I. STATEMENT OF THE CASE
Ten commercial airline pilots bring this suit to vacate and permanently enjoin enforcement
of the Federal Transportation Mask Mandate (“FTMM”)1 put into place by orders of the Centers for Disease Control & Prevention (“CDC”) – under the purported authority of its parent agency, the Department of Health & Human Services (“HHS”) (collectively “the defendants”).
By mandating masks for all American travelers and employees in the transportation sector, the defendants have acted without statutory authorization or following the rulemaking process required by the Administrative Procedure Act (“APA”). This mandate also raises serious constitutional concerns. Because of the FTMM, numerous state, local, and regional transportation and airport authorities are told to enforce a federal mandate that is in direct conflict with the laws and policies of all 50 states that prohibit mask mandates or do not require face coverings.
The Court should vacate worldwide2 the FTMM because it is an illegal and unconstitutional exercise of executive authority. The mask mandate is procedurally defective because the defendants adopted it without following the APA’s notice-and-comment requirements or considering the impact on tens of millions of travelers and transportation workers every single day. They also ignored countless scientific and medical studies and articles showing that face masks are totally ineffective in reducing coronavirus spread but are harmful to human health in at least 68 ways.
Congress never intended for the Executive Branch to have the authority to promulgate this policy – and even if it did, it’s unconstitutional. CDC and HHS may not exercise their authority in a manner that is inconsistent with the administrative structure that Congress enacted.

The book The Year the World Went Mad by SAGE-member Mark Woolhouse, has now been published as an audiobook and will be available in hard cover on April 12th. This is an important book, for here the author, a key player in the pandemic response in the UK, admits that more or less everything he and his colleagues suggested and the government did was wrong.
In this interview with Spiked-online, Woolhouse admits that focused protection, as suggested by the proponents of the Great Barrington Declaration, would have been the right approach, and that he and his associates knew it. He even claims they suggested it, but nobody listened. However, even if they did, why didn’t they speak up? The scientists who wrote and published the Great Barrington Declaration were denounced as pseudo-scientists – and by whom? Among others, by the very people who knew they were right all along.
In the author‘s own words:“So how do you protect those people? First of all, since they have to have contact with certain people, you make it as Covid-safe as possible for them to have those interactions. Take all the precautions we know to take now, about wearing masks, ventilation and physical distancing. But that alone is not enough. You need to make sure that the contact themselves does not have an infection and is not going to pass it on to the vulnerable people they’re interacting with. We were talking about this in April and May 2020 to many people in government. But we never implemented it. It never took off. And yet it’s quite clear from our work that this would have had a very significant impact. It would not be enough by itself “You still need to suppress the virus to a degree, but you would not need lockdown.”
The lockdowns, travel bans, school closures and all the rest were useless and extremely harmful to society. But still the scientists in charge of the pandemic response, including Mark Woolhouse, promoted those methods and justified them. They derided those who criticised their methods, cancelled them, claimed they didn’t respect science. But it was the other way around. This, we must never forget.
This book is a good step. But I wonder if the author has apologised to those who were right all along, to Martin Kulldorff, Sunetra Gupta, Jay Bhattacharya and all the other honest, real scientists who had the courage and moral integrity to tell the truth. If he hasn’t, I urge him to do so.

Another lawyer, who specializes in First Amendment litigation, described being forced to turn away a client with far-right views because the firm thought that any association with the client—even if the claims advanced were meritorious—would be bad for business.
The problem, Strossen said, is that rights mean nothing without representation. “ANYONE who doesn’t have access to counsel in defending a right, as a practical matter, doesn’t have a meaningful opportunity to exercise that right,” the former ACLU chief told me in an email. “Hence, undermining representation for any unpopular speaker or idea endangers freedom for ANY speaker or idea, because the tides of popularity are constantly shifting.”

This is actually the type of evidence I've been waiting for. This is the power of the information authorities. All they need to do is control the point at which reality is converted into data, an arbitrary process, before allowing it to flow down through all the institutional machinery.
A professional who works with data cannot function on the possibility their data is corrupted. They cannot accept it. They'll acknowledge that there are issues, but then pretend they don't matter by either ignoring inconvenient data by literally just calling it 'noise', or by applying subjective controls using the very thing they claim to objectively remedy, INTUITION. They must accept what they are given is close enough to reality to give their job value. This is why they hate intuition. Why they appeal to authority.

Because, if you can demonstrate reality is objective, that there is always a correct version of a thing(Plato's perfect world of forms), you can 'prove' that there is a correct ruling class, and freeze society's hierarchy in place. Really, they don’t want me dead?
Just kidding, of course they do. But they don’t want your loved ones to blame your death on the vaccine, their horrible hospital protocols, or their withholding of effective early treatments. Accordingly, it appears the CDC has been fudging their 2021 mortality data. I’ll pretend I’m shocked.
Honestly, I am, a bit. My shock threshold has risen way up over the last two years, but this one took me by surprise. I just had a conversation the other day with my science-nerd daughter about how the one statistic they really can’t fool around with is the total deaths number, because it’s compiled from county-level offices and has to match up at least somewhat with other sources. But alas, nothing is sacred, and no one is accountable in our federal government any longer.

My plan was to return to this topic, now, three months later, and do the same for Q4. I was pretty excited to run this next chapter, because I wanted to see how many more people our esteemed leaders had killed with their poor treatment protocols, booster shots, and teenager shots over the holiday season. But a funny thing happened when I downloaded the refreshed dataset…
Typically, the numbers in the CDC all-cause mortality data will change over time, because corrections happen, and late reports flow in, even months later. That’s why I waited, both with my original piece and with this one, until 5 or 6 weeks into the new quarter before downloading the data. Just to be sure of my numbers, though, I always keep the originals as they were, start a whole new spreadsheet for the update, and check for differences. As I said, you expect some change—usually way less than 1%—but it’s almost always an upward correction. It’s not often you find folks who were marked as deceased, magically come back to life. The corrections usually go the other way; the death counts go up.
But not this time.
You see, between my original download in mid-November 2021 and my new one in mid-February of supposedly the same data, the count of Americans who died from all causes during the first three quarters of 2021 fell by over 220K. That’s right, we’ve got some serious zombie action going on at the CDC—almost a quarter million newly “undead” Americans.
So let’s break this down. In my summary table below, going across, you’ll find the original data from November, then the February update, then the difference. As you can see, the older data, the 2015-2019 average (1st set of rows), is virtually unchanged, which you would expect after two years. The 2020 data (middle rows) has some adjustments, which isn’t crazy, because it’s still somewhat fresh, and lots of local government offices were closed for a good portion of 2020 and 2021, but as you’ll notice, the 2020 adjustments are almost all increases, that is, new deaths that weren’t reported earlier, a few hundred on top of 3.4 million (+0.02%).
What I’ve never seen before is what’s going on with the 2021 data (bottom set of rows)--basically, a 9% downward correction in deaths. To put this in highly sophisticated mathematics language, “Say what?” There’s no logical explanation for that kind of correction in CDC mortality stats, and none of their technical notes begin to address this.

What’s even more interesting is that the majority of the “correction” is stuffed into the second and third quarters, and very little in the first. It’s almost like the fudgery is purposely paired with the time period when the majority of the young and healthy people in this country were being vaccinated and boosted, and lots of people, vaxxed or not, were experiencing the Delta variant without the benefit of early treatment. You know, almost like someone wants to make it look like a bunch of people didn’t die, when they did.
I further explored whether these variances were clustered by gender, age, or racial group, as that might’ve pointed to some honest error in data collection. But no, the changes were rather neatly distributed across those categories, almost like something that could’ve been done algorithmically…not that I’m implying any data hanky-panky here.
So help me out, folks. Has anyone heard of any big all-cause mortality correction move by the CDC lately? Am I missing something everybody else knows? Is it really Night of the Living Dead this time? Or are they actually fooling around with the one statistic I always thought couldn’t be monkeyed with?
I do plan to go ahead and create an update to the earlier article with the Q4 numbers, but I won’t feel good about it. This data looks like garbage!

In my November post, I focused on only the third quarter of the year, because I wanted to see what effect the vaccination roll-out had on mortality, so I had to leave enough time for everyone who wanted to, to get vaxxed. By the time of the big mandate announcement by Joe Biden near the end of third quarter, about 52% of the US population had had two doses of the vaccines. As of today, that number is 65%, with many of that additional 13% forced into it by employers/mandates, which have mostly been struck down since. Without that element of force, and with more vax facts slipping out into the public sphere, the number who have volunteered for a booster shot of the chemical brew sits at only 29%.
Most of those additional shots were given during the third and fourth quarters of 2021, but the vast majority of original vaccination happened prior to Q3, so let’s see how this jabbarama has played out for Americans, especially younger, low-COVID-risk Americans (which is everyone under about 75).
So what we have here is a comparison of excess death rates between 2020 and 2021 (for a refresher of how this is calculated, please refer to the original post). Now, clearly, the vaccines did not return US mortality to normal, which would be 0% excess death, and in fact, the Q3/Q4 combo—the entire second half of 2021—appears to have been more deadly for many of us than was our first Q3/Q4 with this novel virus, at least for those in that 25-69 year old key demographic that our economy depends on.
For those of you who are graph and chart-challenged, allow me to state it plainly: 25-39 year olds died at a 53% higher rate than normal in 2021, compared to 39% above normal in 2020. And for 40-54 year olds, those numbers are 45% and 28%. In other words, roughly half again as many excess deaths occurred in 2021 as in the prior year.
Do you really want to tell me that’s due to delayed cancer diagnoses? In 25-54 year olds? Really?

The next popular theory is that all the excess deaths were from unvaccinated people dying of the COVID Delta variant. I suspect you, my readers, are bright enough to not need a graph on this one, but here you go anyway.
What we see above is that during Q3/Q4 2021, when 70-80% of the population over twelve years old had had one or two COVID shots, and another 30% had had three, deaths ostensibly due to COVID doubled or even tripled in the age groups that were at lowest risk to begin with. Even in the 70-84 year old group, deaths barely declined. Only the 85+ group saw a significant benefit. That’s some effective vaccine, eh? It’s almost like we should’ve just protected the high risk people and let everyone else get on with their life, untouched by the miracle of modern med—, er, chemistry. In fact, it’s almost like everything all those vaccine experts have been saying all along about vaccinating during a pandemic wasn’t misinformation at all…

A site called Daily Clout (dailyclout.io) is running a very interesting crowdsourced campaign to pore through the Pfizer document dumps and pull out anything interesting. I just watched their first volunteers meeting online - they're keen for anyone, particularly with medical training, to sign up and help.
1500 volunteers so far, close to 400 findings submitted from 55,000 pages of info. They have 250 volunteer lawyers ready to move. One of the hosts said there were potential civil and criminal offences in what's been found so far related to racketeering, RICO fraud, medical coercion, breach of contract and unlawful handling of business records.
According to the host of the meeting:
- 36 children were in the Pfizer trial, including a 2-month-old baby.
- a 90lb 12-year-old received the same dose as a 200lb male
- this seems like a big one - remember "the lipid nanoparticles stay in the injection site/deltoid"? It seems that the documents used by Pfizer for APPROVAL contain evidence that within 24-48 hours they'd entered the bloodstream and were accumulating in the lymph, ovaries, adrenal and spleen!

So, now we’d like you to focus on specific documents that we’ve identified as most important. In order to be sure we get deep focus on all of these documents, we’re asking each volunteer to focus on a specific document as follows:
