Shortly After 8:46 a.m. September 11, 2001: Neighbor Sees Suspicious Men Documenting First WTC Attack and Cheering, Calls PoliceEdit event
A homemaker living near Liberty State Park, Jersey City, New Jersey sees three men behaving strangely on a nearby roof and alerts the authorities. This homemaker, who has given only her first name Maria, is called by a neighbor shortly after the first plane has hit the WTC and is told about the impact. She has a view of the WTC from her apartment building so she gets her binoculars and watches the disaster. However, she also notices three young men kneeling on the roof of a white van in the parking lot of her apartment building. Maria will later recall, “They seemed to be taking a movie.” They are taking video or photos of themselves with the WTC burning in the background. But what strikes Maria is their expressions: “They were like happy, you know… They didn’t look shocked to me. I thought it was very strange.” She writes down the license plate number of the van and calls the police. [ABC NEWS, 6/21/2002] Apparently the men leave the area a few minutes after the first attack is over. [COUNTERPUNCH, 2/7/2007] An FBI lookout bulletin for the van will be issued later in the day (see 3:31 p.m. September 11, 2001) and the three men (plus two more discovered with them) will be detained (see 3:56 p.m. September 11, 2001). When the men detained, one of them will be found with pictures of the group standing with the burning wreckage of the WTC in the background. [FORWARD, 3/15/2002] At least some of the pictures were taken while standing on top of the van. [NEW YORK TIMES, 10/8/2001] The lawyer for the five men will later note that one photograph developed by the FBI shows one of the men, Sivan Kurzberg, holding a lighted lighter in the foreground, with the burning WTC in the background. [NEW YORK TIMES, 11/21/2001] It will apparently be determined at least two of the men are Israeli spies, but what they were doing and why will remain in dispute. One of these Israelis will later say, “our purpose was to document the event.” [ABC NEWS, 6/21/2002]

As to what they were doing on the van, they say they read about the attack on the Internet, couldn't see it from their offices and went to the parking lot for a better view. But no one has been able to find a good explanation for why they may have been smiling with the towers of the World Trade Center burning in the background. Both the lawyers for the young men and the Israeli Embassy chalk it up to immature conduct.

According to ABCNEWS sources, Israeli and U.S. government officials worked out a deal — and after 71 days, the five Israelis were taken out of jail, put on a plane, and deported back home.

While the former detainees refused to answer ABCNEWS' questions about their detention and what they were doing on Sept. 11, several of the detainees discussed their experience in America on an Israeli talk show after their return home.

Said one of the men, denying that they were laughing or happy on the morning of Sept. 11, "The fact of the matter is we are coming from a country that experiences terror daily. Our purpose was to document the event."

Also, five of the Israelis came to the FBI's attention after they were seen by New Jersey residents on Sept. 11 making fun of the World Trade Center ruins and going to extreme lengths to photograph themselves in front of the wreckage. The FBI seized and developed their photos, one of which shows Sivan Kurzberg flicking a cigarette lighter in front of the smouldering ruins in an apparently celebratory gesture.

Steven Noah Gordon, a lawyer for the five, told The New York Times that their behaviour may have been offensive, but said the behaviour was not criminal -- "and they were being treated as if it was." The five have since been deported.

U.S. officials have offered no explanation for the arrests, even to immigration judges. Last month, when the INS asked that bail be denied to 11 of the Israelis, a judge rejected the request, saying the government had been less than forthcoming with evidence.

"Although the [INS] alleges that these cases are 'special,' it has failed to present any credible evidence of the basis for this finding," Judge Elizabeth Hacker wrote. "The service has failed to submit any evidence of terrorist activity or of a threat to national security."

French police want to ban public WiFi during emergencies

The FBI isn't the only law enforcement agency that wants to restrict privacy for the sake of national security. Following the Paris attacks of November 13th, French police and gendarmes have submitted a wish list of security measures for a new bill, according to a document discovered by LeMonde. Among other things, police want to ban public WiFi during states of emergency, "because of the difficulty of identifying people connected to it," according to LeMonde. French law enforcement also wants the Tor network banned completely and would force companies like Microsoft to hand the encryption keys for apps like Skype to police.

The bill could go up for a vote as early as January 2016, but there's no guarantee that the proposed measures will be in the final draft, let alone passed into law. In the US, the FBI has also requested that companies like Facebook, Apple and Microsoft give it backdoor access to encrypted voice, video and chat messages. However, companies have pointed out that such measures would make such applications less secure for everybody, or drive users to other apps.

The idea of banning Tor also seems unrealistic, given that it is a loose, volunteer-run network with servers located around the world. It's also used by journalists and other groups with legitimate needs for privacy, and not just terrorists and drug dealers. The French police proposal seems like it would be difficult to implement, and also be problematic given that privacy is a huge concern across Europe. US librarians have joined with a host of civil liberties groups to condemn a cybersecurity bill now passing through Congress they claim will be both “unhelpful” and “dangerous to Americans’ civil liberties”.

The American Library Association, the world’s oldest and largest library affiliation, has joined with 18 other groups including Fight for the Future, Demand Progress and FreedomWorks to issue a letter to the White House and Congress urging lawmakers to oppose the final version of a bill they claim will dramatically expand government surveillance while failing to tackle cyber-attacks.

Politicians from both sides of the House have been pushing for stronger cybersecurity measures in the wake of the Paris attacks and the recent San Bernardino shooting.


Republican House speaker Paul Ryan has been leading the charge to push through legislation and reconcile two bills, the Protecting Cyber Networks Act (PCNA) and the National Cybersecurity Protection Advancement with the Cybersecurity Information Sharing Act of 2015 (Cisa), a controversial bill that passed a Senate vote in October.

The speed with which Ryan is trying to push through a compromise has worried privacy activists. “We’ve just learned that the Intelligence Committees are trying to pull a fast one,” Nathan White, senior legislative manager at digital rights advocate Access, said in a recent email to supporters. “They’ve been negotiating in secret and came up with a Frankenstein bill – that has some of the worst parts from both the House and the Senate versions.”

According to the letter’s signatories, the proposed “conference” legislation would:

● Create a loophole that would allow the president to remove the Department of Homeland Security, a civilian agency, as the lead government entity managing information sharing.

● Reduce privacy protections for Americans’ personal information.

● Overexpand the term “cyber threat” to facilitate the prosecution of crimes unrelated to cybersecurity.

● Expand already broad liability protection for information disclosure.

● Pre-empt state, local or tribal disclosure laws on any cyber-threat information shared by or with a state, tribal or local government.

● Eliminate a directive to ensure data integrity.

Moreover, they argue, the legislation would dramatically expand the amount of sensitive information held “by government agencies with dismal records on data security” and institute “blind, automatic transfer of personal information to intelligence agencies, including the National Security Agency, that would be authorized to use the information for non­-cybersecurity purposes”.

“The final version of this bill is an insult to the public and puts all of us in greater danger of cyber-attacks and government surveillance,” said Evan Greer, campaign director of Fight for the Future, who organized the letter. “This was already a fundamentally flawed piece of legislation, and now even the meager privacy protections it provided have been gutted, exposing it for what it really is: a bill to dramatically expand abusive government spying.”
