Aquash was a Mi’kmaq from Nova Scotia and was well-known as a skilled organizer and warrior with AIM. In 1975, she said she had been targeted and threatened with death by the FBI. Her body was found on the Pine Ridge Indian Reservation in February 1976. The original autopsy report, made by an FBI-contracted coroner, stated her cause of death as "exposure" and made no record of the bloody bullet-wound in the back of her head. The FBI removed her hands for purposes of identification in Washington as they claimed the body was unidentifiable. The Bureau of Indian Affairs (BIA) buried Aquash as a Jane Doe.

No matter which of the four top candidates for mayor of Chicago is elected, it appears certain that one of the first casualties of the election will be the city's police superintendent.

Former White House chief of staff Rahm Emanuel, former U.S. Sen. Carol Moseley Braun, former Chicago public schools president Gery Chico and City Clerk Miguel del Valle have all now said they want someone other than Jody Weis to head the police force of the nation's third-largest city.

Former FBI agent William Henterly let his CPA license lapse 18 years ago, according to the state's licensing agency, a fact that prohibits him from using the title. The Ohio Accountancy Board shows his license was suspended.

Accountancy board officials sent Henterly a letter Thursday ordering him to stop using the CPA designation. The letter cites Henterly's use of the CPA title on FitzGerald's website and on the website of a Berea law firm that lists Henterly as a consultant.

The state letter cites Ohio law that makes it a crime to use the title without proper licensing.

A Boston lawyer, ordered to provide a footprint to an FBI agent conducting a background check for a federal judgeship, filed a lawsuit in US District Court yesterday, saying the incident and subsequent publicity invaded his privacy and caused him to suffer public ridicule and humiliation.

Walter Prince, who was nominated to the bench by President Bush but never confirmed by the Senate, said the agent, Paul DiMura, took his fingerprints at the FBI office in April 1992, then instructed him to remove his left shoe and sock so that a footprint could be taken, according to the suit.

A Sorry FBI

Following the guilt-by-association model of law enforcement that has become the norm since September 11, I was not surprised to hear that a lawyer in Portland, Oregon, Brandon Mayfield, was falsely alleged to be involved with the terrorist train bombing in Madrid, Spain. Nor was I surprised that papers like The Washington Post and The New York Times reported on Mayfield's detention on a "material witness" warrant (used when the government wants to imprison you, but cannot charge you with a crime because it has no credible evidence) beneath flashy headlines suggesting that, of course, he was a terrorist.

A terrorist because he was a Muslim, married to a Muslim, living in Portland, Oregon where "terrorists" had been prosecuted. A terrorist --and this fact removed all doubt--because he had represented one of those "terrorists" in a custody battle to keep his child.

So, when fingerprints found on a bag at the scene of the crime vaguely had a few points of resemblance to those of Mayfield (found in an FBI database of 44 million prints because he served, honorably, in the Army), the FBI was quick to put the pieces of Mayfield's Muslim connections with the prints and decide that they had their man. Yes sir, here was one of the actual perpetrators of the attack! He even carried a bag of explosives.

Never mind that there was no record of his having been abroad (and you know that the feds know whenever you and I have boarded a plane to travel overseas--if you don't know that, you have not been paying attention). He must have gone to Madrid under an assumed name, they reasoned. And we know that the FBI cannot unravel anything that complex as identifying people who use aliases (a local detective I work with in my law practice can do that kind of analysis, but not the FBI--they don't have computers, remember?).

The FBI finally backed down and released Mayfield, apologizing to him for the mix-up. The prints belonged to an Algerian man the Spanish identified. He is now under arrest. We are so sorry for the mistake, says the FBI.

Just how sorry the FBI is, however, is set out in a New York Times story appearing on June 5.

The FBI is sorry that the Spanish were so insistent on getting the right suspect, not just a convenient suspect that fits the FBI profile of terrorist. The FBI is sorry that the Spanish police "outed" them and their sorry tactics. The FBI is sorry that their mistake may call into question their heretofore unassailable assertions that their fingerprint analysis is 100 percent accurate. The FBI is sorry that they ruined an innocent man's life.

The FBI is sorry that you know how sorry they are.

Think about Brandon Mayfield as you read about FBI Director Robert Mueller's pleas to Congress to allow him to set up a secret domestic surveillance branch of the FBI. To spy on you, ransack your house and office, and maybe, if they are lucky, find your fingerprints at the scene of a "terrorist" strike.

And remember that if the Spanish had not blown the FBI's cover, Mayfield would probably be facing multiple life sentences--or the death penalty for a crime he did not commit.

Seda's prosecutors failed to disclose FBI payments to key witness' husband

Defense lawyers are demanding Pete Seda's money-laundering and tax convictions be dismissed because of what they called "outrageous government conduct" in which cash payments made years ago to a key witness's family weren't disclosed until after Seda's trial.

In new motions filed Wednesday in U.S. District Court in Eugene, defense attorneys say the government long has withheld information that the husband of key witness Barbara Cabral was paid $14,500 for working with the FBI agents investigating Seda and other local Muslims as early as 2004.

Defense attorneys also argue that Barbara Cabral considered the lead investigator in the case, FBI Agent David Carroll, a personal friend and that the pair last year also discussed the FBI paying Cabral $7,500 after the trial.

The FBI told defense attorneys that Cabral did not receive any cash from agents after the trial, and the government has referred to the lack of disclosure as "inadvertent," court filings state.

ACLU Chief Howard Simon Recalls MLK and Bloody Sunday

​Ten years later, with Dr. King's words still resonating and inspiring me, I became executive director of the American Civil Liberties Union of Michigan. My work with the ACLU included work on two cases that addressed the FBI's complicity, under J. Edgar Hoover, in violence against civil rights workers. We uncovered documents revealing that, three weeks before the first Freedom Riders arrived in Birmingham on May 14, 1961, the FBI was told that the Birmingham Police would allow the Klan 15 minutes to attack the Freedom Riders. The notice came from the FBI's chief paid informant in the Klan, Gary Thomas Rowe, Jr.

How I remember that day! We found that document in a box of papers received from the FBI through the Freedom of Information Act, and with the help of a U.S. Senator from Michigan.

My friends, Dr. Walter Bergman, a retired professor and a previous director of the Detroit ACLU, and his wife Francis were part of the racially integrated team of Freedom Riders who arrived in Birmingham in 1961 only to be viciously beaten by a mob that included the FBI's chief paid informant in the Klan. Dr. Bergman's beating caused a stroke that paralyzed him for the remaining forty years of his life.

Four years later, we learned that the same FBI paid informant was one of four people in the car from which the fatal shots were fired, killing Viola Liuzzo.

The ACLU sued the FBI on behalf of the Bergmans and the Liuzzo family. One federal judge ruled against the Liuzzos, finding insufficient evidence the shots that killed their mother were fired by the Klan or the FBI informant. (Think of that: the court was not able to determine whether the Detroit mother was killed by the Klan or the FBI's paid agent!)

Another judge found that the FBI, armed with advance knowledge of the attack but choosing to let it happen, was responsible for the assault on the Freedom Riders.

FBI agent allegedly part of "Operation Blighted Officials" convicted of fraud

BATON ROUGE, LA (WAFB) - An FBI agent who possibly played a significant role in the "Operation Blighted Officials" investigation was recently found guilty on multiple counts of fraud and faces over 300 years in prison.

The development could affect the upcoming trials for some officials indicted following the investigation.

According to a federal indictment out of Nashville, FBI Special Agent Darin Lee McAllister lied about his salary to get over a million dollars in bank loans. In December, McAllister was found guilty of 15 counts of wire fraud and three counts of bankruptcy fraud. He now faces up to 315 years in prison and millions of dollars in fines.
