US Weapons “Walked” Into Mexico Under ATF Operation Supplied Firepower for Juarez Bloodbath

A top enforcer for the Sinaloa drug organization and his army of assassins in Juarez, Mexico — responsible for a surge in violence in that city that has led to thousands of deaths in recent years — may well have been supplied hundreds, if not thousands, of weapons through an ill-fated US law-enforcement operation known as Fast and Furious.

That enforcer, Jose Antonio Torres Marrufo, was arrested by Mexican police in February this year and is now the subject of a 14-count US indictment unsealed in late April in San Antonio, Texas, that also charges the alleged leaders of the Sinaloa organization (Joaquin Guzman Loera, or El Chapo; and Ismael Zambada Garcia, or El Mayo) and 21 other individuals with engaging in drug and firearms trafficking, money laundering and murder in “furtherance of a criminal enterprise.”

However, public records and media reports reveal that the trail of weapons that reportedly helped Maruffo unleash a bloody war against the rival Juarez drug organization for control of the market leads, at least in part, back to the doorstep of US law enforcement agencies, principally the FBI and ATF, through the contortions of the US-sanctioned gun-running operation known as Fast and Furious.Jose Antonio Torres Marrufo is now in the custody of Mexican law enforcement.

Marrufo is allegedly responsible, according to the Mexican government, for the murders of some 18 people at the El Aliviane drug-treatment center in Juarez in the fall of 2009. In addition, the indictment in San Antonio contends he is responsible for the kidnapping, torture and murders of several people who lived in the United States, including a Horizon City, Texas, resident who was killed for losing a load of marijuana to a Border Patrol seizure.

In another case, the US indictment alleges, according to a press release from the US Attorney’s Office in San Antonio, the following:

RFK assassination witness tells CNN: There was a second shooter
Author: By Michael Martinez and Brad Johnson CNN
Apr 28 2012

As a federal court prepares to rule on a challenge to Sirhan Sirhan's conviction in the Robert F. Kennedy assassination, a long overlooked witness to the murder is telling her story: She heard two guns firing during the 1968 shooting and authorities altered her account of the crime.

Nina Rhodes-Hughes wants the world to know that, despite what history says, Sirhan was not the only gunman firing shots when Senator Kennedy was murdered a few feet away from her at a Los Angeles hotel.

"What has to come out is that there was another shooter to my right," Rhodes-Hughes said in an exclusive interview with CNN. "The truth has got to be told. No more cover-ups."

Her voice at times becoming emotional, Rhodes-Hughes described for CNN various details of the assassination, her long frustration with the official reporting of her account and her reasons for speaking out: "I think to assist me in healing -- although you're never 100% healed from that. But more important to bring justice."

"For me it's hopeful and sad that it's only coming out now instead of before -- but at least now instead of never," Rhodes-Hughes told CNN by phone from her home near Vancouver, Canada.

Sirhan, the only person arrested, tried and convicted in the shooting of Kennedy and five other people, is serving a life sentence at Pleasant Valley State Prison in Coalinga, California.

The U.S. District Court in Los Angeles is set to rule on a request by the 68-year-old Sirhan that he be released, retried or granted a hearing on new evidence, including Rhodes-Hughes' firsthand account.

At his 1969 trial, Sirhan's original defense team never contested the prosecution's case that Sirhan was the one and only shooter in Kennedy's assassination. Sirhan testified at his trial that he had killed Kennedy "with 20 years of malice aforethought," and he was convicted and sentenced to death, which was reduced to life in prison in 1972.

Their current battle has prosecutors and Sirhan's new lawyers engaging directly the merits of new evidence -- as well as witness recollections such as Rhodes-Hughes' account -- never argued before a judge.

Prosecutors under the attorney general are contending that Rhodes-Hughes heard no more than eight gunshots during the assassination. In court papers filed in February, Harris and prosecutors argue that Rhodes-Hughes was among several witnesses reporting "that only eight shots were fired and that all these shots came from the same direction."

Sirhan's lawyers are challenging those assertions.

In a response also filed in federal court in Los Angeles, the defense team led by New York attorney William Pepper contends that the FBI misrepresented Rhodes-Hughes' eyewitness account and that she actually had heard a total of 12 to 14 shots fired.

"She identified fifteen errors including the FBI alteration which quoted her as hearing only eight shots, which she explicitly denied was what she had told them," Sirhan's lawyers argued in February, citing a previously published statement from Rhodes-Hughes.

The FBI and the California attorney general's office both declined to comment to CNN on the controversy over Rhodes-Hughes' witness account since the matter is now being reviewed by a federal judge.

Rhodes-Hughes was a television actress in 1968 who worked as a volunteer fundraiser for Kennedy's presidential campaign.

The FBI report indicates that Rhodes-Hughes was indeed inside the kitchen service pantry of the Ambassador Hotel during the crucial moments of the Kennedy shooting, but she contends the bureau got details of her story wrong, including her assertions about the number of shots fired and where the shots were fired from.

Rhodes-Hughes, now 78, tells CNN she informed authorities in 1968 that the number of gunshots she counted in the kitchen pantry exceeded eight -- which would have been more than the maximum Sirhan could have fired -- and that some of the shots came from a location in the pantry other than Sirhan's position.

Robert Kennedy was the most seriously wounded of the six people shot inside the hotel pantry on June 5, 1968, only moments after the New York senator had claimed victory in California's Democratic primary election. The presidential candidate died the next day; the other victims survived.

The Los Angeles County coroner determined that three bullets struck Kennedy's body and a fourth passed harmlessly through his clothing. Police and prosecutors declared the four bullets were among eight fired by Sirhan acting alone.

Rhodes-Hughes tells CNN the FBI's eight-shot claim is "completely false." She says the bureau "twisted" things she told two FBI agents when they interviewed her as an assassination witness in 1968, and she says Harris and her prosecutors are simply "parroting" the bureau's report.

"I never said eight shots. I never, never said it," Rhodes-Hughes told CNN. "But if the attorney general is saying it then she's going according to what the FBI chose to put into their report."

"There were more than eight shots," Rhodes-Hughes said by phone. She says that during the FBI interview in her Los Angeles home, one month after the assassination, she told the agents that she'd heard 12 to 14 shots. "There were at least 12, maybe 14. And I know there were because I heard the rhythm in my head," Rhodes-Hughes said. She says she believes senior FBI officials altered statements she made to the agents to "conform with what they wanted the public to believe, period."

"When they say only eight shots, the anger within me is so great that I practically -- I get very emotional because it is so untrue. It is so untrue," she said.

Contacted by CNN for comment, Sirhan lead attorney William Pepper called the alleged FBI alteration of Rhodes-Hughes' story "deplorable" and "criminal" and said it "mirrors the experience of other witnesses."

Other witnesses also mentioned more than eight shots

Law enforcement investigators have always maintained that only eight shots were fired in the RFK assassination, all of them by Sirhan. His small-caliber handgun could hold no more than eight bullets.

But released witness interview summaries show at least four other people told authorities in 1968 that they heard what could have been more than eight shots. The following four witness accounts appear not in FBI reports but in Los Angeles Police Department summaries:

-- Jesse Unruh, who was speaker of the California Assembly at the time, told police that he was within 20 to 30 feet behind Kennedy when suddenly he heard a "crackle" of what he initially thought were exploding firecrackers. "I don't really quite remember how many reports there were," Unruh told the LAPD. "It sounded to me like somewhere between 5 and 10."

-- Frank Mankiewicz, who had been Kennedy's campaign press secretary, told police that he was trying to catch up to the senator when he suddenly heard sounds that also seemed to him to be "a popping of firecrackers." When an LAPD detective asked Mankiewicz how many of the sounds he'd heard, he answered: "It seemed to me I heard a lot. If indeed it had turned out to have been firecrackers, I probably would have said 10. But I'm sure it was less than that."

-- Estelyn Duffy LaHive, who had been a Kennedy supporter, told police that she was standing just outside the kitchen pantry's west entrance when the shooting erupted. "I thought I heard at least about 10 shots," she told the LAPD.

-- Booker Griffin, another Kennedy supporter, told police that he had just entered the pantry through its east entrance and suddenly heard "two quick" shots followed by a slight pause and then what "sounded like it could have been 10 or 12" additional shots.

An analysis of a recently uncovered tape recording of the shooting detected at least 13 shot sounds erupting over a period of less than six seconds. The audiotape was recorded at the Ambassador Hotel by free-lance newspaper reporter Stanislaw Pruszynski and is the only known soundtrack of the assassination.

Audio expert Philip Van Praag told CNN that his analysis establishes the Pruszynski recording as authentic and the 13 sounds electronically detected on the recording as gunshots.

"The gunshots are established by virtue of my computer analysis of waveform patterns, which clearly distinguishes gunshots from other phenomena," he said in an e-mail. "This would include phenomena that to human hearing are often perceived as exploding firecrackers, popping camera flashbulbs or bursting balloons."

Van Praag's Pruszynski recording findings are now a major point of controversy among new evidence being argued between the two sides in the Sirhan federal court case. Harris contends that his findings amount to an "interpretation or opinion" that is not universally accepted by acoustic experts.

CNN initially reported on Van Praag's audio analysis in 2008 and then with additional details in a BackStory segment in 2009.

Shots fired from two different locations

California prosecutors have argued that witnesses heard shots coming from only one location, but Rhodes-Hughes tells CNN that while the first two or three shots she heard came from Sirhan's position several feet in front of her, she also heard gunshots "to my right where Robert Kennedy was."

According to the autopsy report, the coroner concluded that the senator's body and clothing were struck from behind, at right rear, by four bullets fired at upward angles and at point-blank range. Yet witnesses said Sirhan fired somewhat downward, almost horizontally, from several feet in front of Kennedy, and witnesses did not report the senator's back as ever being exposed to Sirhan or his gun.

In his analysis of the Pruszynski sound recording, Philip Van Praag found that five of the gunshots captured in the tape were fired opposite the direction of Sirhan's eight shots. Van Praag also concluded that those five shots -- the third, fifth, eighth, 10th and 12th gunshots within a 13-shot sequence -- displayed an acoustical "frequency anomaly" indicating that the alleged second gun's make and model were different from Sirhan's weapon.

A chance meeting with Robert Kennedy

The path that eventually led Nina Rhodes-Hughes to the Ambassador Hotel kitchen pantry began 2½ years earlier during a chance meeting with Robert Kennedy at NBC-TV studios in Burbank, California. She was being made up for her co-starring role in the daytime drama "Morning Star" when Kennedy suddenly entered the makeup room. The actress was starstruck. "I saw Robert Kennedy and everything else disappeared from view," she said. "There was an aura about him that was very captivating. He kind of pulled you in. His eyes were very deep set and they were very blue. And when you looked at him, you got very drawn in to him."

As Rhodes-Hughes remembers it, the senator had arrived to pre-record an interview on "Meet the Press" and the two discussed political issues while awaiting their separate TV appearances. "Here I am, just an actress in a soap opera, and he took the time to have an in-depth conversation with me," said Rhodes-Hughes, who was then known professionally by her screen name Nina Roman.

As impressed as Rhodes-Hughes was with Robert Kennedy, she says the senator indicated that he himself was impressed with her ability to quickly memorize many pages of TV script. She says he confided to her that he had no such talent himself but that his older brother, the assassinated President John F. Kennedy, had possessed similar skills.

"Our conversation basically was the clincher for me," Rhodes-Hughes told CNN. "I said to him, 'You know, I have followed your career in politics and I really believe in you and I love all the things that you did -- and are trying to do, and propose to do -- and so if ever you declare yourself a candidate for the presidency, I will work for you, heart and soul.' And he smiled and said, 'Well, I don't know if that's going to happen.' And he was very humble and very sweet."

Rhodes-Hughes says that later, in the spring of 1968, shortly after Kennedy announced his candidacy for the presidency, she helped form a campaign support group in Los Angeles called "Young Professionals for Kennedy" and assisted in raising funds for the California phase of the senator's White House bid.

Weeks later, as he claimed victory in the California primary, addressing hundreds of supporters in the Ambassador Hotel's Embassy Room shortly after midnight on June 5, Kennedy paid tribute to the many volunteers, like Rhodes-Hughes, who had assisted his campaign. Referring to his own role during his brother's successful run for the presidency in 1960, Kennedy told them, "I was a campaign manager eight years ago. I know what a difference that kind of an effort and that kind of a commitment makes."

Trying to keep Kennedy from heading to the pantry

For Rhodes-Hughes there was one more commitment to keep. She had promised Kennedy aide Pierre Salinger that following the candidate's victory speech she would try to meet the senator as he exited the ballroom and usher him to a backstage area where Salinger had been keeping abreast of the California primary returns. She says although she and another campaign volunteer made sure to carefully position themselves to greet the candidate, the opportunity never came. According to Rhodes-Hughes, shortly after Kennedy completed his remarks in the Embassy Room, he was whisked away by others down a corridor and toward the kitchen pantry while she scurried to catch up.

"No, no, that's the wrong way!" Rhodes-Hughes tells CNN she shouted to the senator and his escorts as she chased after them in an unsuccessful effort to turn them around. "It's this way! Come back! You're going the wrong way!"

Kennedy and Sirhan almost face-to-face

Rhodes-Hughes says that after she entered the kitchen pantry's west entrance, she could see Kennedy in left profile, "greeting" well-wishers a few feet ahead of her. She says a moment later she was looking at the back of the senator's head, as he continued onward, when suddenly the first two or three shots were fired.

"I saw his left profile. And then, very, very quickly, he was through greeting, and he turned and went into the original direction that he was being ushered to," Rhodes-Hughes told CNN. "At that point, I saw the back of his head and part of his shoulders and back."

"My eyes were totally on him, and all of a sudden I started hearing popping sounds, which I thought at first were flashbulbs from a camera," she said. It was Rhodes-Hughes' account of Kennedy's movements in the pantry that Sirhan's lawyer Pepper focused on in particular when CNN asked him to comment on Rhodes-Hughes' account of the shooting.

"This observation is vital," said Pepper. "Her clear recollection of being some short distance behind the Senator and seeing his left profile and then seeing him quickly turning so that the back of his head was in her sight at the time the shooting began -- this reveals that the Senator was almost directly facing Sirhan just before he took three shots, from behind, in his back, and behind his right ear at powder burn range, making it impossible for Sirhan to have been Robert Kennedy's shooter," the defense attorney said in an e-mail to CNN. "It clearly evidences the existence of a second gunman who fired from below and upward at the Senator."

Rhodes-Hughes says that while she was behind Senator Kennedy, looking at the back of his head and hearing the first two or three gunshots, Kennedy did not appear to be struck by bullets at that point.

Still believing the first shots were merely flashbulbs, she says she then took her eyes off the senator, while turning leftward, and caught her first glimpse of Sirhan standing in front of Kennedy and to the candidate's left.

She told CNN that the 5-foot-5-inch tall Sirhan was propped up on a steam table, several feet ahead of her and slightly to her own left. Rhodes-Hughes says part of her view of Sirhan was obstructed and she could not see the gun in his hand but she says that, as soon as she caught sight of Sirhan, she then heard more shots coming from somewhere past her right side and near Kennedy. She told CNN that at that point she was hearing "much more rapid fire" than she initially had heard.

In his recent analysis of the Pruszynski recording, Philip Van Praag found that some of the tape's 13 captured shot sounds were fired too rapidly, at intervals too close together, for all of the gunshots in the pantry to have come from Sirhan's Iver Johnson revolver alone.

Sirhan's lawyers report in their federal court papers that gunshot echoes have been ruled out as the cause of the Pruszynski recording's "double shots." Ricochets also are ruled out according to Pasadena, California, forensic audio engineers who verified Van Praag's Pruszynski findings for the 2007 Investigation Discovery Channel television documentary "Conspiracy Test: The RFK Assassination."

'They've killed him! They've killed him!'

Rhodes-Hughes told CNN she heard gunshots coming from some place not far from her right side even while Sirhan was being subdued several feet in front of her. "During all of that time, there are shots coming to my right," she said. "People are falling around me. I see a man sliding down a wall. Then I see Senator Kennedy lying on the floor on his back, bleeding. And I remember screaming, 'Oh no! Oh, my God, no!' And the next thing I know, I'm ducking but also in complete shock as to what's going on.

"And then I passed out," she said.

Rhodes-Hughes says that, moments later, while she was regaining consciousness from having fainted to the floor, she noticed that her dress was wet and that she was missing a belt and one of her shoes. It was clear to her that she had been trampled, but she was unhurt.

She then looked across the room and saw Kennedy once again, lying on the floor and bleeding, this time with his wife Ethel kneeling and trying to comfort him. Rhodes-Hughes says the sight horrified her, sending her screaming out of the pantry and back through the corridor, where she was attended to by her then-husband, the late television producer Michael Rhodes.

"I'm running out of the pantry and I'm yelling, 'They've killed him! They've killed him! Oh, my God, he's dead! They've killed him!'" Rhodes-Hughes told CNN. "Now, the reason I said, 'they' is because I knew there was more than one shooter involved."

L

Rhodes-Hughes describes the events of early June 1968 as "the most iconoclastic experience" of her life.

"Although it was 44 years ago, I will swear that this is exactly what happened. I remember it like it was almost yesterday, because you don't forget something like that when it totally changes your life forever," she said. "It took a great toll on me. For a while, even the backfiring of a car would send me into tears."

Never called to testify

Despite the fact her FBI interview summary indicates Nina Rhodes-Hughes was inside the kitchen pantry during the assassination, she was never called to testify at Sirhan's 1969 trial or at any subsequent inquiry over the years. Rhodes-Hughes says she made a point of telling two FBI agents in 1968 that she would be willing to make herself available to appear as a witness anywhere at anytime and to testify "that there were more shots."

"They never wrote that down," she says of the FBI agents who conducted the interview in her Los Angeles home. She also says that when the pair of agents departed following their visit, they forgot to take along their attaché case and, minutes later, had to return to her residence and retrieve it.

Rhodes-Hughes says that, in the months following the June 5, 1968 assassination, she and some others who had been at the Ambassador Hotel refused news media interviews so as to avoid interfering with preparations for Sirhan's trial. It wasn't until the 1990s that Rhodes-Hughes was asked whether she would ever be willing to testify under oath -- an invitation coming not from a prosecutor or law enforcement official but from author Philip H. Melanson, a chancellor professor of policy studies at the University of Massachusetts Dartmouth.

At Melanson's request, Rhodes-Hughes reviewed her 1968 FBI interview summary for the first time and found it contained more than a dozen inaccuracies. She provided Melanson with a statement, but the professor died some years later and Rhodes-Hughes once again missed her opportunity to testify. Before his death, Melanson published Rhodes-Hughes' statement in "Shadow Play," a book he co-authored with William Klaber in 1997 and one of several Melanson wrote on the Robert Kennedy assassination.

Rhodes-Hughes recounted the Kennedy shooting and her initial contact with Melanson in a 1992 interview on "Contact," a local TV program carried at the time in Vancouver by Rogers Cable.

Defense attorney William Pepper calls Rhodes-Hughes' recollections "significant verification" of new assassination evidence that the Sirhan legal team is currently presenting. "It provides further verification of a dozen or more gunshots and mirrors the experience of other witnesses which confirms the existence of the cover-up efforts," he told CNN.

"Along with all of the other evidence we have provided, one wonders why it has taken so long for this innocent man to be set free, a new trial to be ordered or, at least, a full investigatory hearing to be scheduled," Pepper said. "Nothing less than the credibility and integrity of the American criminal justice system is at stake in this case."

Sirhan Sirhan's current legal team is doing something his original lawyers never did. They are asserting that Sirhan did not shoot Kennedy.

Sirhan's original defenders had decided at the outset that Sirhan was the lone shooter. Because Sirhan's initial lawyers presented a diminished capacity case in 1969, they never pursued available defenses. Evidentiary conflicts, and issues such as a possible second gun, simply were not addressed at Sirhan's 1969 trial. Most of the original prosecution's evidence was stipulated by the original defense team, which agreed that Sirhan had killed the presidential candidate.

Nina Rhodes-Hughes opposes freedom for Sirhan Sirhan, whom she regards as one of two gunmen firing shots inside the Ambassador Hotel kitchen pantry. "To me, he was absolutely there," she said. "I don't feel he should be exonerated."

Rhodes-Hughes insists the full truth of Robert Kennedy's murder has been suppressed for decades, and says she hopes that it will now finally come out and that the alleged second shooter will be identified and brought to justice.

"There definitely was another shooter," said Rhodes-Hughes. "The constant cover-ups, the constant lies -- this has got to stop."

FBI Plans To Investigate Congressman Michael Grimm’s Fundraising

by Laura Vladimirova on Apr 30th, 2012

Source: United States Federal Government via Wikimedia Commons

CORRECTION (4/30/2012 at 9:29 p.m.): The following article erroneously portrays the incident as a recent news story. In actuality, the allegations in this story came to light in a January New York Times story, and this report includes details that were first reported in March. A recent news item, however, confirms that the FBI is still currently investigating the allegations referenced here, specifically that Grimm accepted a donor’s envelope of cash, and that he attempted to intimidate a rabbi into helping him raise money. We sincerely apologize for any confusion, and endeavor to serve you with the most accurate and timely information in the future. – N.B.

Local Congressman Michael Grimm may come under FBI fire due to a series of allegations regarding his most recent campaign contributions.

Donors have come forward to say that they contributed illegally to Grimm’s 2010 campaign, according to the Associated Press. The donors, mostly congregants of Manhattan-based Rabbi Yoshiyahu Yosef Pinto, raised hundreds of thousands of dollars for Grimm.

Grimm, a former FBI agent, denies the allegations. He also denies any knowledge of Pinto’s supporters lawbreaking donations.

“These allegations are so profoundly absurd that they serve as proof of the coordinated Democratic smear campaign designed to recruit a stronger opponent to challenge me,” Grimm said.

Pinto has not made any public comments regarding the scandal. However, disgraced former U.S. Representative Anthony Weiner has stated that Pinto came to him to discuss Grimm’s involvement with the illegal donations.

“I can confirm the Rabbi did bring allegations to me and I can confirm that I turned them over to the FBI immediately,” Weiner said to Roll Call.

'Lockerbie Witnesses Were Paid'
Despite years of US government denials, new evidence and admissions have come to light
Ludwig De Braeckeleer (ludwig)
Published 2009-02-11

Now it appears there is a blustery effort on the part of the Clinton administration to convince the skeptics it is finally getting serious. First, there was the unveiling of the WANTED poster, featuring a photograph of the two Libyans on the inside lid of a suitcase laden with $4 million cash bounty... Those who financed and planned the deadliest ever terrorist attack on American citizens continue to remain unindicted. The remarkable silence invites suspicion that the US government is engaged in little more than another calculated effort to ignore the larger issues: Iran's motivations for revenge, and the US government's responsibility. -- US NAVY Captain Dave Carlson, April 9 1995

In recent times, allegations have resurfaced regarding payments offered to key witnesses of the Lockerbie trial.

Specifically, there have been rumors that Majid Giaka, Paul and Tony Gaud were each paid about US$4 million for their help in the conviction of Megrahi for the bombing of Pan Am 103 over Scotland on Dec. 21, 1988.

Additionally, another key witness, Edwin Bollier, claims that a FBI agent promised him the same amount if he could help with the investigation.

Richard Marquise, the FBI agent who led the Lockerbie investigation, forcefully denied that witnesses were ever offered any money.

"I can assure you that no witnesses were ever offered any money by anyone--including the CIA," Marquise told OhmyNews. "This issue came up at trial and I spoke with the defense lawyers about it in Edinburgh in 1999 -- before trial. No one was promised or even told that they could get money for saying anything. Every FBI agent was under specific orders not to mention money to any potential witness."

Frank Skroski from the US Marshals Service at trial testified about money which may have been paid to Magid Giaka. Skroski said, other than food, shelter and clothing, no money was ever paid to him.

"If it is Bollier who is making the allegations, I will say again. He was not offered or paid any money -- ever. We did pay for his trip to the US in 1991," Marquise told OhmyNews.

In a formal statement, FBI spokesman Richard Kolko emphatically rejected any suggestions of a payoff.

"Any accusations that any witness was paid to lie are complete fabrications and these ridiculous statements should be immediately discounted as the untruths they are," Kolko said. "That is not the way the FBI operates."

A CIA spokesperson ridiculed a witness's accusations that it offered or paid Edwin Bollier anything. "It may disappoint the conspiracy buffs, but the CIA doesn't belong in your story."

Richard marquise confirmed to OhmyNews that the bureau met with Bollier in Washington in 1991, and that he personally attended the meeting. But marquise denied Bollier was offered anything to implicate Libya.

Edwin Bollier tells OhmyNews that he was shown a size A4 light-grey brochure. According to Bollier, the document is printed on one side only and displays two suit-cases with dollar note bundles, overwritten with "reward $4 million." The text and illustrations are printed in black.

A source speaking on condition of anonymity told Jeff Stein, the national security editor of the Congressional Quarterly, that a key witness, Tony Gauci, and his brother were each paid somewhere between $3 million to $4 million for providing information leading to the conviction of Megrahi.

Moreover, former State Department lawyer Michael Scharf confirmed to OhmyNews that rewards were paid in the context of the Lockerbie trial.

"I knew that rewards payments were made, but not the amount. The Awards for Terrorism Information program has been around since the 1980s, and has been expanded to rewards for information leading to the arrest or conviction of international indicted war criminals like Karadzic and Mladic. When I worked at the Office of the Legal Adviser of the State Department I was involved in the program," Scharf wrote in an email to OhmyNews.

Justice Department seeks more than 1,700 secret warrants

Published May 03, 2012

FoxNews.com

The Justice Department made 1,745 requests to a secret court for authority to wiretap or search for evidence in terrorism and espionage investigations last year.

That's according to an April 30 letter from the department to the Senate that was first reported Thursday by the Federation of American Scientists.

The Foreign Intelligence Surveillance Court, which meets in secret to hear classified evidence from government attorneys, did not reject any of the requests, though judges did require modifications to 30 requests.

It was an increase over 2010, when the department made 1,579 requests.

The FBI also made 16,511 national security letter requests for information regarding 7,201 people last year. The letters allow officials to collect virtually unlimited kinds of sensitive, private information like financial and phone records.

The situation escalated when Rochon and some of his tormentors were transferred to Chicago. He started getting death threats. In one instance, white agents said they would cut off his genitals. Then, about a week later, a death and dismemberment insurance policy appeared on Rochon's desk.

"That was traced back to an FBI agent," he says. The agent forged Rochon's signature on the policy.

The FBI supervisor said it was harmless fun and wrote the incidents off as pranks.

In separate investigations, the Justice Department and Equal Employment Opportunity Commission saw it differently. They found that Rochon was humiliated by agents because he was black. The former special agent in charge of the Omaha office told the EEOC that he considered the pranks to be "healthy" and a sign of "esprit de corps." He said he was aware of Rochon's racial harassment complaints, but he didn't take any formal action.

FBI: We need wiretap-ready Web sites -- now

CNET learns the FBI is quietly pushing its plan to force surveillance backdoors on social networks, VoIP, and Web e-mail providers, and is asking Internet companies not to oppose a law making those backdoors mandatory.

by Declan McCullagh May 4, 2012 9:24 AM PDT

The FBI is asking Internet companies not to oppose a controversial proposal that would require the firms, including Microsoft, Facebook, Yahoo, and Google, to build in backdoors for government surveillance.

In meetings with industry representatives, the White House, and U.S. senators, senior FBI officials argue the dramatic shift in communication from the telephone system to the Internet has made it far more difficult for agents to wiretap Americans suspected of illegal activities, CNET has learned.

The FBI general counsel's office has drafted a proposed law that the bureau claims is the best solution: requiring that social-networking Web sites and providers of VoIP, instant messaging, and Web e-mail alter their code to ensure their products are wiretap-friendly.

Former top statie: FBI racket ran deep
By Gayle Fee and Laura Raposa With Megan Johnson Inside Track
Monday, May 7, 2012

An explosive new book by the former head of the state police who spent 20 years chasing Winter Hill mob boss James “Whitey” Bulger details a decades-long FBI protection racket that he says went well beyond one rogue agent, and fingers a host of feds who allegedly abetted the Southie mob boss’ murderous crime spree.

“I know I’m going to take some flak on this thing, but it had to be told,” retired state police Col. Thomas J. Foley told the Track. “It happened. It’s totally backed up and that’s just the way it was.”

According to Foley, disgraced ex-FBI handler John Connolly, currently serving a 40-year sentence in Florida in connection with his corrupt relationship with Bulger and cohort Steve “The Rifleman” Flemmi, took the fall for systemwide coddling of the South Boston gangster, now charged with 19 murders and racketeering.

“Connolly deserved what he got, but he wasn’t the only one that should have got it,” Foley said.

According to Foley’s book, “Most Wanted: Pursuing Whitey Bulger, The Murderous Mob Chief The FBI Secretly Protected,” a raft of FBI agents and supervisors allegedly were complicit in a federal deal-with-the-devil that allowed Bulger to run wild. At the same time, the FBI “did everything in their power” to thwart a state police investigation that might bring the Southie crime boss to justice. Foley blasts a number of big names in the tome, including:

In 1993, Anthony Summers, in his book Official and Confidential: The Secret Life of J. Edgar Hoover, wrote that Hoover did not pursue the Mafia.

According to Summers, this was because the Mafia had blackmail material on Hoover.

Summers quotes Susan L. Rosenstiel as saying that, in 1958, she was at a party at the Plaza Hotel where Hoover was dressed as a woman.

Hoover, calling himself "Mary", was reportedly wearing a dress and high heels.

According to Rosentiel:

Hoover "was wearing a fluffy black dress, very fluffy, with flounces and lace stockings and high heels, and a black curly wig. He had makeup on and false eyelashes."

Rosentiel said she saw Hoover, boss of the FBI, go into a bedroom and take off his skirt.

There, "young blond boys" worked on him in bed.

The person principally cited on the cross-dressing is Susan Rosenstiel, a former wife of Lewis Rosenstiel, a millionaire distiller with close links to organized crime - and a longtime Hoover associate who contributed $1,000,000 to the J. Edgar Hoover Foundation. Those who suggest the former wife's cross-dressing claim is not credible raise the fact that she had pled guilty in 1971 to attempted perjury. I was aware of that, reported it in the original edition of my book Official and Confidential - and explained the circumstances.

The charge was brought in connection with a civil suit and - I was told by New York State Legislative Committee on Crime interviewees - was thought by them to be unprecedented and bizarre. Noting that the charge was brought the very week the Committee intended to produce Susan Rosenstiel as a witness to her former husband's Mafia links, the Committee sources said they thought the charge was instigated by Lewis, in an effort to discredit his former wife and thus obstruct the Committee's inquiry. Court records showed that Lewis Rosentiel had used similar tactics to obstruct the course of justice in the past.
During six years' work on Official and Confidential, which included repeated interviews with Susan Rosenstiel, her account on various areas - including the sex allegation - remained consistent. She signed an affidavit asserting that the information she provided was true. I asked Mrs. Rosenstiel to agree to a television interview and to grant me exclusivity for a matter of years, and paid her a fee in that connection. I emphasize, however, that the matter of a fee came up only after she had given me her lengthy initial interview, which was therefore not tainted by any payment.

New York Judge Edward McLaughlin, former Chief Counsel of the Crime Committee, and Committee investigator William Gallinaro, told me Mrs Rosentiel had been an excellent witness. "I thought her absolutely truthful," Judge McLauglin said. That too, was in my Hoover biography, and more - but was not quoted by any of those who assailed the passage on Susan Rosentiel in the book. Almost no one noted, moreover, that a similar account of alleged cross-dressing came to me from two other interviewees, referring to a different location and a different timeframe. On the basis of all of this, and after discussion with my publishers, we included her account - which was broader than the cross-dressing allegation - in the book.

2. Hoover was principal architect in the Pearl Harbor Coverup
http://www.ihr.org/jhr/v04/v04p388_Stimely.html
, "Pearl Harbor: The Story the Rest of the Media Won't Tell," in which he claimed that his friend, Secretary of State Hull, had confided to him on 29 November 1941 that J. Edgar Hoover and FDR knew that the Japanese were going to attack Pearl Harbor withing a few days, and that the President, over Hull's strident objections, was going to let this happen as a way to get the country into war. Hull's dilemma was that he could not reveal this openly to the press, since the White House would simply denounce him, and no one would believe him. He turned over to Lieb a document containing a transcript of Japanese radio intercepts which supposedly detailed the Pearl Harbor plan, making the reporter promise never to reveal the source. Leib rushed the story, minus the identification of Hull, to the United Press bureau, which refused to run it since it was so incredulous. But Leib did manage to persuade UP's cable editor, Harry Frantz, to transmit it on the foreign cable. Although the story managed somehow to get garbled in transmission, it did create a front-page banner headline in the Sunday, 30 November, Honolulu Advertiser: JAPANESE MAY STRIKE OVER WEEKEND! Thus Leib, writing in 1983, has finally cleared up the mystery of the origins of that headline, which has always been a particularly curious part of the Pearl Harbor puzzle. He promises to release more information about his knowledge in other forums.

http://www.spartacus.schoolnet.co.uk/JFKboggs.htm

Boggs had doubts that John F. Kennedy and J. D. Tippit had been killed by Lee Harvey Oswald and that Jack Ruby was not part of any conspiracy." According to Bernard Fensterwald: "Almost from the beginning, Congressman Boggs had been suspicious over the FBI and CIA's reluctance to provide hard information when the Commission's probe turned to certain areas, such as allegations that Oswald may have been an undercover operative of some sort. When the Commission sought to disprove the growing suspicion that Oswald had once worked for the FBI, Boggs was outraged that the only proof of denial that the FBI offered was a brief statement of disclaimer by J. Edgar Hoover. It was Hale Boggs who drew an admission from Allen Dulles that the CIA's record of employing someone like Oswald might be so heavily coded that the verification of his service would be almost impossible for outside investigators to establish."

It has been claimed by John Judge that when Alan Dulles was asked by Hale Boggs about releasing the evidence, he replied, "Go ahead and print it, nobody will read it anyway."

According to one of his friends: "Hale felt very, very torn during his work (on the Commission)... he wished he had never been on it and wished he'd never signed it (the Warren Report)." Another former aide argued that, "Hale always returned to one thing: Hoover lied his eyes out to the Commission - on Oswald, on Ruby, on their friends, the bullets, the gun, you name it."

Thomas Hale Boggs disappeared while on a campaign flight from Anchorage to Juneau, Alaska, on 16th October, 1972. Also killed in the accident was Nick Begich, a member of the House of Representatives. No bodies were ever found and in 1973 his wife, Lindy Boggs, was elected in her husband's place.

Lead FBI Agent in Stevens Case Undergoing Internal Ethics Review
By Elizabeth Murphy | May 9, 2012
The FBI director said the lead agent in the botched Sen. Ted Stevens case is undergoing a conduct review by the agency’s internal ethics watchdog.

Mary Beth Kepner is facing investigation by the FBI Office of Professional Responsibility, Robert Mueller told a House Judiciary Committee hearing on Wednesday. Kepner’s handling of witness notes came under scrutiny in a report on the bungled prosecution by special investigator Henry F. Schuelke III.

Rep. Dan Lundgren (R-Calif.) said in the hearing that while an OPR investigation is well and good, the FBI needs to show it is taking serious action.

“You have an obligation to be absolutely fair [to defendants], because if in fact you make an error, you’ve not only done an injustice to an individual, but you’ve also done an injustice” to others, Lundgren said, noting that in the Stevens case his Alaska constituents also suffered. At the time of his 2008 trial, Stevens was the longest serving Republican in the U.S. Senate, but he lost re-election shortly after his conviction.

Lundgren pointed to the special investigator’s report, which found that Kepner did not record post-interview notes with key witnesses in the months leading up to trial, potentially leaving out evidence that could have helped the defense. The former California attorney general said the allegations are “disturbing,” adding that “I always thought that when you find improper conduct by officials, action needs to be taken.”

Lundgren added: “That makes it very, very clear to others in the department that such actions will not be tolerated.”

Mueller said the review is ongoing and that any individual has the right to present his or her side of the story.

“There needs to be some posture that this is being taken seriously,” Lundgren replied.

The allegations surrounding Kepner came to light after fellow FBI agent Chad Joy filed a whistleblower complaint with the Justice Department in 2009. In his complaint, Joy claimed Kepner, along with the department prosecutors, worked to conceal evidence from the defense. He also alleged that Kepner had an improper relationship with the prosecution’s key witness, Bill Allen.

FBI and Birmingham Civil Rights Institute Announce the Civil Rights for Everyone Conference

BIRMINGHAM—The Federal Bureau of Investigation (FBI), Birmingham Division and the Birmingham Civil Rights Institute (BCRI) will sponsor a conference, “Civil Rights for Everyone,” Sunday and Monday, May 20-21, 2012, at the Birmingham Civil Rights Institute, 520 Sixteenth Street North.

On Sunday, May 20 at 4:00 PM, the public is invited to a program that will include a discussion by civil rights organizations. Retired United States District Judge UW. Clemon will deliver the Sunday keynote address, and the Sunday program will conclude with a reception and tour of BCRI.

The conference continues on Monday, May 21 with training sessions for community leaders, law enforcement, and the public from 8:00 AM until 2:00 PM The training both Sunday and Monday is free and open to the public, but registration is required. The objective is to educate attendees on civil rights laws and how they play a role in protecting a cross section of the community.

Presenters include representatives from the Civil Rights Sections of FBI Headquarters and the United States Department of Justice in Washington, DC ., as well as panel discussions by local experts.

The FBI is the primary federal agency responsible for investigating all allegations regarding violations of federal civil rights statutes. These laws are designed to protect the civil rights of all persons, citizens, and non-citizens alike within United States territory. The laws include: hate crimes; “color of law” violations (actions taken by a person acting under authority of local, state, or federal laws to willfully deprive someone of their rights secured under the Constitution); human trafficking (the illegal “business” of trafficking persons into forced labor and prostitution); and freedom of access to clinic entrances.

“Everyone has protections under the nation’s civil rights laws. ‘Civil Rights for Everyone’ is a message we want to convey to law enforcement and the community, and it is our hope this conference will enlighten the public on the laws that are in place to protect their rights,” said FBI Special Agent in Charge Patrick J Maley.

“To ensure fair and equal treatment for everyone, it’s important to be educated in civil rights matters,” stated Dr.

Lawrence Pijeaux, Jr, president and CEO of BCRI. “A constructive dialogue between law enforcement and diverse cultures can help remove barriers and promote understanding for everyone.”

How to cause it to revolve around my brown shell, like a surveillance camera, and assess the threat from my surroundings. I sensed my supervisor's cold, drawn body move up closer behind me. I could visualize the pastel-colored eyes that sat in his sunken sockets, the lifeless, stringy hair. His eyes moved from left to right with my eyes, across the article on sanctions that had been placed on the South African government for the continuation of its satanic system of apartheid.

I felt the coldness from the depths of his soul as he opened the door to his frozen morgue and began to speak. "I don't understand these sanctions. They're stupid. We are only hurting Americans. I mean, take for instance my wife, how am I going to buy quality diamonds for her if we can't get them from South Africa? Everything else South Africa does to its people is irrelevant to me."

I didn't acknowledge his presence. As far as I was concerned he was just another zombie Klansman being utilized by the true holders of power to cause me to act in a self-destructive manner. He was one of the cretins, shrouded in government sheets, who had invaded my FBI Academy dormitory room, attempting to bait me into physical confrontation. I had ignored them, and I could certainly ignore this shadow of a man. This mentally infirm, frail agent-provocateur.

It seemed as if he was on a mission to engage me in a verbal and physical battle, a battle in which I could easily be made to seem the savage aggressor. Who would speak against him? Who would tell the truth? He was shadowboxing with me, waiting for me to throw and undisciplined rabbit punch so that he could justify my disqualification from this historically segregated and sexist arena. Or maybe he was testing me. Seeing if I were willing to make a Faustian deal, as the FBI's selection process had indicated. If not, this was the time to weed out a real Black man who was unwittingly let in through the narrow back door over which hung the sign "Negroes Only."

My supervisor continued his volley. "You know, being a racist is not the worst quality a man can have, or the worst thing a man can be. As long as he provides for his family and does his job, it shouldn't matter." I continued to read and to ignore. But now the simmering volcano deep within overtook my calmness.

As the FBI's "defender of racists" continued his diatribe, I felt warm blood rushing over scattered, broken pieces of suppressed anger that had fallen from the neatly organized shelves of my previously orderly soul. Here before me, or rather behind me, was a FBI supervisor trying to draw me into a discussion on the "righteousness" of a racist and the "complications" that his wife faced because of sanctions in South Africa. Here stood a fraction of a man, whose duties included the defending of civil rights, telling me that the right of his wife to wear diamonds was more important than the lives of African people. He was perilously and wantonly poking a dagger into the soul of a Black man, and he knew it.

A cold, steely silence filled the suffocatingly warm room. A few of the other agents, who were seated at their desks, stopped working and provided the supervisor with the smiles and then the laughter that he so desperately craved. The laughter indicated recognition of a frail insecure human being. It indicated support for a being who needed to know that he had the power to do something -the power to move people toward some type, any type, of emotion. The laughter echoed throughout his hollow soul and puffed up his bony chest. His smile widened. A few other agents, who I believe did not agree with the warped statements of their superior, presented only dry grins to the speaker.

The supervisor was not yet completely satisfied. He had not moved me. I was not smiling or laughing. I sat there, solid, unmoved, unruffled. Either I was supposed to create a fake grin, show my white teeth, and chuckle like a good ol' negro or I was supposed to get up and scream and holler like a hysterical, distressed nigger. Maybe I would physically strike out at him. He had provided the necessary stimulant. It was the same type of incitement that James Thorton had told me was intentionally being used to goad the inner-city community to react in a certain, predicted manner, thus allowing those in control to justify their own heightened reaction, which in reality was a well-planned, well-thought-out, strategic provocation.

The supervisor was determined to fit me snugly into one of two clearly defined categories: "good nigger" or "malcontent trouble maker." He just needed me to reveal myself. Thoughts and memories of words said reverberated in my mind. Echoes of past conversations made relevant by the current event. "They always know what buttons to push." James said that those in power knew how to cause a riot. Well, James was right. For within my soul there was a riot of emotions. I could feel the heat from the fire. Nonetheless, I refused to succumb to the urgings of my emotions. I would not extinguish the fire, rather I would control it and limit its expansion with a strategically placed fire line.

My refusal to bare my soul to this FBI provocateur caused him much consternation. His thin pink lips straightened across his reddened face. His eyebrows became hunched like the back of an agitated cat. Something was wrong. He had put a worm on the hook but the fish wasn't biting. He would get a reaction. He had to. He decided to attempt the more risky tactic of direct confrontation. This tactic would most assuredly cause him to reveal his white Klan hood; his provocation would be obvious. But it no longer mattered. No witness would testify against him. I had to be classified.

"Mr. Powers, what do you think? Do I have a point?" I hesitated. I knew what I wanted to say and how I wanted to say it. I wanted to say "Fuck you and your wife." I wanted to tell him that any woman that would marry an idiot such as him didn't deserve a diamond or anything else. I wanted to confront him physically. To crush every bone on the coward's racist body. But what would it get me besides dead? His whinnying voice broke into my pleasurable plans of forbidden murder. "Do you agree?"

I scanned the room, stood up, and looked straight into the eyes of my tormentor. "Personally, I want nothing to do with a racist. I have found that most of them are cowards who never confront the object of their hate one-on-one, face-to-face. They hide away in some dark closet and engage in perverted conversations with their sick, cowardly cohorts. Have you ever known a racist to face a man one-on-one without his friends or a weapon? Secondly, I have to assume that every racist is out to destroy me; therefore, I must make it my goal to be prepared to destroy him. I don't give a damn about what he does for his family. In fact, I don't give a damn about his family because I know he cares nothing about mine.

The room fell completely silent. The smiles and smirks disappeared. I continued, "As for the sanctions against South Africa, I think it's all bullshit. I think the United States is supplying South Africa with everything they ask for when they ask for it. I think the U.S. is still trading with them. I think that if the Blacks in South Africa want freedom, they are going to have to take it and not wait for the effects of sanctions or the benevolence of the rest of the uncaring world. There are too many people more concerned about their wives' having diamonds than about Black folks' lives. Once they realize that in South Africa, they won't expect help from outside forces. They will either obtain their freedom or die trying."

I moved around or through the thin, frail being and out into the silent hallway. I headed nowhere or anywhere, just away from the danger of my anger-the danger of striking out at an insignificant decoy. I had heard enough and so had he. I figured that I would be labeled because I had dared to express the truth. I had dared to look him right in the eyes. I had not remained silent. I was not supposed to do that; I was supposed to reply in a meek fashion, nodding my head in agreement with whatever he said. To have done so would have meant that I passed the test, that I was okay, that the selection process worked perfectly. I was to have no thoughts except those propagated by my FBI "superiors." I had gone too far. I was reading and thinking on my own and had the nerve to voice my thoughts. I had defied the system. I had not stayed "in my place." From this point forward the FBI would try, in its own words, to "handle the troublemaker."

It sounds like they let him retire before filing charges against him so he could collect his pension.
