Estes, who passed away suddenly in January, called Richmond, Virginia home, but her role as a community strategist and cofounder of the Community Justice Network resonated across the country. You can read more about her life and work here.



This weekend and next week, the Community Justice Network marks her 60th birthday with a book talk by another Bostonian friend, author Jean Trounstine; a bridge walk and resource fair featuring a public records workshop; and a commemoration at the Charles S. Gilpin Community Farm.
On Saturday, author/activist Jenise Justice Brown will host Trounstine and community leader Tobias Estes for a discussion of Trounstine’s book, Boy With A Knife: A Story of Murder, Remorse, and a Prisoner’s Fight for Justice. This is the culmination of an idea that Lillie had before she died, after her son, John, Tobias’s brother, was murdered. Boy With a Knife invites a discussion on restorative justice, a discussion Lillie hoped to take place in Richmond and across the country.
On Sunday, in collaboration with the Houston Institute, we will gather at 1100 E. Leigh St. for a brief program overviewing the Martin Luther King Jr. Memorial Bridge and its role in the city. We will then walk across the bridge to Martin Luther King Jr. Middle School, where we will hold a resource fair featuring speakers from the Virginia Poverty Law Center, Richmond Transparency and Accountability Project, Richmond for All, Legal Aid Justice Center, Advocates for Youth and more. This resource fair will also include a Richmond-specific overview of public records through a MuckRock lens.

The Greensboro, Maryland police officer Daniel Webster, who was involved in the death of an African-American teen, has been decertified by a state agency that sets training standards for law enforcement.
Webster resigned following his decertification.
 
A spokesman for the Maryland Division of Corrections confirmed the decertification occurred during a meeting of the Police Training and Standards Commission on July 26. However, he could not reveal details about what prompted the board’s decision, citing laws which preclude discussing personnel matters.
 
Previously it was reported that at least 26 incidents of use of force from Webster’s former job in Delaware were omitted from his application to work in Maryland.

It’s nearly two months since a container ship was busted at the port of Philadelphia loaded with so much cocaine that even PEOPLE magazine wrote about it.

The MSC Gayane was carrying 19 tons of cocaine, and the highest ranking person arrested so far is still the ship’s Second Mate, whose credit is probably not strong enough to warrant anyone fronting him seven shipping containers filled to bursting with cocaine.  

Then yesterday came news of the largest cocaine seizure ever in Germany, 4.5 tons, at the port in Hamburg.
But German authorities only saw fit to let the public know about it yesterday. The drugs were discovered more than two weeks ago.
Moreover the customs office in Hamburg didn’t even disclose the name of the ship the cocaine containers came from.

In the Philadelphia container ship bust, the warrant for the arrest of sailors from the ship was shown in local news coverage. Then it disappeared.
The next day a Federal Court Clerk stated the entire case had been sealed retroactively. Why is a drug bust being treated—not as a crime—but as a “sensitive” matter of national security?

To Stand Up a Stone

The following blog post originated as an address given by Robert Shetterly at the Brunswick [Maine] Peace Fair,
August 3, 2019.

I was talking with my friend Roger Kirby recently about his work. He’s a painter. He’s English and summers in Brooksville [Maine] near me. He told me he’s become fascinated with the ancient standing stones located  in over 1,000 sites around the U.K. and Brittany. These mysterious stones, often arranged in circles, date from the Neolithic and Bronze
. Roger is attempting to make paintings - not depicting the stones so much as how he feels in the presence of them. 
In the midst of our conversation, after I had asked him about the significance of the stones,  Roger said, “The original human creative act is to stand up a stone.” I thought, What an interesting thing to say and how might that true? 
The stone at rest  has been sleeping for centuries. Dreaming since the last ice age.  Its placidity may call attention to its beauty and its integration into nature. In some sense, then, might it be presumptuous to stand up a stone? Intrusive?   But stand it up and its role changes. It’s invigorated, individuated, inspirited. Has potency. It has ritualized its space. Sanctified - perhaps like an altar without a church. It  commands and shapes the space. It focuses attention. Calls the residents of the area to be in relation to it. It teaches a kind of adherence to its posture. It casts a shadow. And the shadow becomes the keeper of time, the arbiter of time. 
Its standing role is not to dominate but remind one to be present, to be conscious, reminding one of one’s consciousness.  Perhaps it is creative because it is the result of a newly conscious mind, the mind with a will to rearrange nature.   Or, perhaps the act of standing the stone up created that new consciousness - the way any truly creative act does. A creative act always challenges one to think and feel, sometimes act, differently in response to it. The landscape with a standing stone becomes a conscious landscape, conscious of its own history in time. The standing stone is the ambassador of the mute world to the conscious world. The messenger, the emissary. It offers a spiritual partnership, a conversation between the land and the mind. It is not destructive or exploitative; rather, it’s a call to harmony. It anchors. Provides an address, signifies home. The standing stone sounds the awakened land’s first clear note of human creativity in relation to nature’s. Most of the neolithic  stones are in circles, like seasons and cycles, like congregations in conversation, like restorative justice circles, praying, chanting. They amplify the land’s heartbeat by sounding the human. The standing stone is the sentry for what is above and what is below. To stand a stone may be the first creative act; it may also be the first committed act. It commits to taking the materials of nature and crafting human identity, community and dignity. I say dignity because the stone seems a declaration of pride. Pride more than egotism. Not separate from but in relation to. 
An act of moral courage is like  a stone stood up. An act of moral courage rearranges a social space and redefines community. A person standing up resists the mythology and propaganda of violence, of separation, of racism, of dehumanization, of exploitation, of power and of the  justified injustice of the status quo - the way a shadowless pasture of conformity and corporate docility becomes redefined by the standing stone of the iconoclast, the truth teller. The paddock of slavery redefined by Harriet Tubman. The field of status quo history reorganized by the standing stone of Howard Zinn’s A People's History.  The long metallic arc of male dominance re-bent by the militancy of Alice Paul. The massive  bloom of invisible secrets made visible by the standing stone of Daniel Ellsberg.  
The original creative act of the common good is the standing-up person, the signal that justice has a heartbeat, the truth that compassion requires courage. The standing stone of moral courage evolves the consciousness of the community. It exposes the truth that power hates ceding control, scorns equality, will do practically anything to subvert real democracy. The standing stone envisions and makes possible the dignity of other stones. The crazed murderers at My Lai discover their shame in front of the standing stone of Hugh Thompson.  A poor Palestinian home remains standing because Rachel Corrie’s standing, once enacted, cannot be knocked down with a bulldozer no matter how many times the driver runs over her. In jail Camilo Mejia says now he is finally free because he has followed his conscience and refused to continue  participation in an illegal, immoral war. His stone stands in prison. He says he was a coward - not for refusing to fight, but a coward for having accepted taking part in the war in the first place, a coward for fighting. Right here in Brunswick, Bruce Gagnon stands up in the backyard of Bath Iron Works and General Dynamics demanding conversion from warship militarism to sanity and green infrastructure sustainability. Consciousness changes, a community grows. A standing stone is a creative act, a committed act.

William Sloane Coffin said, “”Socrates had is wrong; it is not the  unexamined but finally the uncommitted life that is not worth living.”  The standing of moral courage creates its place, its address in history, because it creates value, creates worth. It makes  a claim to nobility that would otherwise be preposterous.
Think how power has tried to deface the standing of Chelsea Manning. The more mud they sling, the more hateful graffiti scrawled on her,  the more law wielded like shears to cut her stature down, the taller and more adamant she stands - revealing now not only crimes against humanity but the oppressive crimes committed to make her silent and invisible. 
There is a kind of meaning, a claim to stature, in our lives that can only be purchased with courage.
Think of Samantha Smith, a ten year old frightened of nuclear holocaust, who launches a letter like a kite, and she clings to  the tail of that kite until, floating above us, she is teaching adults how to recognize the absurd manipulations of the Cold War. A standing stone. 
In 1969 Fred Branfman, a young American teacher in Laos, recorded  the terrifying experiences of poor rice farmers fleeing from round-the-clock U.S. carpet bombing on the Plain of Jars. BATON ROUGE, La. – A district court improperly dismissed an officer’s negligence claim against the organizer of a 2016 Black Lives Matter protest in Baton Rouge, the Fifth Circuit ruled. The officer alleges the organizer led demonstrators onto a highway and provoked an altercation between police and protestors, causing the officer’s injuries. 
The officer has sufficiently alleged that his injuries were the result of organizer DeRay Mckesson’s “own tortious conduct in organizing a foreseeably violent protest.”

WASHINGTON -- The former chief internal watchdog at the FBI has pleaded guilty to sexually assaulting a 6-year-old girl and has admitted he had a history of molesting other children before he joined the bureau for what became a two-decade career.
John H. Conditt Jr., 53, who retired in 2001, was sentenced last week in Tarrant County Court in Fort Worth to 12 years in prison after he admitted he molested the daughter of two FBI agents after he retired. He acknowledged molesting at least two other girls before he began his law enforcement career, his lawyer said.
Conditt sought treatment for sex offenders after his arrest last year, said his attorney, Toby Goldsmith.
"The problem these people have is they don't really feel like it is their fault," Goldsmith said. "The treatment doesn't work unless you admit you are the one who instigated it, and he did that."
Conditt headed the internal affairs unit, which investigates agent wrongdoing, for the Office of Professional Responsibility at FBI headquarters in Washington from 1999 until June 2001, the FBI said.
FBI officials said yesterday they had no information suggesting Conditt had any problems during his career and he was never the subject of an investigation. Assistant District Attorney Mitch Poe of Tarrant County, who prosecuted

Internal emails show that Department of the Interior employees looked to the FBI’s FOIA policies as a potential solution to the increase in number of requests. Rachel Spector, an official with Interior’s Office of the Solicitor, wrote to an FBI official seeking information on their procedures in an email stating, “Sorry to be so persistent, but we are scrambling to get our arms around a significant surge in FOIA requests.” Spector also referred to the Bureau’s FOIA program as “the gold standard.”

For all of the above, you may exclude any records that are part of the public (unsealed) record in any of the cases listed above, and are requested to do so if it would limit (rather than expand) any burdens related to search or production of records.
For all of the above, please first apply and act on a reasonable interpretation of the most likely sources of non-public records of possible public interest, so as to expedite at least partial release of responsive records.
Then, please contact me (at the email below) with an explanation of what records you are likely to have, how difficult they might be to find or produce (e.g. where they might be located, what parts would be more burdensome than others and why, etc), and I will work with you to narrow the request to suit your record storage practices, exclude records that are of no public interest, and limit the burdens of search or production.

# FOIA template structure
All content after the version number line above, except for the contact details at the very end, is part of my standard FOIA request template and identical between all of my FOIA requests. The provisions below are generally applicable to all FOIA / Privacy Act requests that I make.
There is one exception: the contact details below my signature at the very bottom (provided by MuckRock) are different for each request. Please use the distinct contact details matching each request, to ensure that your responses are correctly tracked.
The template provisions specify e.g. additional requests relating to my FOIA/PA requests themselves, form and format, timing, redaction & review, rolling updates, § 508 compliance, identity, fee waiver, my identity, and the like. They apply to this request, but are not specific to it.
If anything in the request-specific section above explicitly overrides anything in this template section, the request-specific section controls. If there is any ambiguity about such an override, please ask me for clarification.
The version number above is provided to make it easier for you to process my requests. Since all content (except contact info) below identical version number lines is identical between my requests, you need track only the request-specific portions (at the top) and the latest version of my general provisions.

## Template version updates
If you receive any FOIA request from me with a newer template version number than any pending prior FOIA requests from me, please replace the template portion of all prior requests with the updated version, treat the update as a clarification of and/or extension to the prior request, and process each updated request accordingly. If you are permitted by law to refuse to honor such an update, and you choose to exercise that refusal, please process any differences between the new version and the prior version as a new FOIA request in its own right.
# Additional FOIA requests
In addition to the records specified in the request-specific section above, I also request:

This part of the request is to be processed only after you have completed processing all of the above parts. This part does not request that you create any new record; rather, it requests the records that you will have created in processing the above parts, and will therefore exist before you conduct the search for this part. For all responsive records, I also request:

"All parts of the record" means that the "record" should be considered to be the most comprehensive record with any responsive portion. For instance:
a) if any portion of an email is responsive, the entire contents of all email thread(s) to which that email belongs is also responsive (including attachments);
b) if a record is part of a larger record, such as a responsive table that is in a chapter of a report, then the entire larger record (e.g. the full report) is responsive, together with any appendices, amendments, etc.;
c) if a record is part of a book, the entire book is responsive;
d) if a record is part of a database, all related database records are responsive;
etc.
"Related database records" has the technical meaning used in relational database management systems (such as SQL). It recursively includes all directly and indirectly related records (starting with all responsive records, include as responsive the full row of each, and recursively include as responsive all rows for which any responsive record has a foreign key or is referenced by a foreign key), together with the schema for all responsive records.
Items in part (D) should be prioritized at the same level as the record they apply to.
# Timing
For all requests above, the "cut-off date" is, at the earliest, the date that you conduct the search.
The priority order listed above is only for items that may take extra time to respond to, and must not be taken as blocking response to an otherwise lower priority item that could be released more quickly than a higher priority item that is pending time-intensive search or review.
# FOIA IA notice
Please note that this request is made after the enactment of Public Law No. 114-185, S. 337 (114th), the FOIA Improvement Act of 2016 (FOIA IA). The revised statute, as specified in the FOIA IA, applies to this request. FOIA IA § 6.
In particular, please note that:
1. you must provide electronic format documents, §§ 552(a)(2) (undesignated preceding text), 552(a)(2)(E) (undesignated following text), 552(a)(3)(B), and 552(a)(3)(C);
2. you may not specify an appeal duration less than 90 days, § 552(a)(6)(C)(A)(i)(III)(aa);

# "Record" defined
For the purposes of this request, except as otherwise specified, "record" means any agreement, appendix, application, assessment, attachment, checklist, circular, contract, correspondence (including but not limited to email), data management plan, documentation of search parameters, email, email attachment, form, guide, handbook, index of records, information consent agreement, information sharing agreement, instruction, interpretation, kit, management instruction, manual, memorandum, memorandum of understanding, notice, notification, opinion, order, plan, policy, policy statement, processing note, publication, recording, referral, report, request certification form, request detail report, response, rule, script, standard operating procedure, submission, talking point, training document, video, or related record described, regardless of publication status.
# Anti-duplication exclusion
This request specifically excludes providing me with new copies of any records which have been already provided to me or published online for free (e.g. on the agency's online "reading room"), in full or identically to the form that would be provided to me under this request (i.e. with exactly the same format, redactions, and claimed exemptions).
This is only an exclusion on providing records under this request that are identical to those already provided to me or available online, and only if I am or have already been provided a link to the online version (if "available online").
This exclusion is only intended to limit unnecessary duplication or provision, not to limit what records are responsive to this request, nor to permit failure to disclose the location of a responsive record available online. If this exclusion would in any way increase the cost or duration to respond to this request, it is to be ignored to the extent it does so.

# Minimal redaction
Please note that the FOIA requires you to service the maximum extent of my request that can be done via e.g. partial redaction of exempt material. If you believe some portions of a record to be exempt because it contains Sensitive Security Information (SSI, 49 CFR 15 & 1520) or classified information (18 USC 798), please provide a version of the record redacted to the minimum extent necessary to remove exempt information (e.g. per 49 CFR 1520.15), along with adequate information to describe the reason for each specific exemption.
## Redaction of repeatedly occurring content
When redacting any content that appears more than once in the full set of responsive records, please assign a replacement identifier for each, so that your redaction does not obfuscate the commonality.
For example, suppose that responsive records include the names Alice, Bob, Charlie, and Diego, and you determine that each of those names are redactable (e.g. under (b)(7)(C)). Rather than redacting each with only the text "(b)(7)(C)", replace each instance of "Alice" with "(b)(7)(C) - Person 1", each instance of "Bob" with "(b)(7)(C) - Person 2", etc. This e.g. withholds Alice's identity while not withholding the fact of commonality between occurrences.
Please use reasonably descriptive identifiers. For instance, if Elizabeth's name is not redacted but her personal cellphone number is, and that cellphone number appears e.g. both in her email signature and elsewhere by itself, it should in both cases be redacted with the same descriptive identifier, such as "[Alice's cell #]". For documents, this can be specified in the margins. If space or file format does not permit you to do so, then please use a short code (e.g. "[#52]", and provide a table matching codes to full identifiers in your response letter.
If you make any such redactions, please keep but do not provide a table matching codes/identifiers to the redacted content, for use in case your redaction is examined or overturned on appeal or in litigation.
This is a form and format request pertaining to your process of redaction. Because it only applies in situations when you have already exercised the voluntary decision to alter the records from the original form requested, you have necessarily waived any objection to this section "creating a new record", since your act of redaction itself already "makes a new record" in that limited sense. This is only about how you do a redaction you have already decided to make.

Former Houston police officer Gerald Goines and his partner Steven Bryant are both facing serious charges.
The Houston cop who was hailed as a hero for engaging in a bloody firefight with two drugs suspects during a January no-knock raid has been charged with two counts of first-degree murder.
Gerald Goines is also being investigated for allegedly stealing guns, drugs and money. His partner, Steven Bryant, was charged with witness tampering.

The raid uncovered no evidence that the couple killed during the raid, Dennis Tuttle and Rhogena Nicholas, were dealing heroin.
Both men are expected to turn themselves in today, according to the Houston Chronicle. And both retired in the weeks after the incident when it became apparent the police narrative was falling apart.
Prosecutors who are reviewing more than 2,000 cases involving the two cops have already dismissed dozens of cases.

Court rules Tennessee can’t withhold public records just because of a criminal investigation
“Under the state’s position, even public records accessible via the TPRA for years prior may abruptly become exempt from disclosure, an astonishing proposition.”

Last week, the Tennessee Court of Appeals ruled that state agencies can’t withhold public records just because they’re relevant to a criminal investigation.
At issue was a public records request from a Nashville television reporter for travel receipts, credit card bills, telephone records, emails and other documents for the acting director of the Tennessee Bureau of Investigation and another state official. The request was prompted by a tip from the TBI official’s wife, who said her husband was having an affair with an official with the Tennessee Department of Mental Health and Substance Abuse Services, and that they may have used state resources to carry on the affair.
In 2018, the state rejected NewsChannel 5 reporter Phil Williams’ request for these public records, contending they were exempt from disclosure since they were part of an ongoing criminal investigation. Williams and the television station filed a lawsuit to compel these records’ release. But before the case was heard, the state completed its criminal investigation, and then disclosed the records.
So this particular case was moot, but the legal question wasn’t. Are ordinary records of a state agency - not investigative files - exempt from the Tennessee Public Records Act when they become part of a criminal investigation?
On August 16th, the Tennessee Court of Appeals ruled such records aren’t exempt from the TPRA.
“We hold that non-investigative public records made in the ordinary course of business, capable of being accessed from their inception by citizens of Tennessee, do not become exempt from disclosure because of the initiation of a criminal investigation in which they become relevant,” the court ruled, in an opinion written by Chief Justice D. Michael Swiney.

A former contract security guard who stole guns, ammunition and firearms parts from the ATF and then sold them was sentenced Monday to 14 years in prison.
Christopher Lee Yates, of Martinsburg, W.V., admitted in court that he stole the items from ATF’s National Firearms and Ammunition Destruction Branch facility near Martinsburg.
An investigation found that Yates stole the guns, ammunition and firearm parts while serving as a security guard from 2016 to 2019.
The theft prompted an investigation that helped the ATF recover 4,625 guns and firearm parts. They included 120 rifles, 60 pistols, four automatic machine guns and three components to make rocket launcher

ABILENE, Texas — Federal Bureau of Investigation (FBI) Director Christopher Wray has named an adjunct criminal justice professor at Abilene Christian University as an Assistant FBI Director.
Stuart Platt was sworn in on August 27 as the new FBI Assistant Director in charge of the Office of Professional Responsibility at FBI Headquarters in Washington D.C.
The FBI's Office of Professional Responsibility makes sure that employees of the FBI follow the regulations of the FBI and present themselves with the high level of class associated with the FBI.

Ben & Jerry’s Takes on Criminal Justice Reform with New Flavor, Justice Remix’d

In a world in which the trappings of allyship have devolved into Instagram likes or tawdry photo ops, premium ice cream company Ben & Jerry’s has quietly ignored fanfare in favor of doing the actual work.
It’s not uncommon to find posts admonishing the criminal justice system or systemic racism on their website, and since May 2018 they’ve spent over a million dollars on Facebook ads denouncing mass incarceration, advocating for mental health funding and demanding criminal justice reform. And according to the revered ice cream manufacturer, they’re just getting started.
On Tuesday, they partnered with Color of Change and the Advancement Project to unveil their latest flavor, Justice Remix’d, as part of their three-year initiative “to address the destructive cycle of mass incarceration in our country,” according to a statement from Ben & Jerry’s.
Prior to this unveiling, The Root spoke with Jabari Paul, the company’s assistant U.S. activism manager, who explained B&J’s mission further.
“Justice Remix’d is our fan-facing advocacy campaign that focuses on front-end criminal justice reform,” Paul told The Root. “Front-end meaning how do you divert and deflect people from going into the incarceration system in the first place? Many of which have no legitimate reason for being there.”
Paul added, “On a national level, we’ve really focused on three issues: ending money bail, stopping unnecessary prosecutions and disrupting the school to prison pipeline.”
In doing so, Ben & Jerry’s became partners in Color of Change’s Winning Justice campaign, which seeks to transform the criminal justice system by championing reform-minded prosecutors for election. But the company has a local strategy as well, which includes the involvement of the Advancement Project to work towards shutting down jails like Workhouse in St. Louis.
“90 percent of the people there are on pre-trial detention,” Paul said. “They’re just too poor to bond themselves out. You can be rich and guilty and not go to jail pre-trial or you can be poor and innocent and you have to sit in jail.”
Criminal justice reform is long overdue, and with the arrival of Justice Remix’d, Ben & Jerry’s seeks to be a part of the solution instead of resting on their laurels.
“The reason that we believe in social impact is because social impact goes beyond this idea of corporate giving. It’s about really influencing fan behavior,” Paul said. “Our goal is to drive them to increase awareness around the issues that we care about, like criminal justice reform, drive engagement, engage them around those issues and then ultimately inspire them to take action.”
Justice Remix’d is available for pre-order on their website and arrives in stores this week.
