move up the debate, to talk about this in 2005 instead of 2007, so we do not have to worry," Johnson said. The provision, he said, would protect voters as precincts are moved and absentee ballots are mailed.

Unlike the migration of Oklahomans during the Great Depression, which lasted for years, this shift of population — whose consequences could be lasting — occurred over a few days.

One immediate casualty may be Louisiana's unusual political culture.

In the jargon of political consultants, Louisiana is a "pink state." After voting twice for President Clinton, the state voted twice for President George W. Bush. It recently elected its first Republican U.S. senator since Reconstruction — David Vitter.

Johnson, the Louisiana NAACP leader, said he was hoping that evacuees, once relocated, would contact their local National Assn. for the Advancement of Colored People chapters so that the Louisiana branch could reestablish contact.

"The thing I'm worried about is getting New Orleans people back to New Orleans," he said.

"The modern trend in this country is to make it more difficult to vote," said Laughlin McDonald, the head of the American Civil Liberties Union voting rights project. "If people insist on taking that stand [in Louisiana], then a lot of these folks are not going to be allowed to vote."

In his role as secretary of state, Ohio's chief elections officer, Blackwell ruled that supporters had gathered enough valid signatures to get a constitutional amendment on next year's ballot that, if approved, would limit the spending of state and local government.

Blackwell also is honorary chairman of Citizens for Tax Reform, the group backing the amendment.

He said that the group submitted 324,006 valid signatures, more than the 322,899 required. The requirement equals 10 percent of the votes cast in the last governor's race.

Fake letters from the "Bureau of Wanton Corruption" were mailed out last week, touting a new "Pay-to-Play Triple Play" program for Ohio businesses.

The program features such unbearably high employer premiums that competing businesses will steer clear of Ohio and such miserable employee benefits that workers will be desperate enough to take any job, the letter says.

The letter is signed "James Conjob" and at first glance it looks like a legit letter from the scandal-plagued Ohio Bureau of Workers' Compensation.

The letters appear to be the work of the same satirist who sent out chocolate candy coins wrapped in gold foil and marked "Republi-coin, Zero Sense," and probably the same satirist who put out golf tees and a scorecard that had slogans such as "Par for Taft, Bogey Ethics."

This is a great article. Unintentionally, it provides a theater of the absurd chronology of electronic voting. Don’t get me wrong, I admire and respect the people in this group. If you read the whole article, it shows that they have concluded that a paper ballot, verified as correct by the voter is the only reliable way of ensuring a fair vote. Now, given the realities, that we are IMPELLED to have electronic voting, they have put together an open source voting machine that basically produces paper—voila! The absurdity is that to get back to what we had in many places in the country, paper first, last, always; -- we need a “Rube Goldberg” contraption – an electronic voting machine. It is totally amazing. We should all appreciate what they are doing because their standards drive the lousy machine makers crazy. In addition, they are working on open source software for tabulation. This is advanced stuff, SourceForge, etc., but it’s interesting. This is a MUST READ in the original. The original has live links that are superb.

The Open Voting Consortium describes itself as "a non-profit organization dedicated to the development, maintenance, and delivery of open voting systems for use in public elections." To this end, the OVC is designing voting stations, ballot counting equipment, and open source software to run fair and auditable elections. They started with the voting machines themselves, with an open source project appearing on SourceForge as the Electronic Voting Machine Project.

Their efforts have garnered some notable attention in California and in the national press. Could this be the answer to the crisis of confidence in electronic voting in the United States? With this question in mind, I spoke by phone with Open Voting's Alan Dechert (President and CEO), Arthur Keller (OVC Co-founder and Secretary), and David Mertz (Vice President and CTO, also author of the IBM Developer Works column "Charming Python").

So our proposal is that the paper itself be the ballot. If the official thing is the computer memory and the paper is the backup, then you get into all this complexity about putting it under glass so that you have a tamper-free paper trail. But if the paper ballot is the official thing, then there's no reason the voter can't hold onto their ballot, look at it, put it to another device to verify what the ballot says for those who are reading-impaired or visually impaired, and then physically place it in a ballot box to cast it. Going from the official ballot being computer bits to the official ballot being the paper ballot that people know and love…"I'm going to take this paper ballot and put it in the box, and that's casting my ballot." People understand that intuitively. They know that unless and until they place that paper ballot in the ballot box, it is not cast.

Mertz: There's a joint publication of the EAC and the National Institute of Standards and Technology (NIST) that defines terms. "Fundamental representation" means "what counts as the official vote." In VVPAT systems, the fundamental representation is on the electronic media. The audit trail is a secondary verification. If there's a discrepancy, the electrons win.

If a voter is to look at a representation, the voter can't look at electrons, only paper. For true verifiability and transparency of the election process, you need the representation that the voters look at, i.e., the paper, to be the fundamental representation. Where paper is the fundamental representation, that's a ballot printer, and that's what the OVC system is.

Keller: But even if we don't reach the point of open sourcing the entire chain, we have still improved the process, because the thing you feed into our tabulation system is always a checkable paper ballot. Also, our design is to have the system make an image of the ballot as feed it in at the precinct to be tallied, so you can't have ballot stuffing after leaving the precinct.
Mertz: An advantage of using our EBP over other EBP or simple ballot-marking systems is that we can include a cryptographic hash code.


NC & NATION: Fake Republican “Voter Fraud” Group Tries to Tar Edwards

Acorn’s NC Director discovered 75 bogus registrations from a field worker in the 2004 election. The Acorn director turns the field worker and registrations into the state department in NC in charge of this. Get it...that makes Edwards guilt of vote fraud…right, and by the same logic, Mike Brown was a whiz at FEMA because he handles a couple of hurricanes. This is too transparent but needs to be exposed.

RALEIGH - State Republican Party officials are criticizing former U.S. Sen. John Edwards for aligning himself with an anti-poverty group accused of submitting fraudulent voter registration forms in several states, including a case in Charlotte.

Edwards, a Democrat, has teamed with the Association of Community Organizations for Reform Now, or ACORN, in a campaign to raise the minimum wage.

"This is a group that has conducted very nefarious activities around the nation and in North Carolina," said Bill Peaslee, chief of staff at the N.C. Republican Party, "and for someone of John Edwards' stature to be associated with this group and, according to ACORN's Web site, is proud to be associated with them, calls into question John Edwards' judgment."

Since last fall's election, Edwards has focused his public efforts on reducing poverty. He kicked off a lecture series Wednesday at the UNC Center on Poverty, Work and Opportunity, which he heads. Edwards joined with ACORN in the spring to try to put a minimum-wage increase on the ballot in several targeted states, after Congress rejected a federal increase.

"It's too bad that Republicans would rather make baseless political attacks instead of working to raise the minimum wage to help those who are struggling to make ends meet," said Kim Rubey, Edwards' spokeswoman. "Senator Edwards is proud of the work he and ACORN are doing to raise the minimum wage."

An ACORN worker in Charlotte last fall faked 75 voter registration forms, which were discovered by the group's chief organizer in Charlotte and turned over to elections officials. The State Board of Elections has not officially closed the case because the board's investigator, Marshall Tutor, cannot locate the worker to interview her.

"She has dropped off the face of the earth," Tutor said.

Tutor, though, complimented ACORN's efforts in policing themselves. The group discovered the fraud, questioned the worker and then fired her, he said.

"We feel ACORN did such a good job of catching this that it probably, on our part, warrants no further investigation," he said.

FREEHOLD — The Monmouth County Board of Freeholders agreed last week to spend more than $8 million to purchase new touch-screen voting machines in order to comply with a federal law mandating the use of electronic voting machines by 2006.

The county was obligated under the federal Help America Vote Act of 2002 to replace its familiar lever machines with modern electronic ones that resemble automated teller machines.

The act was designed to improve the nation's election system after the 2000 presidential stalemate. It also created minimum election administration standards and provided $3.9 billion in funding for the replacement of punch card and lever machines.

"There was absolutely nothing wrong with the lever machines but we have to comply with the (law)," John Bradshaw, the county's superintendent of elections, said Friday.

On Thursday, the freeholders awarded the contract, worth $8,078,970, to Sequoia Voting Systems Inc. to supply 950 touch-screen machines to be used throughout the county. Sequoia is one of only five companies that produce state-certified models.

The machines, however, will be retrofitted so that a paper receipt is kept inside each machine after every vote is cast. :rofl: The state mandates that voting machines produce paper records by 2008.

Taguig-Pateros Representative Alan Peter Cayetano had moved that the House return the justice committee report recommending the dismissal of the three impeachment complaints filed against Arroyo but majority of the congressmen, who are allied with the administration, voted against the move.

After the voting on Cayetano's motion, the House suspended the session close to midnight Monday.

The session resumed a few minutes after midnight Tuesday, with congressmen set to vote on whether to approve the justice committee report.

The committee presented its report to the plenary Monday afternoon to be voted on by the 236 members of the House of Representatives.
The justice panel junked the impeachment complaint filed by lawyer Jose Rizalino Lopez and the amended version by the opposition because the original complaint filed by lawyer Oliver Lozano barred the two cases. It, subsequently, dismissed the Lozano complaint for "lack of substance".
Proponents of the amended complaint branded the committee report as "a product of the alleged cover up" between President Arroyo and her allies in the Lower House to save her from the case while administration congressmen insisted that the committee's decision was based on the existing rules on impeachment.

He said by junking the impeachment complaints, the administration congressmen in the committee did not save President Arroyo from the case but only put her in an even "worse" situation because the allegations against her would go unanswered.
He reminded his colleagues that they are in Congress not "to protect the President but the Filipino nation."
Cayetano presented in the plenary "pre-fabricated" election returns (ERs) allegedly used by the Arroyo camp to cheat in last year's presidential elections.

Brigadier General Jose Angel Honrado, military spokesman, said the people should be circumspect over their actions so that they would not be misled by sectors advocating instability.

"Our people should not entertain rumors and unverified information as it will only add to the tension and political instability in the country. What will suffer most is our economy," he said.

The military has vowed to respect the people's freedom of expression but Honrado said: "If violence breaks out as a result of the outcome of the ongoing impeachment hearings, the AFP is ready to restore order and uphold the law.

The historic celebration of the Voting Rights Act occurred in a mood the Times described as “more cautionary than celebratory.” As they marched, participants knew that the Republican-dominated House and Senate were showing reluctance to fully renew the act.

The old and new voting right struggles merge.

Many marchers also knew that they are involved in a new voting rights struggle, one that involves blacks, whites, and any citizen voting for Democratic candidates. The struggle came into clear focus in Florida 2000 but in truth has been carried forth ever since the full implementation of the Voting Rights Act. While the act pushed forward the voting franchise to all Americans regardless of race, it was not able to ensure that all votes would be counted, particularly in predominantly black precincts, due to “spoilage” – ballots that are not marked clearly enough to be counted. A Washington Post study (12/3/04) after Florida 2000 showed that spoilage occurred at exceptionally high rates in precincts with greater than 70% black population. The total spoiled votes in just black precincts in Florida 2000 would have given Gore a comfortable victory margin without any reference to “hanging chads” and “butterfly ballots,” under the reasonable assumption that most of the discarded ballots were marked for Gore.

Hackett runs a strong campaign.

Hackett had three major advantages that many Democratic candidates lack. He had just finished an active duty tour in the military, he aggressively engages in intense political combat without flinching, and he has a concealed weapons carry permit. In addition to that, he opposes the war in Iraq with firsthand knowledge, is strong on national security, and has harsh comments for his Republican opponents. In a Cincinnati Post statement, Hackett said of Schmidt, “If you think America needs another career politician steeped in a culture of corruption who does as she’s told and toes the line on failed policies, then I’m not your candidate.” He referred to Schmidt as a “rubber stamp” Republican. He called Republican supporters of the war “chicken hawks” and he was harshly critical of President Bush. Just before the election, Hackett said of Bush, “I don’t like the son of a bitch who lives in the White House but I’ll put my life on the line for him.”

Hackett raised significant funds locally and from Internet activist Democrats, and had some support from the national Democratic Party. Schmidt received an infusion of over $500 thousand during the last few days of the campaign, which allowed her a significant media advantage just before Election Day. The candidates had two formal debates and several joint appearances on local television. Hackett gave strong performances during the debates and appearances and was described by some as charismatic.

The humidity crisis.

Then it happened: the “humidity” crisis. For pure drama, it could not have occurred at a more dramatic point in the vote tabulation. Of Clermont County’s 191 precincts, 100 had been counted. Then the Board of Elections announced that excessive humidity had caused ballots to swell, making them difficult to count. As a result, there would be a delay in the count. At this point, the election was dead even statistically, at 50% for each candidate. The 91 precincts in Clermont represented about 12% of the remaining vote. When the crisis was resolved, the 50-50% tie changed into a 52% to 48% victory for Schmidt.

The sudden stoppage of vote tabulation in Clermont was reminiscent of nearby Warren County’s Board of Elections citizen-media lockout during vote counting in 2004, which county officials claimed to be the result of a Homeland Security alert. There was no alert.

Was humidity the reason the optical scanning machine count stopped in Clermont, or was there some “intelligent design?” Humidity can impact the ability of optical scan counting machines to process paper ballots. It is not frequently reported and there are clear instructions providing easy remedies (e.g. air condition polling and tabulation facilities). The state of Louisiana made its 2003 RFP for voting machines contingent on tolerating a 98% humidity rate, for example. Air conditioning is reported to be widely available in Clermont County, as are dehumidifiers.

Why were 91 precincts impacted while 100 others were not in the same County?

Information about the locations of the humidity-impacted districts is unavailable. Was each of the 91 precincts without air conditioning? That would be a 48% rate of precincts exposed to conditions that the Board had to know could create problems. For them to announce problems with ballots due to humidity after the fact is remarkable. Certainly, they knew that humidity could be an issue. Just days before the special election there were extensive reports of a serious heat and humidity wave in the Cincinnati area. The regions largest newspaper, The Cincinnati Enquirer had been talking about the heat and humidity days before the election. Surely humidity on Election Day should have been taken into account.

WA: Republicans in Shnomish Co. Form “Election Machine Cult”

When I took Anthropology in college, I learned one thing – “cargo cults.” These were groups of indigenous people who had been air-dropped supplies during WWII in the South Pacific. The drops had Allied flags on them and when our guys were in the woods, they would receive help from those who had received the air drops. At the end of the war, the indigenous folks still needed food. They took to building elaborate stick models of cargo planes in hopes that this would attract the planes and the food dropped…hence the term “cargo cults. Now the Republicans in Shnomish County WA (home of DU’s Land Shark) have an “election machine cult.” They’re trying to buy election machines even though the county is almost tall vote by mail (much easier, hence more democratic). I guess they believe that if they buy the machines and put them out, voters will come. We’re up against a tough opponent here.

Despite a Jan. 1 compliance deadline, the Snohomish County Council may wait until after that date to spend about $1 million for backup election equipment.

For weeks, the council has debated whether to purchase a system that creates a paper trail of votes cast on electronic voting machines. The paper backup will be required by state law, effective Jan. 1, after last year's gubernatorial-election debacle.

But with 30 of the state's 39 counties having approved all-mail voting systems, there's a chance the state Legislature will revive one of two bills that would convert the entire state to all-mail balloting.

There's no enforcement provision in the law requiring the backup equipment, and noncompliance could be worth $1 million that would stay in the bank for the county.

King, Pierce and Snohomish counties — with 60 percent of the state's registered voters — have resisted all-mail voting. . But Terwilliger said Snohomish County could be ready to convert tomorrow, as could Pierce County, where 80 percent of voters already use mail-in ballots.

Terwilliger has urged the council to join the all-mail ranks, which could increase to 32 counties before year's end. Spokane and Chelan counties are scheduled to vote on the matter.

Koster, however, is opposed to all-mail balloting, even though it would save the county thousands of dollars annually. An envelope containing a mail-in ballot must be signed, and Koster said there would be too much opportunity for signature fraud. He also doesn't want to take away a voter's privacy rights at the polls.

His view is supported by Councilmen Gary Nelson and Jeff Sax, who round out the board's Republican majority.

NJ:State Republicans Claim Major “Vote Fraud” – “I see dead people-voting.”
This story bears watching. When you see the term “voter fraud” that means fraud by voters themselves. That’s the Republican emphasis in this area -- all those phony Democratic voters. The faux vote fraud group of Republicans found 12 whole “vote frauds” in Milwaukee. They directed a news crew to the home of an alleged culprit who turned out to be a seminarian, not the bogus voter. Now they’ve upped the ante and accused. We will watch this and see if this story has legs. If so, then a crime has been committed. If not, the Republicans are reaching a new low.

CBS) NEW YORK CBS 2 has obtained a draft of a letter that the New Jersey Republican State Committee will deliver Thursday to state Attorney General Peter Harvey asking him to investigate election irregularities, including voter fraud.

The letter lays out the results of what the committee calls an investigation that revealed, among other problems:
1. Nearly 17,000 registered voters are "officially" deceased
2. Nearly 5,000 of them voted in the last Garden State election.

Further, the committee claims that 170,000 people are registered to vote in New Jersey and at least one other state and that more than 6,500 of them voted in both states in the last election.

Editor's Note: The hurricane, by scattering black voters over several states, may have given the GOP a gift.

LOS ANGELES--President Bush, Karl Rove and top GOP strategists would never publicly gloat over Katrina's unintended political consequences. But there was a big and potentially lethal one for black voters and the Democratic Party.

Nature's catastrophe scattered thousands of poor, black Democratic voters throughout more than 30 states, from New Hampshire to California. That could dilute black voting power and Democratic strength in Louisiana and the South. Black voters make up one-third of the state's voters, and nearly one-half of New Orleans voters. They gave Clinton more than 90 percent of their vote in 1992 and 1996. That propelled him to victory over Bush Sr. and Robert Dole, and helped break the GOP stranglehold on state offices.

It also momentarily dented the GOP's Southern strategy. The strategy entailed saying and doing as little as possible about civil rights, actively courting conservative whites and subtly pandering to the bigotry of Dixiecrats-turned-Republicans. Presidents Nixon, Reagan and Bush Sr. (in his 1988 win) banked on that to grab the White House. Transforming Louisiana, with its nine electoral votes, into a crucial swing state forced the GOP to pour resources, time and energy into the state to win it.

Though George W. Bush decisively beat Democratic presidential contenders Al Gore and John Kerry in 2000 and 2004, the top-heavy black vote for them enabled Democrats to bag many top state and local offices -- but just narrowly. A shift of a few thousand votes could tip those offices back to Republicans. The loss of thousands of black votes could also crack the 30 years of unbroken black and Democratic dominance of City Hall in New Orleans. The streets were barely dry in New Orleans blackest and poorest wards when there was talk that a white Republican may challenge black Congressional Democrat William Jefferson. If the majority of black voters in Jefferson's district don't return, and the likelihood is that many won't, that could make the GOP dream of seizing the Democratic Congressional seat a reality.

Black voter dispersal could also spell trouble for New Orleans Mayor Ray Nagin. He grabbed a majority of the white votes in his surprise victory in 2002. That could easily change in 2006. He's up for re-election, and a white candidate who plays hard on the widespread perception that Nagin, as Bush, also bungled the city's relief efforts could rally white voters.

The future of black voting strength in Louisiana depends on who comes back to the city and state, and when. Many of the mostly white, upscale parts of New Orleans received relatively minor storm damage. The voters in these areas will stay, and those whose homes were damaged have the resources to rebuild them. Many of them are Republican. Thousands of poor blacks don't have the resources to rebuild.

Even if many blacks choose to live permanently in the states they relocated to, that could dilute their vote, and further marginalize their political power. To prevent that, the NAACP and other voter groups have called on Congress to pass emergency legislation to extend special protections of the Voting Rights Act, which will expire in 2007, to displaced Louisiana voters. The aim is to insure that they can vote without restrictions in the places where they relocated.

There's little chance that GOP Congressional leaders will do that. They insist that there are enough protections to prevent state officials from tampering with voting laws and procedures. The act currently requires that the Justice Department or federal courts approve any changes in vote procedures that involve redistricting, district annexation, registration requirements, holding at-large elections and methods to qualify candidates to safeguard against discrimination.

But this hasn't stopped states from making changes in voting procedures that hurt minority voters. That includes changing or consolidating polling place locations, tightening voter identification procedures and adding new and tougher requirements on the timing for filing absentee ballots. State officials claim that the changes were made to prevent fraud or streamline the voting process. There's no evidence that the changes were deliberately made to thin the ranks of minority voters. Still, if minority voters don't have proper identification, have not been informed of polling changes or locations or don't have transportation to get to them, they could be shut out of the voting booth. The identification documents of thousands of blacks displaced by Katrina were destroyed or lost in flight.

Even with no polling restrictions or roadblocks, the voting power of the evacuees could still be crippled. Black political strength lay in blacks' numbers and concentration in key states such as Louisiana. Dispersal reduces them to a blip on the political radar in the far-flung states they've ended up in. That further waters down their voting strength, and potential political clout. Katrina destroyed the fortunes of thousands of New Orleans blacks, while potentially boosting the political fortunes of the GOP. That certainly hasn't escaped Bush and Rove.

Venezuela: US “Foundation” Continues to Fund Chavez Opponents.

Now we have international politics and elections. Seems a US group, the “National Endowment for Democracy” funded the Sumate group which backed anti-Chavez activities. Who is the NED? It’s a group of Council of Foreign Affairs types, with Vin Weber, (R, MN, Ret.) as Chairman of the Board of Directors. Weber knows how to screw up an election. He headed the software firm the wrote the code for the famous 2000 Jeb Bush Florida “felon” voter purge. This denied up to 90,000 legitimately registered black Floridians the vote. Many showed up and all were sent home.. Interestingly, NED has some Democrats on the board too. Why does US foreign policy for Venezuela include support from a Non Government Organization (NGO) filled with people, almost exclusively from the moderate to solid right wing?

CARACAS, Venezuela(Reuters) -- Opponents of President Hugo Chavez, facing trial for receiving money from a U.S.-financed organization, have gotten the group's approval for additional funding, representatives said Wednesday.

A Venezuelan judge last month ordered four members of the Sumate civil association, which backed the 2004 referendum against Chavez, tried for conspiracy after they received a grant last year from theNational Endowment for Democracy.

The NED is a nongovernmental organization funded by the U.S. Congress to promote democracy internationally.

New Sumate financing could fuel already tense relations between Washington and Chavez, an ally of Cuba's Fidel Castro who often clashes with U.S. officials over his self-proclaimed socialist revolution in the oil-rich country.

Chavez brands Sumate traitors, while opposition leaders and some U.S. officials say the group has been targeted in a political witch hunt against critics of the former army soldier turned president.

The grant, which will help to "strengthen the democratic process in Venezuela" is approved but in the final stages of being signed, NED spokeswoman Jane Riley Jacobsen said.

Earlier this year, a Sumate leader, Maria Corina Machado, held talks with U.S. President George W. Bush in the White House. The Venezuelan government slammed the meeting as a provocation.

Chavez, an ex-army paratrooper elected in 1998 vowing to combat poverty, often accuses Washington of trying to topple him and backing a failed 2002 coup. He won the August 2004 referendum, although opponents complained about fraud, a charge international observers did not support.

U.S. officials reject Chavez's plot charges, but they portray him as an authoritarian who undermines democracy at home and destabilizes the region by promoting "new socialist" ideas.

In other words, to fortify the opposition of undesirable foreign governments as in the case of Venezuela, or to support a government that is favorable to US interests and avoid of coming to power of forces that are not seen as favorable to US interests."

Trojan Horse: The National Endowment for Democracy

How many Americans could identify the National Endowment for Democracy? An organization which often does exactly the opposite of what its name implies. The NED was set up in the early 1980s under President Reagan in the wake of all the negative revelations about the CIA in the second half of the 1970s. The latter was a remarkable period. Spurred by Watergate-the Church Committee of the Senate, the Pike Committee of the House and the Rockefeller Commission, created by the president, were all busy investigating the CIA. Seemingly every other day there was a new headline about the discovery of some awful thing, even criminal conduct, the CIA had been mixed up in for years. The Agency was getting an exceedingly bad name, and it was causing the powers-that-be much embarrassment.

Something had to be done. What was done was not to stop doing these awful things. Of course not. What was done was to shift many of these awful things to a new organization, with a nice sounding name-the National Endowment for Democracy. The idea was that the NED would do somewhat overtly what the CIA had been doing covertly for decades, and thus, hopefully, eliminate the stigma associated with CIA covert activities.

It was a masterpiece. Of politics, of public relations and of cynicism. Thus it was that in 1983, the National Endowment for Democracy was set up to "support democratic institutions throughout the world through private, nongovernmental efforts". Notice the "nongovernmental"-part of the image, part of the myth. In actuality, virtually every penny of its funding comes from the federal government, as is clearly indicated in the financial statement in each issue of its annual report. NED likes to refer to itself as an NGO (non-governmental organization) because this helps to maintain a certain credibility abroad that an official US government agency might not have. But NGO is the wrong category. NED is a GO.

Allen Weinstein, who helped draft the legislation establishing NED, was quite candid when he said in 1991: "A lot of what we do today was done covertly 25 years ago by the CIA." In effect, the CIA has been laundering money through the NED.

Our Gang in Venezuela?

In the weeks before the April 12-13 coup in Venezuela, Asociacion Civil Consorcio Justicia, a legal rights outfit, was planning an April 10 conference to promote democracy in that country. At the time, Venezuela was undergoing severe political strife. Business groups and labor unions were bitterly squaring off against President Hugo Chavez, a democratically elected strongman/populist. Using an $84,000 grant from the Washington-based National Endowment for Democracy, a quasi-governmental foundation funded by Congress, Consorcio Justicia was supposed to bring together political parties, unions, business associations, religious groups and academicians to discuss "protecting fundamental political rights," as an NED document put it. In a proposed agenda Consorcio Justicia listed as one of the main speakers Pedro Carmona, president of Fedecamaras, a leading Venezuelan business group. But when the coup came, Carmona was handpicked by the plotters to head a government established in violation of the Constitution. Then he signed a decree suspending the National Assembly and the Supreme Court. Carmona, it turns out, was hardly interested in safeguarding "fundamental political rights."

Created by President Ronald Reagan and Congress in 1983, NED was designed to run a parallel foreign policy for the United States, backing and assisting entities that Washington might not be able to officially endorse--say, an opposition party challenging a government with which the United States maintained diplomatic relations. In a way, NED took public some of the covert political activity the CIA had previously mounted. The endowment--which devotes much of its budget to funding the foreign policy arms of the Democratic and Republican parties, the Chamber of Commerce and the AFL-CIO (its core grantees)--has been involved in both questionable and praiseworthy projects. It awarded a large grant to a student group linked to an outlawed extreme-right paramilitary outfit in France, helped finance the development of conservative parties in countries where democracy was doing just fine and played a heavy-handed role in Nicaragua's 1990 elections. In the late 1980s it aided the pro-democracy opposition in Chile and antiapartheid organizations in South Africa. But even if its programs have indeed enhanced democracy on occasion, NED overall has long been problematic, as it has handed taxpayer dollars to private groups (such as the two major parties) to finance their overseas initiatives and has conducted controversial programs that could be viewed abroad as actions of the US government. What might the reaction be here, if the British government funded an effort to improve the Democratic Party's get-out-the-vote operation in Florida?

Which brings us back to Venezuela--where the US Embassy was compelled after the coup to declare as a "myth" the notion that "the US government, through organizations such as the National Endowment for Democracy, financed coup efforts." For months before the coup, Americans--including US government officials and officials of NED and its core grantees--were in contact with Venezuelans and political parties that became involved or possibly involved with the coup. This has provided Latin Americans cause to wonder if the United States is continuing its tradition of underhandedly meddling in the affairs of its neighbors to the south.

Consider some NED activities there. When Consorcio Justicia began to assemble the pro-democracy conferences, it approached the two main opponents of Chavez--Carmona and his Fedecamaras, as well as the Confederation of Venezuelan Workers (CTV), the leading anti-Chavez labor union--according to documents obtained from NED under a Freedom of Information Act request. Christopher Sabatini, NED's senior program officer for Latin America, says, "The idea was that the conferences (which were to include Chavistas) would be able to define a consensus-based policy agenda" for the entire country. But certainly NED's core grantees were trying to beef up Venezuelan organizations challenging Chavez. The AFL-CIO, for example, was working (seemingly laudably) to bolster and democratize the CTV, which Chavez had been trying to intimidate and infiltrate. The International Republican Institute was training several parties that opposed Chavez. At one session, Mike Collins, a former GOP press secretary, taught party leaders how to mount photo-ops; at another he suggested to Caracas Mayor Alfredo Peña, a prominent Chavez foe, how he "could soften his aggressive image in order to appeal to a wider range of voters," according to an IRI report. (Human Rights Watch found that at least two members of the police force controlled by Peña--now Chavez's primary rival--fired weapons during the April 11 melee.) The question, then, is, since it was not explicit US policy to call for Chavez's ouster--though his departure from office was desired by the Bush Administration, which detested his oil sales to Cuba and close ties to Iraq, Iran and Libya--should US taxpayer dollars have gone to groups working to unseat Chavez, even through legitimate means?

-ECG heart info or....voting as it comes in!

2) see if the data has been accessed
-nurses see it?... or poll officials seen the vote count yet!

I'd say it is speculation after the Triad ownership data but that's what we have to do. You present a chilling case. Medical equipment has a very low fault tolerance. They can't afford it. After all, people can suffer and die. Unlike the White House which is exempt from law suits, these manufacturers are not. You can be sure that the products (with very, very few exceptions) do just what they say they'll do. Remote monitoring of voting systems. Lord.

The non speculative part of this is the Triad connection. Did somebody say Ohio, 2004. Finestein's husband gets tens of millions in Iraq related contracts, he invests in a company hostile to the Democratic Party and the entire country, it would seem, and she and he skate all the way to the bank, examined and critiqued in the PI forum. Where's the outrage? Where's the coverage?

Lieberman blames ES&S Systems, which manufactures the software in question. She says they've known about the problem for at least two years because there was a Broward County mayoral race in which the same thing happened. She said nothing was done about it.

Miami-Dade County also uses ES&S Systems.

I really like Time for Change's DU posts, but I haven't seen him in a while. Wonder what he's up to now. He always presented a very clear, level-headed, and fact-based view of election fraud. I'm glad to see that you've pulled up those other links on election rigging as well. Triad GSI (responsible for rigging the 2004 Ohio punch card tabulators) is very interesting to me, given that its name, founding location, and founding date matches that of several front companies used by Adnan Khashoggi, and that the Rapp family who owned Triad also sold replicas of the butterfly ballot, which were introduced to Palm Beach County FL by Theresa LePore, a former flight attendant on Khashoggi's private planes.

Lemme's suspicious suicide is something that's affected me greatly. I don't know how much you read the RI thread I linked to, but I've spent the past year conducting my own brand-new investigation of the Lemme case. I even secured an interview with the motel worker who cleaned up Lemme's blood after his death, though I haven't been successful in getting Valdosta police officers to talk.

Bogus Voter Fraud Panel Asked Texas To Identify Hispanic Voters

President Donald Trump’s defunct voter fraud commission requested that the state of Texas identify voters with Hispanic surnames when providing voter data to the commission.

The news was revealed in a Dec. 19 letter and accompanying records from the General Services Administration (GSA) to Sen. Claire McCaskill (D-MO), published by the Senate Homeland Security and Governmental Affairs Committee, of which McCaskill is ranking member. The commission operated under the purview of the GSA.

The request was first reported Monday by the Washington Post.

The news will add to concerns among voting rights advocates that the short-lived commission was aimed at making it more difficult for certain groups, including racial minorities, to vote.

Among the documents: an invoice from the Texas Secretary of State to Ronald Williams II, then a staffer on the commission. In October, Williams left the commission after being charged with multiple counts of possessing and distributing child pornography.

“Hispanic surname flagged,” the invoice notes.

The Post reported that Texas maintains a list of voters with Hispanic surnames — based on Census Bureau data — in order to determine if bilingual election notices are necessary, as required by law.

The data request was never fulfilled, the Post noted, due to a lawsuit from voting rights advocates in the state that temporarily stopped the transfer. The paper also noted, based on data published by the Texas Monthly, that one in eight Texas voter data requests from January 2015 and July 2017 included flags for Hispanic surnames.

The defunct election integrity commission’s vice chairman, Kansas Secretary of State Kris Kobach, professed ignorance to the Post of any such request.

“It’s a complete surprise to me,” Kobach said, adding: “Mr. Williams did not ask any member of the commission whether he should check that box or not, so it certainly wasn’t a committee decision.”

Kobach said the “information does not, did not advance the commission’s inquiry in any way, and this is the first I’ve heard the Texas files included that.”

He said he didn’t know “what sort of data analysis you would do even remotely relevant to it” and that only requesting such data for one state would render it “useless.”

But a White House official who appeared to have knowledge of the request told the Post, in the publication’s words, “that given the option in Texas, the commission asked to identify Hispanic surnames to resolve data discrepancies or confusion caused by the traditional Spanish naming convention that uses the surnames of both parents.”

The unnamed official added: “There was never a request made to flag people based on their ethnicity. […] That was never asked for, nor is that what this [Texas] response is saying, though I can see why some could read it that way.”

J. Christian Adams, a conservative former commission member who’s spent a career attempting to purge voter roles of suspected fraudulent voters, called the story “a tempest in a teapot,” according to the Post.

But Maine Secretary of State Matt Dunlap, one of four Democrats on the commission when it folded and now a plaintiff in a lawsuit aimed at forcing it to disclose its records, told the Post the request was “shocking.”

“I find it shocking that they would flag voter names by ethnicity or race, to discover what, we don’t know,” he said, adding: “Right now on its face in my view it looks bad, and it looks bad to a lot of people.”

The Washington Post would have you believe that “Democracy Dies in Darkness,” which is the slogan the paper adopted following the election of Donald Trump. It sounds nice but, with all due respect, it’s complete nonsense. US democracy isn’t dying in darkness, it’s been getting slaughtered in broad daylight — and not enough is being done to stop this from happening.

Here at WhoWhatWhy, we are big believers in democracy. If done right, a government by the people for the people could fix much of what ails the United States. Unfortunately, democracy itself is in trouble. Politicians, lobbyists, corporations and the money elites have conspired to pervert it for their own interests.

And while this cancer from within is bad enough, the last election showed that a new threat to democracy has emerged from abroad. Some say it serves the US right to get a taste of its own medicine (and we have certainly covered the many ways in which the US has meddled in elections elsewhere), but we are troubled whenever any democracy is under assault — and certainly when it happens in our home base.

That is why we have tried to call attention to these threats and abuses. Fortunately, we are not alone in doing so, but it is fair to say that few, if any, other news organizations spend such a large share of their coverage on this topic. Through stories, editorials and podcasts, we are attempting to highlight the relentless attacks on US democracy.

We are guided by the belief that every eligible voter who wants to cast a ballot should be afforded the opportunity to do so, and that all votes should count equally.

Currently, that is not the case in the United States — and we have put a lot of effort into pointing that out.

Today, all Democratic Members of the House Committee on Oversight and Government Reform sent a letter asking Chairman Trey Gowdy to issue a subpoena to finally compel the Department of Homeland Security to produce documents it has been withholding from Congress for months relating to Russian government-backed efforts to monitor, penetrate, or otherwise hack at least 21 state election systems in the 2016 election.

Ranking Member Elijah Cummings issued the following statement in conjunction with today’s letter: “Russia attacked our states in the last election to help Donald Trump get elected President. Why is the Trump Administration now concealing from Congress documents showing exactly how Russia did it?”
Rep. Robin Kelly, the Ranking Member of the Information Technology Subcommittee, stated: “We know that Russians attacked 21 state election systems, including in my home state of Illinois. Congress has an obligation to help states develop technologies and protocols to prevent election interference. However, we cannot do that if the Trump Administration continues to actively conceal critical documents directly related to the security of our elections and voting systems. Chairman Gowdy needs to issue this subpoena so we can get answers and help states defend the integrity of their systems in the upcoming 2018 elections.”
On October 20, 2017, Ranking Members Cummings and Kelly sent a letter requesting copies of the notifications that the Department of Homeland Security provided to 21 states identified as targets of Russian government-linked hacking attempts: Washington, Oregon, California, Colorado, Illinois, Alaska, Arizona, Oklahoma, Texas, North Dakota, Minnesota, Wisconsin, Iowa, Ohio, Alabama, Florida, Pennsylvania, Virginia, Maryland, Connecticut, and Delaware. They also requested all documents “related to the Russian government-backed attempts to hack state election systems.”

In response, the Department provided just one e-mail containing a short script that Department employees apparently read over the phone to state election officials. This script is 13 sentences long and does not refer to any specific state or attack. Rather, it is a generic script that provides no specific information.

“Despite repeated requests over the past several months, the Department has refused to provide the Oversight Committee with this information, and to the best of our knowledge, has not provided it to any congressional committee,” all Democratic Committee Members wrote in their letter to Gowdy. “We have been extremely patient, but we can no longer allow the Trump Administration to defy our requests and withhold this critical information from Congress.”
On November 29, 2017, during a joint subcommittee hearing on the “Cybersecurity of Voting Machines,” Ranking Member Kelly asked Christopher Krebs, the Senior Official Performing the Duties of the Under Secretary of the National Protection and Program Directorate, when these documents would be provided. Although Mr. Krebs assured Ranking Member Kelly that a response would be forthcoming, no further documents were provided.

“The Intelligence Community has warned us that Russia intends to continue interfering with elections in the United States and around the world,” the Members wrote. “It is our responsibility to obtain information about what happened in 2016 so we can adequately prepare for future attempts to interfere with our democracy.”
To follow-up on this request yet again, the Subcommittees sent Mr. Krebs official Questions for the Record on January 3, 2018, with a request by Ranking Members Cummings and Kelly that the Department produce, by January 19, 2018, copies of all documents related to the Russian government-backed attempts to monitor, penetrate, or hack state election systems — including the specific tools the attackers used. The Department has not produced these documents to date.

In today’s letter, the Members asked Gowdy to issue a subpoena to compel the Department to produce all of these documents by February 5, 2018.

The Members concluded, “If you choose not to do so, then we ask that you place this matter on the agenda for our next regularly scheduled business meeting so that all Committee Members will have the opportunity to vote on a motion to issue this subpoena.”

Judge Strikes Down Felon Disenfranchisement System in Florida
The ruling does not immediately restore voting rights to ex-felons, but it could make the process easier.

A federal judge in Florida has struck down Florida’s system for determining which ex-felons have the right to vote, handing an unexpected victory to advocates of broader voting rights.

Florida is one of a handful of states that permanently disenfranchise convicted felons, even after they have completed the terms of their sentence. The result is that more than 1.5 million Floridians are barred from voting, including 20 percent of voting-age African Americans. In November, Floridians will vote on a constitutional amendment to overturn the state’s disenfranchisement law.

Judge Mark Walker’s ruling Thursday does not address the legality of felon disenfranchisement, but rather the manner in which the state haphazardly restores voting rights to some former felons. In Florida, felons must individually apply for rights restoration, often imploring the governor and his Cabinet in person for their rights. That practice, detailed in 2015 by Mother Jones, makes restoring a person’s suffrage a personal decision by top state officials. Governors often determine whether to restore a citizen’s voting rights based on unrelated matters, such as his religiosity or number of traffic citations. Sometimes, the voting rights group challenging Florida’s regime has argued in this case, Republican governors may be swayed to restore voting rights to ex-felons who will vote for Republicans.

“In Florida, elected, partisan officials have extraordinary authority to grant or withhold the right to vote from hundreds of thousands of people without any constraints, guidelines, or standards,” Walker wrote in his opinion. “The question now is whether such a system passes constitutional muster. It does not.” Walker’s ruling, which came without holding a trial, found that Florida’s process violates the First Amendment as well as the 14th, which extends equal protection of the law to all residents.

Mother Jones assessed how Jeb Bush oversaw this process when he was a leading candidate for the Republican nomination for president in the summer of 2015. Florida’s current governor, Rick Scott, has drastically reduced the number of voting rights restorations.

Mother Jones obtained more than 1,000 pages of transcripts of clemency hearings held during Bush’s tenure. Together, they provide a glimpse into his moral reasoning as he weighed the worthiness of the appeals by thousands of ex-felons hoping to regain their rights. The transcripts, covering two years of hearings, show that Bush seems to have relied on an entrenched set of personal values in his rulings. If a crime involved alcohol abuse—such as DUI manslaughter cases, which were relatively common—he liked to see several years of complete sobriety before he would restore the person’s rights. He was loath to approve the applications of petitioners he felt were not sufficiently remorseful or did not take full responsibility for their crimes. He sometimes asked wives in attendance to keep their husbands in check. Ex-felons needed to prove, over years of good behavior, that they had reformed. Bush often denied clemency simply because he believed not enough time had elapsed since the completion of the petitioner’s sentence. He did not appear to question the basic premise of his judgments: that the right to vote should be contingent on a citizen’s moral rectitude.

Good article, thanks, SLAD. Even though it's only a small step, we should take these victories when we get them. Felon disenfranchisement is something I've always felt strongly against, and I look forward to the day (if it comes) we eliminate it entirely. On the other hand, I worry that America's culture is too punitive to allow that to happen.

I recently made the CAVDEF wiki public again: http://cavdef.hopto.org/w/index.php?title=Main_Page There's a fair amount of in-depth info on electronic voting machines, but I still have to cover the 2016 general election, Crosscheck, and other forms of voter suppression in my articles. So I'm glad you reminded me of that as well.

Other active research of mine focuses on the Franklin scandal, Johnny Gosch abduction, Presidio child abuse case, and Finders group. I've spent months hearing both sides of the story, such as the arguments of particularly persistent Franklin denier Vindalf (who left a negative review of Nick Bryant's book and goes by several sock-puppet names) and even Michael Aquino's book defending himself. At the end of it all, I'm still convinced that the "conspiracy canon" of how these events went down is the truth, but my goal is finding solid evidence of that through public records requests and interviews. There are also some interesting leads in the Gosch case, such as potentially having the real identity of one of the kidnappers.

On Monday, the Justice Samuel Alito rejected an effort by Republican leaders in Pennsylvania to restore a Republican gerrymander that has allowed Republicans to dominate the state’s congressional delegation even in years when Democrats won the statewide popular vote.

Though stay requests such as this one are directed to a single justice as a matter of process, that justice typically refers the matter to the full Court if they believe that the request raises a serious legal argument. The fact that Alito, a staunch conservative, unilaterally denied this request speaks to the weakness of the GOP’s claims.

Last month, the state supreme court ordered new maps drawn for the 2018 election. Now that the Supreme Court of the United States has officially stayed its hand, the state’s gerrymandered congressional districts are all but certain to become a relic of the past.

The Republican leaders’ effort to reinstate their gerrymandered maps was always a long shot. Pennsylvania’s supreme court decision relied entirely on the state constitution, and the United States Supreme Court does not have the authority to overrule a state supreme court’s interpretation of state law. Nevertheless, the Republican leaders raised arguments that conflict with a line of precedents that the United States Supreme Court reaffirmed as recently as 2015.

Had the Republicans prevailed, they could have potentially changed the outcome of the 2018 midterm elections. Under the gerrymandered maps, Republicans have won 13 of 18 seats in the state’s congressional district every year since 2012 — even though Democrats won the statewide popular vote in 2012.

Last week, Pennsylvania Senate President pro tempore Joseph Scarnati (R) told the state supreme court that he would not comply with parts of its anti-gerrymandering order. Now that the state supreme court’s decision is officially safe from molestation, Scarnati is likely to find himself in contempt of court if he does not change his tune.

A while back, I also wrote a lengthy article on my blog about the history of computerized election fraud, which may be of interest: http://marionumber1.blogspot.com/2017/0 ... state.html It goes into a lot of the connections, like Christian Dominionists (the Hunt family, Ahmanson family, the Council for National Policy, etc.), the Omaha business community (intersections with the Franklin scandal and Chuck Hagel), financial fraudsters linked to Watergate, defense contractors, and more. This article uses "deep state" in the proper sense of the term, not the version adopted by the alt-right that means "liberals and RINOs who dislike Trump". Arguably, the right-wing network supporting Trump played one of the biggest roles in setting up this system of riggable electronic voting:

When looking at systemic election fraud, an interesting question is when it all began. Obviously, we've had election fraud for as long as this nation existed, but it could never be executed on a national level until computers took over the vote counting process. Since 2000, there's been a nationwide vote shift to Republican candidates, as well as fraudulent primaries (2008 Dem, 2012 Rep, and 2016 Dem) to ensure the corporate candidate won. But did fraud start then, or did people just start paying attention?

Quite often, the Help America Vote Act (HAVA) of 2002 is described as the turning point. The law mandated states modernize their voting systems after the disastrous 2000 election, adopting electronic voting systems (optical scanners and DREs) and voter registration databases. All of this made elections much easier to tamper with on a wide scale.

Yet HAVA only accelerated what had been going on for a long time. The groundwork for fraud was laid back in the 1960s, when punch card voting came into prominence and a private media consortium took over reporting the results. In the 1970s and 80s, Dallas and Omaha powerbrokers began consolidating the elections industry. In the 1990s and early 2000s, financial criminals from Vancouver and Seattle steered Global Election Systems (later Diebold) to a dominant position.

The introduction of electronic voting is a national coup decades in the making. It has numerous ties to convicted criminals, mob organizations, wealthy powerbrokers, military/defense contractors, and the CIA. Sound like a crazed conspiracy theory? Everything I'm about to share can be easily verified.

SLAD, I was taking another look at this DU discussion. It still unnerves me how there's a big gap in his life: from 1980 until 1986 when he opened his used-computer store. But what I have been able to gather about Lewis does at least get us closer to figuring out who R. Doug Lewis is:

  • His political resume was more or less accurate, aside from the fact that he flagrantly lied about his party affiliation. Virtually everything he claimed to have done under the auspices of the Democratic Party, he actually did for the GOP. Why exactly would the director of the Election Center be so keen on hiding his Republican affiliation (I have some guesses...)? And how come Bev and the others who searched Lexis Nexis never came across any of those news articles about Lewis's GOP work back in 2003? They were only found by Sourcewatch a couple years later. I have faith in Bev's research abilities, so it sounds like those articles were very well-hidden.
  • Beyond being a key person in orchestrating the privatization of elections, Lewis had an inordinate amount of power over the election vendors themselves. In 2003, he was able to call all of the vendors to a meeting and force them to sign onto a PR campaign. The PR campaign, meanwhile, was affiliated with a shadowy group of defense contractors called the Election Systems Task Force. Which might hint at who was really backing Lewis.
  • According to Dana Jill Simpson, a former insider from Karl Rove's election stealing operation, Lewis was Rove's political mentor in Texas circa 1977 or so. They almost certainly crossed paths given that both were raising money for 1980 presidential campaigns during that time, albeit for different candidates. And furthermore, Simpson claims that Lewis used his position at the Election Center, whose purpose is training election officials, to influence and corrupt those officials.
  • The name of his used-computer business, Micro Trade Mart, sounds eerily close to the name of the International Trade Mart that CIA agent and JFK assassination conspirator Clay Shaw ran in New Orleans. It's worth noting that Lewis grew up in New Orleans, born only about 7 years after Lee Harvey Oswald and Barry Seal, but that doesn't necessarily prove anything.

All of the strangeness surrounding Lewis's past, and the last bullet point in particular, does make me suspect that he has some kind of intelligence background. I know people on DU were raising that possibility over a decade ago. Lewis is retired now, but his legacy of privatizing the vote count is unfortunately still with us.

If I am remember correctly I think I found a link that a R. Doug Lewis had some connection to Dallas when JFK was shot! I think it was in the police department? But of course the age does not work out....I just found it really strange that that name came up when I was researching stuff..his name was in a box of articles on the assassination from what I remember ...posts about it are probably in all that I shared with you but right now I couldn't tell you where that was

Yeah, I remember seeing you mention R. D. Lewis, the Dallas police officer involved in conducting polygraph tests during the JFK assassination investigation. Not sure whether he had some kind of family connection to the R. Doug Lewis from the Election Center, but it's at least another one of the odd facts surrounding Lewis's identity. It'd be interesting to call the now-retired Lewis up and see what he says...except Bev found he would frequently hang up on people.

Definitely, it's amazing how a 15-year-old discussion like that is still a trove of useful information today. A lot of my work for the wiki is just gathering old discussions and webpages that sadly have gone unnoticed.

I've been promoting my new story on voting system vendors (http://politico.pro/2EGl1Nq ), and I know most of you can't read it, so I'd like to share an anecdote from the reporting process that neatly sums up why security experts are so worried about these vendors.

One of the companies in this space is MicroVote, which sells electronic voting machines to Indiana and Tennessee. Cyber experts say these machines are dangerously insecure.

So, I set up an interview with Bernie Hirsch, MicroVote’s top security employee.

He asked me to send my Qs in advance, which I declined to do. Journalists don't do that.

He asked me for some of the topics I planned to bring up. I mentioned security critiques of his products.

Hirsch then canceled our interview.

"It appears from the subjective nature of your questions that this is more of an opinion piece," he emailed me, "and so I won’t be able to assist you further at this time."

To support his claim that MicroVote's products were secure, Hirsch sent me a 2008 Brookings/AEI voting system report written by people with no cybersecurity expertise.

The report (https://www.brookings.edu/wp-content/up ... voting.pdf …) argues that electronic records are more secure than paper ballots.



This is how MicroVote views election security.

I didn't even get this far with most of the other major players in the U.S. election technology space.

The two biggest voting machine makers, ES&S and Dominion, refused to talk to me.

Voting vendors, fiercely protective of their profits in a difficult market, have spent more than a decade shunning independent testing of their products, throwing up hurdle after hurdle for cybersecurity experts.

When tests occur, they reveal systems riddled with flaws.

The agency that works most closely with vendors, the @EACgov, has little power to rein in vendors, experts told me.

Local election officials — the vendors' customers — have the most power to require better cyber practices (through contracts) but often don't know enough to do so.

Cyber experts want vendors to learn the lessons that computer makers learned in the early 2000s: that researchers are your friends, not your enemies.

Instead, vendors work hard to avoid scrutiny. None of the major firms agreed to interviews. Only a few small ones did.

After I made separate requests to talk to them, the major firms banded together to send me a statement promising that they took security seriously. The statement addressed none of my questions and those vendors ignored follow-up requests for interviews.

Interestingly, the smaller firms who spoke to me said they expected the feds to start scrutinizing vendors more closely, like other providers of critical infrastructure.

Elections are easily the least regulated of the sectors that DHS has designated as critical infrastructure.

Some of the researchers I spoke to were pessimistic about vendors improving their practices. Others were cautiously optimistic that things would change.

But as @mattblaze put it: “How catastrophic a failure are we going to need before that happens?”

Last year, @RonWyden asked the major vendors about their cybersecurity practices. He got few answers.
