After Jeffrey Epstein's death, prosecutors examine his inner circle
New York (CNN) — The jail cell death of accused sex trafficker Jeffrey Epstein over the weekend positioned prosecutors to pursue his associates, some of whom allegedly assisted him in abusing underage girls. On Monday, his accusers and law enforcement officials indicated they had taken the first steps toward doing so.
The US attorney's office in Manhattan has suggested it will advance the case by focusing on the conspiracy charge against Epstein, which accused him of working with employees and associates to operate a vast sex-trafficking ring involving dozens of girls. The conspiracy count could allow prosecutors to charge anyone else involved in the scheme.
Some of Epstein's accusers on Monday moved toward pursuing his alleged co-conspirators in a civil case: they asked a federal judge to unwind a nonprosecution agreement the alleged sex trafficker reached with Florida prosecutors a decade ago that immunized his associates.
Inner circle also under scrutiny unrelated to alleged sex trafficking
Members of Epstein's inner circle who have not faced sexual abuse allegations also appear to be bracing for further legal action.
The financial and personal relationship between Epstein and his onetime client and close friend, L Brands CEO Leslie Wexner, has attracted attention since Epstein's arrest, though Wexner has not been accused of any wrongdoing.
Now Wexner has hired one of the most prominent criminal defense attorneys in New York, Mary Jo White, who is a partner at law firm Debevoise & Plimpton LLP and is the former US attorney in Manhattan, according to people familiar with the matter.
In recent weeks, one of these people said, White reached out on Wexner's behalf to prosecutors working on the Epstein case. Spokesmen for Debevoise and the Manhattan US attorney's office declined to comment.
Last week, Wexner wrote a letter to his charitable foundation saying that Epstein "misappropriated vast sums of money from me and my family."
L Brands has hired an outside law firm to conduct an internal investigation. A representative for the company declined a CNN request seeking comment from Wexner.
Prosecutors will draw on Epstein evidence
As they pursue potential targets beyond Epstein, prosecutors will likely have the ability to use material they seized from a search conducted of his Upper East Side mansion in the hours after his arrest in July, according to former federal prosecutor Rachel Maimin, a partner at law firm Lowenstein Sandler LLP who helped prosecute the case against President Donald Trump's former personal attorney Michael Cohen for campaign-finance violations and other crimes.

During the search of Epstein's home, agents recovered a "vast trove" of lewd photographs of young-looking women or girls, dozens of electronic files, compact discs with labels that suggested they contained pictures or videos of people other than Epstein and other material in a locked safe, according to court filings.
"Others wouldn't have standing to object to it because they have no privacy interest in the property," said Maimin, adding that if prosecutors are contemplating new charges beyond conspiracy, they may choose to obtain a new search warrant for the material out of an abundance of caution.
On Monday afternoon, federal agents appeared to take new evidence-gathering measures. Agents from the FBI's New York office visited Little St. James, the island Epstein owns in the Caribbean, according to a spokeswoman for the bureau.
His death was a blow to Manhattan prosecutors
Of course, Epstein's death does put a stop to the case against him individually, a matter that was set to be one of the highest-profile criminal trials the Manhattan US attorney's office had undertaken in years.

In the months leading up to the indictment, prosecutors took "extraordinary efforts," they told the court, to keep their investigation of him secret so that they could prevent Epstein from evading prosecution.
A press conference after Epstein's arrest was punctuated by a dramatic moment when US Attorney Geoffrey Berman stepped out from behind the lectern and pointed his finger at an oversized photo of Epstein's face, imploring people to come forward "if you believe you are a victim of this man." As the case proceeded, a phalanx of senior leadership at the office attended each of Epstein's pretrial court appearances, with Berman arriving alongside the chief of the public corruption unit and his deputy.
But the case is far from over
Over the weekend, Berman signaled that prosecutors would not let the case expire, saying "our investigation of the conduct charged in the Indictment -- which included a conspiracy count -- remains ongoing."
That charge in the indictment accuses Epstein of having "worked and conspired with others, including employees and associates who facilitated his conduct by, among other things, contacting victims and scheduling their sexual encounters with Epstein at the New York Residence and at the Palm Beach Residence."
The indictment alleges that when Epstein traveled from New York to Palm Beach by private jet, "an employee or associate would ensure that minor victims were available for encounters upon his arrival in Florida."
The indictment describes, but doesn't name, a New York-based employee, as well as two other assistants it suggests were based in Palm Beach.
Multiple civil lawsuits filed over the years by various women who have accused Epstein of sexual abuse also allege that he was aided by a coterie of female assistants and employees, primarily a British socialite, Ghislaine Maxwell.
Maxwell allegedly procured underage victims for Epstein and at times herself engaged in sexual assault of minors. Maxwell, who hasn't made a public statement since Epstein was charged in July, has previously denied the allegations. Her attorney didn't respond to a request for comment on Monday.
Epstein's death also doesn't end a number of related civil cases making their way through the courts, including a defamation lawsuit filed by Epstein accuser Virginia Roberts Giuffre against famed lawyer Alan Dershowitz, who once represented Epstein and with whom Giuffre has said Epstein forced her to engage in sex acts.
Dershowitz has denied those allegations, saying they were fabricated, and has filed a motion to dismiss her defamation case. A hearing in that matter is scheduled next month.
And there are additional court papers expected to be unsealed in a separate defamation case that Giuffre settled in 2017 with Maxwell. A judge has set a court date to discuss the unsealing on September 4.
On Monday, US Attorney General William Barr pledged that the Justice Department wouldn't let those who aided Epstein's alleged crimes walk away in the wake of his death.
"Let me assure you that this case will continue on against anyone who was complicit with Epstein," Barr said during a speech in New Orleans.
"Any co-conspirators should not rest easy. The victims deserve justice, and they will get it."

CBS News has learned that the morning of Jeffrey Epstein's death there was shouting and shrieking from his jail cell. Guards attempted to revive him while saying "breathe, Epstein, breathe."

On the morning of Jeffrey Epstein's death there was shouting and shrieking from his jail cell, a source familiar with the situation told CBS News. Corrections officers attempted to revive him while saying "breathe, Epstein, breathe."
Congress is the latest to start investigating Epstein's apparent suicide over the weekend, with new reports raising questions about the federal jail where he was being held. One of Epstein's guards at the Metropolitan Correctional Center on the night he died was reportedly not a regular corrections officer.
On Monday, Attorney General William Barr criticized the detention center where the disgraced financier was held. "We will get to the bottom of what happened and there will be accountability," Barr said. "I was appalled and frankly angry to learn of the MCC's failure to adequately secure this prisoner."
Government investigators raided the alleged sex trafficker's private island in the Virgin Islands Monday.
With Epstein gone, potential co-conspirators involved in his alleged sex-trafficking network are shifting into focus. British socialite Ghislaine Maxwell is one of four women accused of recruiting underage girls for sex. She's denied those claims in the past and has not been charged with a crime. Maxwell is said to be Epstein's ex-girlfriend turned business associate. Her current location is unknown.
"She was more of a partner in his obsession, really," said Miami Herald reporter Julie Brown, who spent more than two years looking into Epstein's controversial 2008 plea deal. "And there are allegations that she was involved in having sex with some of these girls as well."
Court documents from 2011 reveal Epstein controlled several apartments in a building just blocks from his $77 million New York townhouse and allegedly housed "underage girls from all over the world."
Barr also issued a stern warning for anyone who may be evading justice: "Let me assure you that this case will continue on against anyone who was complicit with Epstein. Any co-conspirators should not rest easy. The victims deserve justice and they will get it."
CBS News has learned that Epstein's estranged brother Mark was called and he identified Epstein's body. The New York City Medical Examiner's office has performed an autopsy, but the results are still pending.
In an interview with our West Palm Beach affiliate WPEC, a former Florida corrections worker said Epstein was "treated like a celebrity" during his 13-month stint in a county jail after he pleaded guilty in 2008 to charges of soliciting a minor for prostitution. She claims his cell was regularly left unlocked and she saw him move freely through the dormitory area – sometimes completely naked – without repercussions.

About 38 minutes before news outlets first reported Jeffrey Epstein's death in prison, a 4chan user published a detailed post about it.

The New York City Fire Department looked into whether an employee posted about Jeffrey Epstein’s death on a notorious internet message board prior to officials announcing it to the public, BuzzFeed News has learned.
After telling BuzzFeed News the post was "under review," an FDNY spokesperson said authorities "determined this alleged information did not come from the Fire Department."
"An investigation is a formal act which brings about a process which includes interviewing witnesses, serving notice, determining credibility of witness statements — and that was not warranted nor did it take place here. This determination was made after a review of the incident. We looked at the information provided by [a BuzzFeed News] reporter and we looked at our own records and there was no match," said FDNY spokesperson Frank Dwyer, who added that the FDNY's Office of Healthcare Compliance conducted the review. "It doesn't match our medical records."
Almost 40 minutes before ABC News first reported Epstein’s death on Twitter, someone posted still-unverified details on 4chan, the anonymous message board popular with far-right trolls and white nationalists.
“[D]ont ask me how I know, but Epstein died an hour ago from hanging, cardiac arrest. Screencap this,” read the post, which was published at 8:16 a.m. alongside an image of Pepe, the green frog that has become a mascot for right-wing internet trolls.
That message was posted 38 minutes before the first tweet about Epstein’s death from Aaron Katersky, an ABC News reporter, at 8:54 a.m. Five minutes later, the main ABC News account tweeted an article about Epstein's death.

After publishing the post, other 4chan users egged on the author. When they expressed doubt, the original poster added more information to the discussion thread, including a detailed breakdown of the procedures allegedly used to resuscitate Epstein, which suggest the poster may have been a first responder, medical worker, or otherwise privy to details about efforts to resuscitate the disgraced financier.
Dwyer told BuzzFeed News he “could not verify the accuracy” of information in the 4chan post. But he said any medical professional who divulges patient information without consent is in violation of a federal health privacy law, HIPAA, and that FDNY would look into it.
“The department will review this incident,” he said at the time. The FDNY later said that it "is reviewing this incident, there is no investigation" — but would not describe the difference between a review and investigation.
Oren Barzilay, the president of the union for EMT workers Local 2507 in New York, said, “our members do not release this type of confidential information, this looks like a 3rd party info.” Barzilay also told BuzzFeed News the union would investigate the potential breach of confidentiality “if such a claim came forward.”
“There's serious consequences for those violations. Discipline. Suspensions. Civil penalties, etc,” Barzilay said in an email.
The medical examiner's office and the Metropolitan Correctional Center both declined to comment. Spokespeople for the New York Presbyterian Hospital have not responded to repeated emails and calls requesting comment.
The full details of Epstein’s death won’t be known until the final coroner’s report is released, meaning the 4chan post laying out the alleged treatment he received cannot be fully verified. An EMS expert contacted by BuzzFeed News said the details in the post are consistent with standard practices. Information released by the Federal Bureau of Prisons also appears to line up with some of what was posted on 4chan.
Dr. Keith Wesley, an emergency medicine physician who has authored several EMS textbooks and articles, viewed the 4chan post at BuzzFeed News’ request and said it lays out standard procedures for paramedics.
“This sounds like standard American Heart Association guidelines, which most EMS agencies use,” Wesley said.
Part of the post refers to “telemetry advised bicarb.” According to Wesley, this could mean the first responders were also speaking with the hospital as they were trying to resuscitate their patient.
“Telemetry implies the paramedics were in contact with a medical control hospital who then gave orders to give Sodium Bicarbonate, bicarb which is designed to reverse the acid buildup in the blood from prolonged cardiac arrest,” Wesley said in an email.
“If one of the medics posted this separately that’s a breach of protocol,” he added. “If there was identifying information on the patient, that is a violation of Federal HIPPA law.”
The 4chan user made six posts about Epstein’s death. One of them claimed that attempts to resuscitate Epstein were made for 40 minutes before he was transported to the hospital, at which point medical personnel tried to revive him for another 20 minutes. Those details are at least partially consistent with the information regarding Epstein’s death that have been publicly released by the Federal Bureau of Prisons.
“Pt transported to Lower Manhattan ER and worked for 20 minutes and called. Hospital administrator was alerted, preparing statements,” said the 4chan post.
“Staff requested emergency medical services (EMS) and life-saving efforts continued,” said a statement released by the Department of Justice’s Federal Bureau of Prisons on Saturday. “Mr. Epstein was transported by EMS to a local hospital for treatment of life-threatening injuries, and subsequently pronounced dead by hospital staff.”
It’s not clear who posted the news of Epstein’s death on 4chan, but first responders and hospital staff would have access to information laid out in the post.
The reaction of 4chan to the news was explosive. Some users didn’t believe the author while others launched straight into conspiracy theories that have since engulfed news of Epstein’s death.
The 4chan thread was first found by Konrad Iturbe, a developer based in Barcelona who was researching conspiracies surrounding Epstein online.
“That'll keep the conspiracies forever!” Iturbe said about the 4chan posts.

A New York Post report on Sunday hinted that Attorney General Bill Barr may have visited the prison where Jeffrey Epstein was being held before he allegedly committed suicide.
Lewis Kasman, a former mobster and top associated of John Gotti Sr., told the Post that Barr made a secret visit to Metropolitan Correctional Center two weeks ago “about the time Epstein was found in his cell with bruises around his neck.”
“When does that happen?” Kasman asked. “The attorney general never visits jails. Something’s not right there.”
According to Kasman, the facility is “totally disgusting — worse than Guantanamo Bay.”
“There are roaches crawling all over you — in every orifice — when you sleep. The Bureau of Prisons’ answer to that is that they can’t spray. It’s toxic,” he added.
Kasman also speculated that Epstein could have paid for help to assist him in carrying out the suicide.
“There are cameras going 24/7 and they’re watching 24/7. Someone had to give [Epstein] the equipment to kill himself and he had to pay for it dearly,” Kasman claimed. “That facility for years had issues of corruption, with correction officers bringing in food or cellphones for wealthy people.”
